The main aim of this paper is to examine the presence of the strict liability category in the legal system of the Latin Catholic Church. According to the correct understanding of the objective responsibility in the legislation of modern states, the Author, after having considered profound analysis concerning the offices' duties of the hierarchical Superior, studied the specific content of the can. 128 CIC/1983 and indicated it as the benchmark in order to establish possible, not only theoretical, answer of the problem. The research has found that, it is highly probable to assign some negative consequences (a real responsibility) to ecclesial Superiors even without their fault. ; Il presente studio s'interrgoa sull'effettiva presenza dell'istituzione della responsabilità oggettiva all'interno dell'ordinamento canonico vigente. La tesi analizza il tema della natura della responsabilità endofamiliare, che rappresenta una tra le maggiori novità che, negli ultimi anni, ha interessato l'evoluzione del diritto di famiglia. Se per lungo tempo la famiglia è stata considerata immune alle regole di responsabilità, oggi, il panorama scientifico italiano è pressoché concorde nell'ammettere l'applicazione delle regole di responsabilità civile nelle ipotesi di violazione dei doveri coniugali e genitoriali. Tale acquisizione si pone quale corollario non solo al superamento dell'idea di specialità dei rapporti familiari, ma anche alla progressiva affermazione dei diritti della persona all'interno delle formazioni sociali in cui si esplica la personalità dell'individuo. Gli interventi della giurisprudenza di merito e di legittimità hanno oltrepassato i tradizionali confini del diritto di famiglia, aprendo tale settore alle regole aquiliane, facendo leva, per questa via, non soltanto sull'insufficienza dei rimedi giusfamiliari, ma soprattutto sulla necessità di assicurare all'individuo adeguata tutela, anche risarcitoria, e ciò indipendentemente dal fatto che l'individuo appartenga ad una comunità familiare. Nonostante la giurisprudenza ormai maggioritaria sia orientata nel senso di veicolare la responsabilità derivante dalla violazione del dovere familiare secondo le regole aquiliane, non mancano, tuttavia, voci contrarie che mettono in discussione la natura stessa di tale responsabilità. Si valuta, dunque, la possibilità di interpretare i doveri matrimoniali quali obblighi di protezione, ponendo attenzione alla natura del rapporto e agli obblighi che ne discendono, con l'obiettivo di valutare se sia possibile offrire una lettura alternativa alle ipotesi risarcitorie riguardanti la violazione dei doveri coniugali. In questo senso non si potrà certamente trascurare la presenza di obblighi giuridici specificamente individuati dal legislatore e la dimensione di relazionalità in cui vengono a trovarsi i familiari conviventi, che non possono essere considerati alla stregua di un «chiunque» generico, in quanto legati da un rapporto preesistente che nasce e si instaura quale rapporto particolarmente qualificato. L'indagine in esame si estende anche a valutazioni che riguardano l'opportunità e la convenienza a ravvisare in taluni istituti finalità punitive. Lo spunto è offerto dall'art. 709 ter cod. proc. civ., in tema di soluzione delle controversie nelle ipotesi di gravi inadempienze e violazioni nell'affidamento dei figli. L'espressa previsione di una formula risarcitoria, che attribuisce al giudice il potere di disporre il risarcimento del danno a carico di uno dei genitori, nei confronti del figlio, o anche dell'altro genitore, ha fatto emergere orientamenti contrastanti in ordine alla possibilità di configurare, attraverso tale disposizione, un'ipotesi di danno punitivo. ; This dissertation analyzes the theme of liability remedies between spouses, which represents one of the most important acquisitions, in recent years, that has interested the evolution of Family Law. If in the past the family was considered immune to the compensatory remedies, nowadays, the panorama of Italian legal science is almost unanimous to admit the application of civil liability rules in cases related to the violation of conjugal and parental duties. This opening to general remedies not only involves the overcoming of the specialty of Family Law, but also progressively affirms the expected growth of personal rights within all social formations, in which the personality of the individual is expressed. The interventions of the case law of merit and legitimacy have transcended the traditional boundaries of Family Law, opening the sector to non-contractual rules, levering, in this way, not only the inadequacy of the existing remedies, but above all the necessity to ensure adequate protection to the individual, also for damages, regardless of whether he belongs to a family community or not. While the majority of jurisprudence is oriented to acknowledge that the violation of duty of a spouse should be regulated by non-contractual liability, as if it were a tort, there are doctrines that contest the nature of that type of responsibility and prefer to define it as contractual liability. Therefore, it is necessary to evaluate the possibility to interpret marital obligations as «obligations of protection», by considering the nature of the relationship and the obligations that descend, with the purpose to evaluate if it is possible to offer an alternative interpretation of the hypothesis of compensation regarding the violation of conjugal duties. In this sense, the presence of legal obligations identified by the legislator and the relatedness of family members, who can not be considered as a generic person, because they are in a particularly qualified relationship, certainly can not be overlooked. This research extends across evaluations that regard the opportunity and convenience to recognize punitive damages, in certain institutes. A starting point is offered by analyzing art. 709 ter cod. proc. civ., in theme with solutions of the controversies in settling disputes in the hypothesis of serious defaults and violations involving child custody. The expressed prevision of a formula for compensation, that confers a judge the authority to order that compensation for damages against one of the parents, in favor of a child or even for the other parent, has caused conflicting orientations to emerge in the order of the possibility to configure a hypothesis of punitive damages. ; Dottorato di ricerca in Persona, impresa e lavoro: dal diritto interno a quello internazionale (XXVII ciclo)
Tort liability for environmental damages and historical pollution The work explores the issue of tort liability for environmental damages, with specific reference to the cases of liability for the so called "historical" pollution, where such term indicates events of long standing environmental deterioration. The starting point is the analysis of a lawsuit decided by the Court of Milan in 2012, relating to damages, either or not of environmental kind, claimed by certain government authorities against the last owner of an industrial site for the production of chemical products. Such industrial site had remained active over the entire twentieth century under the ownership and management of different entities who contributed, to different extent, to the whole status of environmental deterioration identified on the spot. Moving from the case at stake, the work recalls the laws governing the compensation of environmental damages under the Italian legal system, from law 349/86 until the so called Environmental Code (legislative decree 152/06), and the EU legal system, in such last respect with specific reference to EU Directive 2004/35/CE. The analysis of the case has guided the verification, in the application stage, of the solutions created by scholars and case law, and the debate on the different functions that the institute of tort liability holds in respect of the issue of environmental damage. A particular attention has been reserved, on the basis of the scholars' and case law's arguments developed over the years, to crucial issues in the scholars' debate: the legal notion of environment and environmental damage, the question of identifying the persons liable, the role of the cause-to-effect relation, the criteria for allocating the liability, the relationship between the regulation governing the environmental damage and the one governing the recovery, the methods of compensation.
La ricerca ha ad oggetto l'analisi della disciplina della responsabilità del vettore terrestre di merci per conto terzi ed i riflessi che detta disciplina ha avuto modo di svilupparsi nel mercato assicurativo. L'attenzione è stata rivolta al contratto di trasporto di cose in generale, seguendone la disciplina codicistica e le evoluzioni legislative intervenute. Particolare rilievo assume la novella apportata all'art. 1696 c.c., introdotta dall'art. 10 del Dlgs. 286/2005, grazie alla quale l'ordinamento italiano ha potuto codificare il limite di indennizzo dovuto dal vettore nell'ipotesi di colpa lieve, L'introduzione del limite legale di indennizzo per le ipotesi di responsabilità per perdita o avaria della merce trasportata ha generato nel mondo assicurativo interessanti reazioni. L'elaborato esamina anche l'evoluzione giurisprudenziale formatisi in tema di responsabilità vettoriale, evidenziando il crescente rigore imposto dalla giurisprudenza fondato sul principio del receptum. Tale fenomeno ha visto immediata reazione nel mercato assicurativo il quale, sulla base di testi contrattuali non dissimili tra le diverse compagnie di assicurazioni operanti sul mercato domestico e che traevano origine dai formulari approvati dall'ANIA, ha seguito l'evoluzione giurisprudenziale apportando significative restrizioni al rischio tipico previsto dalle coperture della responsabilità civile vettoriale. La ricerca si è poi focalizzata sull'esame delle più comuni clausole contemplate dalle polizze di assicurazioni di responsabilità civile e sul loro significato alla luce delle disposizioni di legge in materia. Tale analisi riveste preminente interesse poiché consente di verificare in concreto come l'assicurazione possa effettivamente costituire per l'impresa di trasporto non tanto un costo bensì una opportunità di risparmio da un lato ed un modello comportamentale, sebbene indotto, dall'altro lato per il raggiungimento di quei canoni di diligenza che qualsiasi operatore del settore dovrebbe tenere durante l'esecuzione del trasporto ed il cui venir meno determina, come detto, sensibili effetti pregiudizievoli di carattere economico. ; The Candidate focused his studies on laws and regulations applicable to civil liability of third parties carrier and on the implications originated from such laws and regulations over the insurance market. The survey started analysing the principal aspects of carriage of goods contracts and examining the relevant provisions set in the Civil Code. The study analysed under that viewpoint the new regulation applicable to freights and the legal provisions that, for the first time, introduced in our country the principle that civil liability must be shared among all the parties involved, with different assignements, in the carriage by land. The introduction of legal limits to compensation in the event of total or partial loss of the goods caused interesting effects on insurances. Together with such issue the study describes the gradual development of carrier's liability case law, starting from the 80's, underlining the strictness of the judgements based on the "receptum" rule, which limits the possibility of carrier's discharge to very few particular cases. On such basis almost all of the italian insurance policies, which were drafted according to ANIA's forms, set relevant limitations to carriers' liability coverages, strictly delimited the risk insured and imposed specific loss prevention conducts to the carriers. The study also examines the most common clauses carried by the liability policies and explains their scope and meaning with reference to all applicable provisions. Such matter is particularly interesting because it shows the reasons why insurance represents a saving opportunity for carrier rather than a cost and it highlights the benefits arising from the compliance to the rules of conducts that the carriers are obliged to follow in order to prevent insurers' obiections to pay insurance indemnity in the event of loss.

A lo largo de este artículo se pretende analizar la regulación española sobre la responsabilidad del empresario en los supuestos de accidente de trabajo. Para ello, se realiza una introducción al deber de seguridad que tiene el empresario en la legislación española con objeto de poder concretar los límites de sus obligaciones preventivas. A continuación, y entrando en el estudio de la responsabilidad civil, se analizan los requisitos para la aplicación de la responsabilidad civil contractual y extracontactual, así como las diferencias entre ambas figuras. Junto a lo anterior, y tras abordar temas como la prescripción y la jurisdicción competente, se pretende dotar al estudio de una visión práctica por lo que se trabaja consentencias judiciales de tribunales españoles. This article aims to analyze the Spanish legislation on the employer's liability relating to accidents at work. To this end, the introduction concerns the duty of the employer in the Spanish legislation, with the goal of identifying the limits of the obligation of safety and health at work. Then, entering in the study of civil liability, the analysis concerns the conditions for the application of contractual and tort liability and the differences between the two figures.Besides the above, and after dealing with topics such as prescription and competent jurisdiction, the study aims to provide a practical vision through judgments of Spanish Courts. La tesi è dedicata ai profili di diritto internazionale privato del danno da prodotto, con particolare riguardo agli sviluppi normativi che hanno interessato i Paesi membri dell'Unione europea. Nella prima parte della trattazione vengono analizzate le vicende più significative connesse alla nascita della fattispecie sia da un punto di vista sostanziale che internazionalprivatistico. In tale ambito, viene riservata peculiare attenzione all'esperienza degli stati Uniti (Cap. 1), che come noto hanno rappresentato la culla della responsabilità del produttore, e viene esaminata la Convenzione dell'Aja del 2 ottobre 1973 (Cap. 2), prima disciplina speciale della materia sul piano del diritto internazionale privato. La seconda parte dell'elaborato si concentra invece sugli interventi legislativi predisposti a livello comunitario (direttiva 85/374/CEE, come modificata dalla direttiva 1999/34/CE, e regolamento 864/2007/CE) al fine di ricostruire i rapporti intercorrenti tra le diverse fonti (nazionali, comunitarie e internazionali) che oggi concorrono a disciplinare la questione della legge applicabile alla responsabilità da prodotto negli Stati membri dell'Unione europea (Cap. 3). ; The thesis examines the conflict of laws aspects of product liability, with particular regard to recent developments of EU Member States' legislation. Product liability law as a distinct body of law – at least partially independent from general tort law – is a relatively new phenomenon. It arose during the 1960s in the Unites States of America. In that period US courts and scholars started to deal with choice-of-law issues in product liability cases. Chapter 1 gives an overview of the most significant events relating to product liability history, from both a domestic and international point of view. The need for a special conflicts rule – pointed out first by the US commentator Albert Ehrenzweig – led to the adoption of the 1973 Hague Convention on the law applicable to product liability, the first regulation of the topic in private international law, which is analysed in Chapter 2. Finally, Chapter 3 examines European Community legislative interventions in the field of product liability (Council Directive 85/374/EEC, amended by Directive 1999/34/EC, and Regulation 864/2007/EC) with the aim of assessing the present state of the law in EU Member States. Different sources are currently competing to regulate the issue of the law applicable to product liability in the EU context and this chapter analyses the relationships between them.
