The subject. The article is about the peculiarities of referendum and popular initiative which are the main forms and institutions of direct democracy in Switzerland.The purpose of the article is to determine the peculiarities of direct democracy in Switzerland and characterize its main forms: referendum and popular initiative. In order to achieve the objective the following tasks can be defined: 1) to find the origins and identify the variations of forms of direct democracy in Switzerland; 2) to trace the evolution of enshrining on the statutory level of such institutions of direct democracy in Switzerland as referendum and legislative initiative from the time of their conceiving till the enactment of the actual Constitution; 3) where relevant, to perform a brief comparative analysis of the forms of direct democracy in Switzerland and similar institutions shaped in other countries; 4) to define the role and meaning of referendum and legislative initiative in history as well as in the modern stage of the development of the Swiss State.The methodology of the study includes the use of general scientific methods (description, deduction, induction, analysis and synthesis) together with formal juridical and comparative juridical approach. In addition, throughout the article and, in particular, while working with sources of law, historical approach and systematic approach were practiced. The main results and scope of their application. The article presents the analysis of such forms of direct democracy in Switzerland as referendum and popular initiative, characterizing each form. The principle of democracy expressed by the practice of referendum and legislative initiative is present in its entirety. No country in the world has come as close to applying direct democracy to national political issues as Switzerland. Since the mid-nineteenth century, when the country's first Federal Constitution was adopted, Switzerland has managed to hold more referendums than all other countries combined in the same time frame.Conclusions. Referendum enables Swiss citizens to dismiss the measures taken by their representatives and the initiative gives the citizens possibility to put laws into practice independently from the legislative powers. Swiss experience vividly demonstrates that used sensibly and taking into consideration national legislative traditions such forms of consulting with the people can be quite promising and efficient for other European countries. ; Анализируются основные формы прямой демократии в Швейцарии: референдум и народная инициатива. The article analyzes the artistic situation in Europe on the eve of the First World War and the anti-war character of the Dadaists movement, which arose as a reaction of a group of writers and artists to the catastrophe of the world order, the militaristic engagement of the masses and the crisis of familiar values. The creation and activities of the Dadaist Cabaret Voltaire and the Dada Gallery were attended by artists from different countries who deserted from the front or sheltered from conscription in neutral Switzerland. The protest against the war contributed to the search for a new artistic language, new forms and materials in art, the emergence of a number of program manifestos. ; В статье анализируется художественная ситуация в Европе накануне первой мировой войны и антивоенный характер движения дадаистов, возникшего как реакция группы писателей и художников на катастрофу миропорядка, милитаристскую ангажированность масс и кризис привычных ценностей. В создании и деятельности дадаистского «Кабаре Вольтер» и «Галереи дада» приняли участие деятели искусств из разных стран, дезертировавшие с фронта или укрывшиеся от призыва в нейтральной Швейцарии. Протест против войны способствовал поискам нового художественного языка, новых форм и материалов в искусстве, возникновению ряда программных манифестов.

It has long been known that social alcoholism is an indicator of public moral and wellbeing of the state. Alcoholism is no longer the problem of one particular family but a global issue. How can it be otherwise if a drunkard lying on the ground in broad daylight has become a familiar sight, as well as a violent drinker? Not a single day passes without a number of alcohol related crimes. There is no consensus on when and where alcohol first appeared, but alcoholic drinks are known to have already been quite common during pagan festive and funeral feasts or public merrymakings. As a rule, the main raw material for alcoholic beverages (brags, mead, or beer) in those days was honey, so their influence was more invigorating than intoxicating. In ancient times, this phenomenon was, similarly, a source of much trouble, resulting in Pythagoras (about 540–500 BC) and Aristotle (384–322 BC) being the first methodologists of sober upbringing, and both were described by their contemporaries as displaying teetotalling views, which they passed on to their disciples and followers. Taking into consideration all mentioned above, the history of making and drinking alcohol goes back to ancient times. Living conditions has always had an impact on these processes. The article does not aim at a deep and thorough description of the phenomenon of drinking, production and consumption of liquor; it covers some aspects that remain matters of concern even in such a seemingly prosperous country as modern-day Switzerland. Considering various living conditions of those ancient days, modern historians do not see alcoholics of the past as depraved, weak-willed individuals any more. They believe that it is life conditions (no means of subsistence, poverty, ailing economy, crisis in the country) leading people into hopeless predicament that make people want to look for a way to forget about their troubles for a while. In such a situation one needs support in defining the causes that lead some social strata to unfavorable and malignant conditions. Some social groups are more likely to become vulnerable and even tend to turn anti-social if deprived of support. The long history of fight against alcoholism has often proved that alcoholism cannot be destroyed by frontal, permanent and absolute bans of alcoholic beverages. Therefore, it requires an unconditional fulfillment of alcohol products, existing norms and rules, including those that are prohibitive, by all entities of legal relations in the sphere of production and turnover, as well as a change in the structure of alcohol consumption and the cultivation of a drinking culture and other urgent measures in this. Modern society is getting more and more focused on the four principles that make up the basis of alcohol policy in Switzerland: prevention, treatment, harm reduction and repression. The fact that prevention and repression take the first and the last place correspondingly conforms to the alcohol policy in Switzerland: first they try to avoid the problem, then they treat those for whom preventive measures did not work, then they minimize the harm that habitual drinkers can cause, and repressive measures are considered the last resort, prevention being the main principle. Also, one of the ways of preventive struggle against alcoholism, along with public awareness activities and providing decent living conditions, is to raise alcohol taxes. History shows that liberal policy is based on self-responsibility of people and can be effective only where there is a perspective of a decent life, which presupposes a more or less stable economic situation that allows one to believe in social security. ; Издревле замечено, что пьянство населения является индикатором нравственности и благополучия государства. Не может быть иначе, если среди бела дня на улице можно часто натолкнуться на мирно или не совсем мирно почивающее на земле тело, перебравшее хмельного напитка. Не проходит ни одного дня, чтобы не стало известно о преступлениях, совершенных кем-то в пьяном угаре. Когда появилось и как появилось это «зелье» – в истории указывается поразному, но уже в языческую эпоху на праздниках (пирах, тризнах, игрищах и т. п.) хмельные напитки имели широкое хождение в народе. Как правило, основным сырьем был мёд, поэтому хмельные напитки были скорее бодрящими, чем пьянящими: брага, медовуха, пиво. В античные времена это явление также, видимо, приносило немало неприятностей, поэтому не зря к первым методологам трезвенного воспитания можно отнести Пифагора (около 540–500 гг. до Р.Х.) и Аристотеля (384–322 гг. до Р. Х.), отмеченных мыслителями Древней Греции и Древнего Рима как личности, имеющие трезвеннические позиции, которые они передавали своим ученикам и последователям. Судя по этому, история изготовления и употребления алкоголя уходит в далекие времена, и жизненные условия накладывали на эти процессы различные отпечатки. В данной статье мы не предполагаем глубоко и всесторонне рассматривать данное явление как исторический процесс (производство и потребление крепких спиртных напитков), а коснёмся лишь некоторых аспектов, которые регулярно оказываются предметом озабоченности даже в такой, казалось бы, благополучной стране, каковой является в настоящее время Швейцария. Учитывая уже в давние времена весьма разнообразные жизненные условия, современные наблюдатели того времени перестали смотреть на алкоголиков как на индивидов порочных, со слабой силой воли. Они пришли к выводу, что прежде всего жизненные условия (отсутствие средств к существованию, нищета, слабая экономика страны, кризисная ситуация), приводящие людей в безвыходное состояние, ставят их в условия, когда человек хотя бы на время ищет способ забыться. В данной ситуации человек нуждается в поддержке, в нахождении важных причин, приводящих отдельные социальные слои населения к неблагоприятным и даже пагубным условиям. Какая-то часть населения становится наиболее уязвимой, склонной в случае отсутствия поддержки стать даже на асоциальный путь. В истории борьбы с алкоголизмом практикой многократно было подтверждено, что алкоголизм не изжить фронтальными и перманентными, абсолютными запретами алкогольных напитков. Поэтому необходимы: безусловное выполнение всеми субъектами правоотношений в сфере производства и оборота алкогольной продукции существующих норм и правил, в том числе носящих запретительный характер, а также изменение структуры потребления алкоголя и воспитание культуры потребления алкогольных напитков, реализация иных неотложных мер в этой области. Современное общество все более активно ориентируется на четыре принципа, которые являются основой алкогольной политики в Швейцарии: профилактика, лечение, уменьшение вреда, репрессия. Профилактика в этом перечислении занимает первое место, репрессия – последнее. Это не случайно, а соответствует приоритетам алкополитики. Для Швейцарии типично следующее: сначала пытаются предотвратить проблему, потом лечить тех, для кого профилактика не была действенна, потом уменьшить вред, который могут причинить уже серьёзно больные алкоголизмом, и только в последнюю очередь следует репрессия. Лидирующим принципом является профилактика. При этом одним из способов профилактической борьбы с алкоголизмом, наряду с просветительской деятельностью и созданием достойных условий жизни, может быть повышение налогов на алкоголь. Как показывает история, либеральная политика основана на самоответственности людей, и действенна она может быть только там, где у людей есть перспектива на достойную жизнь. А это значит, что более или менее константная экономическая ситуация и стабильность дают веру в социальную безопасность.
The article is devoted to a comprehensive study of the development of the doctrine of abuse of law in European countries. Particular attention is paid to the civil legislation of Germany, France and Switzerland. The author traces the formation of abuse of law in the European countries studied. Particular attention is paid to the French law school, since it is she who holds the leading position in the development and clarification of the doctrine of abuse of law. The article examines the position of Lewis Joserand, thanks to whose work in France the problems of the consequences of abuse of the law were attracted attention. The author refers to the approach of the Roman law system to the category under study. The article compares the approaches of French, German and Swiss legislation to the problem of abuse of law, shows similarities and differences. The author analyzes the history of the development of abuse of law in three European countries, which will be of interest to specialists in the field of civil law, the history of foreign law ; Статья посвящена комплексному исследованию развития доктрины злоупотребления правом в европейских странах. Особое внимание уделено гражданскому законодательству Германии, Франции и Швейцарии. Автор прослеживает становление злоупотребления правом в исследуемых европейских странах. The article examines the changes in corporate governance bodies connected with financial performance dynamics in German, Austrian and Swiss companies. The main objective of the study is to trace the causal links between financial indicators and Board's gender composition. The paper uses the reports of European companies to determine the Board composition and financial outcomes. Using a sample of 177 corporations and data on their Board and management composition along with financial performance indicators in 2014-2019, the authors apply regressions to determine statistically relevant relations between Board compositions and financial results. The findings show no negative effect of female representation in the Board on corporate financial performance. The study identifies a visible positive correlation between an increasing female representation in the Board and financial outcomes in real estate and manufacturing sector. Austria shows negative dependence of financial outcomes on increasing female representation in the Board, with a reverse situation in Switzerland. The results also show no correlation between the number of female directors and female managers.
The article is devoted to the analysis of the functioning and state regulation of museums activity in France, the United Kingdom and Switzerland. The museum systems of these three countries are chosen by the criterion of representativeness, as representatives of three different political systems of Western Europe. So, Great Britain is a constitutional monarchy, presenting a quasiunitary state, France is a unitary republic, Switzerland is a confederation. Also, the selection criteria were the presence in the country of a significant number of museums, a well-developed museum system. The legislative base concerning the activity of museums in the territory of the countries chosen for analysis has been analyzed. The issue of the number of museums, their status, volumes and sources of funding, and the level of state support are touched on. The organizations whose work is related to the functioning of museums, their targets, subjects and objects of activity are analyzed. That sort of organizations can be divided into two groups — state and public. The first goal is state regulation, control over observance of existing laws, implementation of state policy, and, in part, financing. The latter can in turn be divided into professional and volunteer organizations. The conclusion is made about the legislatively fixed unequal position of museums in the studied countries. ; Статья посвящена анализу функционирования и государственного регулирования деятельности музеев во Франции, Великобритании и Швейцарии. Музейные системы данных стран выбраны по критерию репрезентативности, поскольку эти страны представляют собой три различных политических системы Западной Европы. Так, Великобритания — это конституционная монархия, квазиунитарное государство, Франция — унитарная республика, Швейцария — конфедерация. Также критериями выбора были наличие в стране значительного числа музеев, развитой музейной системы. Проанализирована законодательная база, касающаяся деятельности музеев на территории рассматриваемых государств. Затронут вопрос количества музеев, их статуса, объемы и источники финансирования, уровень государственной поддержки. Исследованы организации, чья работа связана с функционированием музеев, их цели, субъекты и объекты деятельности. Такие организации можно поделить на две группы — государственные и общественные. Цель первых из них — государственное регулирование, контроль за соблюдением действующих законов, проведение государственной политики и частично финансирование. Вторые можно разделить на профессиональные и волонтерские организации. Сделан вывод о законодательно закрепленном неравноправном положении музеев в изучаемых странах.
Nikolay Ivanovich Sieber was without doubt an influent scholar. But at the same time he was isolated, writing a big deal of his production from Switzerland. How is it possible, for a scholar that is not a Minister, not a popular professor among his students, not an applied economist all the time on the roads, but instead a library rat, a scholar sitting at his desk, an armchair economist, to have such an influence on the course of political economy? The controversy between Sieber and Chicherin on the significance of Marx as an economist is first taken as an example of Sieber's influence. The paper then shows that what is known today on Sieber's network is very lacunar. Especially, Sieber lived during a decade in Switzerland, in the cities of Bern and of Zurich, and his contacts at the time are only vaguely known. There was a vast diaspora of exiled Russians in Switzerland, including many Russian revolutionaries and Ukrainian activists. Russian citizens travelling legally in Switzerland, especially for education purposes, also commonly visited the cities in which Sieber lived. Sieber presumably met these people, and this is what suggests the scarce sources that we know. It is also difficult at this stage to ascertain his network of correspondents from Russia. And we know nothing about his links with local Swiss people. As a conclusion, Sieber's characterization as a solitary scholar is perhaps to be retained temporarily only, and his network is to be investigated further to get a fuller picture of his influence among his contemporaries.
The article analyzes legislation prohibiting euthanasia, publications in scientific journals on this issue, the practice of using euthanasia in Switzerland, emphasizes the inadmissibility of its legalization.
The article contains an overview of the reports presented at the international conference Clause Linkage in Sentence and Discourse held on September 27-28, 2023 at the Institute of Linguistics of the Russian Academy of Sciences. The main goal of the conference was to discuss the variety of linguistic devices used to connect clauses - connectors. The conference was attended by more than 20 linguists from Moscow, St. Petersburg and other scientific centers of Russia and Switzerland.
