The trajectory of institutional development of modern Russia: the confrontation of modernization and traditionalism ; Траєкторія інституційного розвитку сучасної Росії
The article considers and analyzes the causes and consequences of the confrontation between modernization and traditionalism in the socio-political and legal field of modern institutional development of Russia. The imperial historical tradition has become a factor that determines the current understanding of the nature, boundaries, mechanisms of protection of political and civil rights of man and citizen in this country. In the modern political and legal life of Russia, a number of informal destructive institutions of politics are clearly expressed, which hinder the proper realization of political and civil rights. First of all, it is the actual (if not de jure, then de facto) appointment of the head of state's successor, patron-client networks, systemic corruption, nepotism, clientelism, clannishness, favouritism, and others. It is this situation that rightly allows us to characterize Russian modern reality as "neopatrimonial" and even "neo-feudal". Government measures of the last decade of state and legal development of the Russian Federation are actively aimed at narrowing the space of civil society and civil, political rights and freedoms, despite their normative consolidation in the 90s of last century. Despite the fact that Russian society is very heterogeneous, it can be stated that the struggle for the possibility of realizing civil and political rights and freedoms is not a priority for Russians in general. The absence of massive and protracted public protests against various manifestations of authoritarianism, human rights oppression, and persecution of NGOs indicates a general indifference of Russians to these issues, insufficient support for human rights values in Russian public opinion. ; У статті розглядаються та аналізуються причини та наслідки протистояння модернізації та традиціоналізму в соціально-політичному та правому полі сучасного інституційного розвитку Росії. Імперська історична традиція стала тим чинником, який визначає нинішнє розуміння сутності, меж, механізмів захисту політичних і громадянських прав людини та громадянина в цій країні. У сучасному політико-правовому житті Росії чітко увиразнено низку неформальних деструктивних інститутів політики, які перешкоджають належній реалізації політичних і громадянських прав. Перш за все це фактичне (якщо не де-юре, так де-факто) призначення спадкоємця глави держави, патрон-клієнтські мережі, системна корупція, непотизм, клієнтизм, клановість, фаворитизм та ін. Саме таке становище слушно дозволяє характеризувати російську сучасну дійсність як «неопатримоніальну» і навіть «неофеодальну». Урядові заходи останнього десятиліття державно-правового розвитку Російської Федерації активно спрямовуються на звуження простору громадянського суспільства та громадянських, політичних прав і свобод, незважаючи на їх нормативне закріплення у 90-х роках минулого століття. Попри те, що російське суспільство є дуже неоднорідним, можна констатувати, що боротьба за можливість реалізації саме громадянських та політичних прав і свобод не є пріоритетами для росіян загалом. Відсутність велелюдних і тривалих протестів громадськості проти різноманітних проявів авторитаризму, утисків прав людини, переслідування НУО свідчить про загалом деяку байдужість росіян до цих питань, недостатню підтримку цінностей прав людини в російській громадській думці.
