The inauguration of Nelson Mandela as South Africa's first democratic president on 10 May 1994 became a symbol of the end of apartheid and the beginning of a new chapter in the country's history. As South African society was deeply divided, the 1993 Interim Constitution expressed the need for reconciliation between the people of South Africa and the reconstruction of its society. The legacy of apartheid was to be addressed based on 'a need for understanding but not for vengeance, a need for reparation but not for retaliation, a need for ubuntu but not for victimization'. Due to its introduction into the Constitution, ubuntu – a philosophy of unity, cooperation, compassion and respect for human dignity, which originated in small African communities – became a source of values for the whole legal system. The goal of the text is to present the ubuntu philosophy and to describe its role in the South African transitional justice process and in selected areas of South African law (criminal law, evictions and defamation). On the whole, South Africapresents a unique case in which both the political transformation and the legal system were strongly shaped by the said philosophical and ethical concepts, which bear close resemblance to the idea of restorative justice. ; Zaprzysiężenie 10 maja 1994 r. Nelsona Mandeli na pierwszego demokratycznie wybranego prezydenta Republiki Południowej Afryki stało się symbolem końca apartheidu i otwarcia nowego etapu w historii tego państwa. Wobec istniejących w społeczeństwie głębokich podziałów przejściowa Konstytucja RPA z 1993 r. wyrażała potrzebę pojednania pomiędzy obywatelami RPA, a także rekonstrukcji wspólnoty. Przezwyciężenie spuścizny apartheidu miało być oparte na potrzebie "zrozumienia, a nie zemsty", "rekompensaty, a nie odwetu" oraz "ubuntu, a nie wiktymizacji". Filozofia ubuntu (wywodząca się z małych afrykańskich wspólnot filozofia jedności, kooperacji, współczucia i respektu dla ludzkiej godności), do której odwołanie zamieszczono w Konstytucji – stała się rezerwuarem wartości dla całego systemu prawa. Celem artykułu jest przedstawienie filozofii ubuntu oraz omówienie jej roli w rozliczeniach z przeszłością w Republice Południowej Afryki i w wybranych obszarach południowoafrykańskiego prawa: w prawie karnym, regulacjach dotyczących eksmisji z nielegalnie zajmowanego gruntu oraz w regulacjach przewidujących odpowiedzialność deliktową za zniesławienie. RPA jawi się przy tym jako wyjątkowy kazus, w którym zarówno polityczna transformacja, jak i system prawny kształtowały się pod istotnym wpływem omawianych koncepcji filozoficznych i etycznych, silnie nawiązujących do idei sprawiedliwości naprawczej.

The article aims to analyse the impact of historical memory on foreign and security policy using the example of the Serbia – Kosovo relations in the period of 2014-2019. Historical memory is a burden, challenge and opportunity for foreign and security policy, and has a considerable impact on bilateral relations between countries which used to be in conflict. Historical memory generates numerous research questions – who is the architect of memory? what are the actors? what are the mechanisms, tools and instruments of its creation? how is it used to maintain power and what are its effects? – to name but a few. In the example analysed, leaders use historical memory to create separate identities and gain power, whereas NGOs do it to commemorate victims. Historical memory is present in celebrating important dates, historical places, monuments and events, and creating national heroes. It also draws attention to the stereotypes in school textbooks and to transitional justice. The most important space for historical memory in the analysis is Kosovo and the role of an international organisation – the North Atlantic Treaty Organization (NATO). Historical memory has an important function in the process of regional reconciliation, which is an essential condition for cooperation and security in the Western Balkans.

A political transformation that has started in Argentina in 1983 put an end on the reign of military junta, but at the same time it was related with a number of challenges for both first democratic governments and the argentine society as a whole. One of the most problematic issues resulting from the confrontation with the crimes from 1976 – 1983 was so called transitional justice and the problem of identity and collective memory of societies coming out of the period of trauma, which are characterized by a high polarization due to different, even contradictory at times interpretations and ideas about the past. The article attempts to analyze the difficult process of settlement of the dirty war period, including the characteristics of the preceding events, the policy of the first democratic governments and the original strategies developed by the argentine movement for human rights, which on the one hand aimed to combat with the impunity of the perpetrators, and on the other hand to counteract the social amnesia and to keep the memory about the tragic past events alive. ; Zapoczątkowany w 1983 r. proces transformacji ustrojowej w Argentynie zakończył okres rządów junty wojskowej, ale jednocześnie wiązał się z wieloma wyzwaniami zarówno dla pierwszych demokratycznych rządów, jak i całego argentyńskiego społeczeństwa. Jednymi z najbardziej problematycznych kwestii determinowanych koniecznością konfrontacji ze zbrodniami z lat 1976 – 1983 okazały się tzw. sprawiedliwość okresu transformacji oraz kwestia tożsamości i pamięci zbiorowej społeczeństwa wychodzącego z okresu traumy, charakteryzującego się wysokim stopniem polaryzacji ze względu na odmienne, często sprzeczne interpretacje i wyobrażenia na temat przeszłości. W niniejszym artykule dokonano próby analizy trudnego procesu rozliczania się z okresem tzw. brudnej wojny, z uwzględnieniem charakterystyki wydarzeń, które do niego doprowadziły, polityki pierwszych demokratycznych po dyktaturze rządów oraz oryginalnych strategii wypracowanych przez argentyński ruch praw człowieka, które z jednej strony służyły walce z bezkarnością winnych, z drugiej zaś miały na celu przeciwdziałać społecznej amnezji i podtrzymać pamięć na temat tragicznych wydarzeń z przeszłości.
