A punição de terroristas, em larga medida preliminar, ou os severos interrogatórios, não se adequam a um perfeito Estado de direito. Pertencem ao direito de exceção. Um Estado de direito que tudo abarque não poderia travar esta guerra, pois ele deveria tratar seus inimigos como pessoas e, conseqüentemente, não poderia tratá-las como fonte de perigo. Em Estados de direito que operam na prática de modo ótimo procede-se de outra maneira, e isso lhes dá a chance de não se quebrarem durante o ataque a seus inimigos.

The terrorist attacks of September 2001 & March 2004 have clearly exposed the handicaps of the European Union in facing this threat. Although the time distance that separates us from these events is still insufficient to enable a more thorough reflection, there is already the certainty that terrorism will have to be dealt with in a multi-disciplinary way. In this sense, this paper aims at analyzing the present fragilities of the European Union, as well as the best strategies to overcome them. References. Adapted from the source document.

Security concerns have always been present in the bilateral relations between France and Tunisia but they also turned out to be increasingly important at the European level. Through discourse analysis, this article aimed at looking for evidences of Europeanisation in the Franco-Tunisian relations both at the bilateral and European level as far as immigration and fight against terrorism is concerned. Bilateralisation clearly predominates, but progressive europeanisation took place in order to strengthen the French immigration control policy. Furthermore, although the cooperation is incipient, France supports fight against terrorism in the European foreign policy so as to develop political dialogue at the EU level. This article offers an analysis of the trajectory of an Islamist movement in Somalia & of the insurrection. The article focuses on the various Islamist militant organizations which comprise the insurrection. The article aims to testing the applicability of social movement theory to understanding Islamist militant organizations in Somalia. In this context, the transformation of the Islamist militant organization Al- Shabaab & its inclusion in the US list of terrorist organizations, since 2008, will be of particular importance. The central argument highlights the importance of avoiding this type of classification. According to Gunning, the classification of an organization with the characteristics of Al-Shabaab as an extremist Islamist militant organization rather than its classification as a terrorist organization fosters analytical fluidity because it enables to consider those inclusivist elements within the organization & those more permeable to a strategy of accommodation & de-radicalization. As with Truman or Reagan, the Bush legacy will be felt during the next decades. American foreign policy was transformed after the September 11 terrorist attacks but the Bush National Security Strategy shares some of his predecessors' priorities, namely the consolidation the international primacy of the United States, the containment of challengers & the need to respond to the threats of Islamic terrorism & the proliferation of nuclear weapons.
