In Martin v. United States, the Federal Circuit Court dismissed a Fifth Amendment regulatory takings and exaction claim for want of ripeness when the claimant failed to apply for a permit, which would have allowed for an assessment of the cost of compliance with governmentally imposed requirements. By finding the claim unripe, the court stood firm on the historical view that federal courts may only adjudicate land-use regulatory takings and inverse condemnation claims on the merits after a regulating entity has made a final decision. However, jurisprudential evolution of the ripeness doctrine and judicial review of takings claims may be forthcoming as the United States Supreme Court is set to deliver a decision in Knick v. Township of Scott.

In 2015, a group of adolescents between the ages of eight and nineteen filed a lawsuit against the federal government for infringing upon their civil rights to a healthy, habitable future living environment. Those Plaintiffs in Juliana v. United States alleged that the industrial-scale burning of fossil fuels was causing catastrophic and destabilizing impacts to the global climate, threatening the survival and welfare of present and future generations. Seeking to reduce the United States' contributions to atmospheric carbon dioxide, Plaintiffs demanded injunctive and declaratory relief to halt the federal government's policies of promoting and subsidizing fossil fuels, due to the limited timeframe for addressing the impacts of climate change. While extensive motion practice has impeded a hearing on merits of Plaintiffs' claims, Juliana v. United States addressed threshold questions concerning constitutional and procedural claims.

Plaintiffs sued the United States government for promoting activities that were known to pollute the atmosphere and cause climate change. They claimed the government's policies violated their rights under the substantive due process clause of the Fifth Amendment, the equal protection clause of the Ninth Amendment, and the public trust doctrine. The Ninth Circuit held it was not within the court's Article III power to create and oversee a comprehensive plan capable of redressing the Plaintiffs' injuries and, therefore, Plaintiffs lacked standing.

The United States Court of Appeals for the Ninth Circuit determined that the government's broad regulatory scope under the Safe Drinking Water Act did not exceed Congress' authority under the U.S. Constitution's Commerce Clause. An Idaho farmer discharged wastewater into a well and was found guilty on criminal charges under the Safe Drinking Water Act. The Ninth Circuit held that in order to bring criminal charges under the Act, the government has the burden to show that a defendant willfully injected a fluid into the ground without a permit, not that the injection actually damaged a source of groundwater.

Grandparenting varies enormously in the United States and here we discuss that growing diversity. Relying on exchange and reciprocity, feminist, and political economic theoretical perspectives, we begin by exploring the increasing need for grandchild care and assistance in the United States and the dearth of federal and employer supports for working families. Assessing the impact of sociodemographic trends, notably the rise in single parenting and the increase in employment among grandparents, we assess the intensification of grandparenting. Then we turn to issues related to proximity, examining the pleasures and challenges of coresidential, custodial, long distance, and transnational grandparenting. Finally, we turn to the impact of grandparenting on the emotional, physical, and financial wellbeing of grandparents.

In-work poverty became a prominent policy issue in the United States long before the term itself acquired any meaning and relevance in other industrialized countries. With America's embrace of an employment-centered antipoverty strategy, the working poor have become even more of an issue. This paper reviews some key trends, drivers and policy issues. How much in-work poverty is there in the United States? How does the US compare to other rich democracies? Has America's in-work poverty rate changed over time? Who are the in-work poor? What are the main drivers of levels and changes in in-work poverty? Finally, what are the prospects for America's working poor going forward?
