[Riassunto] Die Lage der europäischen Rechtswissenschaft s'intitola una delle conferenze che Carl Schmitt, acclamato Kronjurist del Terzo Reich almeno sino al 1936, tiene in varie città del vecchio continente fra il 1941 e il 1944. Pubblicata in ungherese nel 1944 e in tedesco solo nel 1950, essa, considerata come una delle più alte apologie della tradizione giuridica, costituisce un documento di straordinaria rilevanza per chi voglia accostarsi alla problematica figura dello studioso tedesco e in particolare al suo complesso e travagliato pensiero nel campo del diritto, rivelandosi nel contempo di sorprendente attualità. Protagonista ne è la scienza giuridica europea. Quella scienza che per secoli è stata capace di elaborare da sé il diritto, riuscendo a riportare nel suo alveo pure le statuizioni normative a carattere autoritativo provenienti dal suo esterno: e quindi, anzitutto, la scienza dei giureconsulti romani, trasmessa da Giustiniano; e poi anche la scienza dei giureconsulti che si sono avvicendati dall'età dei glossatori a Savigny, in misura variabile dipendente dalla prima. Grazie agli uni e agli altri, invero, a essere vigente in Europa è stato essenzialmente un diritto, qual è quello romano latamente inteso, individuato da un ceto di esperti secondo metodiche razionali, ma non prodotto, più o meno artificialmente, da questo: piuttosto, secondo un'acuta interpretazione della riflessione di Schmitt, da questo «pensato e con-saputo». Un diritto, per giunta, che, per il suo stesso modo di formarsi e affiorare, non porta con sé obiettivi predeterminati, tranne quello di essere ciò che è. Diversamente dal diritto visto in chiave positivistica, quale risultato di un'incessante attività legislativa di monopolio statale volta a scopi specifici, che, a iniziare dal XIX secolo, tende ad azzerare quello delineato dalla scienza giuridica. Consapevole che un ritorno a Savigny e alla centralità delle fonti giuridiche dell'antichità non sarebbe comunque possibile, perché «una verità storica è vera solo 'una' volta», ciò che Schmitt caldeggia invece con forza è una profonda rimeditazione sul ruolo che ancora la scienza del diritto è chiamata a esercitare: che è quello di tutelare l'unità e la coerenza del diritto stesso, di cui rappresenta «l'ultimo asilo», costantemente vulnerate dall'eccesso di produzione normativa. ; [Abstract] Between the years 1941 and 1944 Carl Schmitt, celebrated Kronjurist in the Third Reich at least till 1936, lectured on Die Lage der europäischen Rechtswissenschaft in several cities of the Old Continent. Such a seminar, issued in Hungarian in 1944 and in German just in 1950, is considered one of the strongest apologies of the legal tradition and, besides being astonishingly of great interest, it represents a very important document for whoever's interested in approaching the problematic figure of this scholar and above all, his complicated and troubled thought concerning law. The leading character of this work is the European legal science: this one was able for ages both to elaborate, on its own, the rules of law and to lead outer legal orders coming from an authority back to its core: and so did it, above all, as regards both Roman legal science (handed down by Justinian) and that legal science which, placed in dependence of the first one, beginning from Glossators' age, reached Savigny's. Thanks to both of them, indeed, Europe was ruled, essentially, by a law developed by a class made up of experts, on the ground of rational methods, and not by a law created, more or less artificially, by such a class. But, in a smart interpretation of Carl Schmitt's thought, law was «pensato e con-saputo» by those experts. Moreover, this law, given both its origins and its surfacing, pursues no aim, but to be what it is. And so it did differently from law which, deemed in a positivistic way (i.e. as an effect of a no-ending state-legislation turned to specific aims), has been inclined, since XIX century, to delete law regarded as result of legal science. Schmitt is aware that it is not possible to come back to Savigny and to the central role of ancient legal sources, since «the historical truth is true just once» and, consequently, he supports very warmly a new reflection about the main role the legal science is supposed to play: i.e. to protect unity and coherence of law, such as last shelter, qualities, these ones, hurt in a constant way by excessive legislation.

Aus diesem Anlass haben ihm renommierte Kollegen aus Europa, Amerika und Asien eine Festschrift zugeeignet. Wie Schabert selbst befassen sie sich mit dem Zusammenhang zwischen dem Persönlichen und dem Politischen, einem Thema, das von den systemtheoretisch orientierten bzw. auf empirische Exaktheit schwörenden Richtungen der Politischen Wissenschaften vernachlässigt wird. Politische und philosophische Theorien treten in einen fruchtbaren Dialog mit der Regierungslehre, wobei insbesondere das Verhältnis von Person und Institution in einem neuen Licht erscheint. Der Band enthält neben theoretischen Reflexionen zum Thema eine Reihe von Einzelstudien. Ihr Gegenstand sind Männer und Frauen der großen Politik, aber auch die Faszination des Politischen, wie sie Dichter und Denker erfahren haben.

Wissen und Macht sehen sich in der Wissenschaft in besonderer Weise miteinander verbunden. Erstens, da Wissenschaft immer auch von Subjekten betrieben wird, zweitens, da sie in Institutionen betrieben wird, wie Hochschulen, Schulen usw., die wiederum teil eines Staatsapparates sind, der hegemoniale Wissbarkeiten und die Feststellung, dessen was Wissenschaftlichkeit ist und Wissenschaftswert hat, steuert. Die Beiträge aus den Bereichen Didaktik, Diversity Mangement, Literatur- und Kulturwissenschaft, Pädagogik und Soziologie, die in diesem Band vereint sind, zielen auf eine queer-feministische Wissens(schafts)kritik ab. Nicht nur kritische und emanzipierende Forschung soll dadurch angeregt, sondern auch herausgestellt werden, wie vielfältige Lebensweisen erfahrbar, sagbar, wissbar und vermittelbar gestaltet werden können.
Der Band versammelt die Beiträge eines deutsch-italienischen Symposiums, das im Mai 2023 in der Villa Vigoni stattfand. Ausgangspunkt war die Europa-Rechtsprechung des Bundesverfassungsgerichts und die darin zum Ausdruck kommenden Souveränitätskonflikte. Die Kontroversen um die Rechtsprechung verweisen auf die tieferliegende Frage, welche Bedeutung (nationale) Souveränität in einem Mehrebenen- oder Verbundsystem eigentlich noch haben kann. Sind die Souveränitätskonflikte Ausdruck der Persistenz der Souveränitätsidee und beobachten wir gegenwärtig ihre Renaissance? Oder hat sich Europa im Gegenteil längst von der Idee der Souveränität verabschiedet und sind die Konflikte eher Rückzugsgefechte einzelner nationaler Akteure, die sich (noch) weigern, dies zur Kenntnis zu nehmen? Diese Fragen stehen im Zentrum dieses Sammelbandes, der in interdisziplinärer Perspektive die nationalen, europäischen, rechtlichen, ideengeschichtlichen und politiktheoretischen Gesichter der Souveränität erhellt. / »Faces of Souvereignty«: This volume brings together the contributions to a German-Italian symposium that discussed European sovereignty conflicts on the basis of the European jurisprudence of the Federal Constitutional Court. What is the meaning of sovereignty in a connected system? Are the conflicts a sign of the persistence of the idea of sovereignty or a retreat tactic of individual actors? This edited volume examines the faces of sovereignty from a legal, conceptual and political-theoretical perspective.
