Labour relations as well as labour law are constantly changing, and the political system, economic and social situation in the country as well as the relationship between employees, which are usually represented by trade unions, employers and their organizations and the state, have a decisive influence on their evolution. In this respect, the situation in the Międzymorze (Intermarium) countries is diverse, and therefore they belong to various European social models. In the current period, after the 2008-2009 crisis, it is common for the Międzymorze countries to strive to increase the flexibility of labour relations and to limit the influence of the state in providing employment and living standards. The exception, however, is Belarus, in which in 2012-2014 the state's influence on the regulation of labour relations was increased.

The scientific publication is devoted to the principles of legal regulation of customs regimes in Ukraine as an intersectoral institution of customs law. It is noted that the customs regime is a set of interrelated legal norms that, in accordance with the stated purpose of moving goods across the customs border of Ukraine, determine the customs procedure for these goods, their legal status, tax conditions and determine their use after customs clearance. The methodology of this scientific publication is based on a complex combination of philosophical (laws of dialectics and metaphysics), general scientific and special legal research methods (methodology of comparative law, method of legal modeling, etc.), principles of objectivity and historicism. It is concluded that the role of the principles of law in the regulation of customs regimes is crucial, given the European integration aspirations of Ukraine and the need to comply with the principles of the rule of law, legal certainty and good governance of public administration. The principles of legal regulation of customs regimes include common principles (rule of law, legality, legal certainty, equality before the law, publicity, etc.), as well as special principles, including: the principle of promoting international trade; the principle of protection of national interests and security in the field of foreign economic activity; the principle of dispositive choice of the customs regime, the principle of availability of administrative services provided by public administration bodies (implementation of the «single window» principle in the work of bodies and officials of the State Customs Service of Ukraine), etc. It is noted that given the goal of the nation state to gain full membership in the European Union, the approximation of national customs rules and procedures to EU standards and principles is a key task of public administration in Ukraine. It is concluded that the study of the principles of legal regulation of customs regimes in Ukraine is the basis for further improvement of existing national legislation and legal practice, the development of promising legislation in the field of legal regulation of customs regimes. ; У науковій публікації досліджуються принципи правового регулювання митних режимів в Україні як міжгалузевого інституту митного права. Зазначається, що митний режим є комплексом взаємопов'язаних правових норм, що відповідно до заявленої мети переміщення товарів через митний кордон України визначають митну процедуру щодо цих товарів, їхній правовий статус, умови оподаткування і зумовлюють їх використання після митного оформлення. Формулюється висновок про те, що роль принципів права в регулюванні митних режимів є визначальною, враховуючи євроінтеграційні прагнення України та зумовлену ними необхідність дотримання принципів верховенства права, правової визначеності та належного урядування органами публічної адміністрації. До принципів правового регулювання митних режимів слід віднести загально-правові (верховенства права, законності, правової визначеності, рівності всіх перед законом, гласності тощо), а також спеціальні принципи, серед яких: принцип сприяння розвитку міжнародної торгівлі; принцип захисту національних інтересів та безпеки у сфері зовнішньоекономічної діяльності; принцип диспозитивності вибору митного режиму суб'єктом зовнішньоекономічної діяльності, принцип доступності адміністративних послуг, які надаються органами публічної адміністрації (реалізація принципу «єдиного вікна» в роботі органів та посадових осіб Державної митної служби України) тощо. Зазначається, що зважаючи на мету національної держави набути повноправного членства в Європейському Союзі, наближення національних митних правил та процедур до стандартів та принципів ЄС є ключовим завданням публічної адміністрації в Україні. Формулюється висновок про те, що дослідження принципів правового регулювання митних режимів в Україні є основою для подальшого вдосконалення чинного національного законодавства та юридичноїпрактики, розроблення перспективного законодавства у сфері правового регулювання митних режимів.
Introduction. At present, Ukraine has intensified its efforts to bring the technical regulation system closer to the requirements of the EU. But these efforts mainly concern the formation of a system of technical regulation in general, regardless of the livestock sector. The problem of the livestock products safety remains extremely acute for Ukraine. Its scale in the context of the formation of a free trade zone with the EU is only increasing. This requires substantiation of decisions regarding the formation of the newest components of the state regulation and control system in the field of livestock products safety. These components should be adequate to modern European requirements.Purpose. The purpose of the article is to identify the components of the newest state regulation and control system in the field of livestock products safety, as well as substantiation of tools for improving the efficiency of their functioning.Results. The signs of certain archaism of the Ukrainian system of state regulation and control (supervision) in the field of safety are revealed. By 2015, it was oriented towards the principles of command and administrative economy. The newest tendencies and system tools for improving the domestic control system in order to harmonize it with the European one are outlined. These trends contribute to the development of a process or integrated approach to ensuring the safety of livestock products. The newest system of state control contains separate elements that guarantee the clarity and unambiguousness in determining the responsibility of market operators for violating the requirements of safety legislation.Originality. The conceptual bases of risk assessment in the activity of livestock production market operators (risks of processes and capacities) are offered. Such an assessment is the basis for determining the frequency of inspections and contributes to avoiding corruption and excessive pressure from the controlling authorities. In contrast to the ones already developed and used, the provisions of the author's approach provide for the implementation of the principle of effective motivation for the increase of value added. This principle is to generate incentives for priority investment in the production, processing and processing of livestock products. That is, investment in sectors generating a high share of value added and ensuring the sustained food security of the state is encouraged.Conclusion. It is important to ensure the proper implementation of new requirements for the livestock products safety. After all, the very harmonization of legislation is not enough. This primarily concerns professional inspection and laboratory services - an important component of state control (supervision). There is a need to promote technical accreditation and accreditation by foreign accreditation bodies of a number of testing laboratories. Otherwise, it is technically impossible to ensure effective state control of the livestock products safety and quality. It is advisable to introduce effective mechanisms of HACCP audit. It is the basis of the modern system of control in the field of production and circulation of livestock products. The indicated mechanisms should be based on risk assessment in order to avoid the threat of corrupt actions by the controlling bodies and excessive pressure on the livestock producers market.
У статті авторами розглянуті особливості митного регулювання в країнах-членах Європейського Союзу. Країнам ЄС вдалося в своїх межах реалізувати чотири основні «свободи» - вільне переміщення товарів, послуг, капіталу і праці. В свою чергу, висока ступінь гармонізації та уніфікації митних процедур та практики їх використання є однією з ключових умов, що сприяють ефективному включенню держави у світогосподарські зв'язки.Метою статті є аналіз особливостей розвитку митного регулювання у країнах-членах Європейського Союзу з початку інтеграційного процесу у країнах Європи до теперішнього часу.В статті зазначено, що однією з основ створення сучасного Європейського Союзу був Митний союз, який призвів до розвитку митної системи країн Європи. Основи Митного союзу були закладені з моменту створення Європейського об'єднання вугілля та сталі, тобто з 1951 року. Надалі митна система розвивалася паралельно з подальшим поглибленням інтеграційних процесів між європейськими країнами. Формування єдиного європейського митного простору відбувалося поступово. Створюючи Митний союз європейськими країнами був вибраний шлях рівномірного ступінчастого зниження митних тарифів у взаємній торгівлі.У статті проаналізовані основні нормативні документи, які лежать в основі митного регулювання в рамках Європейського Союзу. Основним юридичним документом ЄС, у відповідності до якого здійснюється торгівля з третіми країнами, є Митний кодекс Європейського Союзу. Авторами статті розглянута структура кодексу.Зазначено, що джерелами митного права ЄС є акти первинного та вторинного права. Найважливіше місце серед первинних джерел займає Римський договір, який був підписаний у 1957 році та сформував загальні поняття та принципи Митного союзу держав-членів. Серед актів вторинного права можна виділити ряд регламентів та директив, які були прийняті країнами-членами Євросоюзу.Як висновок, зазначено, що основою функціонування Європейського Союзу є Митний союз, який передбачає вільний рух товарів і послуг між державами-членами ЄС. Для досягнення цілей Митного союзу були вжиті певні дії у сфері митного регулювання, які значно прискорили процес започаткування єдиної валютної системи Євросоюзу, що наблизило його до кінцевої мети – повна економічна інтеграція та створення економічного союзу. Митне законодавство дозволяє Європейському Союзу організувати та проводити єдину митну політику, здійснювати митне регулювання за встановленими правилами, стимулювати розвиток внутрішнього ринку, проводити успішну єдину торговельну політику в інтересах країн-членів Євросоюзу. ; The article deals with the features of customs regulation in the member states of the European Union. In turn, a high degree of harmonization and unification of customs procedures and practices is one of the key conditions that facilitate the effective inclusion of the state into world economic relations.The purpose of the article is to analyze the peculiarities of the development of customs regulation in the member states of the European Union since the beginning of the integration process in Europe until now.The article states that the main foundation of the modern European Union was the Customs Union, which led to the development of the customs system of European countries. The foundations of the Customs Union have been laid since the creation of the European coal and steel association, that is, since 1951. In the future, the customs system developed in parallel with the further deepening of integration processes between European countries. The formation of a single European customs space took place gradually. During creating the Customs Union, European countries choose the path of a uniformly gradual reduction of customs tariffs in mutual trade.The article analyzes the main normative documents that underlie customs regulation within the framework of the European Union. The EU legal instrument for trade with third countries is the EU Customs Code. The authors of the article considered the structure of the code.It is noted that EU sources of customs law are acts of primary and secondary law. The most important place among the primary sources is the Treaty of Rome, which was signed in 1957 and formed the general concepts and principles of the Customs Union of the Member States. Among the acts of the secondary law, there are a number of regulations and directives adopted by the member states of the European Union.As a conclusion, it is noted that the basis of the European Union is the Customs Union, which provides free movement of goods and services between EU member states. In order to achieve the goals of the Customs Union, certain actions in the field of customs regulation have been taken, which greatly accelerated the process of launching a single currency system of the European Union, which brought it closer to the ultimate goal of full economic integration and the creation of an economic union. Customs legislation allows the European Union to organize and implement a single customs policy, to carry out customs regulation in accordance with established rules, to stimulate the development of the domestic market, to pursue a successful single trade policy in the interests of the EU member states.
The article describes the modern legislation of legal regulation of trade secrets, in particular the provisions of the Civil Code of Ukraine. It is noted that legal relations in the field of trade secrets are governed by the Criminal and Commercial Codes of Ukraine, the Code of Administrative Offenses, a number of laws, including the Laws of Ukraine: «On Information», «On Protection against Unfair Competition», «On Banks and banking activity», «On advocacy and advocacy activity», «On state secret» and by-laws, the resolution of the Cabinet of Ministers of Ukraine «On the list of information that does not constitute a trade secret».The study found that in Ukraine, as in many other countries, new technologies, intellectual property and other products are created that contain trade secrets that need legal protection. Due to new information achievements, state borders are practically transparent for the circulation of information. In this case, the more this industry is involved in commercial turnover, the greater the need to protect the interests of the owners of trade secrets.Keywords: legal regulation, information, trade secret, legal responsibility, owner of trade secret, intellectual property, economic activity ; У статті проведено характеристику сучасного законодавства правового регулювання комерційної таємниці, зокрема положень Цивільного кодексу України. Звертається увага, що правовідносини у сфері комерційної таємниці регулюються нормами Кримінального та Господарського кодексів України, Кодексу України про адміністративні правопорушення, низкою законів, серед яких слід відзначити Закони України: «Про інформацію», «Про захист від недобросовісної конкуренції», «Про банки і банківську діяльність», «Про адвокатуру та адвокатську діяльність», «Про державну таємницю» та підзаконним нормативно-правовим актом, постановою Кабінету Міністрів України «Про перелік відомостей, що не становлять комерційної таємниці».За результатами дослідження визначено, що в Україні як і в багатьох інших країнах, створюються нові технології, інтелектуальна власність та інші продукти, які містять комерційну таємницю, яка потребує правової охорони. У зв'язку з новими інформаційними досягненнями, державні кордони практично стають прозорими для обігу інформації. In the article international experience and domestic practice of customs-tariff regulation are researched. It is noted that the customs-tariff regulation of foreign economic activity is an economic method of regulation of international trade, which is used in Ukraine with the use of such instruments: customs tariff, classification of goods in accordance with the commodity nomenclature of foreign economic activity, determination of the country of origin of goods, its customs value, as well as application of the system customs privileges and preferences. It is noted that the implementation of tariff and customs regulation is a complex and systematic process involving not only the actors of the functioning of all branches of state power ‒ the legislative, executive and judicial, but also the direct participants of international economic relations ‒ the enterprise. It is stressed that the creation of optimal conditions for competition is possible only in the case of resolving the main contradiction of tariff and tariff regulation: on the one hand, it should contribute to the development of competition, the solution by importing the problem of monopolization of the market by monopoly enterprises, that is, the realization of an offensive function; on the other ‒ to ensure the protection of the national producer from excessive foreign competition, that is, the implementation of a protective function. The authors of the study noted that in practice the tariff method of regulating trade consists in the application of customs duties on goods imported or, at least, when exported from the country. In Ukraine, import and export duties, seasonal and special types of duties are applied. Special duties include special, anti-dumping, countervailing duty and additional import duty. Special types of duties (except for collection) are used according to the results of investigations and are aimed at protecting the national producer. The international practice of customs and tariff regulation is analyzed, namely, the bases of the current US trade policy, which is named «Donald Trump Tariff Policy», are generalized. It is noted that modern approaches to the regulation of trade should be based on compliance with international obligations and predictability of the trade policy of the state as a reliable trading partner. ; В статье исследовано международный опыт и отечественную практику таможенно-тарифного регулирования. Отмечено, что таможенно-тарифное регулирование внешнеэкономической деятельности является экономическим методом регулирования международной торговли, который применяется в Украине с использованием таких инструментов: таможенного тарифа, классификации товаров в соответствии с товарной номенклатурой внешнеэкономической деятельности, определение страны происхождения товара, его таможенной стоимости, а также применение системы таможенных льгот и преференций. Замечено, что осуществление таможенно-тарифного регулирования ‒ это сложный и системный процесс, в котором принимают участие не только субъекты функционирования всех ветвей государственной власти ‒ законодательной, исполнительной и судебной, но и непосредственные участники международных экономических отношений ‒ предприятия. Отмечено, что создание оптимальных условий для конкуренции возможно только в случае решения главной противоречия таможенно-тарифного регулирования: с одной стороны, оно должно способствовать развитию конкуренции, решению благодаря импорту проблемы монополизации рынка предприятиями-монополистами, то есть реализации наступательной функции; с другой ‒ обеспечить защиту национального товаропроизводителя от иностранной конкуренции, то есть выполнение защитной функции. Авторами исследования отмечено, что на практике тарифный метод регулирования торговли заключается в применении пошлины на товары при ввозе или, реже, при вывозе из страны. В Украине применяются ввозные и вывозные пошлины, сезонные и особые виды пошлины. К особым видам пошлины относятся специальная, антидемпинговая, компенсационная пошлины и дополнительный импортный сбор. Особые виды пошлины (кроме сбора) применяются по результатам расследований и направлены на защиту национального производителя. Проанализировано международную практику применения таможенно-тарифного регулирования, а именно, обобщенно основы современной торговой политики США, которая получила название «Тарифная политика Дональда Трампа». Отмечено, что современные подходы к регулированию торговли должны основываться на соблюдении международных обязательств и предсказуемости торговой политики государства как надежного торгового партнера. ; У статті досліджено міжнародний досвід та вітчизняну практику митно-тарифного регулювання. В Україні застосовуються ввізне і вивізне мито, сезонне та особливі види мита. До особливих видів мита відносяться спеціальне, антидемпінгове, компенсаційне мита та додатковий імпортний збір. Проаналізовано міжнародну практику застування митно-тарифного регулювання, а саме, узагальнено основи сучасної торговельної політики США, яка отримала назву «Тарифна політика Дональда Трампа». Зазначено, що сучасні підходи до регулювання торгівлі мають ґрунтуватися на дотриманні міжнароднихзобов'язань і передбачуваності торгової політики держави як надійного торгового партнера.

The article contains the author's concept of the importance of local rulemaking, which is formed on the basis of the analysis of legal acts and the results of scientific research.The article states that only certain aspects of labor relations that reflect their specificity at a particular enterprise are included in the field of local rulemaking (for example, the establishment of internal labor rules, work schedules, etc.). Local legal norms are normative in nature. They represent the command of the authorized body of management, the general decisions of the employer and the trade union committee, the will of the labor collective. These norms, enshrined in the said documents, are the result of the relevant legal specialization, set for the purpose of specifying and detailing, taking into account the peculiarity of specific relations. Particular attention is paid to the legal nature of internal labor rules, technical rules and instructions.The author formulates his vision of the importance of the acts of local rulemaking in the regulation of labor in three main aspects. First, it is a manifestation of the principle of the democracy of labor relations, according to which the needs and interests of the employee directly affect the normative content of labor relations. Secondly, it is a means of nurturing the legal culture of the employee and the employer, as well as their mutual responsibility in labor relations. Third, it is the implementation of the requirement of legal certainty, according to which the subjects of labor relations should be given the possibility of easy access to the legal regulations that determine the requirements for their behavior, as well as the ability to use local legal norms to protect their rights and interests in the case of need. ; Стаття містить аналіз сутності актів локальної нормотворчості та їхнього впливу на правове регулювання праці. Автор розглядає концепції та підходи до локальної нормотворчості в доктрині трудового права. Стаття містить авторську концепцію значення локальної нор-мотворчості, яка сформована на підставі аналізу правових актів і результатів наукових досліджень. У статті зазначено, що до сфери локальної нормотворчості віднесено лише певні сторони трудових відносин, які відображають їхню специфіку на конкретному підприємстві (наприклад, встановлення правил внутрішнього трудового розпорядку, графіка робіт тощо). Локальні правові норми мають нормативний характер. Вони являють собою веління уповноваженого органу управління, спільні рішення роботодавця та профспілкового комітету, волевиявлення трудового колективу. Ці норми, закріплені в зазначених документах, є результатом відповідної правової спеціаліза-ції, встановлюються з метою конкретизації та деталізації, урахування своєрідності конкретних відносин. Особлива увага приділена правовій природі правил внутрішнього трудового розпорядку, технічних правил та інструкцій. Автор формулює своє бачення значення актів ло-кальної нормотворчості в регулюванні праці у трьох основних аспектах. По-перше, це прояв принципу демократичності трудових відносин, відповідно до якого потреби й інтереси працівника безпосередньо вплива-ють на нормативний зміст трудових відносин. По-друге, це засіб виховання правової культури працівника і роботодавця, а також їхньої взаємної відповідальності у трудоправових відносинах. По-третє, це реалізація вимоги правової визначеності, відповідно до якої суб'єктам трудових відносин має бути надана можливість легкого доступу до правових приписів, що визначають вимоги до їхньої поведінки, а також можливість використати локально-правові норми для захисту своїх прав та інтересів за необхідності.
The author of the dissertation "Peculiarities of Legal Regulation of Customs Duties in International Trade between the European Union and the People's Republic of China, the Russian Federation and the Republic of India" investigates the legal regulation of customs duties (tariffs) as the main instrument of regulating the international trade in the EU and the peculiarities of its application towards the third countries of the BRICS region, as the leading international trade partners of the EU. In this context, the author uses thematic analysis method and investigates the emerging practice of the international dispute settlement bodies (WTO), the Court of Justice of the EU and national courts (Supreme Administrative Court of Lithuania) in the legal disputes concerning the application of customs duties towards the investigated countries. Based on this analysis, the author identifies the problems of legal regulation of customs duties and other related import taxes arising both at the international/multilateral level, the supranational level as well as at the national level and suggests their solutions, relevant to the EU and its Member States (the Republic of Lithuania). By formulating these proposals, the author takes into account the necessity (which was evidenced by the study data), to eliminate the identified gaps and uncertainties of EU customs law, as well as to ensure the compliance of national practices and legal regulations with the provisions of the EU customs policy.

The article is devoted to the research about essence and principles of customs and tariff regulation in Ukraine. The current customs system, its functions, tasks and normative base are analyzed. Based on the analysis, a number of problems have to be solved in the near future, namely, the improvement of the regulatory and legislative framework for the taxation of export-import operations. The article focuses on the principles of the legislation formation in the international economics activity field, determined to approach the EU. The article proposes certain measures to ensure the effectiveness of customs regulation in Ukraine. There is a need for the implementation of international rules and regulations that will allow the transition to the application of common standards in the field of customs and solve issues related to the accession of Ukraine to the European Union. There is a need for implementation of such procedures as joining international conventions on harmonization and simplification of customs formalities, amendments to national legislation and the use of only those instruments of customs and tariff regulation which not only do not contradict the principles of the WTO and the European Union but are also able to protect national interests Of Ukraine. ; Статья посвящена исследованию сути и принципов таможенно-тарифного регулирования в Украине.
