Policy change is an issue ranking high in many governmental and academic agendas, especially in the old common Europe. Face to the problems of economic growth that since the 1970s affect many countries, policy change is expected to maintain, if not to improve, citizens' affluence and the availability of resources for enforcing social equity, however defined. Especially after Hall's seminal work, this implies to focus on the change of the paradigm that lies beyond public policies: Namely, as the relevant paradigms for growth‐oriented policies are economic, on the shift from demand‐sided to supply‐sided frameworks of reference. The analysis is supposed to highlight the role that different modes of accounting and evaluation play in stabilizing the paradigm shift: as a (more or less) meaningful discipline of whose players' behavior, and/or as a different arena where stakeholders, policy‐takers, administrative bodies and maybe executive bodies can clear their preferences up, align their framing, and finetune the implementation design to make it viable without losing the nature of change –i.e. fixing framing conflicts by argument and evidences, and allowing policy actors learning. The results could then link the research to the questions raised by detractors of the neoliberal paradigm when accusing it for harming democracy because of the narrower range of options it leaves to voters. This contribution could support the thesis for which the order that results from the paradigm shift is instead 'differently democratic', as it recognizes the need for a reauthorization of policy changes to come from the actors in the administrative field, in order to balance and refine the amorphous consent expressed by vote without reversing it. This would mean a different way for citizens to play political rights–not just as voters but also as those with a stake in the concrete way a "public" good is (poorly) produced and delivered here and now– and to deal with social conflict, in this way dispersed and at the same time attached to the concrete problem.

Dottorato di ricerca in Diritto dell' economia ; La tesi affronta il tema degli effetti spiegati sul piano civilistico da alcuni provvedimenti adottati dalle Autorità Amministrative Indipendenti. Dopo il richiamo, seppure in sintesi, dell'ambito storico-economico (liberalizzazioni del mercato e privatizzazioni) nel quale si colloca e va individuata la genesi di tali organismi indipendenti, si è proceduto alla analisi sistematica delle Autorità medesime, suddividendo la trattazione in due parti. L'una, dedicata alle Autorità cd. "di regolazione" - Autorità per l'energia elettrica ed il gas; Autorità per le garanzie delle comunicazioni; ISVAP - preposte alla regolazione ed al successivo controllo del settore di propria competenza. L'altra, riservata alle Autorità cd. "di garanzia" - Banca d'Italia; Consob, Antitrust – istituite allo scopo di garantire ed assicurare la tutela di interessi pubblici o collettivi di rilevanza costituzionale. Per ciascuna delle Autorità menzionate è stata richiamata ed esaminata sia la legge istitutiva sia le successive che ne hanno integrato e/o modificato la disciplina. La vastità del panorama normativo - cui corrisponde, peraltro, la complessità e la diversità dei poteri e delle funzioni riconosciuti a ciascun organismo – e l'ambito del profilo specifico trattato hanno reso necessaria la individuazione selettiva delle norme più rilevanti sotto il profilo civilistico, anche alla luce della prassi applicativa. Si è, quindi, proceduto ad enucleare le norme che attribuiscono alle Autorità: - poteri di natura prevalentemente "regolatoria", che si esplicano e si realizzano mediante provvedimenti normativi di natura secondaria ("regolamenti" ed anche "direttive" dell'Autorità per l'energia elettrica ed il gas e dell'Autorità per le garanzie delle comunicazioni; regolamento ISVAP in ordine al contenuto ed allo schema della "nota informativa"); - poteri di natura più squisitamente amministrativa cui corrispondono atti amministrativi a carattere discrezionale ("autorizzazione in deroga" dell'Antitrust); - altri poteri, infine, cui il legislatore non attribuisce un preciso nomen (potere della Banca d'Italia di prescrivere il "contenuto tipico determinato" per determinati contratti o titoli), lasciando spazio a diverse soluzioni interpretative. Quanto agli effetti conseguenti alla mancata osservanza dei provvedimenti delle Autorità, talora è prevista la sanzione di "nullità relativa" (in caso di "inosservanza" della forma prescritta dalla Consob ed in caso di contratto "difforme" rispetto al contenuto tipico determinato prescritto dalla Banca d'Italia). Altra volta (nell'ambito del mercato vincolato della energia elettrica) conseguono la "modifica" e la "revisione" del regolamento di servizio. L'approfondimento dei temi trattati nell'ampiezza del quadro legislativo rende palese la difficoltà di affrontare in termini unitari il profilo degli "effetti privatistici" delle (diverse) attività delle Autorità Amministrative Indipendenti e di pervenire ad univoche conclusioni di sintesi. ; The thesis addresses the civil-law effects of several measures issued by the Independent Administrative Authorities. A brief review of the historical and economic context leading up to the establishment of the independent authorities (market liberalization and privatization), is followed by a two-part systematic analysis of the Authorities themselves. The first part focuses on the so-called "regulatory" authorities, such as the electricity and gas regulator, the telecommunications regulator, and the insurance market regulator (ISVAP), set up to regulate and control their respective market sectors. The second part focuses on the so-called "supervisory" authorities, such as the Bank of Italy, the financial services authority (Consob) and the competition authority, set up to ensure the protection and safeguarding of constitutionally relevant public or collective interests. The laws establishing each of the above mentioned Authorities are examined, including any later supplements and/or amendments. Due to the vastness of this body of regulations, which, moreover, reflects the great complexity and diversity of the powers and functions of each organization, and the specific profile addressed, it has been necessary to selectively determine the more relevant civil-law rules and provisions, also in the light of their application. Therefore, the thesis highlights the provisions vesting the Authorities with the following powers: - powers of a predominantly "regulatory" nature, which translate into the issuing of secondary legislation (the "regulations" or "directives" issued by the electricity and gas regulator and the telecommunications regulator; the ISVAP regulation relating to the layout and contents of the "nota informativa" or notice providing information on insurance policies); - administrative powers, translating into the introduction of discretionary administrative measures (in the form of the "autorizzazione in deroga" by the competition authority, namely authorized exceptions to the law); - other powers without a specific name (such as, for example, the power of the Bank of Italy to lay down, in a pre-determined manner, a "template" for certain contracts or securities), leaving room for various legal interpretations. With regard to the effects of the failure to comply with and abide by the measures introduced by the Authorities, a penalty of "nullità relativa" (relative voidness) is sometimes provided (in the case of failure to comply with the form laid down by the Consob, and in the case of contracts "differing" from the standard template set out by the Bank of Italy). In other cases (with regard to the regulated electricity market) there is the "amendment" or "revision" process of the supply regulation. The in-depth investigation of the subject matter, with respect to the broadness of the statutory framework, clearly highlights the difficulty of addressing the "civil-law effects" of the (different) activities of the Independent Administrative Authorities in unitary terms, and, therefore, to reach univocal summary conclusions.

Dottorato di ricerca in Politica agraria ; La tesi effettua un'analisi preliminare riguardo la collocazione sul mercato dei prodotti dell'agricoltura sociale (AS) ed individua alcune possibili strategie di valorizzazione. Data la particolare natura di questi beni, viene esaminato il mercato dei prodotti etici ed in particolar modo si analizzano le caratteristiche del consumatore etico. Riguardo al funzionamento del mercato etico si valuta quello che è il suo principale fattore limitante: il gap esistente tra interesse e comportamento di acquisto da parte dei consumatori. Inoltre, vengono individuati i possibili rimedi per il superamento di questo gap. Il lavoro svolto include un'indagine empirica presso alcuni target specifici di consumatori – gli studenti universitari ed i gruppi di acquisto – che mira ad individuare la conoscenza e l'interesse dei consumatori per i prodotti delle fattorie sociali (FS), le motivazioni che sono alla base di questo interesse e dei comportamenti di acquisto, l'eventuale diffusione ed organizzazione del mercato dei prodotti dell'AS, i limiti attuali e gli eventuali spazi futuri per la commercializzazione. ; This thesis carries out a preliminary analysis about market placement of products of social farming (SF) and identifies some eventual valorisation strategies. Due to the peculiar nature of these goods, the market of ethical products, as well as the characteristics of ethical consumers, have been investigated. As it regards the organization of the ethical market, its main restraining factor, that is the actual gap between purchasing attitude and behaviour, has been evaluated. Furthermore, the possible solutions to pass this gap have been individuated. The analysis includes a survey among some specific consumer targets: university students and buying groups. This investigation aims to discover consumer awareness and attitude for products of green care farms (GCF), the motivations underneath these purchasing attitudes and behaviours, the eventual diffusion and organization of SF products market, the actual limits and the possible future allocation on the market.

Dottorato di ricerca in Scienze e tecnologie per la gestione forestale e ambientale ; La Commissione europea ha richiesto, ai paesi membri, una maggiore finalizzazione degli interventi, secondo un percorso logico e conseguente fra analisi dei fabbisogni, strategia di intervento e misure proposte, con il rispetto degli Orientamenti strategici comunitari (OSC) 2007- 2013 per lo sviluppo rurale. L'Italia ha recepito le indicazioni europee delineando un Piano strategico nazionale (PSN) per lo sviluppo rurale la quale finalità è quella di garantire la coerenza strategica tra i piani comunitari, nazionali e regionali e di garantire il raccordo strategico e finanziario tra gli strumenti di sviluppo rurale, la PAC e le politiche di coesione. In esso si definiscono: - L'analisi del contesto; - Le linee di indirizzo generale per le politiche di sviluppo rurale; - La coerenza con le altre politiche di intervento nazionali comunitarie; - Il quadro finanziario comune; - Aspetti comuni per il monitoraggio e la valutazione, controlli e le sanzioni; - I Piani di sviluppo rurale (PSR) e la loro dotazione finanziaria. Nell'ambito del Piano strategico vengono individuate alcune tipologie di indicatori da utilizzare nel processo di programmazione quali strumenti necessari per conoscere i progressi, l'efficienza e l'efficacia dei Programmi di Sviluppo Rurale (PSR). Infatti, oltre ai tradizionali indicatori finanziari, di realizzazione, di risultato e di impatto vengono introdotti gli indicatori di baseline, con i quali è possibile definire la situazione iniziale del contesto su cui agisce il programma, descrivendola anche in termini di punti di forza e debolezza, permettendo così di inquadrare al meglio la strategia d'intervento della politica di sviluppo rurale e creando i parametri su cui valutare successivamente l'efficacia della programmazione. In particolare, per l'analisi della situazione ambientale sono stati proposti i seguenti indicatori baseline: biodiversità: avifauna delle aree agricole, aree ad alto valore naturale, composizione delle specie forestali. Sulla base di questi orientamenti, sia a livello europeo che nazionale, questo lavoro propone una metodologia alternativa alle linee guida proposte dall'EEA, in cui si tenga conto dei fattori strutturali del territorio per l'individuazione delle aree agricole ad alto valore naturalistico (HNVF). Lo scopo principale dell'individuazione delle aree agricole ad alto valore naturalistico è legato al mantenimento della biodiversità nelle aree agricole, ciò implica un aumento del valore paesaggistico e crea allo stesso tempo il mantenimento delle pratiche agricole tradizionali o specifiche. L'individuazione delle HNVF è una questione di notevole rilevanza sia a livello di pianificazione territoriale il cui obiettivo è quello di preservare in un contesto dinamico queste aree per una agricoltura sostenibile, sia a livello esecutivo per redigere piani operativi di intervento e finanziamento. La gestione del territorio dipende da delle decisioni che agiscono a livello spaziale. Per questo motivo si è deciso di utilizzare i Sistemi Spaziali di Supporto alla Decisione (Spatial Decision Support Systems). Sono sistemi informatici che lavorano attraverso un'integrazione di diverse informazioni e determinano l'ordinamento delle alternative sulla base di specifici criteri. Tali strumenti integrano i Sistemi Informativi Geografici, i modelli spaziali e l'Analisi Multicriteriale per arrivare a definire una gestione che rispetti le dinamiche dei sistemi naturali ed esprima una decisione integrante i diversi criteri. Questo studio ha lo scopo di proporre un percorso metodologico per l'individuazione delle aree agricole ad alto valore naturalistico alternativo a quello attualmente proposto dall'EEA. Si prefigge lo scopo di identificare "aree sensibili" della Provincia di Viterbo dove più rilevanti possono essere gli impatti delle attività antropiche e più efficaci le misure di mitigazione, cioè, dove pratiche agricole opportune possono quindi condurre a risultati migliori. Questo obbiettivo può essere raggiunto attraverso una pianificazione per "processi" cioè che tenga conto delle peculiarità del territorio. L'obiettivo della presente ricerca è quello di sviluppare un Sistema Spaziale di Supporto alla Decisione, applicato all'individuazione delle aree agricole di elevato valore naturalistico, che tengano conto della complessità del sistema rurale, ambientale, sociale ed economico e delle relazioni fra le sue variabili. Alle aree rurali viene, quindi, riconosciuto un ruolo all'interno del sistema dinamico ambientale, come elemento di connessione con gli ambienti naturali limitrofi, tale approccio si basa sull'individuare e preservare il rapporto tra sistemi di habitat al fine di migliorare il grado di biodiversità. Principale obiettivo è la realizzazione di una cartografia delle "aree sensibili" ottenuta seguendo una procedura di analisi multicriteriale valutando il grado di influenza dei fattori "strutturali" ambientali e antropici in funzione della loro distanza e densità. ; The European Commission demanded from the member countries a better finalisation of the intervention following a logical and consequent path between analyses of needs, strategy of intervention and proposed measures, regarding the Community Strategic Guidelines 2007-2013. Italy has acknowledged the European guidelines outlining a national strategic plan (Piano strategico nazionale, PSN) for rural development, with the aim to guarantee the strategic coherence between the communitarian, national and regional plans and to guarantee the strategic and financial connection between the instruments of rural development, the PAC and the policies of cohesion. In this strategic national plan are defined the following aspects: - Analysis of the context; - The general guidelines for the policies of rural development, - The coherence between other national communitarian policies of intervention; - The common financial table ; - Common aspect for monitoring evaluations, controls and sanctions; - The national strategic plans of rural development and their financial endowment. In the ambit of the strategic plan are singled out several typologies of indicators, which can be used for the programming process as necessary instruments to understand the progress, the efficiency and efficacy of the programs of rural development (PSR). In fact, in addition to traditional indicators of finance, realisation, result and impact, are being introduced the baseline indicators, with which it is possible to define the initial state of the context in which the program operates, describing it in terms of points of strength and points of weakness. This baseline indicators permits to define in the best possible way the strategy of intervention of the policy of rural development, and creating the parameters, which help to evaluate successively the efficiency of the programming. In particular for the analysis of the environmental state, have been proposed the following baseline indicators: Biodiversity: bird population of the agricultural areas, High Nature Value Farmland, composition of the forest species. Based on this directions, both on the European level and on the National level, this work proposes a alternative methodology to the guidelines proposed by the EEA, in which are taken in account the structural factors of the territory that locates the High Nature Value Farmland (HNVF). The principal aim, to locate the High Nature Value Farmland, is linked to the maintenance of the biodiversity of the agricultural areas. This implicates an increase in the value of the landscape and creates in the same time the maintenance of the traditional, specific and agricultural practices. To locate the High Nature Value Farmland is an important matter both in a territorial planning level, in which the aim is to preserve in a dynamic context these areas for a sustainable agriculture, and in an executive level to draw up the operational plans of intervention and finance. The management of the territory depends on the decision that act in a spatial level. For this reason it has been decided to use Spatial Decision Support Systems. They are information systems that work with the integration of different information and they determine the arrangement of the alternatives based on specific criteria. This instruments integrate the Geographical Information Systems, the Spatial Models and the Multi-Criteria Analyses with the aim to define a management that respects the dynamic of the natural systems and that shows an integrated decision between different criteria. The aim of this thesis is to propose an alternative methodological path for the location of the High Nature Value Farmland, to the actual path proposed by the EEA. It has the aim to identify "sensitive areas" of the province of Viterbo, where the impacts of the anthropic activity can be more relevant and the measures of mitigations more efficient, that is, where opportune agricultural practice can lead to better results. This aim can be reached through planning of "processes", that is taking in account the peculiarity of the territory. The goal of this research is to develop a Spatial Decision Support System, applied to the location of the High Nature Value Farmland that takes in account the complex city of the rural, environmental, social and economical system and of the relation between its variables. To the rural areas then it is recognised a role within the environmental dynamic system as a connecting element with the surrounding environments. This approach is based on locating and preserving the relation between habitat systems with the aim of increasing the level of biodiversity. The main objective is the realisation of a cartography of the sensitive areas obtained following a multi-criteria analysis procedure, evaluating the level of influence of the environmental and anthropic structural factors depending on their distance and density.

All'interno del sistema territoriale meridionale la Regione Campania si presenta come un polo importante nel settore del trasporto e dello smistamento delle merci. Questo ruolo si è venuto rinforzando in seguito alla realizzazione di infrastrutture dedicate alla logistica, connesse ad infrastrutture di supporto. Il sistema campano presenta punte di eccellenza di livello nazionale che possono incentivare il ruolo della Regione in questo settore, ma presenta anche fattori negativi che possono rallentare il decollo del settore. Si fa riferimento alle strozzature infrastrutturali e gestionali che ne inceppano l'efficienza, ma anche alla debolezza del sistema produttivo regionale che non garantisce una massa critica locale alla logistica campana. Un terzo aspetto è la mancanza di un chiaro disegno di programmazione degli investimenti e una maggiore chiarezza dei ruoli da assegnare alle diverse iniziative, nate soprattutto sulla base di spinte localistiche non coordinate. Il paper analizza la situazione della logistica territoriale in Campania e delle sue interrelazioni territoriali individuando punti di forza e di debolezza e potenziali fattori evolutivi. Gli aspetti della logistica che vengono affrontati sono di tipo territoriale e si differenziano da quelli della logistica urbana per la quantità di merci movimentate e per la concentrazione in pochi poli strategici, in quanto queste piattaforme logistiche richiedono attrezzature specializzate e ampi spazi per la movimentazione e il deposito. L'analisi del rapporto tra territorio e logistica individua quelli che sono i principali elementi di interconnessione e, spesso, di crisi, nell'uso dello spazio fisico, in ragione degli obiettivi a volte divergenti tra il governo del territorio ed i soggetti economici. Si passa successivamente ad analizzare lo stato del movimento merci in relazione alla portualità mediterranea e lo stato del sistema logistico campano (non ancora definito in tutte le sue parti) in relazione anche alla situazione economica e territoriale regionale. A questo scopo il paper approfondisce anche l'evoluzione della pianificazione territoriale in Campania, mettendo in evidenza come molte scelte, tra cui quelle connesse alla localizzazione degli impianti della logistica, siano avvenute al di fuori di strumenti di piano vigenti. ; Logistics can be defined as the process of planning, organization and control of all the activities of transport and storage of goods and informations; it interests all the productive phases, from the acquisition of raw materials, to the production process in the factories, up to the delivery of the finished products to the final customers. The specific trend of the production's process due to the logistics involves the flows and the storage of goods, from raw materials to semi-finished goods to finished products, so they are available to consumers. In this way the logistics intersects the territory at different stages of its activity: when the raw materials are brought to the factory, when the factory sends to other factories semi-production units, where products are stored in equipped areas, and when the final goods are brought to terminal sales. Within the Southern territorial system the Campania is an important hub in the transport and sorting of goods. This role has made stronger after the carrying out of new infrastructures dedicated to the logistics, related to other support infrastructures, as railways and motorways. The regional system presents nationwide excellence's peaks that could encourage its role in this sector, but there are also negative factors that may to slow the take-off of the sector. The reference is to the infrastructures and operating bottlenecks interfering the efficiency, but also to the weakness of the regional production's system that doesn't ensures a local critical mass to the logistics of the region. A third aspect is the lack of a clear structure of programming investment and greater clarity of roles assigned to various initiatives, arising mainly on local, uncoordinated pushes. The paper analyzes the situation of territorial logistics and of its spatial interrelationship in Campania, identifying strengths, weaknesses, and potential evolutionary factors. The discussion faces up aspects of territorial logistics; they differ from the urban logistics for the amount of handled commodities and for the concentration in a few strategic poles, because these logistics platforms require specialized equipments and wide spaces for movement and deposit. The first part of the paper analyses the relationships between territory and logistics and identifies either the main elements of interconnection or, often, of crisis in the use of physical space, for reasons of the diverging objectives between the territorial government and the economic actors. The second part considers the condition of good's movement in relation to the Mediterranean port facilities, to the state of the logistics system of Campania, and to the economic and territorial situation of the region. To this purpose, the paper also explores the evolution of territorial planning in Campania, highlighting how a series of choices, including those related to the location of logistics facilities, have been made outside of existing planning tools.
