Was bedeutet: 'Transitional Justice'?

Der Begriff "transitional justice" steht für Bemühungen, das vergangene Unrecht während Diktaturen oder gewaltsamen Konflikten aufzuarbeiten, um den Übergang zu einer friedlichen Zukunft zu ermöglichen. Dabei wird angenommen, dass die Phase der Transition eng mit dem Streben nach Gerechtigkeit verbunden sein muss und dass nur ein klarer Bruch mit der Vergangenheit zukünftige Verbrechen verhindern kann. Dieser grundlegende Ansatz fächert sich in der Praxis in eine Reihe von Zielen auf, die von der historischen Aufklärung von Verbrechen, der Identifizierung und moralischen oder strafrechtlichen Verurteilung der Verantwortlichen, der Prävention zukünftiger Straftaten bis hin zur Wiederherstellung der Würde der Opfer sowie zur Ermutigung zur Aussöhnung und friedlichen Koexistenz reichen. Im vorliegenden Beitrag wird die semantische und konzeptionelle Basis dieses Modells erläutert und seine sich wandelnde Bedeutung aufgezeigt. Ausgehend von der bundesdeutschen Nachkriegserfahrung wird zunächst der Begriff der Aufarbeitung kritisch diskutiert. Auf eine Darstellung der internationalen Verbreitung des Konzeptes in den 1980er und 1990er Jahren folgt schließlich eine genauere Betrachtung gegenwärtiger Ansätze und ihrer normativen Ansprüche an Wahrheit, Gerechtigkeit und Versöhnung. Damit wird "transitional justice" vor allem im Hinblick auf die aktuell sichtbaren Möglichkeiten und Grenzen der Umsetzung diskutiert. (ICI2)
