El gobierno de las universidades americanas está profundamente enraizado en los ideales de la democracia americana y en el concepto de citizen board of trustees(personas ajenas a la institución que llevan a cabo una supervisión de la Universidad o el College sin llegar a llevar el trabajo cotidiano). Estos ciudadanos no son empleados de la institución o de alguno de los gobiernos de los cincuenta Estados del país. Su tarea consiste en representar a la vez a la institución y al conjunto de los intereses de los ciudadanos.Un governing board posee diferentes e importantes responsabilidades, como la supervisión de las finanzas de la institución financieras, los programas académicos y los estándares, y el conjunto de las directrices estratégicas. Una de las más importantes responsabilidades que asumen los governing board es la protección y preservación de la independencia y la autonomía de la institución. Para que el governing board lleve a cabo con éxito sus tareas hace falta una estrecha relación de trabajo con la administración de la institución de educación superior y, en particular, con el presidente/rector. El presidente/rector es contratado y evaluado por el órgano de gobierno y es el principal gestor y portavoz. Cuenta con un gabinete de vicepresidentes/vicerrectores, y preside la administración académica y tiene la facultad de dirigir los objetivos estratégicos establecidos y aprobados por el governing board. Aunque la máxima responsabilidad resida en el governing board, algunas decisiones se podrían delegar al presidente/rector, y a la autoridad académica como las decisiones curriculares.El sistema de estructuras de multicampus, donde un Consejo gobierna múltiples instituciones, son frecuentes en los Estados Unidos de América. AbstractAmerican higher education governance is deeply rooted in the ideals of American democracy and in the concept of a citizen board of trustees – persons outside the institution who oversee the university or college but do not run it on a day-to-day basis. These citizens are not employees of the institution or of any of the individual 50 state governments. Their duty it is to represent both the institution and the broad public interest of citizens.A governing board has several important responsibilities, including oversight of the institution's finances, academic programs and standards, and broad strategic direction. One of the most critical governing board responsibilities is protecting and preserving the independence and autonomy of the institution. For the board to successfully carry out its responsibilities requires an effective working relationship with the college or university administration, in particular, the president. The college president is hired and evaluated by the governing board and is the lead manager and lead spokesperson. With a cabinet of vice presidents, he or she leads the academic administration and the faculty toward the strategic goals established approved by the governing board. Although ultimate responsibility rests with the governing board, many decisions should be delegated to the president, and also to the faculty for academic and curriculum decisions.Multicampus system structures, where one board governs multiple institutions, are prevalent in the United States. Some systems govern all public colleges and universities in the state, some govern institutions of similar mission, and some are regionally based. Systems are led by a system executive with constituent campuses by campus presidents. Statewide coordinating boards and agencies exist in most states, and in just under half they play a significant role in state policy development and regulation.While citizen trusteeship generally reflects the decentralized approach to decision making that is part of American political culture, there are concerns about qualifications for board members selection, adequate orientation and education, and competing demands on their time and attention. Modern challenges facing U.S. higher education, such as preparing more and better teachers, increasing college degree production, and narrowing the education achievement gaps of minority populations, also lead many to question whether governance structures undergirded by citizen boards are adequate. Talk of reforms to strengthen governance and its ability to lead strategic responses to these challenges are increasing in frequency. Although subject to criticism about their selection, training, and commitment to either the broad public interest or the institution, and despite concerns about their effectiveness for the 21st Century, citizen governing boards remain one of American higher education's best features.

Objective. To provide a brief history of the illicit tobacco trade between Mexico and the United States. Materials and methods. Research included a previously published study: "Cigarette taxes and smuggling: A statistical analysis and historical review", published by the Mackinac Center for Public Policy; US Customs and Border Protection data; various US court documents; General Accountability Office reporting; media reports; other historical material, and a personal interview. Results. The research revealed that there is no credible evidence of organized criminal activity related to the illicit trade in tobacco products from Mexico into the United States. However, there is clear and convincing evidence of organized criminal activity in smuggling tobacco products from the United States into Mexico for at least 167 years. Conclusion. Historical records from 1845 into the 21st century clearly demonstrate that the United States was usually the source country for tobacco products moving illegally between the two countries. ; Objetivo. Describir brevemente la historia del comercio ilícito de tabaco entre Estados Unidos y México. Material y métodos. La investigación incluye publicaciones previas, como "Impuestos sobre los cigarrillos y el contrabando: Un análisis histórico y estadístico"; datos de la Agencia de Aduanas y Protección Fronteriza; varios documentos de la Corte; los informes de la Oficina General de Rendición de Cuentas de EU; notas de prensa; materiales históricos, y una entrevista personal. Resultados. La investigación reveló que no hay pruebas creíbles de actividad delictiva organizada relacionada con el comercio ilícito de productos de tabaco de México a EU. Sin embargo, hay pruebas claras y convincentes de que esta actividad se ha realizado de EU a México por lo menos durante 167 años. Conclusión. Los registros históricos desde el año 1845 claramente demuestran que EU solía ser el país de origen del tabaco ilegal entre los dos países.

RESUMEN This test analyses the importance of the study and interpretation of contemporary imperialism in the United States, understood as a multidimensional phenomenon and as a system of domination in which hegemony and, as part of it, ideological processes occupy a prominent place and perform essential functions for its preservation, reproduction and consolidation. Attention is drawn to the validity of such a study from the perspective of critical thinking and of a Marxist and Lleninist theoretical approach in today's social sciences that address US reality. ; RESUMEN Este ensayo analiza la importancia del estudio e interpretación del imperialismo contemporáneo en Estados Unidos, entendido como un fenómeno multidimensional y como un sistema de dominación en el que la hegemonía y, como parte de ella, los procesos ideológicos ocupan un lugar destacado y cumplen funciones imprescindibles para su preservación, reproducción y consolidación. Se llama la atención sobre la vigencia de tal estudio desde la perspectiva del pensamiento crítico y de un enfoque teórico marxista y leninista en las ciencias sociales actuales que abordan la realidad norteamericana.

Thomas Jefferson y John Marshall encarnan las dos más relevantes personalidades contrapuestas de la joven República. Simbolizan asimismo dos enfrentadas convicciones constitucionales en esta época. Esa contraposición se ponía especialmente de manifiesto en el caso United States v. Burr (1807), en el que Aaron Burr, Vicepresidente de los Estados Unidos durante el primer mandato presidencial de Jefferson, iba a ser acusado del delito de traición.Desde el punto de vista constitucional, el Derecho de traición presentaba un interés excepcional. El delito era el más grave contra la seguridad del Estado, pero, por el estigma que entrañaba y por la vaguedad de su alcance, se podía convertir en un notorio instrumento de poder arbitrario y de facción política. A tenor de la Sección tercera del Art. III de la Constitución: «La traición contra los Estados Unidos consistirá tan sólo en hacer la guerra en su contra o en unirse a sus enemigos, dándoles su ayuda y protección. A ninguna persona se le condenará por traición a no ser con base en la declaración de dos testigos del mismo acto manifiesto, o en una confesión en sesión pública de un tribunal».Marshall iba a presidir el Tribunal de Circuito de Richmond que juzgaría a Aaron Burr. El caso de Burr era un juicio político de primera magnitud. Con anterioridad al juicio de Burr, el Presidente Jefferson, en un mensaje dirigido al Congreso, con base en débiles pruebas y simples rumores, proclamó abiertamente la culpabilidad de Burr. Como algún autor ha dicho, Jefferson estaba salvajemente decidido a que Burr fuera colgado y proyectó todo el peso y prestigio de la Administración detrás de la acusación. Para alcanzar tal fin, el Presidente estaba completamente dispuesto a burlar la Constitución. Marshall era consciente de que una definición permisiva del delito de traición posibilitaría su utilización como un arma para la represión política. De ahí que en un caso anterior, Ex Parte Bollman, sostuviera que: «Es más seguro, así como más conforme a los principios de nuestra Constitución, que el delito de traición no debe extenderse por deducción a los casos dudosos, y que aquellos delitos no claramente dentro de la definición constitucional reciban el castigo que la sensatez de la legislatura pueda disponer».En su alocución al jurado en el caso de Burr, Marshall adujo dos consideraciones cruciales: lª) Que esta acusación, habiendo formulado cargos al prisionero (Aaron Burr) de hacer la guerra en la isla de Bennerhassett y no conteniendo otro acto manifiesto, no puede sostenerse por la prueba de que la guerra se hizo en aquel lugar por otras personas, en ausencia del prisionero, aún admitiendo que esas personas estén relacionadas con él en una común conspiración traidora. 2ª) Que admitiendo que tal acusación pudiera sostenerse por tal prueba, la previa condena de alguna persona que cometió el acto del que se dice equivaler a hacer la guerra, es indispensable para la condena de una persona que aconsejó o procuró ese acto. El jurado emitió un veredicto de no culpabilidad, exonerando a Burr del delito de traición. De inmediato, Jefferson criticó acerbamente a Marshall al considerar que el Presidente del Tribunal había adoptado una conducta partidista en el juicio de Burr. Jefferson nunca discutió en términos jurídicos la sentencia; tampoco la interpretación dada por Marshall a la cláusula constitucional de traición; su crítica siempre giró en torno a que el proceso fue un evento político. El caso United States v. Burr fue en realidad el caso de John Marshall contra Thomas Jefferson. ; Thomas Jefferson and John Marshall embodie two opposed personalities of the young Republic. They also symbolize two encountered constitutional convictions at this time. That conflict was especially showed in the United States v. Burr case (1807) in which Aaron Burr, Vice-president of the United States during the first Jefferson´s presidential period, was charged of treason. From the point of view constitutional, the Law of treason offered an exceptional interest. The crime was the most serious against the safety of the state; but, by the same token, the stigma it carries, and the vagueness of its reach might to be converted in a notorious instrument of arbitrary power and political faction. In accordance with the third Section of the Art. III of the Constitution: «Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court». Marshall presided over the Circuit Court at Richmond which judged Aaron Burr. The Burr case was a political trial of the first magnitude. Previously the trial, President Jefferson, in a message sent to Congress, on weak evidences and mere rumours, openly proclaimed thar Burr was guilty. As some author has told, Jefferson was savagely determined that Burr should hang and threw the whole weight and prestige of the administration behind the prosecution. He was quite prepared to circumvent the Constitution to this end. Marshall was aware that a permissive definition of treason should allow its utilization as a weapon for the political repression; so that in a previous case, the Ex Parte Bollman case, maintained: «It is, therefore, more safe as well as more consonant to the principles of our constitution, that the crime of treason should not be extended by construction to doubtful cases; and that crimes not clearly within the constitutional definition, should receive such punishment as the legislature in its wisdom may provide». In his charge to jury in the Burr case, Marshall alleged two crucial considerations: 1st. «That this indictment, having charged the prisoner —Aaron Burr— with levying war on Blennerhassett´s island, and containing no other overt act, cannot be supported by proof that war was levied at that place by other persons, in the absence of the prisoner, even admitting those persons to be connected with him in one common treasonable conspiracy». 2nd. «That admitting such an indictment could be supported by such evidence, the previous conviction of some person who committed the act which is said to amount to levying war, is indispensable to the conviction of a person who advised or procured that act». The jury expressed a verdict of no guilty and by it the jurors exculpated Burr of the crime of treason. Immediately, Jefferson criticized bitterly Marshall on considering that the Chief Judge had assumed a factional behaviour in the Burr trial. Jefferson never discussed in legal terms the judgment; neither the interpretation given by Marshall of the treason clause; its criticism always turned around the process had been a political event. The case United States v. Burr was actually the case John Marshall versus Thomas Jefferson.

At the ideological level, the protection of human rights and freedoms in the United States is proclaimed as a political, legal and moral axiom. It has become a generally accepted view that the rule of law conception reflects the meaning and content of the US legal system, which is based on the original values of the American people. The ideological source of the rule of law conception in the United States was the theological direction of natural law theory. The theological direction, based in the United States on the doctrines of Calvinism, developed an attitude to law as a supernatural entity that is not subject to the state. The article considers the influence of these ideas on the formation of the modern rule of law conception in the United States. It is impossible to give a comprehensive and correct definition of the rule of law that included all the meanings of the concept and its equivalents in all languages. This creates an analogy with large-scale sacred concepts, such as "God". It can be said that the concept "rule of law" is definitely similar in this sense to the concept "God", which is also inclusive in its sphere, and means the objectified supernatural entity that is the object of worship and the source of the good.

Due to the inability of the United States political structure to resolve deep internal disagreements over the Vietnam War, Americans lost their faith in an effective public order regardless of their political sympathies. 1968 was the year in which faith in the nation's political institutions cracked. The year began with an organized movement within the Democratic Party to oust Lyndon Johnson from the White House and to place an antiwar leader at the head of the party, a leader who would refocus the political energies of the nation on healing racial division and the "war on poverty." The assassinations of Martin Luther King, Jr., and Robert F. Kennedy terminated movement to national reconciliation around a progressive program. Conservatives profited from escalating internal violence by presenting themselves as the only political force capable of bringing order. The New Left did not profit from the national political crisis, but new social movements forced into the public arena new conceptions of how the nation had developed and what "justice for all" entailed. The left failed politically, but its movements transformed the conduct of everyday life. The direction flowing from 1968 in the United States proved over the long term to be cultural regeneration of the nation's liberal values to fit the realities of a more diverse and divided citizenry. ; Debido a la incapacidad de la estructura política de los Estados Unidos de resolver los profundos desacuerdos internos sobre la Guerra de Vietnam, los americanos perdieron su fe en un orden público efectivo a pesar de sus simpatías políticas. 1968 fue el año en el que se quebró la fe en las instituciones políticas de la nación. El año comenzó con un movimiento organizado dentro del Partido Democrata que desbancó a Lyndon Johnson de la Casa Blanca y que colocó a un líder antibelicista a la cabeza del partido, un líder que centraría de nuevo las energías políticas de la nación en aliviar la división racial y la "guerra contra la pobreza". Analysts should avoid the retrospective illusion of believing that the US hegemony, as a trend and a firmly entrenched practice occurred during the Independence or a little later (with the Monroe Doctrine). In fact, the onset of hegemony took place during the last decades of the XIXth century and strengthened during the following century, particularly because of the European decline. Moreover, the period following 09/11 has been a very crucial one, with the emergence of a new foreign policy that combines a large element of the doctrine of intervention, with the ancient just-war doctrine, a difficulty to take into account the change in the art of war, and the forgetfulness of the classical terms of the diplomatic and strategic behavior. The successive years will reveal if the eruption of Condoleeza Rice's "Transformational Diplomacy" represents a real epoch-making turning point. ; El analista tiene que evitar la ilusión fatalista retrospectiva que hace de la hegemonía de Estados Unidos una tendencia nacida con la independencia o poco después (con la doctrina Monroe). Esta hegemonía apa rece realmente a partir de las últimas décadas del siglo XIX, para desarrollarse en el siglo siguiente, en particular a causa del declive europeo. En cambio, el periodo pos-11/09 es muy específico en cuanto a la nueva política que combina una amplia doctrina de intervención sostenida por la vuelta a la antigua doctrina de la guerra justa, una dificultad para tomar en cuenta las transformaciones de la guerra y un olvido de los términos clásicos de la conducta diplomático-estratégica. Los próximos años dirán si la irrupción de la "diplomacia transformacional" de Condoleeza Rice representa o no un verdadero viraje.
