The Northern Territory National Emergency Response Intervention (the Intervention) of 2007 was a bold experiment by the Howard Government. The Intervention was developed quickly without comprehensive policy development based on evidence or consultation. During its five-year statutory life (ending August 2012), the absence of coherent policy logic has seen the Intervention fundamentally reframed by the Rudd and Gillard Governments. The unprecedented and controversial nature of the Intervention has seen extraordinary levels of monitoring, review and evaluation, but the absence of an overarching evaluation strategy has resulted in a fragmented and confused approach. In this article, we do not seek to critique the Intervention itself or to assess whether these multiple monitoring and evaluation exercises have been successes or failures. Indeed, our review illustrates that in highly contested policy areas, notions of success, failure and the evaluations themselves become politically charged. Instead we make a series of critical observations regarding this contradictory messiness of evaluations, using political science and anthropological frameworks to draw wider conclusions about the nature and logic of evaluation fetishism. We conclude that evaluations of the Intervention have not led to greater transparency, accountability and monitoring of outcomes and outputs. The Intervention evaluations instead are consistent with the view that they are both obfuscating mechanisms and techniques of governance designed to allay public concern and normalise the governance of marginalised Indigenous Australian spaces.

The concept of territory is central in international law, but a detailed analysis of how the concept is used in both discourse and practice has been lacking until now. Rather than reproducing the established understanding of territoriality within the international legal order, this study suggests that the discipline of international law relies on an outmoded spatial paradigm. Gail Lythgoe argues for a complete update and overhaul of our understanding of territory and space, to engage more effectively with key processes, structures and actors relevant to contemporary global governance. In this new theoretical account of an essential aspect of public international law, she argues that territory is a dynamic social reality created by the exercise of power. Territories are constituted by the practices of a more diverse array of actors than is acknowledged. As a result, functions are re-assembling in territories constituted by state and non-state actors alike.

Historical injustice and global inequality are basic problems embedded in territorial rights. In 'Global Justice and Territory' Cara Nine advances a general theory of territorial rights adapting a theoretical framework from natural law theory to ground all territorial claims.

The book provides an account both of the nature of rights to territory and of the nature of the right-holder, considering the arguments that might justify state territory as well as the appropriate relationship between the state, the people, and the land implied by that justificatory argument. In recent political and constitutional history, scholars seldom specify how and why they use the concept of territory. In research on state formation processes and nation building, for instance, the term mostly designates an enclosed geographical area ruled by a central government. Inspired by ideas from political geographers, this book explores the layered and constantly changing meanings of territory in late medieval and early modern Europe before cartography and state formation turned boundaries and territories into more fixed (but still changeable) geographical entities. Its central thesis is that analysing the notion of territory in a premodern setting involves analysing territorial practices: practices that relate people and power to space(s). The book not only examines the construction and spatial structure of premodern territories but also explores their perception and representation through the use of a broad range of sources: from administrative texts to maps, from stained glass windows to chronicles

This collection examines the challenges faced by countries competing over territorial claims during constitutional transitions. It addresses two scenarios in particular: authoritarian to democratic rule against a backdrop of violent conflict; and transitions within electoral democracies in response to claims for territorial autonomy.
