2001 Ekonomik Krizi Sonrasında Türk Dış Ticaretinin İncelenmesi Gökhan KURT 16 yy'dan itibaren başlayan iktisat bilimi sonraki yüzyıllarda birçok alt bölüme bölünmüştür. 18 yy'dan itibaren ise ülkeler arası entegrasyonlar ve ilişkiler artmaya başlayınca dış ticaretle ilgili teoriler ortaya çıkmıştır. Smith ve Ricardo ile başlayan Uluslararası ticaret teorileri, Mill, Stolper-Samuelson, Heckscher-Ohlin, Leontief gibi iktisadi düşünürler tarafından geliştirilerek 1965 yılına kadar klasik dış ticaret teorileri varlığını devam ettirmiştir. 1965 yılından itibaren Yeni Dış Ticaret Teorilerine ihtiyaç duyulmuş ve günümüze kadar, ne kadar Uluslararası ticaretin temellerini oluşturan klasik dış ticaret teorileri varlığını sürdürmekte ise de, Yeni Dış Ticaret Teorilerinin uygulama sahası daha da genişlemiştir. Dış Ticarette kurallar koyan ve dış ticaretin sınırlarını artırmaya çalışan Uluslararası ve ulusal kurumlar bulunmaktadır. Uluslararası kurumlar olarak GATT ve DTÖ gibi kurumlar sınırlamalar ve kotalar, tarifeler gibi konularda Uluslararası kurallar koymaktadır. Ulusal kurumlarımız ise Dışişleri Bakanlığımız, Dış Ticaret Müsteşarlığı, İGEME vb. kurumlarımız ve özel sektör kuruluşlarımızdan oluşmaktadır. Türk dış ticareti 1980'lı yılların ikinci yarısında başlayan bir atılım sürecine girmiş ve 2000 yılı kasım ayı Likidite krizi ve 2001 Şubat krizinden sonra büyük bir atılım gerçekleştirmiştir. 2001 yılına kadar Türk dış ticaretini dış dinamiklerden daha çok iç dinamikler etkilemiştir. Siyasi istikrarsızlık, politik krizler ve tabi ki tabiat olayları (deprem vb.) gibi olaylar daha çok etkilemekte ve dış ticaretimizde uzun vadeli politikalar ve atılımlar gerçekleşmesine engel olmakta idi. 2001 yılından sonra daha geniş bir atılım sürecine girilmiş ve 2009 yılına kadar bu ivme yukarı doğru devam etmiştir. 2008 küresel mali krizin etkisiyle 2009 yılı dış ticareti, tüm dünyada olduğu gibi daralmıştır. 2010 yılının ilk çeyreğinden itibaren bu daralma atlatılarak tekrardan toparlanma sürecine girilmiş olup uzun vadeli dış ticaret politikalarını gerçekleştirmek için gerekli adımlar atılmaya başlanmıştır. ; After The 2001 Turkish Foreign Trade Investigation Of Economic Crisis Gökhan KURT The science of economics which began in the 16th century divided into a lot of sub-divisions in the following centuries. As of 18th century with the start of increase in relations and integrations between countries theories related to foreign trade emerged. International foreign trade theories, starting with Smith and Ricardo, improved by economics thinkers such as Mill, Stolper-Samuelson, Heckscher-Ohlin, Leontief , continued to exist as classical foreign trade theories until 1965. After 1965, New Foreign Trade Theories were needed and even though classical foreign trade theories which formed the foundations of international trade have existed until today, New Foreign Trade Theories have expanded in field of application. There are international and national institutions which make rules and try to increase the limits of foreign trade in Foreign Trade. GATT and UFT as international institutions make rules in limitations, quotas and tariffs. National institutions consist of institutions such as Ministry of Foreign Affairs, Undersecretariat of Foreign Trade, IGEME etc. and private sector institutions. Turkish foreign trade entered a phase of great progress in the second of 1980s and after 2000 November liquidity crisis and 2001 February crisis made a great leap of progress. Until 2001, foreign dynamics affected Turkish foreign trade more than the internal dynamics. Events such as political instability, political crisis and of course natural disasters (earthquakes etc.) affected more and prevented long-term policies and progress to be achieved in our foreign trade. After 2001 a wider phase of progress was entered and this leap forward continued upwards until 2009. by the effect of 2008 global economic crisis, the foreign trade of 2009 declined as in the whole world. After the first quarter of 2010 this decline has been overcome and a phase of recovery entered, in order to realize long-term foreign trade policies essential steps have been started to be taken.

Yüksek Lisans Tezi ; Türkiye' de 1980 sonrası süreçte ekonomi alanında büyük bir değişim yaşanmış ve ekonominin liberalleşmesi yönünde çok önemli adımlar atılmıştır. Ülkenin dışa açık bir ekonomik yapıya kavuşturulması için bu yönde politikalar benimsenmiş ve dış ticaret mevzuatı ile ilgili köklü düzenlemeler gerçekleştirilmiştir. Ancak ekonomik ve siyasi istikrarsızlıkların yanında politika yapıcı ve uygulayıcılar arasındaki yetki çatışması, bu alandaki uyuşmazlıkları kaçınılmaz hale getirmiştir. Söz konusu uyuşmazlıklara ilişkin değerlendirmelerin yapıldığı bu çalışmada, öncelikle ekonomi politikası, teori ve kavramların açıklanması biçiminde analiz edilmiştir. Sonrasında kapsam olarak son derece geniş ve karmaşık bir içeriğe sahip olan dış ticaret mevzuatı, basitleştirici ve bütünleştirici bir yol izlenerek hukuki çerçevede ele alınmıştır. Dış ticaret konusunda mevzuat kaynaklı sorunlara değinilmiş ve çözüm önerilerine yer verilmiştir. Son olarak ise, Türkiye' de ekonomi politikası uygulamalarının dış ticaret mevzuatı ile etkileşimi incelenmiştir. ; The time period after 1980, a major change in economic area was experienced and significant steps were taken towards having a liberal economy in Turkey. In order to obtain an open economic structure, some kinds of policies were adopted and radical arrangements about foreign trade rules and regulations were implemented. However, not only economical and political instabilities but also conflicts of authority between policy makers and policy implementers have made these conflicts in this field inevitable. Primarily in this study, which has evaluation of the conflicts in question, economic policy, theory and concept were defined and analyzed. Subsequently, foreign trade rules and regulations that have wide scope and complicated content were explained in a regulatory framework by following a simplifying and integrating way. Rules and regulations problems about foreign trade were mentioned and the solution proposals were discussed. In the last section, the interaction between applications of economic policies in turkey and rules and regulations about foreign trade was analyzed.

Genel bir tanımlama ile serbest bölgeler, ülke sınırları dahilinde olmakla beraber, dış ticaret, vergi ve gümrük mevzuatının uygulanması bakımından ülkenin gümrük hattı dışında sayılan bölgelerdir. Bu bölgelerde ilgili ülkeye ait yasal düzenlemeler uygulanmamakta, bunun yanında yapılan faaliyetler için çeşitli teşvikler sağlanmaktadır. Serbest bölgelerin kurulmasındaki amaçlar; ihracatın arttırılması, dış ticaret ve yatırımlar ile ilgili bürokrasinin azaltılması, ithalatın daha kolay ve daha az maliyetli gerçekleştirilebilmesi ve üretim ve istihdamın arttırılmasıdır. Bugün ülkemizde faaliyet gösteren serbest bölgelerin sayısı yirmi bire ulaşmıştır. 1985 yılında 3218 sayılı Kanun'la kurulmaya başlanan serbest bölgeler kuruldukları günden bu yana ekonomiye belirgin katkılar sağlamışlardır. Ağırlıklı olarak sanayi faaliyetlerinin yürütüldüğü serbest bölgelerimizdeki faaliyetlerden elde edilen her çeşit kazanç vergi dışı bırakılmaktadır. Avrupa Birliği'nde serbest bölge uygulamaları incelendiğinde ise, bölgelerde ağırlıklı olarak ticaret faaliyetlerinin yürütüldüğü, dış ticaret, gümrük ve vergi uygulamaları açısından da formalitelerin kısmen daha az olmakla birlikte, ülkemizdeki kadar muafiyet tanınmadığı görülmektedir. Türkiye'deki serbest bölgelerin AB'ye uyum sürecinde tartışma konusu olacağı ve Birlik yasal mevzuatına uyum sağlaması gerektiği açıktır. ; In general, free zones can be described as the zones which are within the borders of country, but are out of customs line of the country in terms of foreign trade, tax and administration of customs legislation. Legal regulations of the country are not carried out in these zones; however, various supports are available for the actions performed. The aims of establishing free zones are to increase export, to decrease the bureaucracy related to foreign trade and investments, to perform easier and cheaper import and to raise production and employment. Today, in our country, the number of free zones has reached twenty one. In 1985, the free zones that started to be established through Law number 3218 have had remarkable contributions to economy since then. Every sort of earning gained from our free zones, at which mostly industrial actions are carried out, is tax-exempted. When free zone administrations are examined in EU, it can be seen that in these zones usually trade actions are carried out and although the formalities are partially fewer in terms of foreign trade, customs and taxation, exemption is not as much as in our country. It is very clear that the free zones in our country will possibly be a debatable subject during EU adaptation process and will have to adapt to Union legal legislation.

Bu bağlamda, ülkemizin Avrupa Birliği mevzuatına uyum çalışmalarına bağlı olarak CE işareti ile ilgili çalışmalar devam etmektedir. CE İşareti bir ürünün sağlıklı ve güvenli olduğunu gösteren bir Avrupa Birliği işaretidir. 2002 yılında yürürlüğe giren Kanun ile birlikte CE İşareti Türkiye'de zorunlu bir teknik işaret kapsamına alınmıştır. Ancak CE İşaretinin uygulanabilmesi için gerekli çalışmalar tamamlanmamış ve geçiş süreleri öngörülmüştür. Bu çalışmada; Avrupa Birliği ve Türkiye ekonomik ilişkileri ele alınmıştır. Ayrıca, Avrupa Birliği'ne uyum kapsamında CE işareti; anlamı, özellikleri ve Türkiye açısından önemi ayrıntılı bir biçimde değerlendirilmiştir.Keywords : CE Mark, European Union, Foreign Trade Barriers ABSTRACTCE MARK AS A TRADE BARRIER AND COMPLIANCE WITH THE EUROPEAN UNIONThe Customs Union between Turkey and the European Union, covering the main objectives of the principle of free movement of goods between the parties requires that the technical regulations in harmony with each other. In this regard, due to Turkey's works on EU legistation harmonization, it is going on CE marking studies. CE Marking is the sign of European Union indicates that a product is safe and healthy. CE marking is mandatory in Turkey on a technical sign since the Law came into force in 2002. However, the required studies of CE marking has not completed and transition periods for the implementation has been envisaged. In this study; economic relations between Turkey and European Union has been considered with their duties in details. In addition to these, context of the European Union, CE marking has been assessed of meaning, qualifications and its importance for Turkey in details.

GENERALThe form of government is republic, capital is Sofia, Population is 8.297.000(1997), increasing of population is %0. 7, distinctive characteristics in common with Turkishs, Pomaks, Russians, Gipsies, Tatars, Jewishes are in 16 percent.Estimated agricultural area is 1/3 and woodland is 1/3 of all the land. Charcoal, petroleum, natural gas, ferrum and sources except metal are too much. Bulgaria can't use the money too much on surroundings cause of economical lacks.Too many people are migrated to Turkey reason of economical lacks after communism regime. Population is decreased year by year, but unemployment.2. BULGARIA BEFORE 1989Ottoman empire had governorship on the Bulgaria more 500 years till 1908. Then, Bulgarian Kingdom is founded in 1908. Stamboliyski is in powered from Farmer Party in 1920. A new fascism supporter government is founded but communists and farmers were outside of government.Bulgaria is allied with Germany in 1941. Although a new government was found in 1944, the republican regime with referendum is founded in 1946. The new constution is validated in 1947. Cercenkov is in powered in 1950, relations with U.S.A. were out of order and membership of United Nations was validity in 1955.The new constitution is validated in 1971. T.Jivkow is in powered continually, became arrested cause of irregularity in 1990 and then, again a new constitution is validated. Communist Party is made to take out of only one party. In that year, state's name is changed to Republic of Bulgaria and removed the communist symbols from flag. Privatizational laws are validated with Jelev in 1992. The Government of Videnov is contraried the privatization in 1994.Peter Stoyanov is Nato's supporter and he was president in 1996. United Democratic Forces is in powered with 52 percent of vote after selections in 1997.2.1. COMECON AND COLLAPSING OF SYSTEMComecon is a union that emerged by East European Countries. Bulgarian economy has begun to transition period with some negative ness like other East European countries causes of political incompetence and dissociating end of 1980s.Bulgaria which had more than 60 percent of export to associate but it had couldn't find the new markets cause of inadequate ship of quality standards and had an old technology. Foreign currency reserves are high level. It has too many debts, political incompetent ship in the land. Financial system is not conformity to market economy and also could not claim 2 million dollars of money owing from Iraq because of golf war. So, Bulgaria couldn't save from crisis because of above reasons.2.2 GENERAL ECONOMICAL DEVELOPMENT AND SECTORSBulgarian manufacturing industry basically is founded on textile, wooden engrave, leather products and food prep rationing sectors.Bulgaria had realisation the attacks on the heavy industry that supported by S.S.C.B. after 2nd world war.Production of electro-mechanic and electronic goods in manufacturing sector is reached to an important share since 1970s.The biggest natural wealth of Bulgaria is productive earths. There are not important minerals in Bulgaria.In the following period of 2nd world war, metallurgy and chemical production had an importance. Industry sector had old technology. Its competition is losted the power with disunited of the Comecon.Productivity rates on industry are grown with economical reforms that started in 1979. Economical growing is dynamically continued in spite of reducing the productivity on agriculture sector, building sector and investments in Bulgaria. Especially, price volatility on agriculture sector is a reason of suspicion about real value of growth in 1988 according to 1987.Productions on agriculture and industry of Bulgaria are reduced according to statistics. Main problem on agriculture sector is delivery prices of goods.A stagnation indicator on Bulgarian economy is weakness of building and construction sector. Manufacturing products such as cement and weawing is in necessity. Manufacturing level is inadequate on that area and also unqualificationed organisations have been affected.2.3 - FOREIGN TRADEThere are no definite results on foreign trade reason of inadequate of numerical data's.However, export is increased up to the rate of 4 percent in 1988 and import is reduced to the rate of 1.8 percent. Bulgaria finance deficit is 600 million dollars result of trade with west countries in 1998. Tourism revenues are positive. Trade connections with Turkey are weak according to another East European countries.2.4 – PERESTROICA POLITICSThe new age on economy with state council's decision is started in January 9,1989. Activities to get the indepences of firms are velocitied. At the same time, this decision is more benefit to foreign investors too.3. 1989 – 1997 TRANSITION PERIOD3.1 – ECONOMICAL REFORM ACTIVITIESAlteration is started in east block countries after 1989 and together with this alteration. Comecon is losted the activity. So, idle capacities are commenced and Bulgaria is losted the production markets.The reforms are making started by new government in February 1991. External trade regime is liberalisation in one direction; this is one of the import nest factors of the reforms. With a decision is accepted in 1989, basic of economical reforms are occurred. Firms had equal rights to execution of economical activities. The laws related to foreign investment are validated in 1992.Commercial banks have gone to consolidation. Prices had freed except 11 basic consumption. Economical activities, government status on economy, foreign trade and foreign exchange regime, price regulations, privatization, tax systems are reorganized about foreign investors.3.2. SECTORAL CONSTITUTIONIndustrial sector had the over 50 percent of share on economy until 1990s. 11 private sector's share with service and trade sector approached to 60 percent between 1992 and 1997.SECTORSProductivity with old technologies on industrial sector is at low level. Engineering sector is developed. Products of textile sector are manufactured at high quality.CHEMICALSChemical products that have an important mark on export of Bulgaria. They were 1,096 milliard dollars with 22,3 percent in 1997 and 983 million dollars with 19.4 percent of total export in 1998.AGRICULTURE, FOOD AND TOBACCORate of plan tablelands are 34 percent in Bulgaria. Totally 304 firms are active on food, drink and tobacco sector.METALLURGY AND MINERSHIPIron product is 6.2 percent and other than iron is 6.8 percent on all of industry in 1998. In 1997, metallurgy sector is grown up to 117.2 percent with 529 million dollars in total amount of export in Bulgaria.MACHINEShare of machine sector is 13.8 percent in all of industry. Principal are; Machine parts, tractor, bus, ship, building and auto spare parts.CONSTRUCTIONPrivate firms in the sector have share with 13 percent in 1991. That share is grown to 62 percent in 1995 but then; it is reduced reason of financial inadequate ships.TOURISMTourism revenues are approximately 280 million dollars in 1995.4.5 million of transits and totally 8 million tourists are visited the Bulgaria in 1996.3.3. TRADE AFTER ECONOMICAL REFORMSExport of Bulgaria is totally 4.9 milliard dollars in 1997. The import nest export products are fuel oil, other fuels, cooper and its products and nuclear reactors. Import is 4.5 milliard dollars in 1997 and included the product such as mineral fuels, nuclear reactor heaters and spare parts, electric machines, mineral substances, cotton, synthetic fibres, cereals, auto and tractors.3.4. EXTERNAL DEBTSRate of the external debts to export revenues were 249.9 Percent in 1993 but then, back to 188.2 percent in 1994.Official external debts were 10.363 dollars in the end of 1997.3.5. FOREIGN INVESTORS EXTERNAL CAPITALMost investments with 636.2 million dollars by foreigners are made in 1997. This amount is 526 million dollars in 1998. Principal foreign investors are European countries and U.S.A. A new foreigner investment law is prepared in Oct 1997. Main sectors to investment are industry, trade, finance and tourism.3.6. COMMERCIAL BANKINGState banks are privatization by associate. Regulations relate to control of banking are valitidied by government. In the middle of 1997, a new law on banking are validated after economical crisis in 1996, Central Bank Law are rebuilt. High levels of capital and capital qualifications are obligationed.3.7. PRIVATIZATIONPrivatization is started with foundation transformation and privatization belongs to state and municipalities in April 1992. Privatization Agency is built-up. Privatization is realization with totally 836 million dollars between Jan 1,1993 and Dec 30,1998. Its part of 421.4 million dollars is in 1997 and part of 116 million dollars is realization in 1998.Foundations like ports, telecommunication and, etc.are out of privatization by laws. 95 percent of state firms transformed to form of private limited or nationalization. Share of these firms are belong to state.III. BULGARIA IN EUROPAN UNION AND CONNECTIONS WITH TURKEY1. BULGARIAN ECONOMY AND CONNECTIONS WITH TURKEYTest and certification operations, metal products except iron, chemical products, cereals, operational petroleum. Products are important substances from Bulgaria to Turkey.Although weaving products, food, chemical products, leather and stout leather products, glass, ceramics, brick products are ones of important from Turkey to Bulgaria.1.1. CONTENTS OF FREE TRADE AGREEMENT BETWEEN TURKEY AND BULGARIAAll taxes and restrictictions on industrial products by signed on European Agreement between European Union and Bulgaria in Mar 8,1993 and validated in Dec 31,1993 will be removed till 2002.Turkey and Bulgaria made easy to particularization into agricultural products market by reduced the taxes for between their selves.End of signed acts, 131 products of 446 that stated to Turkey and 1141 goods of existing on European Union Agreement are liberalization by remove from list of sensitive products.Foreign companies had a partnership rights with corporations and individuals and also foreign individuals had a right on economical activities by law of keeping foreign investors, which is validated in 1992. Same economical rights are recognized between foreigners and Bulgarians and also getting unlimited share from exist companies and companies that will be found.2. CONNECTIONS WITH EUROPEAN UNION AND FINANCIAL PORTREIT OF BULGARIA2.1. G24s are transferred to entrust with coordination of support to the European Union Commission.That commission is functionizationed the Phare program that helps on financial and technical areas to Poland and Hungary. Reforms have been out of control at the result of that crisis.Leva is devaluated as 100 percent and inflation is reduced to 90 percent on annual average. At this parallel, financial and revenue politics, money and its value are controlled. The debts to foreign countries are decreased to 9.8 milliard dollars with precautions in 1994 and end of 1996.Financial balance are obtained again in the first months of 1995, reduced the inflation and also rate of interests to 72 percent.Rate of exchange (Leva/$) was 503 percent between Jan 1 and Feb 12,1997. Especially, that increasing was 20-percent/each day in Feb 1997.Rate of interest was 300 percent in Sep.1996. 14 Banks are bankrupted in that period. Bulgaria had been 1st of the world from inflation increasing speed of view.Inflation, devaluation, unemployment and also wages are on the lowest level in transition period in Bulgaria. Can there be such a society that does not use cash and to bring forward the possible consequences of such a system. Technological developments are taking place with great speed, causing individual preferences and expectations necessitate a reconstruction of financial institutaions in the light of those changes. Studies reveal that the Internet, compared to other technological products, has spread widely in a very short time. Through the Internet, trade is also changing and companies are gaining a significant advantage through e-trade. E-trade is preffered by companies because it enables them to offer the market new products and services, to reach new geographic markets, and to gain access to new industries. The internet is creating a world of its own through its institutions, laws, and tools. Just as in the real world, one of the most important elements in this virtual world is money. Studies on e-money are being carried out by private companies and public institutions in Europe and the United States since long. Recently, the legal and financial regulations concerning this have been accelelerated. In a world where national boundaries are disappearing, no country can afford not to take these developments into consideration. Turkey has made commitments to the European Union as to become an e-state within "e-Europe+" by the end of 2003. As I mentioned above, as a result of technological developments, widespread use of internet and the increasing size of electronic trade, a great need of new payment systems has been occured. In this thesis, I have tried to analyse the macroeconomic consequences of electronic money. In this study, I have presented a definition of money and the quantity theory. Then, I have discussed the influences of credit cards which can be qualified as the transitional tool between cash user and non-cash user societies on the demand for and the circulation rate of money. Also, I have analyzed these consequences by classifying money to three parts as cash money, plastic money and electronic money. I have tried to make assumptions by looking the process of the historical development of money. The descriptions of money will be expanded, the positions of Central Banks will be different from their present positions and the tendencies of the economies towards to the financial crisis will be increased.To be ready to these probable conditions, countries have to speed up the arrangements of the legal and financial institutions.

ÖZETAVRUPA BİRLİĞİ'NE GİRİŞ SÜRECİNİN TÜRKİYE SERBEST BÖLGELERİ ÜZERİNE ETKİSİHazırlamış olduğum çalışmada serbest bölge olgusu, tarihsel gelişimi ve teorik yapısı bağlamında incelenmiş ve dünyadaki gelişme seyri ülke örnekleriyle açıklanmıştır. Daha sonra serbest bölgelerin Türkiye'deki gelişimi tarihsel olarak incelenmiş ve serbest bölgelerin kurulmasını gerektiren dönem koşulları ortaya konulmuştur. Şu anda Türkiye'de bulunan serbest bölgeler detaylı olarak incelendikten sonra elde edilen veriler ışığında serbest bölgelerin kuruluş amaçları doğrultusunda beklenilen etkiyi yaratıp yaratmadığı incelenmiştir.Diğer bir bölümde ise Avrupa Birliği'ne giriş sürecinin Türkiye serbest bölgeleri uygulaması üzerinde yaratacağı muhtemel değişiklikler incelenmiştir. Kuruluş amaçları farklı olan Avrupa Birliği ülkeleri serbest bölgelerinde uygulanan teşvikler ülkeler bazında açıklanmış olup kanuni uyum süreci içinde Türkiye'nin yapması gereken değişiklikler açıklanmaya çalışılmıştır. Avrupa Birliği Komisyonu 1985 yılında çıkarılan Serbest Bölgeler Kanunu'nun Avrupa Birliği Gümrük Kodu'na uyumlaştırılması için çalışmalara devam edilmesi konusunu ilerleme raporlarında sürekli belirtilmektedir. Türkiye'de bu bölgelerde yaklaşık 44.500 kişinin istihdam edildiği ve toplam dış ticaret hacminin yaklaşık 'unun serbest bölgelerden yapıldığı göz önüne alınırsa gerekli uyumun en kısa sürede gerçekleştirilmesi bu bölgelerde yatırım yapan veya yapabilecek firmalar için de önemlidir. Deneyimler ışığında serbest bölgelerdeki mevcut durumun uzun süre sürdürülebilmesinin mümkün olmadığı görülmektedir. Dolayısıyla bu bölgelerin ulusal ekonomiye sağlayacakları katkılar açısından yasal düzenlemelerin en kısa süre içinde yapılması önemlidir. ABSTRACTTHE EFFECT OF ACCESSION PROCESS TO EUROPEAN UNION ON TURKISH DUTY FREE ZONESOn the study that I prepaired, I tried to present the historical development and theoretical framework to analyze the phenomenon of the duty free zones. Also development period of them on all over the world with exampling some countries are mentioned. And then I examined the development of duty free zones in Turkey on historical way with exampling the needs of establishing free zones. Existing free zones in Turkey are examined carefully and tried to find out if they realized the effects which were mentioned at the time of duty free zones were establishing.On the other part, on the entrance process to European Uniıon, possible difference effects of Turkish duty free zones has been examined. Both intencives on Turkish duty free zones and different European Union country's duty free zones are mentioned and it has been shown what kind of amendments Turkey has to do to adapdate his laws to European Union laws on this matter. Since 2000, on the development reports of Turkey, it is taking part that in a short time period Turkey has to amend his regulations which will be harmonious with European custom code. If we take into consideration that 44.500 people are working on these zones in Turkey and of foreign trade volume is made here, it is very important that harmonizing regulational operations in a very short while has a big importance for the companies who are taking part on these regions and for the potential customers that can take part on duty free zones. From the previous experiences it is clear that situations on existing duty free zones can not go for longer. That is why because of the advantages which will be provided from the zones, legal regulations has to be done as soon as possible.

Bu sürecin etkin aktörleri olan uluslararası sermaye ve uluslararası kurumların ulus devletin işlevlerinin değişiminde oynadıkları roller üzerinde durulmuştur. Ulus devletin ulus üstü ve ulus altı birimlere yetki devri ve ulus devletin egemenliğinin aşınması sonucu, bağımsız para, maliye, dış ticaret, istihdam politikası uygulama imkanlarının kısıtlanması ele alınmıştır. Son aşamada ise küreselleşme gelişmelerinin tüm ülkeler gibi Türkiye'yi de etkilediğinden bahsedilmiştir. ÖZETGELİŞEN ULUSLARARASI HUKUK SİSTEMİNDEİSTANBUL VE ÇANAKKALE BOĞAZLARIİLE MARMARA DENİZİTürk Boğazları, geçmişte olduğu gibi 21.yüzyılın başlarında da jeostratejik, askeri, ekonomik ve siyasal önemini muhafaza etmektedir. Bunun en önemli nedeni, SSCB'nin dağılmasıyla ortaya çıkan Kafkas Ülkeleri'nin sahip olduğu petrol rezervlerinin, uluslararası pazarlara Boğazlar kanalıyla açılmasıdır. Burada iki sorun ortaya çıkmaktadır. İlki Boğazlar ve İstanbul'un çevresel güvenliğinin zedelenmesi, ikincisi ise ABD'nin Karadeniz'deki ticareti güvene almak için burada asker bulundurmak istemesidir. Bu çalışmayla, Cumhuriyet dönemindeki Boğazlar'a ilişkin antlaşmalar ve uluslararası kritik gelişmeler incelenerek; Türkiye'nin Boğazlar sorunun kaynağı tespit edilmeye çalışılmıştır. Sorunun sebebi Montrö Antlaşması'nın yetersiz kalması gibi görünsede, aslen bu Antlaşma'nın; Türkiye'nin 'Askeri Güvenliğini' ve Karadeniz'deki 'Uluslararası Güçler Dengesini' sağladığı görülmüştür. Ayrıca Montrö Rejimi'nin, bir önceki Lozan Antlaşması'nda ve 1982 BM Hukuk Konvansiyonu'nda belirlenen rejimlerden, Türkiye lehine üstün olduğu belirlenmiştir. Sonuç olarak Türkiye'nin Çevresel Güvenlik problemlerinin, atılmayan somut adımlardan kaynaklandığı, bu alanda hükümet destekli çalışmaların sürekli olmasının sorunları çözümleyeceği anlaşılmıştır. Bunun en güzel örneği ise şu anda uygulanan Türk Boğazları Deniz Trafik Düzeni Tüzüğü ve onu destekleyen Gemi Trafik Yönetim ve Bilgi Sistemi'dir. ABSTRACTTHE TURKISH STRAITS AND SEA OF MARMARA IN THE DEVELOPING INTERNATIONAL LAW SYSTEMTurkish Straits keep their geostrategic, military, economic and political importance at the beginning of 21st century as it was in the past. Because, reserves owned by Caucasian countries, which appeared after Soviet Russia was collapsed, were opened to international markets through straits. There are two problems arising: First one is damaging environmental safety of the Straits and Istanbul and the second one is USA's desire of deploying its army there to ensure the trade in Black Sea Region. The source of Turkey's Straits problem is tried to be found by examining the contracts related to the Straits and international critical developments of the Republic. Even if the reason of the problem is seen as the deficiency of Montreux Convention, actually this Convention ensured Turkey's Military Security and 'International Balance of Powers' in Black Sea Region. Furthermore, Montreux Regime was determined to be superior in favor of Turkey over the regimes determined in Lausanne Convention and 1982 UN Law of the Sea Convention. Consequently, Turkey's environmental security problems result from concrete steps that are not taken. The continuity of government-supported activities will solve the problems in this field. The best example is the Turkish Straits Maritime Regulation which is in use now which is supported by the Vessel Traffic Management and Information System.

ÖZET10 Kasım 1938 tarihinde Mustafa Kemal Atatürk'ün hayatını kaybetmesi ile bir-likte Cumhurbaşkanı olan İsmet İnönü ülke yönetiminde en yetkili kişi haline gelmiştir. İnönü'nün CHP ve ülke yönetimindeki adete tek kişilik hakimiyeti ( Milli Şef ) Celal Bayar başta olmak üzere dönemin CHP'li milletvekili ve yöneticilerinde tepkiye neden olmuştur. Bir şahsın parti ve ülke yönetimindeki hakimiyetine İkinci Dünya Savaşı'nın da etkisiyle halkın büyük çoğunluğunda oluşan ekonomik sıkıntının ve iktidarın halkın muhafazakarlığı ile çelişen eğitim ve sosyal alanlardaki uygulamaları CHP ve dışındaki siyasi çevrelerde ve halkın büyük bir bölümünde muhalif bir tutumun oluşmasına neden olmuştur. Bu süreç hükümetin birtakım radikal uygulamaları ile birlikte örgütlü bir mu-halif hareketin doğmasına neden olmuştur. Yukarıda belirtilen nedenlerden kaynaklanan ve açıktan açığa bir söylem ve ey-leme dönüşmeyen CHP milletvekillileri içindeki bireysel tavırlar ilk defa Çiftçiyi Top-raklandırma Kanunu teklifi sırasında ortaya çıkmıştır. CHP milletvekilleri Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan, 14 Mayıs 1945 tarihinde bu kanun teklifinin TBMM'de görüşülmeye başlaması ile birlikte hükümetin bu uygulamasına karşı tavırlarını yaptıkları konuşmalar ile ortaya koymuşlardır. Fakat esasen bu kanun tasarısının TBMM'ye sunulmasından önce CHP içinde muhalif bir grubun oluşması Tevfik Rüştü Aras'ın evinde yapılan perşembe toplantılarıyla başlamıştır. 1945 yılının Nisan ayından itibaren Tevfik Rüştü Aras'ın evinde bir araya gelen Emin Sazak, Adnan Menderes ve Fuat köprülü CHP'nin, İsmet İnönü'nün otoritesi altında olduğunu ifade etmişler ve bu durumu değiştirmek gerektiği üzerinde durmuşlardır. İkinci defa bir ara-ya gelen Adnan Menderes ve Fuat Köprülü demokratik bir merkez oluşturma konusun-da görüş birliğine varmışlardır. Daha sonraki toplantılara Refik Koraltan da katılmıştır. Adnan Menderes, partide ve toplum içinde etkili olan Celal Bayar'ı bu gruba katmak gerektiğini açıklamıştır. Celal Bayar ile yapılan toplantı sonunda o da gruba dahil ol-muştur. Grup üyeleri 18 Mayıs 1945 tarihinde yapılan toplantıda CHP Meclis Grubuna vermeyi düşündükleri Dörtlü Takriri hazırlamışlardır.Takrir verilmeden önce TBMM'de 1945 yılı devlet bütçesinin oylamasına katı-lan üç yüz yetmiş üç milletvekilinden İzmir Milletvekili Celal Bayar, Aydın Milletve-kili Adnan Menderes, İçel Milletvekili Refik Koraltan, Kars Milletvekili Fuat Köprülü ve Eskişehir Milletvekili Emin Sazak bütçeye karşı aleyhte oy kullanmışlardır. Cumhu-riyet Dönemi'nde ilk defa bir bütçeye karşı aleyhte oy kullanılmıştır. Böylece muhalif tavırlarını ikinci defa ortaya koymuşlardır. Grup üyeleri 7 Haziran 1945 tarihinde Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan'ın imzası ile Dörtlü Takrir'i CHP Meclis Grubu Başkanlığı-na vererek muhalif tutumlarını somutlaştırmışlardır. Takrirde CHP'nin işleyişinin de-mokratik ilkelere uygun hale getirilmesini ve TC. Anayasası'nda var olan vatandaş hak ve hürriyetlerinin tanınması talep etmişlerdir. Bu takrir 12 Haziran 1945 tarihinde CHP Meclis Grubu'nda görüşülmüş ve red-dedilmiştir. Takririn reddedilmesi ile birlikte devam eden süreçte bu kadronun CHP içinde siyaset yapma imkanı kalmadığı gibi takrirde talep edilen bir düzenin kurulma-sının CHP içinde mücadele edilerek olamayacağı ortaya çıkmıştır. Takririn, CHP Meclisi Grubuna verildiği günlerde Cumhurbaşkanı İsmet İnönü, Rauf Orbay ile görüşmüş yeni parti kurulması fikrini ona açmıştır. Bu görüşmeden, İnönü'nün yaptığı diğer konuşmalardan cesaret alan grup üyelerine karşı CHP'li yöne-tici ve milletvekillerinin olumsuz tavrı, partinin yayın organı Ulus gazetesindeki ağır sözlerle dolu yazılar grup üyelerinin CHP'den ayrılmalarına neden olmuştur. Zaten Adnan Menderes ve Fuat Köprülü Vatan gazetesinde yayınlanan yazıları nedeniyle CHP Divanı tarafından 25 Eylül 1945 tarihinde CHP'den ihraç edilmişlerdir. Diğer isimlerde istifa etmişlerdir. Partisiz kalan grup üyeleri parti kurma çalışmalarına başla-mışlar ve Demokrat Parti 7 Ocak 1946 tarihinde resmen kurulmuştur. Demokrat Parti, Dörtlü Takrir'in imzacıları: Celal Bayar, Adnan Menderes, Fuat Köprülü ve Refik Koraltan tarafından kurulmuştur. Demokrat Parti'nin simgesi "DP", genel merkezi ise Antalya Milletvekili Cemal Tunca'nın Ankara Sümer Sokaktaki sekiz numaralı binası olmuştur. Demokrat Parti'nin kuruluş gerekçesinde ve programında Türkiye'de demok-ratik bir rejimin kurulacağı, TC Anayasası'nda demokrasiye aykırı kanunların kaldırı-lacağı, vatandaşların hak ve hürriyetlerinin anayasal teminat altına alınacağı dile geti-rilmiştir. Muhalefet yıllarında ise CHP ve iktidar demokratik olmayan tutum ve davra-nışlar sergilemekle itham edilmiştir. Muhalefet yıllılarında iki parti arasında demokra-siye aykırı birçok olay yaşanmıştır. Hatta 7 Ocak 1947 tarihinde gerçekleşen Demokrat Parti Birinci Genel Kongresi'nde kabul edilen Hürriyet Misakı'nda TC Anayasası'na aykırı olan kanunların kaldırılması ve demokrasiye uygun kanunların yapılması talep edilmiştir. Bu istekler yerine getirilmez ise Demokrat Parti Genel Yönetim Kurulu'na sine-i millet kararı ( TBMM'den çekilme ) hakkı verilmiştir. Demokrat Parti yönetici-leri iktidara gelmeleri halinde vatandaşlara hak ve hürriyetlerinin tanınacağı, demokra-siye aykırı kanunların kaldırılacağı ve TC Anayasası'nın demokrasiye uyumlu hale ge-tirileceği sözlerini vermişlerdir. 14 Mayıs 1950 seçim faaliyetlerinde aynı vaatler tekrarlanmıştır. Hatta 2 Nisan 1950 tarihinde Kasımpaşa'da konuşan Demokrat Parti Genel Başkanı Celal Bayar, grev hakkının demokratik hak olduğunu ve demokrasinin olduğu ülkelerdeki gibi toplumsal düzene ve ekonomiye zarar vermeyecek biçimde işçilere grev hakkının verileceğini ifa-de etmiştir. Seçimleri kazanan Demokrat Parti adına Adnan Menderes 22 Mayıs 1950 tarihinde hükümeti kurmuş ve 29 Mayıs 1950 tarihinde hükümet programı TBMM'de onaylanmıştır.Hükümet programında partinin seçim beyannamesinde olduğu gibi iktidar deği-şikliğinin ülkede maddi ve manevi hiçbir sarsıntıya yol açmasına imkan tanınmayacağı ve özellikle devri sabık yaratılmayacağı vurgulanmıştır. Programda, TC Anayasası'nda vatandaş hak ve hürriyetlerine ve millet iradesine dayanan kararlı bir devlet düzeninin gerçekleşmesini sağlayacak düzenlemelerin yapılacağı ifade edilmiştir. Ayrıca CHP hükümetlerinden ( tek parti dönemi ) kalan, demokratik olmayan kanunların, alışkan-lıkların ve anlayışların değiştirileceği vurgulanmıştır. Programda, işçilere grev hakkının sosyal ve ekonomik düzeni bozmayacak şekilde tanınacağı açıklanmıştır. Demokrat Parti İktidarı Programı'nda sadece vatandaşlara tanınacak haklar yer almamıştır. Ayrıca o tarihlerde azınlıkta olsa da bazıları tarafından hak olarak görülen faaliyetlerin yasaklanacağı da yer almıştır. Cumhuriyet'in ve inkılapların korunması için aşırı sol akımlara ( komünizm ) izin verilmeyeceği ve bunlarla etkin bir biçimde müca-dele edileceği ifade edilmiştir. Bunlara karşı kanuni tedbirlerin alınacağı çünkü bu tür düşüncelerin günün şartlarında fikir ve vicdan hürriyeti olarak görülmediği vurgulan-mıştır. Bu fikir akımların hürriyet maskesi altında yayın yapmalarına izin verilmeyeceği çünkü bu düşünce akımlarının amacının özgürlükleri ortadan kaldırmak olduğu iddia edilmiştir. Komünizm fikir akımının yanı sıra irticai hareketlere de asla müsaade edil-meyeceği vurgulanmıştır. Demokrat Parti Dönemi'nde iktidarın sivil toplum kuruluşları ile ilişkilerine özetlemeden önce sivil toplumun örgütü tanımını yapmak yerinde olacaktır. Sivil top-lum kavramı farklı biçimlerde tanımlanan bir kavramdır. Özellikle devlet ile sivil top-lum arasındaki ilişki farklı tanımlamalara neden olmaktadır. Bu tanımlardan bazılarında sivil toplum, devletten tamamen bağımsız, devleti kontrol eden ve hatta devletin alter-natifi olan örgütlü bir güç olarak tarif edilmiştir. Diğer tanımlarda ise devlet ile sivil toplum arasında bu kadar keskin bir ayrılığın olmadığı, sivil toplumun devlete top-lumsal katılımı sağlama amacının var olduğu ileri sürülmüştür. Modern anlamda sivil toplum kavramı "Non Govern Mental Organizations" ( devletten bağımsız örgütlen-meler ) olarak tanımlamasının yanı sıra "gönüllü kuruluşlar", "kar amacı gütmeyen ku-ruluşlar" gibi ifadelerle de tanımlanmaktadır. Sivil toplum tanımını yaptıktan sonra Demokrat Parti iktidarları öncesi sivil toplum örgütlenmesine devletin müdahalesinin ne zaman kaldırıldığına kısaca yer verelim. Türkiye'de 28 Haziran 1938 tarihinde yürürlüğe giren 3512 sayılı Cemiyetler Kanunu ile Osmanlı Devleti döneminden kalma 1909 tarih ve 121 sayılı Cemiyetler Kanun'u ve bu kanunda yapılan 353 ve 387 sayılı kanunlar yürürlükten kalkmıştır. Bu kanunun dokuzuncu maddesinin h bendiyle "aile, sınıf, ırk, cins" esasına dayalı der-neklerin kurulması yasaklanmıştır. Bu madde ile sendika ve birçok derneğin kurulması yasaklanmıştır. Bu kanunun kabul gerekçesinde, o dönem de bazı ülkelerde var olan ko-münist ve faşist rejimlerin ülkenin yönetimin ele geçirmesini önlemek olduğu ileri sü-rülmüştür. İsmet İnönü'nün 10-11 Mayıs 1946 tarihinde CHP Kurultayı'nda yaptığı konuşmadan sonra 5 Haziran 1946 tarihinde 4919 sayılı Kanun ile dernek kurma işle-mindeki izin alma formalitesi kaldırılmıştır. Sınıf esasına dayalı dernek kurma yasağı da kalkmıştır. Bu kanunun kabulü sırasında Demokrat Parti adına bir konuşma yapan Adnan Menderes, kanunda yapılan değişikliği demokrasiye giden yolda önemli bir aşa-ma olarak adlandırmıştır. Sivil toplum örgütlenmesinin önündeki engeller Demokrat Parti İktidarı öncesinde kaldırılmıştır. Demokrat Parti İktidarı döneminde sivil toplum kuruluşları ile ilişkiler iki bölü-mde ele alınabilir. Birinci bölüm hükümetin sivil toplum alanında yaptığı düzenleme-lerden oluşur. İkinci bölüm ise iktidarın sivil toplum kuruluşlarına yaklaşımı yani onların faaliyetlerine karşı tutumu, ülke yönetimi ile ilgili alınan kararlara ilgili sivil toplum kuruluşlarının tepkileri ve sivil toplum kuruluşlarının kendi alanları ile ilgili alınan kararlarda bu kuruluşların isteklerinin ve itirazlarının dikkate alıp almamasından oluşur.Demokrat Parti İktidarı döneminde sivil toplum alanında birçok düzenleme yapılmıştır. Hükümetin yaptığı bu düzenlemelere günümüzün demokrasi düzeyi ile yaklaşmak zamanın koşullarını ve demokrasi kültürünün oluşum sürecini dikkate almamak anlamına gelir. Hükümetin sivil toplum alanında yaptığı ilk düzenleme 5680 sayılı Basın Kanunu'dur. Kanunun kabulü demokrasi ilkeleri ile bağdaşan bir uygulama olmuştur. Bu nedenle basın ve basın-yayın örgütleri bu yasayı doğru bir adım olarak görmüşlerdir. Hükümetin sivil toplum alanında yaptığı ikinci kanuni düzenleme 5844 sayılı Komünizm İle Mücadele Kanununu çıkarmasıdır. İktidarın programında komü-nizm fikir akımına ve komünist yayınlara karşı mücadele edileceği, bu fikir akımlarının faaliyetlerinin demokratik bir fikir ve vicdan hürriyeti olarak görülmediği aksine de-mokratik rejimi ortadan kaldırmaya yönelik bir tutum ve tavır olduğu vurgulanmıştır. Muhalefetin de bu konuda iktidarla aynı düşünceye sahip olması bu kanunun çıkarıl-masını kolaylaştırmıştır. Demokrat Parti İktidarı'nın bu tür düşünce akımlarına ve onların faaliyetlerine izin vermemesini değerlendirirken zamanın koşullarını ve demok-rasi kültürünün oluşum sürecini göz önünde tutmak yerinde olacaktır. İktidarın sivil toplum alanı ile ilgili yaptığı bir başka uygulama ise 5816 sayılı Atatürk Kanunu'nun çıkarılmasıdır. Atatürk'ün kişiliğine, ilke ve inkılaplarına saldırıların sonucunda kabul edilmiş olan bu kanun günümüzde de geçerlidir. Bu kanunun çıkarılmasına Atatürk'ün kurduğu parti olan CHP'li milletvekillerinin karşı çıkmış olmaları ise üzerinde durul-ması gereken önemli bir husustur. Hükümetin sivil toplum alanında gerçekleştirdiği bir başka düzenleme ise 6761 sayılı Vicdan ve Toplanma Hürriyetini Koruma Kanunu'nun kabul edilmesidir. Kanun, irticai hareketlerin artarak rejimi tehdit eder hale gelmesinin sonucu çıkarılmıştır. İrticai hareketlere izin verilmeyeceğini, demokratik rejimi koruya-cağını programında ilan eden hükümet bunun gereğini yerine getirmiştir. Dinin siyasi veya diğer çıkarlar için kullanılması ve bu tür örgütlenmelerin kurulmasını demokratik ilkelerle bağdaştırmak mümkün değildir. Hükümetin sivil toplum alanına bir başka müdahalesi Neşir Yolu ile veya Radyo ile İşlenecek Bazı Cürümler Hakkındaki Kanun'u çıkarması ile 6732 ve 6733 sayılı basın kanunlarının bazı maddelerini değiş-tirmesi ile olmuştur. Bu kanunlarda yer alan kişilerin şikayeti olmadan savcıların ya-yınlar ile ilgili kendiliğinden harekete geçebilmesi unsuru haber alma ve verme hür-riyetini engelleyen bir koşul oluşturmuştur. Yine gazetecilerin yaptıkları haberler ve köşe yazarlarının yazdıkları yazılar nedeniyle şikayet edilmeleri halinde kendilerini müdafaa edebilmeleri için ispat hakkının onlara verilmeyişi bazı konularda ( iktidar ve mülki amirler ile ilgili yolsuzluk vb) haber yapmalarına, yazı yazmalarına engel olacak ortamı oluşturmuştur. Ayrıca, halkın haber alma özgürlüğüne, gazetecilerin özgür ve bağımsız çalışmasına engel olmuştur. İspat hakkı verilmediği gibi bu tür yazı ve haberler için cezaların arttırılması basın hürriyetini ortadan kaldırmıştır. Bu nedenle bazı basın mensupları hareket içerikli haber ve yazıları nedeniyle ceza almış olsalar da hükümetin politikalarını eleştiren onlarca basın çalışanına hapis cezalarının verilmesi vatandaşlara hak ve hürriyetlerini vereceğini ve devri sabık yaratmayacağını söyleyen Demokrat Parti İktidarı'nın bu uygulamaları onun söylemleri ve adıyla çelişmesine ne-den olmuştur. Hükümetin sivil toplum alanında yaptığı bir başka kanuni düzenleme 6771 Sayılı Toplantılar ve Gösteri Yürüyüşleri Kanunu'nu çıkarmasıdır. Kanun, siyasi partilerin seçim varmış gibi çok fazla miting yaptığı ve bu mitinglerde konuşanların hükümeti ağır bir şekilde eleştirdiği ve hatta bazı hatiplerin hükümet üyelerine ağır sözler söylediği gerekçeleriyle kabul edilmiştir. Bu kanun ile partilerin miting ve kapalı alan toplantıları seçim zamanı ile sınırlandırılmıştır. Bu nedenle bu uygulama demokrasiye aykırı bir düzenleme olmuştur. Bir parti veya dernek kanunlara aykırı hareket etmediği sürece istediği zaman izin almak koşulu ile miting yapabilmelidir. Hükümetin sivil toplum kuruluşları ile ilişkilerine baktığımızda ise olumlu ve o-lumsuz tutum ve uygulamaların varlığından söz edebiliriz. İktidarın sivil toplum kuru-luşları ile ilişkileri dernekler, sendikalar ve basın teşkilatları ile olmak üzere üç ana bö-lüm halinde ele alınabilir. Derneklerle ilişkilere baktığımızda öğrenci dernekleri ile iliş-kilerin daha yoğun olduğunu söyleyebiliriz. Özellikle TMTF ve MTTB gibi öğrenci dernek federasyonları yönetimleri ile ilişkiler öğrenci dernekleri ile ilişkilerin en önemli bölümünü oluşturur. Bu konuda partilerin bugünde devam eden derneklerin yönetimle-rini elde etme isteği Demokrat Parti İktidarı'nın da faaliyetlerinden birisini oluşmuştur. Muhalif olan yönetimleri değiştirmek için çeşitli çalışmalar yapılmıştır. Bu doğrultuda Demokrat Partili dört milletvekili tarafından öğrenci derneklerine hükümetin verdiği ö-deneği dağıtma ve gençlik sorunlarını çözmek amacıyla kurulmuş olan Gençlik Bürosu' nun TMTF ve MTTB'nin yönetim kurulları seçimlerine müdahale etmesi ve sonrası yaşanan olaylar demokrasi ilkeleri ile bağdaşmamıştır. Ayrıca Türkiye Milli Gençlik Teşkilatı adında bir gençlik derneği varken Türk Milli Birliği'nin kurulması ve böylece geçliği farklı cephelerde örgütleme isteği gençliğin birbiri ile kavgalı hale gelmesine ne-den olmuştur. Radyo Dinlemeyenler Cemiyeti'nin İstanbul Valisi Ethem Yetkiner tara-fından kanunsuz bir biçimde kapatılması, Ankara Üniversitesi Siyasal Bilgiler Fakültesi Dekanı Turhan Fevzioğlu'nun görevden alınması nedeniyle eylem yapan öğrencilerin gözaltına alınması ve mahkemeye verilmesi, İTÜTB'nin üniversitedeki yemek boykotu nedeniyle öğrencilerin gözaltına alınmaları, mahkemeye verilmeleri ve hükümet yetki-lilerinin bu konuda yaptıkları açıklamalar demokratik bir iktidar sivil toplum kuruluşu ilişki tarzına aykırı olmuştur. Tahkikat Komisyonu kararları ile örfi idarelerin kurulması ve öğrencilerin tepkilerinin engellenmesi de demokrasi açısında doğru olmayan uygula-malar olmuştur. Kiracılar Cemiyeti'nin istekleri dikkate alınarak Kira Kanunu'nun ka-bul edilmesi, tüccar, esnaf ve sanayicilerin derneklerinin talepleri dikkate alınarak Milli Korunma Kanunu'nda yapılan değişiklik ve kredi imkanlarının artırılması gibi karar-larda dernekler ile ilgili hükümetin olumlu yönde uygulamaları olmuştur. Ayrıca hükü-metin irtica ve komünizm ile mücadeleleri de dernekler tarafından olumlu karşılan-mıştır. In reaction to negative effects of Industrialization Revolution, the first environmentalist movements have emerged in 19th century as protectionist movements. In year 1971, Greenpeace, the largest NGO of the world struggling with environmental crimes, has been established. In this study, Greenpeace's activities will be dealt with in the face of increasing environmental problems caused by the impact of developing technology and globalization, by revealing the change that civil society and non-governmental organizations have undergone.

Sivil toplumun ortaya çıkması, devlet alanını etkilemesi, sivil alanda belirlenen ihtiyaçların devletin düzenlemelerinde kendini bulabilmesi uzun ve karmaşık bir tarihsel sürecin ürünüdür. Tarihsel süreç içinde toplumsal sorunların değişmesi devlet ile sivil toplum arasındaki ilişkide tarafların rollerinin de farklılaşmasına yol açmıştır. Özellikle ilk çağlardan itibaren ticaret ile uğraşan kesim, devlet politikalarının sınırlandırıcı olması nedeni ile giderek devlet yönetimini eleştirmeye başlamış ve devletin yetkilerinin sınırlandırılması gerektiğini savunmuştur. Tüm bu gelişmeler ve küreselleşme süreci ile birlikte devlet ve sivil toplum ilişkileri dönüşüm geçirmiş ve sivil toplum örgütleri ile devlet yönetimleri denetim altına alınmak istenmiştir. 1970'li yıllardan sonra iletişim ve teknoloji alanındaki gelişmeler ile birlikte dünya sınırların kalktığı küresel köy halini almıştır. 1990'lı yıllarda Sovyetler Birliği'nin dağılması ile birlikte ulus devlet anlayışı giderek zayıflamış, neo-liberal politikalar işlerlik kazanmış ve sivil toplum kuruluşlarının sayısı giderek artmıştır. Bu gelişmeler yönetim anlayışını da etkilemiş ve yönetimden, katılımcılığın esas alındığı çok aktörlü yönetişime geçiş başlamıştır. Bu noktada üçüncü sektör olarak devlet ve özel sektör arasında köprü görevi alan sivil toplum kuruluşları hemen hemen her alanda aktif rol oynamaya ve önemli bir aktör olmaya başlamıştır. Dünyada Sanayi Devrimi sonrasında çevre sorunlarının giderek artması, bu sorunlarla mücadele etme gereğini beraberinde getirmiştir. Sanayi Devrimi'nin yarattığı olumsuz etkilere tepki olarak, ilk çevre hareketleri 19. yüzyılda korumacı hareketler olarak ortaya çıkmıştır. 1971 yılında, dünyanın çevre suçlarıyla mücadele eden en büyük sivil toplum örgütü olan Greenpeace kurulmuştur. Bu çalışmada sivil toplum ve sivil toplum kuruluşlarının geçirmiş olduğu değişim ortaya konularak, gelişen teknoloji ve küreselleşmenin de etkisi ile artan çevre sorunları karşısında Greenpeace'in faaliyetleri ele alınacaktır. Along with all these developments and globalization process, state and civil society relations have transformed and civil society organizations and state governments have been under control After the 1970s, with the developments in communication and technology, the world became a global village where the borders are left. With the disintegration of the Soviet Union in the 1990s, the understanding of the nation-state became weaker, the neoliberal policies became operative and the number of non-governmental organizations (NGOs) increased steadily. These developments also affected the management approach and the transition from management to multi-actor governance on which participation was based. At this point, NGOs which act as a bridge between the state and the private sector as the third sector, play an active role in almost every field and become an important actor.
