The discourse of political activism makes use in many cases of an intertextual rereading of historical events for purposes of discussion. This is the case of the action of the Zentrum für Politische Schönheit Erster Europäischer Mauerfall, which took place in Berlin in 2014. The action evokes the Berlin Wall and its fall in a prototypical way to project its political discourse on all the walls currently present in the world and on the consequences of their existence for some political minorities. [Riassunto] Die Lage der europäischen Rechtswissenschaft s'intitola una delle conferenze che Carl Schmitt, acclamato Kronjurist del Terzo Reich almeno sino al 1936, tiene in varie città del vecchio continente fra il 1941 e il 1944. Pubblicata in ungherese nel 1944 e in tedesco solo nel 1950, essa, considerata come una delle più alte apologie della tradizione giuridica, costituisce un documento di straordinaria rilevanza per chi voglia accostarsi alla problematica figura dello studioso tedesco e in particolare al suo complesso e travagliato pensiero nel campo del diritto, rivelandosi nel contempo di sorprendente attualità. Protagonista ne è la scienza giuridica europea. Quella scienza che per secoli è stata capace di elaborare da sé il diritto, riuscendo a riportare nel suo alveo pure le statuizioni normative a carattere autoritativo provenienti dal suo esterno: e quindi, anzitutto, la scienza dei giureconsulti romani, trasmessa da Giustiniano; e poi anche la scienza dei giureconsulti che si sono avvicendati dall'età dei glossatori a Savigny, in misura variabile dipendente dalla prima. Grazie agli uni e agli altri, invero, a essere vigente in Europa è stato essenzialmente un diritto, qual è quello romano latamente inteso, individuato da un ceto di esperti secondo metodiche razionali, ma non prodotto, più o meno artificialmente, da questo: piuttosto, secondo un'acuta interpretazione della riflessione di Schmitt, da questo «pensato e con-saputo». Un diritto, per giunta, che, per il suo stesso modo di formarsi e affiorare, non porta con sé obiettivi predeterminati, tranne quello di essere ciò che è. Diversamente dal diritto visto in chiave positivistica, quale risultato di un'incessante attività legislativa di monopolio statale volta a scopi specifici, che, a iniziare dal XIX secolo, tende ad azzerare quello delineato dalla scienza giuridica. Consapevole che un ritorno a Savigny e alla centralità delle fonti giuridiche dell'antichità non sarebbe comunque possibile, perché «una verità storica è vera solo 'una' volta», ciò che Schmitt caldeggia invece con forza è una profonda rimeditazione sul ruolo che ancora la scienza del diritto è chiamata a esercitare: che è quello di tutelare l'unità e la coerenza del diritto stesso, di cui rappresenta «l'ultimo asilo», costantemente vulnerate dall'eccesso di produzione normativa. ; [Abstract] Between the years 1941 and 1944 Carl Schmitt, celebrated Kronjurist in the Third Reich at least till 1936, lectured on Die Lage der europäischen Rechtswissenschaft in several cities of the Old Continent. Such a seminar, issued in Hungarian in 1944 and in German just in 1950, is considered one of the strongest apologies of the legal tradition and, besides being astonishingly of great interest, it represents a very important document for whoever's interested in approaching the problematic figure of this scholar and above all, his complicated and troubled thought concerning law. The leading character of this work is the European legal science: this one was able for ages both to elaborate, on its own, the rules of law and to lead outer legal orders coming from an authority back to its core: and so did it, above all, as regards both Roman legal science (handed down by Justinian) and that legal science which, placed in dependence of the first one, beginning from Glossators' age, reached Savigny's. Thanks to both of them, indeed, Europe was ruled, essentially, by a law developed by a class made up of experts, on the ground of rational methods, and not by a law created, more or less artificially, by such a class. But, in a smart interpretation of Carl Schmitt's thought, law was «pensato e con-saputo» by those experts. Moreover, this law, given both its origins and its surfacing, pursues no aim, but to be what it is. And so it did differently from law which, deemed in a positivistic way (i.e. as an effect of a no-ending state-legislation turned to specific aims), has been inclined, since XIX century, to delete law regarded as result of legal science. Schmitt is aware that it is not possible to come back to Savigny and to the central role of ancient legal sources, since «the historical truth is true just once» and, consequently, he supports very warmly a new reflection about the main role the legal science is supposed to play: i.e. to protect unity and coherence of law, such as last shelter, qualities, these ones, hurt in a constant way by excessive legislation.
Questo studio di Stanislas Frossard parte dall'esposizione dell'evoluzione e del tenore del concetto di «politica giovanile» così come è andato sviluppandosi in Svizzera a partire dagli anni Settanta. Questa breve disamina consente quindi di identificare quattro dimensioni atte a definire diverse politiche giovanili, due delle quali (quella partecipativa e quella proattiva) sono destinate alla caratterizzazione delle procedure o delle modalità d'applicazione delle politiche, mentre le altre due (politiche d'incentivazione o di protezione e politiche trasversali) favoriscono la determinazione dei contenuti. Le politiche giovanili dei cantoni svizzeri sono descritte successivamente in funzione di tali caratteristiche. Un'analisi evidenzia alcuni legami intercorrenti tra le politiche cantonali e le circostanze della messa in agenda politica, la definizione dei problemi perseguita da tali politiche o la configurazione dei soggetti che hanno contribuito al loro sviluppo. Le descrizioni relative alla situazione nei singoli cantoni e l'analisi esplicativa consentono infine di enucleare alcune tendenze generali e di formulare delle raccomandazioni per i principali soggetti coinvolti (Confederazione, cantoni, comuni e associazioni).
Die in diesem Band versammelten Aufsätze rekonstruieren und analysieren einige historiographische Themenbereiche der Beziehungen zwischen Italien und Deutschland in der neueren Geschichte: Von den politischen und wirtschaftlichen bis hin zu den kulturellen und wissenschaftlichen Beziehungen, von der Debatte über Analogien und Unterschiede in der Geschichte der beiden Länder zwischen dem 19. und 20. Jahrhundert bis hin zum Problem des historischen Vergleichs. Die Geschichtsschreibung, die die italienische und deutsche Geschichte aus einer vergleichenden Perspektive oder im Hinblick auf die bilateralen Beziehungen analysiert hat, unterstrich zu Recht die zahlreichen Analogien und gleichzeitig die tiefgreifenden Unterschiede zwischen den beiden Nationen vom Zeitpunkt ihrer Vereinigung in der zweiten Hälfte des 19. Jahrhunderts. Die hier vorgestellten Beiträge zeigen die methodische und konzeptionelle Komplexität, die entsteht, wenn man versucht, die Geschichte zweier Länder zusammenzufassen, die in der neueren Geschichte intensive politische, wirtschaftliche und kulturelle Beziehungen geknüpft haben und in unregelmäßigen Abständen einen bedeutenden direkten und/oder indirekten Einfluss auf das jeweils andere Land ausüben. Die Aufsätze stellen dem Leser verschiedene Perspektiven der Forschung und der historiographischen Reflexion vor, um sich einerseits in der Geschichte der bilateralen Beziehungen und Kontakte (Andrea D'Onofrio und Filippo Triola) und andererseits in den Debatten der politischen Geschichte zu orientieren, die einige der umstrittensten Phasen der Geschichte der beiden Länder betreffen (Stefano Cavazza). Andrea D'Onofrio führt den Leser in die weite und vielschichtige Geschichte der zahlreichen Kontakte und Verbindungen ein, die Italien und Deutschland vor allem aus wissenschaftlicher und kultureller Sicht zwischen dem 19. und 20. Jahrhundert geknüpft haben; Stefano Cavazza, der über die Rolle des Führers in autoritären Regimen nachdenkt, bietet einen Beweis dafür, wie die vergleichende Geschichte ...
