The essence of the management system of educational establishments in the sphere of tourism and hospitality in Switzerland has been reviewed. It has been noted that the organization of the educational process in educational institutions of the country is determined by the decentralized and federalist structure of the Swiss education system. Management policies at different hierarchical levels have been considered: federal, cantonal and communal. It has been found that the accreditation system of tourism education in Switzerland holds a special significance, since replacing the system of federal control. Much attention has been paid to the Swiss Hotel Schools Association and its role in politics of increasing excellence in tourism education. It has been noted that the modernization of the Swiss system of training of future specialists in tourism is being made by decentralization of education management in tourism and the usage of international accreditation as a means of measuring the quality of tourism education. The influence of the process of decentralization on the efficiency of public administration is analyzed on the example of Switzerland and Belgium. On a retrospective basis, the role and place of the decentralized nature of authority are described, and the advantages and disadvantages of the decentralization process are examined. The case-study method was used to reveal differences in the nature of the impact of decentralization of public authorities on the democratization of different political system types. The method of comparative analysis of the dynamics of decentralization of democratic federal systems is used, including cross-temporal and longitudinal analysis and binary comparison. Countries for the comparative analysis were selected according to the principle of system similarity. As a result, the general and specific political characteristics of two models of decentralized state structures in Switzerland and Belgium were identified.The decentralized nature of authority is an important principle of functioning of effective management, but the importance of decentralization is different within various theories of public administration. The explanatory mechanism of the importance of decentralization also differs. Thus, according to Good Governance, decentralization is a way to bring public authorities closer to the citizens, to eliminate the phenomenon of political alienation, and to activate political participation, since the instruments of direct democracy that have a correlation in the basic principles of Good Governance can function to the best extent in small local territorial units. Therefore, in accordance with the provisions of the key theories of public administration, decentralization can be a factor of effective governance, since it is one of the principles of democracy functioning.Decentralization is not about dividing the country, it is about creating opportunities for the development of cities, villages, and settlements where people live in unified Ukraine. The article considers the evolution, structure and dynamics of legal support of archival activities in France, Switzerland and Belgium. Retrospective comparative legal analysis of international and foreign standards for digitization of retrospective documentary projects, instructional and methodological documents and many other normative archival and legal sources on the regulation of archival affairs allowed to identify as certain common features inherent in the vast majority of legal systems and foreign countries. national and regional features. It was found that the legal basis and principles of the organization of the archival industry are laid down in the national laws on archives of the respective states, and are supplemented by special regulations. It has been established that Switzerland holds leading positions both in the field of research and in the field of legal regulation of issues related to technical media. The author concludes that the information activities of any civilized country are based not only on the best practices of other states, but also take into account their own national interests. It is proved that rapid changes in the archival field reflect the entry of European countries from the end of the XX century to the high-tech information society and generate new approaches to the legal regulation of the organization of management, storage, transmission and use of archival information in the context of digitization of the global information and communication space. It is emphasized that according to the level of regulation, modern standards of digitization of archival documents are divided into three categories of standards: international, national and organizational. As a result, the author determined that the system of archival legislation of European countries, where the main links are public, sectoral and private archives, is included in the global information and legal space as an important component. ; У статті розглядається еволюція, структура і динаміка нормативно-правового забезпечення архівної діяльності у Франції, Швейцарії та Бельгії. Ретроспективний порівняльно-правовий аналіз міжнародних та зарубіжних стандартів з приводу цифровізації ретроспективних документальних проєктів, інструктивно-методичних документів й багатьох інших нормативних архівно-правових джерел з регламентації архівної справи дозволив визначити як певні спільні риси, що притаманні більшості правових систем зарубіжних країн, так і національні та регіональні особливості. З'ясовано, що правові основи та принципи організації архівної галузі закладено у національних законах про архіви відповідних держав, а також доповнюються спеціальними нормативно-правовими актами. Встановлено, що Швейцарія займає лідируючі позиції як у сфері наукових досліджень, так і в галузі правового регулювання питань, пов'язаних з технічними носіями інформації. Авторка доходить висновку про те, що інформаційна діяльність будь-якої цивілізованої країни спирається не тільки на передовий досвід інших держав, але й враховує власні національні інтереси. Доведено, що стрімкі зміни в архівній галузі відображають вступ країн Європи з кінця XX ст. до високотех-нологічного інформаційного суспільства і породжують нові підходи щодо правового регулювання організації управління, зберігання, передачі та використання архівних відомостей в умовах цифровізації глобального інформаційно-комунікаційного простору. Окремо наголошується на тому, що за рівнем регулювання сучасні стандарти оцифровки архівних документів розділяють на три категорії стандартів: міжнародні, національні та організаційні. У підсумках автором визначено, що система архівного законодавства країн Європи, де основними ланками є державні, галузеві та приватні архіви, включена до глобального інформаційно-правового простору як важлива складова частина.

This paper focuses on the institution of banking secrecy as the central reason behind the success of the Swiss banking sector, which has recently been citedas complicit in serious cases of tax evasion. A stream of money laundering and other financial scandals have made strict bank secrecy difficult to justify. The Swiss, however, have argued that intervention intheir tax regime from other states is tantamount to bullying of their sovereign prerogative.Social uprisings, budget deficits and austerity measures have brought about a new phase in the world economy, necessitating changes in the Swiss banking tradition as new tax havens such as: Singapore, China and India emerge as serious rivals to Switzerland.In 1934 the principle of banking secrecy was judicially enacted into Swiss penal law, citing the need to protect victims of Nazi persecution and attract foreign business. By offering this kind of bank service and protection to its citizens and foreign countries, Swiss banks took advantage of the international norms as it has become apparent that not just victims of persecution have used these services but also criminals, money launderers and tax evaders. It is an interesting paradox that offshore investment is often more advantageous for foreigners than local residents. The article explores the activities of the European Court of Human Rights. In recent years, many papers have been published on the issue of defining the "standard of proof" and its implementation in national law. The content of the concept of "standard of proof" is explained in the article. Its nature is revealed. Its features are identified and constituent parts of this concept are provided. Its interdependence with the concept of "inner conviction" is substantiated. Criteria for establishing an 'standard of proof' are provided, such as: - the existence of a body that sets these 'standards'; - fixing certain requirements for the content of a certain "standard" in legislative acts; - compliance with these "standards" by other bodies, etc.; - punishment for failing to comply with the requirements of "standards". The activities of the European Court of Human Rights are analyzed. The basic principles of its activity are noted, which include: General principles: -the principle of the rule of law; - the principle of legality; - the principle of justice; - the principle of proportionality of intervention. Special principles include the following: - the principle of "least common denominator"; - the principle that there are no barriers to the inadmissibility of evidence or a pre-determined formula for evaluating it "; - the principle of proportionality; - the principle of discretion; - the principle of additionality; - the principle of effectiveness of the Convention; - the principle of autonomous understanding. It argues that it is impossible to speak of "standards of proof" in the European Court of Human Rights. Such concepts as "beyond reasonable doubt", "equality of arms", "weighing of opposing interests", "evaluation of the fairness of the process as a whole" the author reveals through the case law of the ECtHR, namely " Abu Zubaydah v. The author starts his reasoning from the appeal to historical tradition to which both France and Ukraine as European cultures belong each in its own way. He further analyzes the results of institutionalization which has today united in European Union 47 nations – from Lithuania to Ireland and from Switzerland to Malta. In conclusion the author makes an attempt to find out on which principles the cause of European nations integration may be continued with adaptation to new conditions. The author believes that in the present day sense to become the European means to become the organization member. He sees the history of Europe as the history of nation formation. In the author's opinion Europe can become the political integrity, if the nations populating it will take part in the discussion of these problems together. ; ***
