Peace has all the characteristics of pure public goods, such as non-excludability and non-rivalry. While peace in national level is a public good, peace in international level is a global public good which should be financed accordingly. In this study, first, characteristics of peace as a global public good is investigated, then, how peace operations are financed in United Nations (UN) is examined. Although, there have been significant improvements on financing structure of UN peace operations, it is still not very efficient and the current level of funding for UN peace operations is inadequate. There is also a need for an effective sanction for late payment of peacekeeping assessments. In the literature, there have been many new ideas to finance peace operations more effectively, ranging from insurance approach (countries get insurance from UN) to applying some kind of arm trade tax on countries. Suggestions to improve financing peacekeeping operations as global public goods are also discussed in this study.

Birleşmiş Milletler (BM)'in barışı koruma misyonu kuruluşundan itibaren günümüze kadar gelen süreçte uluslararası barış ve istikrarın sağlanması konusundaki en önemli araçların başında gelmiştir. 1950'li yıllarda ilk örneklerinin görüldüğü barışı koruma misyonları Soğuk Savaş sonrası dönemde değişime uğramıştır. İnsani müdahale ve devlet egemenliği kavramları çerçevesinde yeniden değerlendirilen barışı koruma misyonları uluslararası barış ve güvenliğin sağlanmasındaki en önemli araçlardır. Bu çalışmada BM'nin geleneksel barışı koruma misyonu yapısı koruma sorumluluğu normu çerçevesinde incelenecektir. Koruma sorumluluğunun uygulama alanı olarak Sudan incelenecektir. ; The United Nations (UN) peacekeeping mission since its establish has been one of the most important tools for achieving international peace and stability. In the 1950s the first examples of peacekeeping missions were seen and have been transformed in post Cold War era. After re-evaluated through humanitarian intervention and state sovereignty the peacekeeping missions are the most important instruments in ensuring international peace and security. This study will examine traditional UN peacekeeping missions within the framework of responsibility to protect norm. As case study Sudan will examine through responsibility to protect.

ABD, Birleşmiş Milletler'in onayı olamadan Irak'ı işgal etme gerekçesi olarak, Irak'ın zenginleştirilmiş uranyum elde etmeye çalıştığını; kitle imha silahları (KİS) projesini devam ettirdiğini ve El Kaide'yle işbirliği yaptığını, öne sürmüştür. Dolayısıyla Irak Hükümetini, hem ABD açısından ve hem de dünya barış ve güvenliğine karşı açık bir tehdit olarak nitelendirmiştir. Buradan hareketle, Birleşmiş Milletler Güvenlik Konseyi'nin 1991 Tarih ve 678 Sayılı Kararında Irak'a karşı kuvvet kullanmaya izin verildiği ve ayrıca 2002 Tarih ve 1441 Sayılı Kararın 13. Paragrafında, "Irak'ın ciddi sonuçlarla karşılaşacağı" ifadesinin, kuvvet kullanılacağını öngörüyor olduğu iddiasından yola çıkarak, ABD'nin Irak'a Müdahalesi için yeni bir karara gerek olmadığını öne sürmüştür. Binaenaleyh II. Bush Yönetiminin, 20 Mart 2003'te Irak'a başlattığı saldırının ardından gündeme gelen en önemli tartışmalardan biri, ABD hangi hukuksal nedenlere dayanarak Irak'ı işgal ettiği ve bu müdahalenin uluslararası hukuk bakımından nasıl değerlendirileceği hususu olmuştur. Güvenlik Konseyi'nin 1991 yılında aldığı 678 sayılı kararın amacı; Irak güçlerini Kuveyt'ten çıkarmaktı ve 2002 yılında çıkan 1441 sayılı kararın amacı da; Irak'ın silahsızlandırılmasını ve silahlarının denetlenmesini güvence altına almaktı. Ayrıca UNMOVIC'in (The United Nations Monitoring, Verification and Inspection Commission) başkanı Hans Blix'in 14 Şubat 2003'te sunduğu raporlar ve sonraki dönemde de Irak'ta herhangi bir KİS'in bulunamaması, ABD iddia ve tezlerinin doğru olmadığını açıkça göstermiştir. Birleşmiş Milletler Antlaşmasının kuvvet kullanma ve silahlı zorlama yollarının; uluslararası hukukta öngörülen mekanizmalar işletilmeksizin ve dünya kamuoyunun yoğun muhalefetine rağmen Irak'a karşı gerçekleştirilen bu savaş ve işgal, Birleşmiş Milletler Antlaşmasının "kuvvet kullanma yasağı" çerçevesinde oldukça yoğun tartışmalara sebep olmuştur. Ayrıca işgal sonrası, ABD'nin Irak'ta izlediği politikalar ve işkence iddiaları, insan hakları ve savaş hukuku itibariyle de ABD'nin ağır uluslararası hukuk ihlalinde bulunduğu eleştiri ve tartışmalarını beraberinde getirmiştir. ; The USA claimed that Iraq tried to obtain enriched uranium, sustained the projects for mass destruction weapons (MDW) and ganged with El Kaide as the reason for occupying Iraq without the consent of the United Nations. Thus, it qualified the Iraq Government as a clear threat to both the USA and the peace and security of the world. Starting from this point of view, it was claimed that the USA didn't need a new decree to Interference to Iraq since necessary permission was given with the decree of the United Nations with the date of 1991 and number of 678, and the expression stating that "Iraq will have serious conclusions" in the decree dated 2002 and with the number of 1441, article 13 allowed using forces against Iraq. Consequently, one of the discussions which arose after the attack of the Administration of Bush the II on March 20, 2003 was the legal reasons for the USA's occupying Iraq and how this intervention would be evaluated from the point of international law codes. The purpose of the decree of Security Council dated 1991 and with the number of 678 was to take the Iraqi forces out of Kuwait and the purpose of the decree with the date of 2002 and number of 1441 was to unarm Iraq and control the weapons in Iraq. Moreover, the reports of Hans Blix, the Chairman of UNMOVIC (The United Nations Monitoring, Verification and Inspection Commission) dated February 14, 2003 and non-existence of MDW's in Iraq during the following periods has clearly shown that the claims and hypothesis of the USA weren't true. This war and occupation executed against Iraq despite the severe opposition of world public opinion and without trying the ways of the Charter of United Nations about using forces and armed forcing and the mechanisms prescribed in the international law caused dense discussions within the frame of "the prohibition of the use of force" by the Charter of the United Nations. Moreover, the policies that the USA pursue in Iraq after the occupation and allegations of torture and the claims that the USA executed severe violations of law from the points of human rights and laws of war brought the critics and discussions along.

Uluslararası toplum, uluslararası barış ve güvenliği tehdit eden uluslararası olmayan silahlı çatışmalarla son yıllarda daha sık karşılaştı. 1990'lardaki uluslararası olmayan silahlı çatışmalar dolayısıyla yüzbinlerce sivil evlerini terk etmek zorunda kaldı ve birçoğu öldü ya da yaralandı. Uluslararası toplum, böylesi durumlarda risk altındaki sivillere güvenlik ve insani yardım sunmak için bir çözüm arayışı içindedir. Bu bağlamda, uluslararası toplumun güncel çatışmaların olduğu ülkelerde insani acıları dindirmek için başvurabileceği en etkili ve elverişli tedbirlerden biri de güvenli bölgedir. Bu makale, geçmiş güvenli bölge örneklerini mercek altına almakta ve bu bölgelerin hukuki analizini içermektedir. ; The international community faced with non-international armed conflicts that threaten international peace and security in recent years more frequently. Hundreds of thousands civilians were forced to leave their homes and many of them were either killed or injured as a result of non-international armed conflicts in 1990s. The international community has been in search of a solution for such situations to provide security and humanitarian aid to civilians at risk. In this regard, safety zones may be one of the most effective measures available to the international community to alleviate human suffering in current conflict countries. The article scrutinizes past examples of safety zones and includes legal analysis of such zones.

BM savaş sonrası barışla yaşanan bir dünyayı gerçekleştirmek özlemiyle kurulmuştu. Örgütün kurulmasından sonra on yıllar içinde dünyadaki siyasi dengeler değişmiş, yeni güç odakları oluşmuş, uluslararası barış ve güvenliği tehdit eden devlet dışı unsurlar oluşmuştur. Ancak bütün bu gelişmeler BM sözleşmesine yansımamıştır. Bu sebeple bu yeni gelişmelere göre BM yapısının uyarlanması maksadıyla reform arayışları başlamıştır. Bu arayışlar özellikle uluslararası barış ve güvenliğin korunmasının ana sorumlusu olan Güvenlik Konseyin üzerine odaklanmıştır. Bu makalede Güvenlik Konseyinde Reform arayışları işlenmiştir. Konu önce Güvenlik Konseyinin mevcut yapısı, karar alma usulü ele alınarak incelenmiştir. Ardından Güvenlik Konseyinde neden reform yapmak gerektiği, reformun önünde hangi engellerin olduğu incelenmiştir. Daha sonra da yapılan reform önerileri ayrı ayrı ele alınmıştır. Makalenin sonunda da reform arayışları üzerine bir değerlendirme yapılmıştır. ; UN is established after the war with the hope of peace. After decades from the establishment of the organization, political balances has changed, new power roots emerged and besides these,non-state threats against international peace and security came into existence. However, all these changes are not reflected in the UN contract. Therefore, quest for reform has started in order to make adaptations to UN's structure according to these new events. These quests especially focus on Security Council which is the main responsible for the protection of peace and security. In this paper, quest for reform of Security Council is analyzed. First, the current structure of the Security Council is handled by discussing the order of decision making style of it. Then, the reason why Security Council needs to be reformed and handicaps of these reforms are studied. After that, all reform proposals handled one by one. At the end of the essay, an evaluation about reform seeking is made. After that, all reform proposals handled one by one. At the end of the essay, an evaluation about reform seeking is made and attention is drawn that if the aim is to prevent failure of United Nations' fulfilling its duty about assuring the world peace and safety and also to hinder abasement of this organization, a new settlement should be done about the reform of UN agreement.
