The European Emission Trading Scheme (EU ETS) is the central EU policy instrument aimed at mitigating climate change and to comply with the target agreed in the Kyoto protocol. The EU ETS could result in an harmful impact for the competitiveness of the European firms, as it was unilaterally introduced by the EU, and so firms could be induced to relocate their carbon-intensive production activities in countries with less stringent regulations for mitigating climate change (carbon leakage effect). For this reason, European Union decided to grant most of permits for free in its first phases and to exempt leakage-exposed sectors from auctioning in its third phase. According to Coase (1960), the level of emissions for each firm in equilibrium does not depend on the assignment of property rights over the emissions but this could not be the case in a real world system, with a lot of possible frictions, as transaction costs and behavioural anomalies. The aim of the paper is to exploit the asymmetry in the allocation mechanisms introduced from the third phase of the EU ETS to evaluate whether different allocation mechanisms are neutral in terms of emission abatement decisions. Results suggest a non-neutral role of the allocation mechanisms, with establishments that received allowances for free having greater emissions than plants that were forced to buy allowances through auctions.
La legge n. 146 del 1990 ha istituito la Commissione di garanzia per l'attuazione della legge sullo sciopero nei servizi pubblici essenziali, un'authority deputata al controllo dell'effettivo bilanciamento del diritto di sciopero con gli altri diritti della persona di rango costituzionale nel caso dei servizi pubblici essenziali. Ad essa spettano alcuni poteri tra di loro eterogenei. Accanto a poteri propulsivi e sanzionatori, essa possiede poteri di tipo normativo. La legge prevede, infatti, che le prestazioni indispensabili e le altre misure necessarie al contemperamento siano determinate da accordi tra il datore di lavoro e le associazioni sindacali, mentre per il lavoro autonomo da codici di autoregolamentazione forniti da ognuna delle categorie interessate. Gli accordi e i codici di autoregolamentazione devono essere, comunque, sottoposti al vaglio della Commissione di garanzia la quale in ultimo stabilisce se essi siano idonei a realizzare il bilanciamento dei diritti in questione. Quando i soggetti indicati dalla legge non provvedano alla redazione dei suddetti atti, la Commissione interviene con l'emanazione di una provvisoria regolamentazione, la quale possiede natura di regolamento, giacchè partecipa dei caratteri della generalità ed astrattezza propri delle norme di legge. In effetti, anche altre authorities possiedono un potere normativo, che si sostanzia alle volte in un regolamento indipendente, altre in un regolamento simile ai regolamenti delegati ed altre al regolamento esecutivo. Poiché la legge n. 146 del 1990 prevede quali siano gli istituti idonei a realizzare il bilanciamento (preavviso, proclamazione scritta, procedure di raffreddamento e conciliazione, intervallo minimo, misure indicative delle prestazioni indispensabili), la provvisoria regolamentazione possiede i caratteri del regolamento esecutivo. ; The law n. 146 of 1990 established the Commission to guarantee the implementation of the law on strike in essential public services, an authority delegated to the monitoring of the actual balance of the right to strike with the other person's constitutional rights in the case of essential public services. Some powers belong to it among themselves heterogeneous. Besides propulsive powers and sanctions, it has powers of a legislative. The Act provides, in fact, that the essential services and other necessary steps to reconciliation are determined by agreements between employers and trade unions, while self-employment to self-regulatory codes provided by each of the categories involved. Any agreements and codes of conduct should be, however, subject to review by the Commission to guarantee that ultimately determines whether they are appropriate to achieve the balancing of the rights in question. When the parties according to law does not provide for the preparation of such documents, the Commission takes the issue of a provisional regulation, which has as a regulation in the statutory power sense, since part of the character of the generality and abstractness of laws. In fact, other Authorities have a statutory power, which is embodied in a regulation aimed at independent, regulations similar at the delegate regulations of the Goverment and the executive regulations. Since the law n. 146 of 1990 provides for such institutions are likely to bring about balance (notice, written proclamation, cooling and conciliation procedures, minimum range, indicative measures of performance necessary), the provisional regulation has the character of the executive regulation.
Oggetto della ricerca è l'analisi della gestione del conflitto sindacale nelle relazioni industriali nell'Unione europea, e in particolare l'assenza del riconoscimento dello sciopero tra le materie legislative di competenza della Comunità europea. Lo studio è strutturato in tre capitoli. Il primo è dedicato all'esame degli aspetti fondamentali del sistema di relazioni industriali in Europa; in particolare vengono ripercorse le tappe dell'evoluzione del dialogo sociale, i principali attori e regole, le differenti modalità di organizzazione delle parti sociali, le forme di partecipazione dei lavoratori nonché il sistema delle relazioni industriali nell'Unione Europea. Il secondo capitolo è incentrato sul tema del riconoscimento all'interno dei diritti sociali fondamentali "comunitari", del diritto di sciopero. In particolare, nei paragrafi centrali l'attenzione si incentra, sul diritto dei lavoratori a ricorrere ad azioni collettive per la difesa di propri interessi, così come sancito nella Carta dei Diritti Fondamentali dell'Unione Europea, (proclamata a Nizza il 18 dicembre 2000). Nonostante tale importante riconoscimento, la regolamentazione del diritto di sciopero non rientra tra le materie legislative di competenza della Comunità europea (art. 137.5, del TUE, ora art. 153.5 TFUE). L'esclusione può essere letta come espressione della volontà politica degli Stati membri di rispettare gli standard nazionali, rinunciando a qualsiasi interferenza del diritto comunitario su un terreno nel quale è difficile prospettare armonizzazioni normative, in ragione della eccessiva difformità delle discipline nazionali. Tale scelta ha, tuttavia, determinato una grande differenziazione tra le discipline nazionali, con particolare riferimento alla regolamentazione dello sciopero nei servizi pubblici essenziali. Il tema dell'esclusione si è riproposto e acutizzato negli ultimi anni a seguito di una serie di pronunce della Corte di Giustizia, relative ai casi Viking, Laval e recentemente Commissione vs Germania. In particolare, nel secondo paragrafo sono analizzate le sentenze Viking e Laval, abbinate non solo dal contenuto, ma anche dalla prossimità temporale, la prima dell'11 dicembre, la seconda del 18 dicembre 2007 che registrano un cambiamento rispetto alla precedente fase di indifferenza, in quanto per la prima volta, il diritto di sciopero è riconosciuto come diritto fondamentale dell'Unione europea. L'attenzione è posta anche sulla recentemente pronuncia della Corte di Strasburgo sul diritto di sciopero che con la sentenza Enerij del 21 aprile 2009 marcherebbe una netta evoluzione giurisprudenziale, in quanto si potrebbe sostenere che la Corte abbia ritenuto che il diritto di sciopero, fintantoché è esercitato per sostenere la contrattazione collettiva, è ugualmente essenziale alla libertà sindacale e pertanto direttamente riconosciuto e tutelato dall'art. 11 della Convenzione Europea per i Diritti dell'Uomo. Il terzo capitolo, infine, si propone, pertanto, di analizzare comparativamente le soluzioni legislative adottate dall'ordinamento italiano, francese, inglese e tedesco, riguardo la disciplina dell'azione di autotutela collettiva e del diritto di sciopero nei servizi pubblici essenziali nei principali Paesi dell'Unione Europea dove, i differenti ordinamenti nazionali rendono difficile un confronto teso al raggiungimento di una disciplina comune. In particolare, la legislazione italiana con la previsione di una apposita Commissione di garanzia, quale autorità pubblica indipendente, cui sono affidati compiti di verifica e anche di statuizione in relazione alle prestazioni indispensabili da effettuare per garantire ai cittadini la possibilità di continuare a fruire, seppure con delle limitazioni, dei propri diritti costituzionalmente tutelati, rappresenta un caso unico in Europa che pone l'Italia sotto questo profilo in una posizione più avanzata rispetto all'Europa. ; Object of the search is the analysis of the management of the trade-union conflict in the industrial relations in the European Union, and in particular the absence of the acknowledgment of strike between the legislative matters of competence of the European Community. The study is structured in three chapters. The first one is dedicated to the examination of the fundamental aspects of the system of industrial relations in Europe; in particular they go over again the stages of the evolution of the social dialogue, the main actors and rules, the different kind of organization of the social parts, the forms of participation of the workers let alone the system of the industrial relations in the European Union. The second chapter focuses on the topic of the acknowledgment inside of "communitarian" fundamental of the social rights and of the strike right. In particular, in the middle paragraphs the attention is focused on the right of the workers to resort to collective actions for the defense of own interests, thus like sanctioned in the Paper of the Fundamental Rights of European Community, (proclaimed in Nizza 18 December 2000). Although such important acknowledgment, the regulation of the strike right is not included between the legislative matters of competence of European Community (art. 137.5, del TUE, ora art. 153.5 TFUE). The exclusion can be read like expression of the political will of the Member States to respect the national standards, renouncing to any interference of the communitarian right in a branch in which it is difficult to show normative agreements in reason of the excessive difference of the national disciplines. Such chosen it has, however, determined a great differentiation between the national disciplines, with detail reference to the regulation of strike in the essential public services. The topic of the exclusion has been reproposed and intensified during the last few years as a result of a series of judgment of the Law court, relative to the cases Viking, Laval and, recently, Commission vs Germany. In particular, in the second paragraph are analyzed the Viking and Laval sentences, matched not only by content but also by the temporal proximity, the first of 11 December, the second of December 18 2007. They records a change regarding the precedence phase of indifference, as for the first time, the strike right is recognized like fundamental right of the European Union. The focus is also on the recent ruling by the Strasbourg Court on right to strike, in its judgment of 21 April 2009 Enerij would mark a clear development of the case, as it could be argued that the Court has held that the right to strike, as long as it is exercised to support collective negotiation, it is equally essential to freedom of association and therefore directly recognized and protected by art. 11 of the European Convention on Human Rights. The third chapter, at last, proposes, therefore, to analyze comparatively the legal approaches adopted by the Italian, French, English and German rules, about the discipline of the collective self-defense and the right to strike in essential public services in main countries of European Union, where the different national rules make difficult a compare aimed to the reach of a common framework. In particular, the Italian legislation with a provision for a special Commission of guarantee, represents a unique case in Europe and place Italy in a more advanced position than the member States. Anche se le regolazioni sul commercio dei prodotti agricoli si sono evoluti dagli obiettivi di piena liberalizzazione perseguiti per il commercio dei prodotti industriali, le regole del GATT sono state applicate fin dall'inizio. L'autore dell'articolo ricostruisce il quadro normativo delle fonti internazionali, con particolare attenzione all'Accordo SPS (sulle misure sanitarie e fitosanitarie), all'Accordo TBT (sulle barriere tecniche al commercio), e all'Accordo TRIPs (Trade Related Intellectual Property Rights; Accordo sugli aspetti commerciali dei diritti di proprietà intellettuale). La seconda parte dello studio approfondisce il tema del commercio e dell'informazione a garanzia del diritto internazionale umanitario, partendo da un esame del caso del vino israeliano e dalla motivazione della sentenza della Corte di giustizia dell'Unione europea (C-368/18). Da quando l'OMC è stata istituita sono avvenuti molti cambiamenti, ma soprattutto c'è stata un'inversione di rotta da parte dei Paesi industrializzati che hanno scelto di stimolare accordi commerciali bilaterali rispetto al sistema multilaterale, minando così l'importanza delle regole dell'OMC. La novità più significativa di questa evoluzione è che tali accordi bilaterali non sono più da considerare come ulteriori sviluppi nella costruzione del sistema multilaterale, ma sono spesso diventati dei veri e propri ostacoli alla ricostruzione. Per l'autore, sono proprio le regole del commercio internazionale stabilite con l'OMC a offrire le migliori garanzie di fronte alla crescita degli scambi e alla conquista sempre più crescente di quote significative del mercato mondiale da parte dei Paesi più aggressivi. Le crisi economiche degli ultimi anni e, soprattutto, i recenti sconvolgimenti dei mercati internazionali a seguito della pandemia hanno mostrato la necessità di rinnovare l'agenda globale, legando indissolubilmente la circolazione delle merci (soprattutto agricole) ad ulteriori obiettivi che non possono prescindere dal cambiamento climatico, dalla lotta all'inquinamento e dalla soluzione dei problemi ambientali che sono diventati temi da considerare come tasselli di un unico grande mosaico. Questi obiettivi richiederebbero un rilancio del multilateralismo e confermerebbero l'importanza di trovare un anello comune all'interno dell'OMC. ; Mimo że regulacje dotyczące handlu produktami rolnymi są wynikiem procesu liberalizacji handlu produktami przemysłowymi, to w przypadku produktów rolnych od początku stosowane były zasady GATT. Następnie przedstawiono zagadnienia handlu i informacji gwarantujących międzynarodowe prawo humanitarne, w tym analizę sprawy izraelskiego wina i uzasadnienia wyroku Trybunału Sprawiedliwości Unii Europejskiej (C-368/18). Od czasu utworzenia WTO zaszło wiele zmian, przede wszystkim zmiana orientacji w krajach najbardziej uprzemysłowionych, które zdecydowały się na zawieranie dwustronnych umów handlowych zamiast wielostronnych, podważając tym samym sens przepisów WTO. Uważa się bowiem, że porozumienia dwustronne nie przyczyniają się już do rozwoju systemu wielostronnego, ale często stoją mu na przeszkodzie. Według autora zasady handlu międzynarodowego ustanowione w ramach WTO mogą stanowić najlepszą gwarancję wobec rozwoju handlu i zdobywania coraz większych udziałów w rynku światowym przez najbardziej ekspansywne kraje. Kryzysy gospodarcze ostatnich lat, a zwłaszcza wstrząsy na rynkach międzynarodowych spowodowane pandemią, pokazały, że konieczny jest powrót do globalnego programu działań, łączący przepływ towarów (zwłaszcza rolnych) z innymi celami, których osiągnięcie powiązane jest ze zmianami klimatycznymi, walką z zanieczyszczeniem i rozwiązaniem problemów środowiskowych, gdyż są to elementy jednej całości. Wymagałoby to jednak postępowania zgodnie z zasadami multilateralizmu i znalezienia wspólnego mianownika w ramach WTO. ; Even though the regulation on the trading in agricultural products has evolved from the objectives of full liberalisation pursued for the trade in industrial products, the GATT rules have been applied to agricultural products from the very outset. The author of this article reconstructs the regulatory framework of international sources, with particular attention to the SPS Agreement (the Sanitary and PhytoSanitary measures), the TBT Agreement (the Technical Barriers to Trade), and the TRIPs Agreement (Trade Related Intellectual Property Rights). The second part of the essay delves into the issue of trade and information to guarantee international humanitarian law, starting from the examination of the Israeli wine case and the reasoning of the Court of Justice of the European Union in its judgment (C-368/18). Since the establishment of the WTO, many changes have taken place, but above all there has been a reversal of direction by the most industrialized countries that have chosen to stimulate bilateral trade treaties over the multilateral system, thus undermining the importance of the WTO rules. The most significant novelty of this evolution is that such bilateral agreements are no longer to be considered as further developments in the construction of the multilateral system, but have often become real obstacles to this reconstruction. For the author, it is precisely those rules of international trade established with the WTO that can offer the best guarantees in the face of trade growth and the ever-increasing conquest of significant shares of the world market by the most aggressive countries. The economic crises of the recent years and, above all, the recent upheaval in international markets following the pandemic have shown the need to renew the global agenda, indissolubly linking the movement of goods (especially agricultural goods) to further objectives that cannot be separated from climate change, the fight against pollution and the solution to environmental problems which have become issues to be considered as pieces of a single large mosaic. These objectives would require a relaunch of multilateralism and confirm the importance of finding a common link within the WTO.
Dumping is the practice of a company exporting a product to another country at prices lower than the normal value of the product (the domestic prices of the product) on its own domestic market. In 2002 a new path and evolution about the European Food Legislation started. As a matter of fact, the European Regulation n.178/2002/CE establishes rules, procedures and a pioneering approach regarding food safety. That is automatically introduced and applied in each EU State. Anyway, the European Legislation must 'cross' with national provisions, contained in Penal Code, concerning the protection of human health and of trade. In this paper the Authors outline the "food rules" contained in the Italian Penal Code and analyze the 'parallel convergences' with the EU Rules subjected to direct application, such as the EU Regulations.
Trilateral regulation, based on relations among trade unions, employers (or their associations) and governments, is one of the main mechanisms of socio-economic regulation in Western countries since decades, as well as a cornerstone of the so-called European social model. Notwithstanding, work regulation without trade unions' involvement is an increasingly widespread reality, especially within innovative workplaces. This outcome gives credit to the "race to the bottom" and "globalization theories", which predict a general convergence towards a neo-liberal institutional setting, where there is no space for labour and work regulation is unilaterally set by firms. To examine what underlies trade unions' inclusion or exclusion from regulatory processes, this research focuses on an innovative business like the Factory Outlet Centre, a huge retailing complex with almost one thousand workers, mostly shop assistants. Actually, from an Industrial Relations perspective, it might not be the appropriate unit of analysis to test trilateral regulation's survival, given that its features, like being a greenfield and a multi-employers workplace full of several micro-firms, are usually associated to labour's under-representation. But the context matters too, and here Italy is the setting of analysis, which is a particularly fitted context, because it shows an "organized" system of industrial relations, where labour representation is traditionally rooted. Moreover, Italian legal framework on commerce has been recently reformed, moving several competencies to regional and local administrations. Within this frame, field work deepens eight Factory Outlet Centres evenly spread in four regions (Toscana, Emilia Romagna, Lombardia and Veneto), allowing the emergence of regional varieties, as the ones related to political sub-cultures. The working hypothesis is that innovative businesses rely on new ways to coordinate socio-economic activities that, challenging the old features of regulation, allow the first-mover to act as a rent-seeker, unless involved entrepreneurs, politicians and trade unionists reach a new compromise. So there are only two kinds of actors, "first-movers" and "subordinates", and three kinds of actions, unilateral, negotiated and cooperative. As far as our case-studies are concerned, first-movers are entrepreneurs who promote and develop retailing complexes such as Factory Outlet Centres; as well as local governments, which hold the legal authority to give planning permissions and retailing licenses to make them operate. Instead, subordinate actors are trade unions, firstly worried about the way to reply to others' strategies. As far as cooperation and opportunism are concerned, the former targets to positive-sum games, while the latter always conceives at least a loser. Thanks to an extended review of policy documents, sentences, local newspapers and twenty-two interviews, this research explains precisely why in few cases trade unions have been involved in the work regulation, while in the others such a triangulation has not been feasible, letting employers and local politicians set the rules. Indeed, a clear finding emerges from the empirical analysis. Whenever work regulation is decentralized at local level, employers and local administrators join together to exclude, unilaterally, trade unions from the deal, exchanging mutual favours and acting as perfect rent-seekers. On the contrary, insofar as a more centralized public actor actively intervenes, such as regional policy-makers or judges, cooperation permeates work regulation, including trade unions along with employers and local administrators, as also leading to positive repercussions on workers' well-being without undermining company's profitability. A straightforward demonstration of this dark side of decentralization comes from the Sunday openings issue. On one hand, Sunday openings and the related extension of working time have been allowed by local government and then imposed to workforce by management. On the other, whenever a regional control is still effective, the issue has been solved through an innovative form of industrial relations: collective bargaining at the "site" level, where the workers' counterpart is not their employer, usually a shop-keeper, but it is their workplace's manager, that is the Factory Outlet Centre's director. Here the deal is stroke because trade unions accept a flexible working time arrangement in return for compensations like wage increases and a space for unions' local section. Besides, the ways unions approached these innovative workplaces shed light on the Italian version of "trade unions' revitalization", which encompasses a mix of both organizing and servicing strategies. Basically, despite site-bargaining renovates unions' actions preserving their ability to mobilize workers, its fragility clearly stands out, due to the need of an increasingly rare supportive state. Once said so, the spread of bilateral agencies, despite often judged as a unions' failure and a betrayal to their collective mission, might be the best results currently achievable, at least to keep some power to influence counterparts and institutions. It goes without saying that such a line of reasoning assumes that these two efforts are not seen as mutual exclusive but, adequately set, self-reinforcing. Despite this research zooms a narrow phenomena like Factory Outlet Centres, it aims at contributing to the huge academic debate regarding institutional change, here interpreted in relation to regional models of industrial relations. Among the four regions observed, Toscana and Veneto are in line with their institutional paths, respectively, a neo-corporatist and a neo-conservative one. Vice versa, Lombardia and Emilia Romagna are getting ahead of an institutional change: a bit more labour-friendly the former, in respect to its pluralist point of departure, and a much less labour-friendly the latter, a counter-intuitive outcome considering its progressive tradition and its actual approach inspired to social dialogue. The results open to further researches, specially on different workplaces within the context already considered, Italy, in order to confirm or to controvert such trends; as well as on different contexts but within the same workplace, Factory Outlet Centre, in order to find out similar or different outcomes. As demonstrated in this work, business innovation has strong implications for the future of trilateral work regulation, whose directions are not predictable, depending both on actors' strategies and institutional settings. Obviously, any further deepening of such mechanisms is welcomed.
The Court clarifies the concept of 'obvious procedural error' for the purposes of the European Union trade mark regulation which should lead EUIPO to revoke its own decision. The EUIPO's Board of Appeal's decisions in inter partes proceedings are revocable under art. 80, para.1 of Regulation n.207/2009, in case of a clear procedural mistake committed by the above Boards of Appeal. Any infringement of the obligation to state reasons, such as a failure to state reasons or an inadequate statement of reasons, constitutes a procedural error for the purposes of art. 80 para. 1. The legal error of the Board does not invalidate the decision under appeal, if the decision's is based on different legal principles.
Il contributo si concentra sulla disciplina penale italiana in materia di segreto commerciale, e ha l'intento di verificare se la recente riforma legislativa (D. Lgs. n. 63/2018) sia riuscita a conformare l'ordinamento domestico alle moderne istanze della data-driven economy. La novella ha modificato la struttura e l'oggetto di tutela dell'art. 623 c.p., e ha comportato inoltre un avvicinamento della disciplina penale al sistema di tutela civilistico predisposto dal codice della proprietà industriale (art. 98 c.p.i.). Tale avvicinamento pone all'interprete non pochi dubbi in merito alla compatibilità tra le due forme di protezione, dubbi enfatizzati dalla recente giurisprudenza convenzionale. In conclusione, si tenterà di dimostrare come, nonostante i rischi derivanti dal cumulo delle diverse discipline, permangano spazi di lecito intervento penale in materia, specialmente se si struttura in modo differente l'oggetto del segreto commerciale tutelabile dalle due diverse branche del diritto. ; The paper focuses on the Italian criminal provisions regarding trade secret. It aims at analyzing the consistency between the criminal law system (recently reformed by D. Lgs. N. 63/2018) and the modern needs of data-driven economy. D. Lgs. n. 63/2018 modified the structure and the object of protection of art. 623 c.p. and it also filled the gap between the criminal law system and the civil law protection (art. 98 industrial property code). Problems regarding the compatibility of the different forms of protection may arise from this reform, as underlined by the case law of the ECHR too. Notwithstanding the risks related to the overlapping of the two regulations, the paper tries to differentiate the notion of trade secret of the two branches of law in order to demonstrate the need of the criminal protection of trade secret. ; El presente trabajo aborda la regulación penal italiana en material de secreto comercial, a fin de verificar si la reciente reforma legislativa (D. Lgs. n. 63/2018) logró adecuar el ordenamiento nacional a las modernas instancias de la data-driven economy. La reciente intervención legislativa modificó la estructura y el objeto de tutela del artículo 623 del Código Penal italiano, comportando una aproximación de la regulación penal al sistema de tutela civil, previsto en el Código de Propiedad Industrial (artículo 98). Tal acercamiento plantea dudas respecto a la compatibilidad entre las formas de protección, las cuales se ven reforzadas por la reciente jurisprudencia de la Corte Europea de Derechos Humanos. Sin perjuicio de los riesgos relacionados con la superposición entre ambas regulaciones legales, el presente artículo intenta diferenciar la noción de secreto comercial en las dos ramas del derecho con la finalidad de demostrar la necesidad de la protección penal del secreto comercial.
Since 1997, the Palestinian Authority (PA) has expressed an interest in getting observer status in the WTO; this has been a step which paves the way to getting full membership in the organization. Here, the question which shall be addressed is "Does the PA possess a legal readiness which meets the accession requirements in terms of its control over Palestine's trade policy, on the one hand, and the existence of the regulations, laws and legislations which are compatible with the requirements of the accession to the WTO as well as its multilateral agreements held, on the other hand? The most important issues are outlined as follows: • The extent of the ability of the PA to enact economic laws, contributing to the creation of a legal environment that is able to respond to the rapid changes which distinguish the economic sector. • The extent of the ability of the PA to enact laws that are compatible with each other, as well as with international trade standards and the WTO's rules and requirements. • The extent of the ability of the PA to terminate or amend the Paris Economic Protocol, which limits Palestine's control over its foreign trade policy.

Il commercio equo e solidale (Cees) è andato sviluppandosi nel mondo occidentale nel corso degli ultimi quaranta anni, quale risposta alla crescente consapevolezza del fatto che i vantaggi derivanti dagli scambi e dall'espansione del commercio internazionale non risultano equamente ripartiti tra tutti i Paesi e tra i vari strati della popolazione di ciascuno dei Paesi stessi. La progressiva estensione del fenomeno in termini di ampliamento delle aree geografiche coperte e di aumento del quantitativo e delle tipologie dei beni commerciati, nonché il proliferare dei soggetti coinvolti e la loro stessa eterogeneità ha via via evidenziato le potenzialità connesse a tale realtà divenuta, nel corso di pochi decenni, da settore di nicchia, modello di riferimento per un commercio giusto nel panorama internazionale di mercato. Orbene, allo scopo di inquadrare precisamente il fenomeno e di sviscerarne i contenuti si è ritenuto opportuno suddividere la trattazione del tema in quattro macro-blocchi inerenti rispettivamente: la descrizione socio-economica del Cees, i progetti di normazione presenti in materia a livello sovranazionale-nazionale e regionale, le altre esperienze parallelamente sviluppate in altri paesi europei, nonché l'analisi degli strumenti contrattuali in uso nel settore con particolare riguardo ai contratti di Ctm. Il punto di partenza è rappresentato da una serie di considerazioni di ordine introduttivo, con particolare riguardo alla dimensione socio-economica del fenomeno, alla luce della sua crescente evoluzione e del suo attuale valore in termini di incidenza all'interno del nuovo ordine globale delle relazioni economiche. A seguire, dato il taglio essenzialmente giuridico della ricerca, si è ritenuto opportuno penetrare immediatamente la realtà del commercio equo con specifico riferimento alle problematiche ed alle prospettive connesse all'opportunità di una regolamentazione giuridica del fenomeno stesso, le quali costituiscono, precisamente, l'oggetto centrale del presente studio. In particolare si è scelto di elaborare una serie di riflessioni introduttive a proposito dei differenti approcci posti in essere in materia, considerando la complessità del quadro di riferimento nonché la varietà degli intenti. Orbene, nel tentativo di ricostruire le ragioni che hanno determinato l'esigenza di regolamentare la materia, si è pensato in primo luogo di esaminare i numerosi tentativi di autoregolamentazione attuati in tal senso, con riferimento da un lato alle cc. dd. Carte dei Criteri ed in particolare alla Carta Italiana, elaborate allo scopo di identificare i requisiti ed i soggetti destinati ad operare in tale contesto, e dall'altro lato ai sistemi di certificazione privati e specializzati posti in essere allo scopo di etichettare i prodotti del Cees e garantire così la conformità a determinati standard, nonché il rispetto dei principi propri del settore in esame. Una volta esaminati i percorsi inerenti la via dell'autoregolamentazione e le peculiarità connesse agli stessi si è ritenuto interessante procedere nell'analisi dei percorsi di eteroregolamentazione posti in essere in materia, e ciò in particolare sulla scorta dei limiti e delle incongruenze intrinsecamente legate alla strada dell'autodisciplina. La creazione di un preciso schema legislativo in materia, corrispondente ad una vera e propria legge, consentirebbe, infatti - ed è precisamente ciò che la ricerca è tesa a dimostrare - di realizzare, al di là del riconoscimento ufficiale del fenomeno, anche una specifica individuazione dei prodotti del Cees e dei soggetti coinvolti, ciò che determinerebbe, attraverso l'istituzione di un rigoroso sistema sanzionatorio, la conseguente eliminazione del rischio che gli stessi si trovino in un certo senso a miscelarsi inconsapevolmente con soggetti estranei ai principi del movimento, traducendosi implicitamente in una enorme garanzia per il consumatore. Una volta accertata la necessità di regolamentare la materia e una volta enucleate le motivazioni attraverso le quali si è giunti ad affermare la preferenza di soluzioni di tipo eteroregolamentative, si è scelto di proseguire nell'analisi dettagliata dei percorsi e degli interventi legislativi elaborati su scala sovranazionale, nazionale e regionale; ciò al fine di riflettere più compiutamente sul taglio che un intervento regolativo in materia dovrebbe avere. I paragrafi elaborati nell'ambito della Parte II e precisamente inerenti una ricognizione e valutazione critica dei progetti di normazione presenti in materia, si muovono in effetti proprio in tale ottica, nel tentativo di chiarire se, posta la complessità degli interventi legislativi predisposti a vari livelli, sia ravvisabile all'interno di uno di questi un possibile modello da seguire. Sempre allo scopo di riflettere sui profili regolamentativi del fenomeno del Cees e posta la necessità di rintracciare un modello indicativo sulla base del quale pervenire all'elaborazione di un preciso schema di inquadramento legislativo, si è scelto di dedicare le successive fasi della ricerca all'esame delle esperienze maggiormente rilevanti nel settore condotte all'interno di altri paesi. La terza parte-sezione del lavoro di ricerca si incentra, infatti, sull'analisi degli schemi e delle soluzioni legislative elaborate a livello europeo (e non solo) in tale ambito, ciò allo scopo di valutare le affinità e le compatibilità, ma anche eventualmente le divergenze esistenti rispetto al nostro sistema. Ebbene, a parte lo studio delle strategie tracciate all'interno del contesto europeo, ed in modo particolare in paesi come la Spagna e la Francia - attraverso l'analisi delle varie proposte e normative concretamente poste in essere - si è ritenuto interessante proporre anche l'esame di una realtà profondamente differente, sia per struttura che per impostazione, quale, appunto, quella canadese, e ciò considerato in particolare anche il carattere innovativo di una indagine comparata tra le due dimensioni (quella italiana e quella, appunto, canadese). Alla luce di tali considerazioni, nonché allo scopo di rendere effettivamente concreti i profili teorici anzi sviluppati, si è scelto di completare la ricerca mediante l'analisi di alcuni contratti commerciali, utilizzati nella pratica degli affari e recanti appunto norme rispettose dei principi del Cees. In particolare, l'ultima sezione del lavoro, inerente temi di giustizia sociale e diritto dei contratti - con specifico riferimento alla disciplina giuridica del contratto inteso appunto quale mezzo attraverso cui orientare il corretto funzionamento del mercato concorrenziale e fornire adeguate tutele ai consumatori - si sofferma sull'analisi della modulistica contrattuale (Il "Fair Trade Partnership Agreement"; l'"Annual Plan"; il "Fair Trade Purchasing Contract"; il "Delivery Order") utilizzata da Ctm Altromercato nelle operazioni di acquisto, nonché di trasporto e vendita dei prodotti equo-solidali. Tale modulistica, reperita grazie ad una profonda collaborazione con la sede legale del Consorzio, è stata ritenuta particolarmente interessante sotto un duplice profilo: da una parte, infatti, tali strumenti contrattuali potrebbero rappresentare una effettiva garanzia per quel consumatore socialmente responsabile che voglia visionarli al fine di constatare direttamente il rispetto di determinati standard e principi e che voglia, cioè, accertare che i prodotti che acquista siano effettivamente rispettosi di quegli standard; dall'altra parte, tali contratti rappresenterebbero una sorta di garanzia sociale, vale a dire un mezzo attraverso il quale far rispettare i suddetti valori e recuperare, in una prospettiva più ampia, anche determinati diritti. ; The fair trade phenomenon expanded in the western world during the last forty years because the benefits of trade and the expansion of international trade are not equitably distributed among all countries and between different levels of population. The gradual extension of phenomenon, the expansion of the geographic areas covered, the increase of quantity and types of traded goods and the proliferation of actors, gradually showed the strength related to this reality, which has become, in a few years, a true reference model for a fair trade on the international market. However, in order to classify precisely the phenomenon and to reveal its contents, it was considered appropriate to divide the discussion of the topic into four macro-blocks, respectively associated to: -the socio-economic description of the fair trade; -the different standardization projects elaborated in this field at the supranational, national and regional levels; -the other experiences developed in a comparative perspective with other European countries (and not only); -the analysis of contractual instruments used in the sector with particular regard to the contracts used by CTM Altromercato. The starting point is represented by some different preliminary considerations, with special emphasis on socio-economic phenomenon, considering its increasing trend and its current value in terms of incidence on the new global order of economic relations. Secondly, as legal research, it was considered appropriate to immediately penetrate the reality of fair trade, with specific reference to the problems and prospects related to the best legal regulation of this phenomenon, which represents the central object of this study. In particular, we chose to develop some general discussion about the different approaches elaborated in this area, considering the complexity of the framework and the variety of proposals. However, reconstructing the underlying reasons for a legal adjustment of this phenomenon, it was thought primarily to examine the many attempts to self-regulation, referring firstly to the "Carte dei Criteri" and especially the "Carta Italiana", drawn up to identify the requirements and the people suitable to operate in that context, and secondly concerning the private certification schemes, specialized in this field, and created to label the products of fair trade and thus to ensure compliance with standards and respect for the principles of the sector. After examining the pathways of self-regulation and the peculiarities connected to the same, it was considered interesting to carry out the analysis of a different form of regulation, called "heteroregulation", considering, in particular, the limitations and inconsistencies intrinsically linked to the self-discipline. In fact, the creation of a clear legislative framework, corresponding to a real law, would- and this is precisely what the research is oriented to prove - to establish, in addition to official recognition of the phenomenon, the specific identification of the fair trade products and of the parties involved and moreover, establishing a strict system of sanctions, to realize the subsequent elimination of the risk that they are, unconsciously, mixed with persons outside the principles of the movement, meaning a huge guarantee for the consumers. Once we have established the need to regulate this field and once outlined the reasons for a preference of heteroregolamentative type solutions, it was interesting to analyze the detailed paths and the legislative actions drawn up at the supranational , national and regional level, to reflect more broadly on the style that a regulatory intervention in this area would have. The paragraphs elaborated in the II part, concerning a critical evaluation of the projects of regulation existing in this context, want to clarify if, considering the complexity of the sector, a potential model to follow exists. Thirdly, in order to reflect on the regulation profiles of fair trade phenomenon and considering the need to find a legislative framework, it was chosen to dedicate the next stages of research to examine of the most important experiences carried on in this field from other countries. The third part-section of the research is focused on the analysis of legislative solutions developed at European level (and not only) in this context; the aim is to value the similarities and the compatibility, but also the differences, compared to our system. In addiction to the study of strategies, outlined in the European context, and particularly in the countries like Spain and France - through the analysis of various proposals and regulations put in practice - it was considered interesting to propose also the examination of Canadian perspective, considering in particular the innovative nature of a comparative study between these two dimensions (Italian and Canadian). For these considerations and to realize the theoretical profile, it was decided to complete the research with the analysis of some commercial contracts, which are used in the practice of business and containing the fair trade rules and the principles. In particular, the last section of work, concerning the social justice issues and the law of contracts - with particular reference to the legal framework of the contract conceived like an instrument to ensuring the proper functioning of the competitive market and protect consumers - is focused on the analysis of contractual forms ( "Fair Trade Partnership Agreement", "Annual Plan, "Fair Trade Purchasing Contract" and "Delivery Order") used by CTM Altromercato in transactions of purchase, transportation and sale of fair trade products. These contracts, obtained thanks to a strong collaboration with the legal office of the Consortium CTM Altromercato, were considered particularly interesting: first of all, these instruments could be a contractual guarantee for a consumer socially responsible, who wants to view them and to observe directly the relevance of these standards and principles, and to ensure that the products meet those standards; on the other hand, these contracts represent a kind of social security, namely an instrument to enforce these values and also to recover, in a broader perspective, specific rights.
Negli ultimi anni - anche a seguito di gravi episodi di cronaca (dalla BSE, all'influenza aviaria, fino alla cosiddetta "terra dei fuochi") ed in generale dell'interesse dei media per la tematica dell'alimentazione - l'attenzione dell'opinione pubblica sul sistema di controllo degli alimenti si è notevolmente accresciuta. Non sempre però la suddetta opinione pubblica percepisce correttamente la complessità del sistema in questione, complessità che in gran parte deriva proprio dalla multiforme articolazione dell'apparato produttivo che, nella fase attuale, realizza la produzione e la distribuzione degli alimenti, nonché dalla pluralità di modelli organizzativi costruiti dal mercato o definiti in sede istituzionale (basti pensare ad esempio al biologico). Rispetto al sistema dei controlli le opinioni correnti sono abbastanza contraddittorie oscillando, a seconda della situazione, tra l'accusa di "opprimere" gli operatori economici e la difesa incondizionata di essi in quanto baluardo dei consumatori. Il primo obiettivo della ricerca realizzata nell'ambito del dottorato è stato pertanto quello di analizzare lo scenario normativo – relativo alla sicurezza, alla qualità, etc. - dal quale promanano le diverse esigenze di controllo e di vigilanza. Connesso a questo scenario vi è il processo normativo avviato, sempre a livello europeo, negli ultimi decenni, che ha teso a uniformare proprio il sistema dei controlli in ambito agroalimentare, sistema del quale si è proceduto a ricostruire il quadro normativo vigente così come definito in ambito europeo e nazionale. Sulla base di tale ricostruzione sono stati analizzati in dettaglio tutti i soggetti (pubblici e privati) che, nel caso italiano, rappresentano gli attori del sistema dei controlli e le funzioni loro attribuite. Il modello organizzativo risultante – costituito da più di trenta soggetti (amministrazioni statali, regionali, locali, e privati che esercitano funzioni pubbliche), di cui ben ventitré coinvolti nell'attività ispettiva – appare molto articolato e lascia di per sé ipotizzare l'esistenza di sovrapposizioni e duplicazioni nei controlli. Tali fenomeni sono stati analizzati in dettaglio, considerando le diverse aree del controllo (igienico-sanitario, merceologico e fiscale), attraverso delle matrici di interazione che hanno evidenziato la sussistenza di livelli elevati di interazione non solo all'interno della stessa area, ma anche tra le diverse aree. Il sistema dei controlli nel suo insieme (comprensivo delle diverse aree sopra indicate) realizza una mole di attività davvero consistente: basti pensare che, facendo riferimento alle sole visite ispettive, nel 2011 sono stati effettuati oltre un milione di sopralluoghi e nell'anno successivo più di ottocentomila. Nel caso delle produzioni a qualità regolamentata ai sensi del Reg. (CE) n. 1151/2012 il sistema dei controlli appare ulteriormente complesso; tali produzioni (DOP e IGP) sono infatti sottoposte ad "doppio meccanismo" di controllo, nel senso che sono soggette ai controlli "ordinari" e a quelli derivanti dalla loro specificità normativa. Per i prodotti in questione il sistema dei controlli è articolato in quattro "canali": quello propriamente ispettivo, quello della certificazione (svolto dagli Enti di Certificazione), quello di vigilanza "al commercio" (svolto dai Consorzi) e quello di vigilanza sugli Enti di Certificazione (svolto dall'ICQRF e/o dalle Regioni). L'intero sistema agisce su uno scenario produttivo estremamente differenziato nel quale coesistono denominazioni caratterizzate da produzioni su larga scala, denominazioni "di nicchia" e denominazioni in fase di avvio. Sulla base di tale schema interpretativo l'ultimo obiettivo perseguito attraverso la ricerca è stato quello di realizzare una indagine empirica finalizzata a quantificare il "peso" del sistema dei controlli nel caso delle produzioni in parola. L'indagine è stata realizzata integrando dati di fonte amministrativa con informazioni reperite attraverso una indagine diretta. Le elaborazioni effettuate considerano progressivamente le diverse tipologie di controllo fino ad integrare le informazioni disponibili in un modello di regressione, finalizzato a spiegare la numerosità dei controlli stessi in funzione delle altre variabili disponibili. Il quadro risultante evidenzia, per un numero consistente di denominazioni, che il sistema di controllo appare coerente con il quadro normativo e per certi versi - specie per alcune classi di prodotto - abbastanza efficiente. Per altre denominazioni, tuttavia, il quadro che emerge dalle elaborazioni evidenzia alcune criticità. Infine le stime della regressione evidenziano che le variabili che influenzano in maniera significativa il numero dei controlli sono rappresentate dal numero degli operatori assoggettati e dal numero di campioni prelevati. ; In recent years - partly as a result of severe chronicle episodes (from BSE, to Avian Influenza, to the so-called "Terra dei Fuochi") and in general of the interest of the media in the issue of alimentation - the attention of the public opinion on the food control system has increased greatly. Not always, however, the above mentioned public opinion correctly perceives the complexity of the system in question, a complexity that largely derives from the manifold articulation of the productive system that, at this stage, fulfils the manufacturing and distribution of food, as well as the plurality of organizational models, created by the market or institutionally defined (for example, organic food). Regarding the control system, the current opinions are quite contradictory, oscillating, depending on the situation, from the accusation of "oppressing" the economic operators (traders) and their unconditional defense as a "bulwark" of the consumers. The first aim of the research carried out as part of the PhD was therefore to analyze the regulatory set – about safety, quality, etc. from which the different needs of control and supervision emanate. Connected to this scenario, there is a regulatory process started, always at an European level, in the last decades, which has tended to standardize just the system of controls in the agricultural and food sector, the system of which we proceeded to rebuild the existing regulatory framework as defined at European and national levels . On the basis of this reconstruction all the subjects (public and private) were analyzed in detail and, in the Italian case, they are the actors of the control system and the functions assigned to them. The resulting organizational model - consisting of more than thirty subjects (central, regional, local governments and private individuals wielding public functions), of which twenty-three are directly involved in the inspection - looks very articulate and lets assume the existence of overlaps and duplications in the controls. These phenomena have been analyzed in detail, considering the different areas of control (sanitary and commodity-related and fiscal) through some interaction matrices that have shown the existence of high levels of interaction not only within the same area, but also between different areas. The control system as a whole (including the various areas mentioned above) makes a really significant amount of activities: in fact, referring only to the inspections in 2011 there were over a million of visits and in the following year more than eight hundred thousand. In the case of the quality productions regulated by the Regulation (EC) No . 1151/2012, the control system is further complicated; such productions (PDO and PGI) are in fact subject to a "dual control mechanism", meaning that they are subject to "ordinary" inspection and to those resulting from their specific regulations . For the products in question, the control system is divided into four "channels": the one of proper inspection, the one of certification (played by Certificate Authorities), the one of trade supervision (played by Consortiums) and that of supervision of Certificate Authorities (played by 'ICQRF and / or by Regions) . The entire system operates at a highly differentiated production scenario in which names characterized by large-scale productions, "niche" names and names at start-up point coexist. On the basis of this interpretative scheme the ultimate goal pursued by the research was to provide an empirical study aimed at quantifying the "weight" of the control system in the case of the productions in question. The survey was undertaken by integrating administrative data with information obtained through a direct survey . The performed calculations progressively consider the different types of control up to supplement the available information in a regression model, which aims at explaining the plurality of checks themselves in relation to other available variables. The resulting picture shows, for a large number of names, that the control system appears to be coherent with the regulatory framework and in some ways - especially for some classes of product - very efficient. For other denominations, however, the picture that emerges from the elaborations underlines some critical issues. Finally, the estimates of the regression show that the variables that significantly influence the number of controls are represented by the number of operators subjected and by the number of samples taken. ; Dottorato di ricerca in Biotecnologia degli alimenti (XXVI ciclo)
The European scenario has been characterized lately by a systematical harmonization of contract law. The EU Institutions consider the development of a common European contract law as a strategic priority; it could enhance the viability of the EU internal market by facilitating cross-border trade. The thesis analyses the development of the projects that aim at a uniform European contract law, from the specific perspective of liability for breaking off negotiations. After a comparative analysis of the liability for breaking off negotiations in the main European legal systems and in European case law and legislation, the thesis takes into consideration the solution proposed by the instruments for uniform European contract law: the proposal for a Regulation establishing the "Common European Sales Law" (CESL), the Draft Common Frame of Reference (DCFR), the Principles of European Contract Law (PECL) and the Acquis Principles (ACQP). Attention is paid also to the parallel experience of the international instruments of uniform contract law: the Vienna Convention for international sales law and the Unidroit Principles.
In contrasto con l'opinione prevalente nelle istituzioni di regolazione macroeconomica dell'Eurozona, che attribuiscono la recente esplosione del rapporto debito pubblico/Pil avvenuta in alcuni Stati membri al fatto di aver vissuto " al di sopra delle proprie possibilità" , nel presente contributo suggeriamo un'interpretazione alternativa del fenomeno. Facendo affidamento su alcune evidenze empiriche, sosteniamo invece che il crescente indebitamento di alcuni Stati membri sarebbe l'effetto congiunto di tre diversi fenomeni: (a) la propensione del settore finanziario all'assunzione di elevati rischi (una caratteristica peculiare del modello neoliberista di regolazione macroeconomica), tendenza che mette periodicamente il settore pubblico di fronte alla necessità di intervenire per salvare dalla bancarotta banche e altre istituzioni finanziarie; (b) la peculiarità del modello di regolazione macroeconomica adottato dall'Eurozona, che non prevede alcun meccanismo automatico di aggiustamento degli squilibri commerciali e in cui, quindi, i flussi di capitali compensativi tendono ad innescare bolle speculative nei paesi in deficit; (c) la strategia di contrasto alla crisi scelta dall'UE, caratterizzata dall'inasprimento della già rigida disciplina fiscale prevista dal Trattato istitutivo per effetto dell'entrata in vigore del Fiscal Compact e dei cosiddetti Two Pack e Six Pack. In sintesi, l'indagine suggerisce che l'esplosione del debito sovrano nell'UE sia una spia della crisi della filosofia neo-liberista di regolazione macroeconomica incarnata dal Trattato di Maastricht, basata sul sostanziale esautoramento dei governi dalle funzioni allocative e sul loro trasferimento alle spontanee forze di mercato. I venti anni di vita dell'Eurozona sembrano infatti dimostrare che l'aggiustamento degli squilibri commerciali in un'area a moneta unica sia difficilmente realizzabile attraverso l'operare di mercati deregolamentati senza il supporto di politiche fiscali anticicliche. ; In contrast to the opinion prevailing in Eurozone leading institutions, attributing the recent sovereign debt crisis in some member countries to the fact of ""having lived above their means" , in this contribution we suggest an alternative interpretation of public debt dynamics occurred in the last decade. Relying on some empirical evidence, we argue that the rising debt/GDP ratio in EU member States is instead the joint effect of three different phenomena: (a) the propensity of banks and financial institutions to assume excessively risky portfolio structures (a characteristic feature of the neoliberal model of macroeconomic regulation), which obliged the public sector to periodically bail-out banks and other financial institutions from bankrupt; (b) the peculiarity of the Eurozone's model of macroeconomic regulation, where there is no automatic mechanism for adjusting trade imbalances, and where compensative capital flows are likely to feed speculative bubbles in deficit countries;(c) the EU strategy to tackle the crisis, characterized by a further strengthening of the already tight fiscal discipline envisaged by the Maastricht Treaty. In summary, our investigation suggests that the explosion of sovereign debt in the EU reveals the crisis of the neo-liberal philosophy of macroeconomic regulation embodied in the Maastricht Treaty, based on a massive transfer of allocative functions from governments to market forces. However, these twenty years of Eurozone's life seem to testify that the adjustment of trade imbalances in a single currency area is difficult to achieve by simply relying on the working of deregulated markets, without the support of countercyclical fiscal policies.
