Die Einführung des Eilschiedsrichters füllt die prozessuale Lücke, die im Rahmen des einstweiligen Rechtsschutzes vor der Bildung des Schiedsgerichts bestand. In der Investitionsschiedsgerichtsbarkeit ist dieser besondere Eilrechtsschutz eine Neuheit. Anhand der bisherigen Eilschiedsrichterverfahren in Investor-Staat-Schiedsverfahren werden die Funktionsweise dieses Rechtsinstituts untersucht und die sich ergebenden rechtlichen Probleme dargestellt. Um Lösungen zu erarbeiten, wendet die Autorin Methoden der ökonomischen Analyse des Rechts an. Diese Analyse veranschaulicht die dynamischen Interessenskonflikte in Investitionssachverhalten und eröffnet Möglichkeiten, wie sich die Effektivität des Eilschiedsrichter steigern lässt.

Trotz erheblicher internationaler Kritik und dem Vorwurf des Völkerrechtsbruchs hat die EU zum 01. Januar 2012 den Luftverkehr in das Europäische Emissionshandelssystem einbezogen. Rückenwind hatte sie kurz zuvor durch den EuGH bekommen, welcher die zugrunde liegende RL 2008/101/EG für gültig erklärt hatte. Längst wurden hierdurch aber nicht alle offenen Rechtsfragen geklärt. Der EuGH begründet seine Entscheidung im Wesentlichen damit, dass sich aus den vorgetragenen internationalen Abkommen keine Pflichten der EU ableiten lassen. Materiell-rechtlich prüft er lediglich einen Verstoß gegen das "Open-Skies"-Abkommen und eingeschränkt gegen das Prinzip territorialer Souveränität. Auch darüber hinaus verstoßen die EU und ihre Mitgliedstaaten durch die Einführung des Emissionshandelssystems für den Luftverkehr aber nicht gegen internationale Abkommen oder Grundsätze, namentlich das Kyoto-Protokoll, das Chicagoer-Abkommen, das WTO-Recht, oder das Völkergewohnheitsrecht. Zudem geht die oftmals geäußerte Kritik fehl, die EU habe sich für einen Alleingang außerhalb der vorgesehenen internationalen Institutionen, insbesondere der ICAO, entschieden und so international isoliert. Die Verhandlungsgeschichte auf internationaler Ebene zeigt, dass die EU aktiv an den internationalen Verhandlungen beteiligt war, diese sich aber als wirkungslos erwiesen haben. Support had been gained by a judgement of the ECJ, declaring valid the directive 2008/101/EC which legally supports the inclusion. Still, not all legal questions have been solved by this judgement. Die in der letzten Schiffbaustudie prognostizierten negativen Entwicklungen für die Beschäftigung im deutschen Schiffbau bestätigen sich in der aktuellen Erhebung. Die tatsächliche Situation stellt sich jedoch deutlich schlechter dar als es noch im Vorjahr abzusehen war. Im Jahr 2003 hat sich die Beschäftigungslage auf den deutschen Werften in Vergleich zu den beiden Vorjahren deutlich verschlechtert. Während in den letzten Erhebungen jeweils ein Zuwachs an Arbeitsplätzen in der Werftindustrie verzeichnet werden konnte, ist im Vergleich zum Vorjahr die Beschäftigung im Jahr 2003 um 5,1 Prozent gesunken. Im September 2003 arbeiteten nur noch 20.681 Menschen im deutschen Schiffbau. Auch die Zahl der Fertigungsstunden ist von 2001 auf 2002 um 23,5 Prozent gesunken. Für das Jahr 2003 muss von einem weiteren Rückgang ausgegangen werden. Die Beschäftigungssituation wird sich auch im nächsten Jahr voraussichtlich weiter verschlechtern. Nach gegenwärtigen Schätzungen muss mit einem weiteren Verlust von ca. 1.800 Arbeitsplätzen in 2004 (-8,7 Prozent) ausgegangen werden. Vier Werften befinden sich aktuell in einem Insolvenzverfahren. Auf diesen Werften sind aufgrund des ungewissen Ausgangs des Verfahrens akut 608 Arbeitsplätze in Gefahr. Für die ostdeutschen Werften wird die Situation in der internationalen Konkurrenz zunehmend kritischer, da die strengen Kapazitätsbeschränkungen weiterhin Bestand haben. Alle ostdeutschen Betriebsräte drängen auf eine Aufhebung dieser Regelungen. Vor dem Hintergrund der weltweit zu beobachtenden Konsolidierung in der wehrtechnischen Industrie zeichnet sich im Zusammenhang mit dem anstehenden Verkauf der HDW Werft auch eine Neustrukturierung des deutschen Marineschiffbaus ab. Der Ausgang dieses Prozesses wird entscheidend sein für die zukünftige Stellung des deutschen Marineschiffbaus innerhalb einer europäischen Rüstungsindustrie. Nach wie vor liegt ein zentrales Problem im globalen Wettbewerb, der durch die Preispolitik der koreanischen Werften stark verzerrt ist. Trotz der von der EU Kommission eingereichten Klage bei der Welthandelsorganisation (WTO) gegen Südkorea setzen die koreanische Regierung und die koreanischen Werften ihre offensive Kapazitätsausweitung verbunden mit einer Dumpingpreispolitik fort. Nach dem Scheitern des Welthandelsgipfels in Cancún ist eine außergerichtliche Entscheidung in dieser Sache in der nahen Zukunft nicht zu erwarten. Aufgrund der aggressiven Preispolitik südostasiatischer Werften haben die europäischen Werften weiter Marktanteile verloren. Ende 2002 konnten die EU Werften nur noch 7 Prozent der Marktanteile auf sich vereinen. ; The in the previous study from 2002 prognosticated negative employment trends in German shipbuilding industry had been confirmend by this study. Even more, the current situation is even more worse as foreseen in the last year. In 2003, the employment in German shipbuilding yards has been decreased by 5,1 %, compared with 21.796 jobs in September 2002. Now in September 2003 just 20.681 employees work in the German shipbuilding industries. Parallel to this the number of production hours has been dropped from 2001 to 2002 by 23,5 %. For the year 2003 another decrease must be considered. The employment situation will presumably be decreasing in 2004. According to estimations there will be another loss of 1.800 jobs in 2004. Four yards are in the current situation of bancruptcy (according to the German law of "Insolvenz"). Because of the not foreseeable outcome another 608 jobs are in danger. For the yards in the new laender (East Germany) the situation within the global competition is getting more critical insofar, as the strict EU limitations of capacities are still in power. The works councils of all these yards are demanding to abolish these regulations. On the background of the worldwide consolidation process of armanent industries, the German Naval Shipbuilding Industry will be reconstructed in the course of the selling of the yard HDW/Kiel. This sale will be decisive for the future standing of the German Naval Industry within the European Naval Industry. As in the last years, the aggressive capacity expansion and price policy of the Korean yards as one of the main problems of the global competition is remaining. Despite of the legal action by the EU Commission against South Korean dumping practices at the WTO, the Korean government and the Korean yards are going on with their policy. After the failing of the Cancun Meeting a compromise beyond the WTO court is not in sight. Due to this processes the European yards have lost further market shares - in the end of 2002 only 7 % of the World Shipbuilding market are concentrated on yards in the EU.

A particular point of contention in the current negotiations on the Transatlantic Trade and Investment Partnership (TTIP) carried out by the European Union and the United States is the question whether the European protected geographical indications for food should be enforced in the USA. The concern of the US Food and dairy industry is that products which have been so far produced and sold as 'Feta' or 'Gorgonzola,' may only be called 'Feta-like' or 'Gorgonzola-like' in the future. The political dispute over the protection of geographical indications in international trade law has become virulent in the negotiations in the Doha Round of the WTO (since 2001). The question asked is whether the protection of geographical indications is sufficient under the Agreement on Trade-Related Aspects of Intellectual Property Rights (1994). The European Union requires a certain protection reinforcement – a proposal to which the United States, Canada and Australia strongly object. The opposing positions are based on historical trends, divergent economic interests and different legal concepts. The different legal concepts in the world range from competition law to specific labelling law and to trademark law. A specific labelling law exists in the EU with a comprehensive und highly differentiated character compared to other protection concepts. It distinguishes between three categories of marks: designations of origin, geographical indications and traditional specialities guaranteed. In the case of designations of origin, all production stages have to take place in the same region (for example: 'Oscypek' smoked sheep milk cheese from Poland), 'Allgäuer Bergkäse' from Germany und 'Feta' from Greece). In the case of protected geographical indications only one production stage has to take place in a certain region (for example: 'Rogal świętomarciński,' pastry from Poznań and 'Spreewälder Gurken' from Brandenburg). In the case of traditional specialities, a guaranteed reference a certain region is not necessary, but a traditional recipe which has existed for 30 years is required. Geographical indications and traditional specialities which have been registered by the European Commission obtain EU-wide protection and are a legal interest to which not only all applicants but also all beneficiaries jointly are entitled (according to the specification of the product). Since the establishment of the European protection system, a number of judgments of the European Court of Justice have been delivered and served to resolve disputes and to clarify legal questions. Further, they also referred to the cultural differences in the production and consumption of foodstuffs. It remains to be seen how the conflict between the USA and the EU will be solved in the field of geographical indications. In this context a direct agreement on the mutual acceptance of this food regulatory regime could be obtained as full harmonization, as graded harmonization or as a flexible system of equivalence. ; Durante gli attuali negoziati svolti tra l'Unione Europea e gli Stati Uniti circa il Partenariato Transatlantico per il Commercio e gli Investimenti la tutela della denominazione di origine del prodotto alimentare costituisce un particolare punto di disaccordo: si tratta di stabilire se la tutela in oggetto, in vigore in Europa, dovrebbe essere introdotta anche negli USA. L'industria alimentare statunitense teme che i prodotti fabbricati e venduti finora sotto il nome di "Feta" o "Gorgonzola" possano essere chiamati solo prodotti "tipo Feta" o "tipo Gorgonzola". La disputa politica intorno alla protezione delle indicazioni geografiche nel commercio internazionale ha preso la forma più virulenta durante i negoziati svolti (dal 2011) a Doha nell'ambito dell'Organizzazione Mondiale del Commercio (WTO). Il dibattito riguarda la questione se le decisioni dell'Accordo sugli aspetti commerciali dei diritti di proprietà intellettuale (1994) risulteranno sufficienti nel caso di controversia circa la tutela della denominazione di origine geografica. L'Unione europea chiede che tale tutela venga introdotta, ma gli Stati Uniti, il Canada e l'Australia sono fortemente contrari a tale soluzione. Queste posizioni contrastanti derivano da fattori storici, interessi economici divergenti e diverse concezioni giuridiche, partendo da un approccio diverso nei confronti del diritto della concorrenza, per arrivare ad una particolare (specifica) legge sull'etichettatura e la legge che riguarda il marchio. Nell'Unione Europea vige una legge specifica sull'etichettatura complessa e molto diversificata rispetto ad altre concezioni di tutela. Si distinguono tre categorie di indicazioni: denominazione di origine, indicazione geografica e specialità tradizionale garantita. Nel caso della denominazione di origine tutte le fasi di produzione devono svolgersi nella stessa zona (per esempio "Oscypek", formaggio affumicato di pecora proveniente dalla Polonia), "Allgäuer Bergkäse" dalla Germania, oppure "Feta" dalla Grecia). Nel caso delle indicazioni geografiche protette, solo una delle fasi di produzione deve svolgersi in una data zona (per esempio "Rogal świętomarciński" – un cornetto tipico di Poznań oppure "Spreewälder Gurken" – cetrioli della Provincia del Brandeburgo). Nel caso delle specialità tradizionali non è necessaria una particolare zona di riferimento, ma una ricetta tradizionale che può vantarsi di almeno 30 anni di storia. Le indicazioni geografiche e le specialità tradizionali registrate dalla Commissione Europea (iscritte nel registro) vengono protette in tutta l'Unione Europea. Fin dall'inizio dell'introduzione del sistema di tutela europeo, la Corte di giustizia dell'UE ha emesso una serie di pronunce volte a risolvere le controversie e fornire chiarimenti giuridici, che allo stesso tempo si riferivano alle differenze culturali concernenti la produzione e il consumo dei prodotti alimentari. Aspettiamo di vedere come si risolverà la controversia tra l'Unione Europea e gli USA in materia di indicazioni geografiche. The Treaty of Lisbon will grant the European Union (EU) an exclusive competence for Foreign Direct Investments (FDI) as part of the Common Commercial Policy (CCP). The article outlines the historic background of the competence beginning with the EEC Commission's proposal for a regulation instituting a guarantee system for investments in third countries in 1972. The Commission hereby referred to the CCP as a legal basis. Attention is drawn to the revisiting of the topic in the context of GATT/WTO negotiations. The reasoning of the ECJ in its Opinion 1/94 clarified that FDI did not fall within the scope of the CCP. This resulted in continuous efforts of the European Community to extend the scope of the CCP. The different suggested approaches, drafts and proposals that were discussed during several Conferences of Representatives of the Governments of the Member States and sessions of the European Convent are entirely examined. The article focuses on the scope of the new exclusive competence of the EU. The term "Foreign Direct Investment" is defined by using recent ECJ decisions on the fundamental freedom of establishment, European secondary law and the definition of the OECD and the IMF. Especially a concept paper of the Working Group on the Relationship between Trade and Investment is regarded as important for the definition. It is concluded that a transaction will regularly qualify as FDI, when an investor owns 10 per cent or more of the shares or voting rights in a company. If an investor holds less than 10 per cent of the shares, the investment should be assessed by using a holistic approach that determines six criteria: representation in the Board of Directors; participation in policy-making processes; inter- company transactions; interchange of managerial personnel; provision of technical information and provision of long-term loans at lower than existing market rates. Befinden wir uns auf dem Weg hin zu einer internationalen Rechtsherrschaft - dem Äquivalent zur nationalen Rechtsstaatlichkeit?
