Bowman en sus obras que no solo se limitó a la geografía física de los andes centrales de Sudamérica o los andes del sur del Perú, también recolecto mucha información sobre la opresión y explotación del indígena, del problema de la tierra y el latifundio, de cómo hasta la fecha donde el viajo se explotaba al indio sin ninguna retribución económica, ese quizás es parte de su legado sobre el estudio del Perú, porque sus obras fueron consultadas por diversos académicos peruanos y peruanistas al respecto de la sociedad andino – amazónica en los primeros años del siglo XX. Mención aparte es el proceso de modernización de la cartografía con la mejora de los procesos técnicos en el siglo XX, con ello su uso e importancia en la construcción de los estados y de la relación hegemónica de EE. La presente tesis confronta el proceso de transformación de Feliza Bursztyn, con el proceso de creación o mutación de su obra y los cambios generados en Colombia a finales del siglo XIX y principios del siglo XX. Orientándose siempre a identificar sí las experiencias personales de la artista y las condiciones del entorno influyeron o se vincularon a la concepción y configuración de sus esculturas con chatarra. Se realiza entonces una exploración sobre las experiencias personales y académicas de la artista, las características de su obra y las tendencias ideológicas, políticas, culturares y sociales de Colombia a finales del siglo XIX y durante el siglo XX. Prestando especial atención a biografías, exposiciones, análisis de la obra, aproximaciones a movimientos artísticos, comentarios y apreciaciones que se encuentran inmersos dentro de contextos políticos, sociales y culturales particulares. Dicha exploración se estructura en tres capítulos de la siguiente manera: En el primer capítulo se realiza un recuento cronológico de la vida de la escultora colombiana Feliza Bursztyn, a partir del cual se narran los acontecimientos familiares, artísticos, sociales y políticos destacados de la historia de la artista. Identificando de este modo aspectos relevantes de su búsqueda individual y aspectos asociados a la configuración de sus esculturas con chatarra. A nivel individual se rescata: la contradicción hacia el orden establecido, la mirada participativa, solidaria, interdisciplinar y cooperativa en el arte, su posición como mujer, judía, bogotana, madre divorciada, artista, amante de la literatura, integrante informal de grupos intelectuales de la época, científica, obrera, docente, con una ideología de extrema izquierda, defensora de la libertad, abierta a la diversidad, promotora del cambio, la renovación y la inclusión. En cuanto a la concepción y configuración de sus esculturas se reconoce: el conocimiento de las vanguardias Europeas, su vínculo con artistas plásticos, escritores, críticos del arte, directores de teatro, cineastas, arquitectos, periodistas, y su permanente exploración de las propiedades del metal, la chatarra y la soldadura, hasta el punto que el trabajo con el material llega a relacionarse con la vida misma. En el segundo capítulo se esboza un proceso de creación escultórica que hace referencia a los elementos conceptuales y materiales con los que se concibe y configura la obra de la escultora, para hacer visible como estos elementos se ensamblan, reestructuran o acoplan logrando presentar una idea, un deseo, un inconformismo, una opinión, un diálogo, una intervención, una puesta en escena, que deconstruye y reconstruye el sentido de la chatarra y el desecho industrial para presentar otra faceta de los materiales pobres y de los objetos manipulados. Reconociéndose de este modo la manera como la artista da valor a las esculturas con chatarra como producto de ensamblajes de recuerdos, realidades, imaginaros y reflexiones que circundan la existencia de la Artista, con el fin de comunicar, opinar, modificar o adaptar preceptos y espacios del contexto colombiano. Una vez planteados el origen y el proceso mediante el cual se conciben y se configuran las esculturas con chatarra, se determina el alcance de las mismas. En el tercer capítulo se expone la manera como las esculturas de Feliza se convierten en una propuesta de apertura y participación del proletariado en los diferentes ámbitos del país, al proponer con ellas otros caminos o modelos de acción frente a las situaciones que se presentaban. Por ello se hace el reconocimiento de la situación colombiana de principios del siglo XX, de sus problemáticas, de las acciones tomadas por la artista para afrontar dichas problemáticas, de las relaciones posibles entre el proletariado y su escultura, y de las propuestas de apertura y participación del proletariado gracias al trabajo con la chatarra. La discusión sobre la declinación americana ha generado una profusa literatura. Por ejemplo, un libro clásico fue publicado por Paul Kennedy, historiador británico y profesor de la Universidad de Yale. En "TheRise and Fall of the Great Powers" (RamdonHouse, 1987) el autor hace hincapié en la dinámica de "over-expansión" en la que sistemáticamente han caído los imperios y grandes potencias. Por otro lado, es también suficientemente amplia la literatura que duda o descree abiertamente de la declinación americana. Por ejemplo, podemos citar a los Profesores Michael Cox y Josef Joffe. Cox ha escrito breves pero profundos artículos (que se encuentran online) como "Powershift and thedeath of thewest? notyet!o "Is United States in Decline-Again? Es poco importante la salud financiera y empresarial de los EE.UU. y, en cambio, es demasiado importante los desafíos y amenazas que supondrán para los derechos individuales la aparición de un sistema capitalista autoritario que ha generado un inédito bienestar a amplios sectores populares en Oriente, particularmente en China.La declinación posee dos ámbitos geo-políticos (interno y externo). Dentro del ámbito o escenario interno, encontramos dos variables principales: la calidad de la política y la productividad de la economía. Ambas se encuentran, lógicamente, en el actor que supuestamente declina (EE.UU.) y en el o los actores que supuestamente ascienden (China). El éxito contemporáneo de los EE.UU. ha descansado en la interacción virtuosa de ambas variables. La calidad de la política (es decir, la vigencia de pesos y contrapesos) ha contribuido a la productividad de la economía. La posible declinación relativa descansa en la dificultad de mantener una economía altamente productiva frente a una política deficitaria. Por otro lado, la ascendencia china ha reflejado en esta nación una virtuosa interacción entre política y economía. A diferencia de la experiencia americana, el éxito chino ha descansado en una interacción que reflejaba una economía productiva porque había ausencia de pesos y contrapesos. In this thesis we discover a model of city developed jointly by the architect Mies van der Rohe and the city planner Ludwig Hilberseimer, which we have called the Metropolis as a Garden City. This name comes from a sketch by Hilberseimer in 1927, where we can see how he wanted to incorporate the architectural prototype of the Weissenhof colony in his city planning schemes. The Metropolis as a Garden City is a model of an ecological, sustainable, and socially just city, which remained completely hidden because of the disciplinary division their own authors established. To reconstruct it, we have decided to establish a double look analyzing the architecture of Mies through the eyes of Hilberseimer, and the city planning of Hilberseimer through the eyes of Mies. In the first part, we analyze the historical and cultural context where the Metropolis as a Garden City is produced, that is to say, its SUPERSTRUCTURE. From the analysis of a text by Mies and another by Hilberseimer, we discover that the antecedents of the Metropolis as a Garden City are in the theory of the Linear City by Arturo Soria (1882), and in the theory of the Garden Cities by Ebenezer Howard (1898). In the second part, we analyze the city planning model of the Metropolis as a Garden City. We arrive to the conclusion that the great contribution of Hilberseimer is produced in the field of the INFRASTRUCTURES, and we create the hypothesis that the first city planning models by Hilberseimer are applications of the theory of the Linear City. The next step was to introduce the variable of the landscape through the architectural model of the Weissenhof. In the third part, we analyze the transformation of the urban space from the architecture, which Mies calls STRUCTURES. Mies propose to redefine the texture of the city from the concept of mixed height, that is to say, mixing the architecture of the city and the architecture of the suburb. We create the hypothesis that this mixture is an application of the theory of the Garden Cities. The first example is the Weissenhof colony. In this thesis we discover a model of city developed jointly by the architect Mies van der Rohe and the city planner Ludwig Hilberseimer, which we have called the Metropolis as a Garden City. This name comes from a sketch by Hilberseimer in 1927, where we can see how he wanted to incorporate the architectural prototype of the Weissenhof colony in his city planning schemes. The Metropolis as a Garden City is a model of an ecological, sustainable, and socially just city, which remained completely hidden because of the disciplinary division their own authors established. To reconstruct it, we have decided to establish a double look analyzing the architecture of Mies through the eyes of Hilberseimer, and the city planning of Hilberseimer through the eyes of Mies. In the first part, we analyze the historical and cultural context where the Metropolis as a Garden City is produced, that is to say, its SUPERSTRUCTURE. From the analysis of a text by Mies and another by Hilberseimer, we discover that the antecedents of the Metropolis as a Garden City are in the theory of the Linear City by Arturo Soria (1882), and in the theory of the Garden Cities by Ebenezer Howard (1898). In the second part, we analyze the city planning model of the Metropolis as a Garden City. We arrive to the conclusion that the great contribution of Hilberseimer is produced in the field of the INFRASTRUCTURES, and we create the hypothesis that the first city planning models by Hilberseimer are applications of the theory of the Linear City. The next step was to introduce the variable of the landscape through the architectural model of the Weissenhof. In the third part, we analyze the transformation of the urban space from the architecture, which Mies calls STRUCTURES. Mies propose to redefine the texture of the city from the concept of mixed height, that is to say, mixing the architecture of the city and the architecture of the suburb. We create the hypothesis that this mixture is an application of the theory of the Garden Cities. The first example is the Weissenhof colony. Comentario del artículo de John J. Mearsheimer, "Imperial by Design", The National Interest, No. 111 (Jan/Feb 2011), pp. 16-34.Desde el fin de la Guerra Fría, Estados Unidos se ha visto envuelto en un continuo proceso de búsqueda, re-definición, y autocrítica con respecto a los lineamientos fundamentales de su conducta internacional. En un mundo ya sin la presencia de la Unión Soviética, la identificación de las amenazas a la seguridad nacional estadounidense se ha vuelto una tarea mucho más compleja, aunque aún muy necesaria. En paralelo a todo este proceso, las diversas perspectivas teóricas de nuestra disciplina juegan un rol fundamental en tanto que brindan herramientas analíticas no sólo para quienes debaten los asuntos políticos internacionales, ya sea en un aula o públicamente, sino también para aquellos que deben diseñar políticas y tomar decisiones en nombre del estado. Por medio de la colocación de ciertos acentos y de diversos niveles de enfoque, cada una de las grandes teorías de relaciones internacionales permite navegar el turbio mar del día a día de los asuntos internacionales; y en definitiva, ayudan a separar la hojarasca y lo anecdótico, de aquello que es más relevante.En el último número de The National Interest, John J. Mearsheimer, profesor de la Universidad de Chicago en los EE.UU. y exponente destacado de la vertiente más dura del realismo estructural, realiza una muy necesitada revisión, actualización y crítica del tradicional debate sobre las opciones estratégicas futuras de EE.UU. En principio, Mearsheimer logra captar magistralmente los aspectos centrales fundamentales de cada estrategia y relacionarlas con las distintas corrientes teóricas de la disciplina. Más importante aún, consigue destilar en cada caso las implicancias políticas a largo plazo de perseguir o no ciertas estrategias y explicaciones teóricas. Esto constituye, luego, la materia prima con la cual Mearsheimer moldea sus críticas al liberalismo y al neoconservadurismo estadounidense.En su artículo, John J. Mearsheimer plantea una lectura mordaz y contundente sobre el debate en torno a cada una de estas preguntas. Haciendo eco de sus credenciales realistas, Mearsheimer dedica gran parte de su trabajo a desbancar el "profundo sentimiento de optimismo acerca del futuro" (p.16) que ha llegado a predominar en EE.UU. desde el fin de la Guerra Fría. Este optimismo, Mearsheimer explica, puede verse con claridad tanto en el discurso político de estadistas como Clinton o Albright, como también en la prédica de pensadores, escritores y académicos como Francis Fukuyama y Charles Krauthammer. Ambos grupos por igual, según Mearsheimer, son los responsables por la instauración de un "consenso" liberal político y económico que, además de un "peligroso optimismo", buscan implantar de la democracia por el mundo, la profundización del proceso de globalización y la consolidación definitiva de un sentido de "fin de la historia". Según el autor, sin embargo, "los resultados han dejado al país en una situación desastrosa" (p.16).En lo que respecta a la política exterior estadounidense, Mearsheimer sostiene que existe un ya conocido conjunto de opciones estratégicas o diseños de "grand strategy" (Posen & Ross 1996/97; Kohout III et al. 1995; Nacht 1995) que emanan de la rica historia política del país, que se entremezclan con elementos de su cultura política, y que alimentan el actual debate sobre qué rumbo debe tomar el país de cara al siglo XXI (cfr. Russell-Mead 2002; Jentleson 2010; Dueck 2006). En resumidas cuentas, sostiene el autor, existen tres grandes tipos de estrategias identificadas por la literatura especializada: en primer lugar, y tal vez la más venerada por quienes ven en los Padres Fundadores valores y principios aún aplicables a la actualidad, existe la opción del aislamiento. Los elementos principales de esta primera alternativa son, según algunos de sus exponentes actuales (Tucker 1972; Nordlinger 1995; Gholtz et al. 1997), la concentración casi exclusiva en el Hemisferio Occidental como la zona prioritaria de los intereses vitales estadounidenses y la adopción de una actitud neutral y prudente frente a las posibilidades de expansión más allá de estos límites, en busca de ganancias económicas o poder. Una segunda opción estratégica es el involucramiento selectivo, la cual incorpora (además del Hemisferio Occidental) a Europa, Noreste de Asia y al Golfo Pérsico como áreas vitales donde EE.UU. debiera mantener una presencia militar clara y contemplar el uso de la fuerza llegado el caso extremo de ser ello necesario (Art 1991; Chase et al. 1995).En tercer lugar, la favorita de casi todos los realistas en EE.UU. (incluyendo a Mearsheimer): el equilibrio extra-continental. Esta tercera opción estratégica también pone el énfasis en las regiones de Europa, Noreste de Asia, Golfo Pérsico y, por supuesto, el continente Americano, pero con la importante diferencia de que la presencia militar en tales regiones debe hacerse de una manera más indirecta. En otras palabras, mientras que el involucramiento selectivo plantea para los EE.UU. un rol de sheriff o "policía internacional", patrullando estas regiones estratégicas y manteniendo una presencia vigilante constante "en las calles" de la política mundial, por su parte el equilibrio extra-continental plantea un rol ya no de policía sino algo más cercano al de "bombero internacional". A diferencia de un rol de policía mundial, un bombero no patrulla sino que permanece preparado en su cuartel de bomberos a la espera de la llamada de auxilio. Gracias a esta analogía, es posible observar que este otro rol planteado por la estrategia del equilibrio extra-regional, no obstante, demanda dos elementos cruciales: uno, que en cada una de las regiones consideradas vitales haya "tomas de agua" listas para ser utilizadas (es decir, presencia de aliados, bases militares, despliegue de flotas en los océanos cercanos, etc.), y dos, vecinos dispuestos a intentar "apagar el fuego" por sí solos de forma que, sólo una vez agotados todos sus recursos regionales, sea EE.UU. quien recurra a solucionar los problemas en dicha región. Puesto en términos más académicos, EE.UU. actuaría sólo como equilibrador de último recurso. Como se puede notar, la diferencia entre ambos roles no es menor ya que generan consecuencias políticas muy disímiles.Las tres opciones estratégicas mencionadas hasta aquí han sido comúnmente identificadas y discutidas en profundidad durante los últimos quince o veinte años por quienes estudian la política exterior estadounidense. En su artículo, sin embargo, Mearsheimer incorpora a la discusión dos nuevas estrategias: por un lado, la búsqueda de la construcción de un orden liberal internacional, y por el otro, la búsqueda de la construcción de un "imperio" norteamericano. La primera estrategia, netamente liberal, plantea una alternativa más viable y "americana", acentuando la promoción de la democracia (sobre todo en el Oriente Medio) y la defensa de las instituciones internacionales liberales. Dentro de este esquema, EE.UU. juega un rol central en tanto que representa el primer estado hegemónico en la historia de corte liberal, lo cual lo convierte, según el argumento, en un líder internacional benévolo y más pacífico. A su vez, y dado esto último, se vuelve posible la construcción de un orden mundial apoyado en el liderazgo estadounidense, a través de instituciones globales, que limiten y amplifiquen según el caso el poder de los estados. También central para esta corriente es la idea más reciente de la conformación de una "coalición de democracias" que aceleren y comanden la construcción de este orden liberal global (Ikenberry 2001; Slaughter 2004; Ikenberry & Slaughter 2006).La segunda de estas otras estrategias, la del "imperio", que en realidad posee una larga historia, durante los últimos años ha tomado una nueva relevancia gracias al resurgimiento del pensamiento neoconservador en EE.UU. durante la última administración Bush (Halper & Clarke 2004). Compartiendo ciertas premisas elementales con el liberalismo, como por ejemplo la idea de la promoción de la democracia (Kagan 2008), o el foco en Oriente Medio como objetivo central de aplicación (Kaplan & Kristol 2003), pero distanciándose principalmente en temas concernientes al rol y uso de las instituciones y del poder militar (Kagan & Kristol 2000), los neoconservadores proponen que EE.UU. haga uso directo de su preeminencia militar para pacificar la política internacional, construyendo una suerte de pax americana que solidifique este status quo particular en el tiempo. En definitiva, mientras la visión liberal de orden coloca a EE.UU. en el rol de líder, dentro de una coalición de potencias liberales, bajo un contexto de promoción de la democracia y con una autolimitación al poder emanada de instituciones internacionales estables; la visión neoconservadora, en cambio, coloca a EE.UU. en un rol más bien de imperio benévolo, ávido y listo para hacer uso de su preeminencia militar, y en total descreimiento de la utilidad de las instituciones internacionales en la consecución de este tipo de orden global.Al incorporar estas dos "nuevas" estrategias, debe reconocerse que Mearsheimer no sólo ha logrado enriquecer el debate sobre las opciones estratégicas estadounidenses, ampliándolo y actualizándolo aún más, sino que también ha permitido hacer una más clara y honesta (re)evaluación sobre los elementos teóricos detrás de cada una de ellas, y sobre las implicancias políticas reales de seguir ciegamente uno u otro camino. Frente a las más cruciales interrogantes de momento para quienes deben tomar decisiones en EE.UU., como por ejemplo: ¿Cuál es la mejor manera de solucionar el problema del terrorismo internacional?; ¿Cómo reaccionar política y económicamente al raudo ascenso de China en la escena internacional?; ¿Cómo administrar los vastos intereses globales estadounidenses con la actual crisis económica nacional e internacional?, Mearsheimer sugiere que la opción del equilibrio extra-continental u off-shore balance es la mejor manera no sólo de dar una respuesta a estas cuestiones, sino también al más acuciante dilema de cómo sostener el rol de preeminencia global de cual goza EE.UU. desde el derrumbe soviético. Y es aquí desde donde, tal vez, se pueda criticar a Mearsheimer desde una perspectiva sudamericana, si se quiere.Para Mearsheimer, la opción del equilibrio extra-continental se encuentra en una categoría única en sí misma, separado del resto de las demás (inferiores) estrategias. En principio, permitiría minimizar costos, maximizar beneficios, y volver más segura (y no más insegura) la actual posición de primus inter pares de EE.UU. Sin embargo, en palabras de Mearsheimer y de otros realistas contemporáneos (Posen 2007, Walt 2005), pareciera ser como si el equilibrio extra-continental realizara proclamas de superioridad tanto prácticas como morales en lo que respecta a la política exterior de la superpotencia que, en realidad, son altamente debatibles. A los ojos de Mearsheimer, esta estrategia permitiría no sólo solucionar el problema del terrorismo internacional, sino también los profundos desequilibrios fiscales estructurales del país y –más sencillo aún– la cuestión de la mala imagen estadounidense en el mundo. No obstante, existe un conjunto de serios problemas con la magnitud de estos alegatos: el caso de China y la paradoja del declive hegemónico.En lo que concierne al ascenso de China en la escena internacional, tanto Mearsheimer como otros realistas (Mearsheimer 2006; Layne 2008) se ven enfrascados en un dilema. Por un lado, son conscientes que China puede, o puede que no, llegue a desafiar la preeminencia estadounidense. En parte, uno u otro resultado se deberán a las decisiones de los líderes y estados involucrados en el proceso histórico. Sin embargo, como buenos neorrealistas, el particular énfasis que estos académicos ponen en la estructura no les deja muchas opciones a elegir más allá de la "inevitabilidad estructural" de un conflicto con China (Mearsheimer 2010). Esto, entonces, plantea una suerte de profecía de auto-cumplimiento desde la cual es difícil escapar desde el neorrealismo duro, y que, conjugado con la idea del equilibrio extra-continental, genera serias dudas sobre realmente cuán seguro haría a EE.UU. el perseguir tal camino. Asimismo, en lo que respecta a la durabilidad de la hegemonía estadounidense, la estrategia de equilibrio extra-continental plantea grandes ambigüedades.En su versión original (Layne 1997), el off-shore balancing era visto como la mejor estrategia para "administrar el declive hegemónico". Después de todo, la idea misma de esta estrategia fue repensada a partir de la experiencia británica en el siglo XIX y de cómo ésta potencia "administró" su propio declive con maestría y pericia. En manos de Mearsheimer, sin embargo, el equilibrio extra-continental es presentado como la mejor estrategia para prolongar la primacía de EE.UU. En otras palabras, para Mearsheimer esta estrategia se vuelve no una suerte de receta para superpotencias de la tercera edad, sino más bien una píldora para permanecer siempre joven. Con esto, también, Mearsheimer genera no sólo que sus enérgicas críticas a los "imperialistas liberales" y a los "imperialistas neoconservadores" se tornen más ambiguas, sino que también el respeto por la venerable tradición realista hacia el equilibrio extra-continental se esfume rápidamente, si no por desencanto, entonces por impracticabilidad. Si el foco más duro de la crítica de Mearsheimer hacia las demás estrategias se centra en que, al defender una forma de "imperio americano" éstas generan todos los problemas de seguridad actuales (como el terrorismo, la bancarrota financiera por el excesivo gasto de sostener un involucramiento activo permanente en el mundo, etc.), pierde sentido el proponer una estrategia "alternativa" que, de fondo, posee los mismos objetivos: permanecer en la cumbre. Al final del día, pareciera ser que no hay tantas diferencias entre liberales y "liberales con esteroides" (o neoconservadores), y quienes se dicen "realistas". En manos de Mearsheimer, el realismo deja de apoyarse en la idea del equilibrio como una herramienta de estabilidad internacional, y adquiere el potencial de convertirse en un medio alternativo para el mismo fin liberal y neoconservador de congelar la historia. En definitiva, la interpretación de Mearsheimer convierte la discusión en algo más banal; en un simple debate sobre distintos medios para alcanzar un mismo fin.En conclusión, la gran pregunta, que atraviesa transversalmente a toda la discusión sobre las opciones estratégicas de EE.UU. luego del fin de la Guerra Fría, al parecer sigue siendo ¿cómo pretender sostener una posición de preeminencia internacional sin devenir en un proyecto imperial en el largo plazo? Si la idea del equilibrio extra-continental ha de retener cierto valor y utilidad, es sólo en su versión moderada, proponiéndose un único y simple rol, más humilde y prudente, de ayudar a las superpotencias a declinar con dignidad. Es, en última instancia, una receta para las potencias en declive; una forma suave, gentil y honorable de dar paso a la historia. If not, then governments will be given incentives to constantly create crises, or perceptions of crises, and declaring "official states of emergency" in order to grab more and more power and money and destroy more and more liberty and prosperity'.United States Supreme Court (Ex Parte Milligan. 1866)IntroductionSince the September 11 attacks, the notion of state of exception has been used in order to coin the legal and political repercussions of the 'War on Terror'. These, by being labeled within the state of emergency's legal -or extralegal- framework, have been able to be constitutionally justified and, also, ethically criticized. Proponents of draconian measures consider that, in certain circumstances, necessity dictates policies aimed at protecting the State from terrorist attacks. They deem terrorism an imminent and serious threat capable of destroying the institutions that give political cohesion to society. Denying, suspending and limiting certain individual rights amount to a lesser evil; compared to the, apparently, almost certain greater evil that terrorists embody. On the other hand, advocates of the inviolability of the rule of law believe that under any situation a democratic government should allow urgency and peril prevail over the constitutionally recognized political and human rights. For them, counterterrorism should not rely on extralegal actions 'legitimized' by the state of exception. The State already has the legal and adequate tools, provided by the police and criminal justice, to persecute terrorists. Democracies that recur to lesser evil arguments to fight terrorism always end up committing more damage that the one they were trying to prevent.This essay will analyze the state of exception by studying the legal and the political-social natures of it. Various arguments, in favor and against the exception, will be showcased by continuously referring to the War on Terror and its effects on the legal system and democracy. Lastly, a conclusion will address the importance of this debate in current politics and society. The State of ExceptionThe state of exception or emergency can be studied under two different kinds of views: the legal and the political-social ones. The former defines the state of emergency, within the various constitutional frameworks of current modern democracies, as a temporary measure that limits or suspends certain individual freedoms within the territory of the State . It is prompted by a critical and imminent, domestic or foreign, threat to the State's existence. Under this scenario, necessity overcomes the 'normal' rule of law. Consequentially, individual freedoms are limited while police, security and military agencies' powers are enhanced. The debate regarding the state of exception's legal aspect circles around the constitutionality of its enactment, the variety of faculties attributed to the State's security forces and, more importantly, the personal rights suspension's lawfulness. Politically and socially, the state of emergency is conceived either as the pivotal attribute that defines the sovereign body as such; or, either as the transitional step required for -'legitimately'- transforming a democracy into a dictatorship. The former perception links the state of exception with the concept of sovereigntyunderstood as the State's existence as an organized polity . The latter one considers any type of restriction to individual freedoms as a permanent damage to the fabrics of democracy . The Legal Nature of the State of Exception The legal, and political, origin of the state of emergency is to be found in ancient Roman law. According to the lex de dictatore creando, whenever the Roman Republic was in grave danger, the Senate designated an extraordinary magistrate that was invested with absolute and total authority over the Republic . Subsequently, a provisional dictatorship was instituted that lasted for six months or until the threat passed. The republican and the dictatorship authorities, to the Romans, were complementary; quite the opposite of how democracies and authoritarian regimes are understood today. However, Roman dictators quickly learned how to indefinitely prolong their authority by perpetuating foreign wars through the creation of an Empire.The institution of the Roman provisional dictatorship is the historical legal inception of the various types of state of emergency that are currently present within modern constitutions. Broadly speaking, in every constitution the state of exception is declared by the head of the executive power whenever the normal functions of the State's institutions are no longer guaranteed because of foreign attack or domestic unrest. Fundamental liberties and rights -such as habeas corpus, freedom of movement and public gathering among others- are suspended or severely restricted. In most cases, the executive is entitled to order the arrest of individuals and to set military commissions for their trials. The security forces' faculties are enhanced and the military is allowed to take on police activities. Depending on the country, the state of emergency could be declared to last for days, months or years and it can even be extended indefinitely number of times . The debate concerning the state of exception's legal aspect comprises three main issues: its constitutionality; the amount of power given to the security forces; and, the limits set on fundamental freedoms, individual rights and constitutional guarantees. The state of emergency's constitutional validity considers under which cases it can be declared. As stated before, it is necessity that calls for the establishment of exception. It is necessary to give to the executive branch of government extraordinary powers and authority in order to prevent the State's breakdown from an imminent and grave danger. This peril can be prompted by a domestic or foreign threat. The latter are not sufficiently, and narrowly, defined by modern constitutions. Normally, they invoke a military invasion by a foreign country or an internal insurrection; but both of them are broad cases and can be loosely interpreted. Taking the U.S. Constitution, for example, the state of emergency is only referred to in Article I, Section 9 where it states: 'The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.'Therefore, only in the cases of rebellion –domestic threat- and invasion –foreign threat- the state of exception can be enacted. Regrettably, the Constitution does not define what constitutes a rebellion or an invasion. The task was left for legal experts and the Judiciary to tackle; but, it has not been easy or even coherent.The Supreme Court had the opportunity to take on the constitutionality of the state of emergency after President Lincoln had declared it in 1861 . In Ex Parte Milligan, it was decided that the suspension of the habeas corpus and the setting of military tribunals for citizens was unconstitutional because, even if a rebellion was in course, civilian courts were still operating. Additionally, the Supreme Court went even further by declaring that the theory of necessity, which justifies the state of exception, was false. It was argued that under the rule of law, guaranteed by the Constitution, the powers needed to protect the State's institutions are already set in place. Lastly, the Justices regarded the state of exception as a dangerous instrument that could only lead to despotism . Nevertheless, the Court did not pronounce itself about the issue of defining what constitutes a rebellion or invasion. Interestingly, even if it was deemed –correctly- that necessity never justifies the suspension of the rule of law, by not defining what constitutes an emergency, the Court considered the issue a political, and not a legal, matter . Rebellion and invasion remain broad, undefined, cases open to interpretation and to malleability by politics. In subsequent cases, the Supreme Court refrained itself from approaching the issue .The question of the security forces' enhanced powers, during the state of emergency, is a thornier one when compared to the former. Moreover, it is also deeply intertwined with the problem regarding limitations to fundamental liberties. During the state of exception the police and other security agencies are given extraordinary faculties aimed at facilitating the expedient resolution of the crisis. Therefore, they are allowed to search within premises without warrants, to arrest suspects without a court order, to hold individuals for a long period of time with no access to a lawyer or judge, to carry out aggressive interrogations, to set up wiretapping and close surveillance with no Judiciary control. Furthermore, it could also be the case that intelligence agencies and the military would be empowered to perform police and judicial activities. Since the declaration of the state of emergency by President George W. Bush, following 9/11, numerous enhanced and new attributes have been granted to the United States' security forces and agencies. Their faculties were augmented by several executive decrees and the three Patriot Acts. These pieces of legislation were said to be justified by the imminent and severe danger that terrorism embodied. But, are these prerogatives really needed to prevent future terrorist attacks? This is, of course, an endless debate; and one that again points out to the relationship between law and politics. As implied by the Supreme Court in Ex Parte Milligan, terrorists can be persecuted without declaring the state of emergency, by applying 'plain' criminal law and by letting the F.B.I -not the military- take the lead. To sum up, the 'normal' rule of law is perfectly suited for the task. However, depending on how terrorism is considered, as a war act or as a criminal one, is still a political issue.Just like in both the question of the constitutionality of the state of exception and the empowerment of security agencies, the concern regarding the suspension or restriction of fundamental liberties is one that is ascribed within the lesser evil debate. Legally, the selection between continuing the 'normal' rule of law or enacting the state of exception weights the possible damage that not acting would cause against the harm that limiting individual freedoms would produce . It is here where the legal concept of necessity comes into play. It is necessary to inflict or withstand a lesser evil in order to prevent a greater evil. This is the pragmatic view of constitutional freedoms: the risk of harming individual freedoms is a lesser one when compared to the possibility of not having any State that protects those liberties . The moral point of view argues that, by restricting constitutional freedoms, the State is causing an irreversible damage that may, quite possibly, be greater than the one that necessity is trying to avoid . When a state of exception is enacted the fundamental liberties that are suspended are, normally, the right to habeas corpus; freedom of movement; the right to public and private gathering; and the right to due process among others. The United States Government, during both the Bush and the Obama Administrations, restricted and suspended several individual freedoms and constitutionally guaranteed rights in order to effectively and speedily fight terrorism and avert further attacks. The rights to habeas corpus, to due process, to unnecessary cruel punishment and to trial by jury have been gravely and irreversibly hampered by the legalization of indefinite detention, targeted killing, aggressive interrogation and military tribunals respectively. In nearly all these cases, there is no chance of contradictory or revisionary procedures that would allow the dismissal of their establishment by proving their unfairness or unconstitutionality . The issue, maybe, is that they are not only unfair, but that they are unnecessary and cause permanent damage. Targeted killing and aggressive interrogation, which would be better labeled as targeted assassination and torture, are completely detrimental to the rule of law and set up dangerous precedents for the future. Since both measures have to be sanctioned, in each case, by the President and there is no possibility of revision, it could be argued that the executive is taking on the exclusive attributes of the other two branches of government. The check and balances system, designed to avoid despotic power, is totally disregarded in these cases . Here, the effects of necessity are clearly the greater evil.Depending on the country, the state of emergency or exception is labeled as martial law or state of siege (état de siège or estado de sitio). Both, however, share the same objectives and are justified by necessity. La presente tesis de doctorado se propone realizar una búsqueda de caminos pedagógicos para la selección, el empleo y la explotación didáctica de textos literarios argentinos en la enseñanza del español lengua segunda y extranjera (ELSE). Asimismo, expone recorridos para el abordaje de este tipo de textos desde los niveles iniciales de enseñanza y aprendizaje de esta lengua. Para ello, la tesis plantea un itinerario por bibliografía teórica referida a la adquisición de lenguas, examina los tres enfoques pedagógicos más actualizados —comunicativo, por tareas y orientado a la acción—, estudia los vínculos entre la lengua, la cultura y la literatura, así como analiza la manera en que ha sido tomada la literatura en la enseñanza de lenguas a lo largo de la historia, y considera los aportes de la teoría literaria a la didáctica de la literatura. A su vez, esta investigación se propone dejar en evidencia la escasez de materiales didácticos destinados a la enseñanza de ELSE que den cuenta de las variedades lingüísticas y culturales argentinas, y que incluyan, de forma manifiesta, textos literarios de escritores de esta procedencia. Además, la tesis justifica que, dada la creciente importancia del español en el mundo, esta insuficiencia de materiales didácticos —que respondan a las características que describimos— representa un área de vacancia que debe atenderse. Por este motivo, la tesis plantea propuestas didácticas que parten de textos literarios argentinos, con el fin de explorar caminos de abordaje de estos textos, para promover el desarrollo de las diferentes competencias en los alumnos, así como el perfeccionamiento de las cuatro destrezas lingüísticas (comprensión lectora y auditiva y producción escrita y oral). Conjuntamente, se destaca la funcionalidad de la literatura en el aula de ELSE para desarrollo de la competencia comunicativa intercultural (CCI), que debe ser considerada en el marco de las sociedades multilingües y multiculturales contemporáneas. Por otra parte, este estudio se posiciona, frente a los materiales literarios, con una mirada práctica y se propone plantear una explotación holística de este tipo de textos, que cubre el trabajo con diferentes aspectos lingüísticos, literarios, discursivos y culturales inherentes a las obras; sin descuidar la fruición estética que estimula la literatura. Al mismo tiempo, la tesis se propone dar cuenta de los resultados de la puesta en práctica de una selección de tareas elaboradas en el marco de esta investigación. De esta manera, este estudio se presenta como un aporte original en la medida en que plantea no solo la integración de teorías de diferente procedencia disciplinaria —orientadas al aprendizaje de ELSE y al empleo de los textos literarios en este marco de enseñanza—, sino también porque demuestra la aplicación práctica de estas teorías a través del diseño de las tareas que se exponen en esta investigación. Finalmente, esta tesis se posiciona en apoyo de las políticas lingüísticas que sustentan las variedades del español que se hablan en Argentina como válidas y auténticas y como portadoras de culturas particulares de gran valor. ; This doctoral dissertation explores pedagogical paths for the selection, use and didactic exploitation of literary texts for the teaching of Spanish as a second and foreign language (SL2/SFL). In addition, this study exposes ways of working with these types of texts for language learning at the introductory and upper levels. In view of this purpose, the thesis puts forward a bibliography of theoretical works in reference to language acquisition, and it also examines the three most current pedagogical approaches —communicative, task-based language teaching and action-oriented approaches—. Furthermore, it studies the links between language, culture and literature, and it analyses the ways in which literature has been applied in the field of second language teaching throughout history, taking into account the contribution of literary theory towards the didactics of literature. This research has the aim of highlighting the scarcity of didactic materials intended for the teaching of SL2/SFL that include Argentinian linguistic and cultural varieties, involving texts written by authors of this origin. In consideration of the increasing importance of Spanish in the world, this study argues that the shortage of didactic materials —as per the characteristics outlined in this dissertation— represents an area of deficiency that merits attention. For this reason, the thesis posits didactic proposals that start from Argentinian literary texts, with the objective of exploring different ways of working with them to promote the development of student competences, as well as to improve the four linguistic abilities (reading and listening comprehension, and oral and written production). What is more, the functionality of literature in the SL2/SFL classroom is highlighted for the development of the intercultural communicative competence (ICC), which needs to be considered in the context of contemporary multilingual and multicultural societies. From a position that views literary materials from a practical and holistic point of view, this dissertation covers the linguistic, literary, discursive and cultural aspects inherent to the literary texts, without neglecting the aesthetic fruition stimulated by literature. Additionally, this study has the purpose of demonstrating the results of the practical implementation of a selection of didactic tasks elaborated in this research. In this way, the present dissertation constitutes an original contribution to SL2/SFL research inasmuch as it presents not only the integration of theories of different disciplinary origins —oriented to the language learning process as well as to the use of literary texts in the teaching framework—, but it also demonstrates the implementation of these theories towards the design of tasks, as they are developed in this research. To conclude, this thesis takes a position in favour of the linguistic politics that support the diversity of Spanish language used throughout Argentina as valid and authentic, and as highly valued carriers of distinct cultures. ; Dans cette thèse de doctorat, nous proposons une réflexion sur les orientations pédagogiques à suivre pour la sélection, l'utilisation et l'exploitation didactiques des textes littéraires argentins dans l'enseignement de l'espagnol langue seconde et étrangère (EL2/ELE). Nous exposons dans ce travail de recherche également des pistes pour aborder ce type de textes dès les niveaux débutants d'enseignement et d'apprentissage de cette langue. À cet effet, nous proposons un itinéraire à travers une bibliographie théorique portant sur l'acquisition des langues ; nous examinons les trois approches pédagogiques les plus actualisées – l'approche communicative, par tâches et actionnelle – ; nous étudions les liens entre la langue, la culture et la littérature ; nous analysons également la manière dont la littérature a été perçue dans l'enseignement des langues au cours de l'histoire ; et nous considérons les contributions de la théorie littéraire à la didactique de la littérature. Parallèlement, ce travail de recherche met en évidence le manque de matériaux didactiques destinés à l'enseignement de EL2/ELE qui prennent en considération l'inclusion des variétés linguistiques et culturelles argentines, et qui incluent, de façon manifeste, les textes littéraires d'écrivains de cette diversité. De plus, étant donné l'importance de l'espagnol dans le monde, nous soutenons que cette insuffisance en matériaux didactiques – selon les caractéristiques que nous en donnons – représente un manque qui doit être comblé. Pour cette raison, la thèse offre des propositions didactiques qui partent de textes littéraires argentins, afin d'explorer différentes façons d'aborder ces textes, dans le but de promouvoir le développement des différentes compétences des étudiants, ainsi que le perfectionnement des quatre compétences langagières (la compréhension écrite et auditive et la production écrite et orale). Nous soulignons également la fonctionnalité, dans la classe de EL2/ELE, de la littérature pour le développement de la compétence communicative interculturelle (CCI) dans le cadre des sociétés multilingues et multiculturelles contemporaines. D'autre part, nous nous positionnons dans cette étude, au regard des matériaux littéraires, dans une perspective pratique et nous proposons une exploitation holistique de ce type de textes, qui comprend le travail sur différentes questions linguistiques, littéraires, discursives et culturelles inhérentes aux mêmes œuvres, sans négliger le plaisir esthétique que la littérature stimule. Ainsi, cette étude constitue un apport original dans la mesure où nous y proposons non seulement l'intégration des théories de différentes provenances disciplinaires – orientées sur l'apprentissage de EL2/ELE et l'emploi des textes littéraires dans ce cadre de l'enseignement –, mais également la démonstration de la mise en œuvre de ces théories à travers la présentation de la conception des tâches. Kennedy, writing for the majority, Citizens v Federal Election CommissionThe 2010 midterm elections cost a total of $4 billion dollars, including federal campaign spending by candidates and political parties raised in the two-year cycle 2008-2010, and funding by independent groups. Although the Democratic Party committees raised more money than the Republican Party, Conservative-leaning independent groups outspent Democratic-leaning group two to one. The US Chamber of Commerce, American Action Network, American Crossroads and Crossroads GPS, four "shadow GOP" groups, top the chart of independent donor groups, with two Democratic-leaning federal employee unions coming in a distant fifth and sixth, according to data reported by Opensecrets.org. The Supreme Court decision Citizens v. Federal Electoral Commission of January 2010 changed the law to allow corporations and unions to spend unlimited amounts of money on behalf of or against political candidates. If they choose to do so directly, they must report their expenditures and reveal their donors. Unions regularly report their donations to the Department of Labor and the FEC. However, corporations are loath to reveal their donors, so they take an easier and more enticing alternative made possible by the same ruling, which lifted an earlier ban that prohibited them to give money to nonprofit organizations. Referred to as501c organizations, these are groups that finance advocacy advertisements (also known as "issue ads" or "electioneering communications") and are not required by law to reveal their donors. Needless to say, an array of these new non-profits suddenly exploded into the political landscape and propped up the campaigns of the Tea Party newcomers and other Republican candidates who, oh so ironically, want to "change Washington from the inside." They were very successful in winning House races, but much less so in the Senate.In American politics, there are three main sources of campaign financing: money spent by the candidates themselves (form their own fund-raising or personal wealth), money spent by the party campaign committees on behalf of the party candidates, and money invested by outside groups who in general fund "issue ads" attacking or defending a candidate's record on issues but not explicitly soliciting the vote. In deciding by a 5-4 vote that corporations have the right to spend unlimited amounts of money for and against candidates, the Supreme Court transformed the electoral landscape in a way potentially more profound than it can be fathomed today. As many predicted, the Citizens United ruling unleashed the greatest wave of corporate spending in history, though it is probably safe to say that their spending in 2012 will make this year's outlay look modest. Although Democratic candidates raised more money and had a 60% spending advantage at the outset of the campaign, the new "GOP shadow" groups created outside the party overpowered them with their large, unrestricted donations. For example, American Crossroads and American Crossroads GPS, two organizations set up by political wonk Karl Rove spent at least $75 million on key House races. And although Labor unions in some cases matched that number in support of Democrats, the main difference lies in the fact that Labor unions do it openly, while the other "non-profit', "advocacy" groups operate anonymously. By law, they do not have to disclose their donors to the Federal Election Commission. Although it is true that most money is candidate- driven or party- driven and is therefore regulated, the rest, so called "soft money" that doesn't go directly to a candidate's campaign is now completely unregulated. As the tide turned decisively against the Democrats in the last two weeks before the election, Obama took aim at the anonymous flood of money by outside groups on behalf of Republican candidates, saying that it corrupts the process and provides an unfair advantage to their opponents. Along that same line of thought, many Democrats have claimed that the big winners of the election were not Tea Partiers and the GOP, but Big Oil, pharmaceutical corporations and insurance companies who have the most to lose from the President's reform agenda. Republicans prevailed in 75% of the House races in which they spent more than Democrats. But they were not so fortunate in the Senate, where the money impact was less or in some instances, even backfired.Money alone cannot sway an election, of course. But anonymous money can be much more effective in creating political furors over false information, for which there is no responsibility and little deniability, since the source is unknown. This is why revealing the source is important for the integrity of the democratic process. People need to know whose interests the newly-elected Congress will be representing. The huge number and clout of these undisclosed campaign financiers is arguably the most antithetical trait of a government of the people, by the people, for the people. Even more so in a year of populist anti-incumbent mood and new blood coming to Washington directly from the grassroots, to do away with appropriations, deny access to interest groups and balance the budget based on the best interests of, who else, but the American people?Indeed, to add plausibility to the above argument, money appeared to be much less effective when voters knew where it came from. A case in point is that of the self-funded millionaire candidates. Republican candidate Meg Whitman, former eBay CEO running for governor of California, spent $ 140 million of her own money (the most expensive race of all times and at all levels) and lost to District Attorney Jerry Brown (a former Democratic governor was has beaten two gubernatorial records in his lifetime, being the youngest governor when he was first elected in 1974 and the oldest one today). Similarly, Republican Linda McMahon, former CEO of the World Wrestling Federation, who was running for a Senate seat in Connecticut, also lost in spite of having spent 46 million of her own money. And the list goes on and on, with few exceptions. Of the 32 candidates who spent more than a million of their own money in a federal race, only 4 won.But this election is not only important for the obvious reasons, namely, that it may deny President Obama a second term and give a free hand for Republicans to repeal everything the White House has accomplished in these two years. There is another less conspicuous but not less relevant issue at stake. At the same time as they were voting for Congress representatives and some Senate seats, Americans in several states were also electing new governors and new state legislators. Republicans won 11 state governorships and seized 18 state legislatures that were previously in Democratic hands. These newly elected Republican state legislatures and governors will have the power of re-districting, that is, of re-drawing new political district boundaries of about 200 House districts in 2011. This is an opportunity that comes on the year after a federal Census, which is held every ten years, and that each party covets, since it enables the incumbent party to reshape the political landscape at the national level for a generation. Redistricting (or its corrupted form, "gerrymandering") is an obvious vice of the "Winner Takes All" electoral system and one that not many are interesting in reforming, since both parties take advantage of it when in power. In sum, the huge amounts of money strategically invested in this 2010 mid-term election delivered a Republican tsunami that affected all levels of government, put the next re-districting cycle safely in Republican hands and rebuilt party capacity for the near future. In the meantime, on Sunday night all pundits' eyes were on Sarah Palin's new reality show on The Learning Channel, "Sarah Palin's Alaska", where she goes hunting and fishing with her family and makes intriguing, but no doubt, very deep remarks about " Mamma Grizzly" and her protective instincts, as bear cubs pounce around in the creek to catch their salmon. This issue of the Review begins with an article by the Mexican economist Arturo Guillén Romo on the main tensions in the world economy and trade since the 2007-08 crisis and the recession of the following years. It highlights the loss of land of the United States in production, international trade and foreign direct investment, although preserving a clear military advantage. One conclusion that it is possible to extract the text is the configuration of a scenario in which it is plausible to expect a consolidation of control by the United States over its areas of influence, including Latin America, as part of its strategy against the European Union, Russia and especially China. In this context, the condition of EE. USA As a majority shareholder of the IMF, he raises an element of particular complexity regarding the strategy of re-profiling the external debt and vis-à-vis the multilateral organization, which represents one of the ingredients of the US-Argentina bilateral relationship. Guillén Romo's text allows us to discern the scenario in which Argentina will move, trying to take advantage of the reconfigurations of power relations at the global level. The following three articles approach the territorial dimension of social processes and the ways in which they are determined from different angles, but complementary. The text by Lucas Ferrero and Alejandro San José analyzes the formation of the Argentine socioeconomic and demographic structure and the dynamics of population agglomeration and expulsion from the periphery in the peripheral regions, stories from the Northeast and Northwest regions. In counterpoint from the territorial point of view but as a complement to the synergy between protocols and regulations, structural trends and performance of private actors, the article by Verónica Pérez and Jorge Sánchez sets its sights on the organization and performance of the motor transport sector public transport in the Metropolitan Region of Buenos Aires and its variations in the last ninety years, and the importance of this service in the design of the area throughout almost a century. For its part, the work of Letizia Vazquez, Sergio Andrés Kaminker and Renata Hiller reconstructs how a national public policy differentially impacts different territories according to local socioeconomic contexts and different actors. The differential results of the program in two localities allow us to affirm the importance of local networks when formulating a national policy. The popular economy, or social economy, has proven to be, in its multiple expressions and spheres of development, much more than a survival resource for those excluded from the labor market by the regressive dynamics of neoliberalism. The articles by Claudia Cabrera and María Victoria Deux Marzi focus from various angles on the rich problems offered by the articulation between popular organization, insertion in commercial relations and modalities of state intervention. Cabrera's research in the Buenos Aires suburbs aims to analyze the strategies of social reproduction of the homes of the popular economy that live in neighborhoods that were accessed outside the formal real estate market. According to the author, the popular economy finds its conditions of possibility in the territory; therefore there is a rationality of adaptation to the environment by those who join it; This means that it is not possible to explain the particularities of the reproduction strategies of households outside the territories they inhabit. Frequently the specificity of the modes of labor insertion in these contexts collides with the taxonomic systems of framing of the occupations of the workers; hence the inadequacy of conventional statistical categories to account for the variety of concrete situations that arise, thus posing a theoretical and methodological challenge to conventional forms of social research. Deux Marzi's article reconstructs the policies of the national state promoting the popular economy between 2015 and 2019, a period of government in sharp contrast, in this as in many other aspects of public policy, with which it preceded it. His vision encompasses both the public organizations that during that period managed the policies related to the sector, as well as the programs carried out, the actors involved and the various types of intervention. The author highlights the predominant orientation of interventions lacking a broader and more inclusive approach to the various modalities of the popular economy, which could have promoted productive and labor strategies. Obviously, the predominant paradigm in the theoretical and philosophical conceptions of neoliberal administration - centered on individualism, interindividual competition, entrepreneurship - went against the community and solidarity dimension, which is one of the central characteristics of the schemes of the economy. popular. The following two articles, although dedicated to different topics, raise the necessary adaptation of the large intellectual categories that guide the design of institutions and public policies, with the need to narrow the gap between these designs and their effective implementation, the product of a variety of factors derived from the scenarios or the actors involved in different ways in this dimension of politics. Matías Mattalini presents a case study of the system for the promotion and protection of the rights of children and adolescents in the province of Buenos Aires. In it, he distinguishes various paradigms or models of approach: social representations derived from practices, devices and structures that address the problem according to the dominant vision of an era. The author adopts the position of the coexistence of paradigms assuming that, when exploring the institutional daily life of organizations dedicated to this problem, a plurality of practices emerge that tend to establish from below an institutionality based on institutional co-responsibility. Appealing to the categories of analysis of the political philosophy of Raymond Williams, María Alejandra Bowman and Mariana Tosolini focus their gaze on the implementation of two public policies in recent Argentine history, in individual moments of profound sociopolitical and ideological differentiation, present in the policies under examination: the Adult Educational Reactivation for Reconstruction Campaign developed between 1973 and 1975, and the Youth with More and Better Work Program created in 2008. According to the authors, Williams' analytical categories contribute to clearing the dynamics of resignification of the policies, between the definitions formulated from the state instances, the administrative interventions of the policy managers, and the meanings that the subjects assign to the normative prescriptions from their links with the institutions, to their conceptions of the world and the way these are lived. A proposition whose scope goes far beyond the policies examined, insofar as it points to the conceptual and operational gap that usually exists between the design of policies and their effective implementation. ; Este número de la Revista se inicia con un artículo del economista mexicano Arturo Guillén Romo sobre las principales tensiones en la economía y el comercio mundial a partir de la crisis de 2007-08 y la recesión de los años siguientes. El texto de Guillén Romo, permite discernir el escenario en el que necesariamente habrá de moverse Argentina, intentando sacar ventaja de las reconfiguraciones de las relaciones de fuerza en el plano global. Los tres artículos siguientes abordan desde ángulos diversos pero complementarios la dimensión territorial de los procesos sociales y los modos en que éstos contribuyen a la producción de aquél. El texto de Lucas Ferrero y Alejandro San José analiza la formación de la estructura socioeconómica y demográfica argentina y las dinámicas de aglomeración y expulsión poblacional de la periferia en las regiones periféricas, considerando tales las regiones Noreste y Noroeste. En contrapunto desde el punto de vista territorial pero como complemento en cuanto a la sinergia entre intervenciones y regulaciones estatales, tendencias estructurales y desempeño de los actores privados, el artículo de Verónica Pérez y Jorge Sánchez pone la mira en la organización y desempeño del sector del autotransporte público de pasajeros en la Región Metropolitana de Buenos Aires y sus variaciones en los últimos noventa años, y la gravitación de este servicio en el diseño del área a lo largo de casi un siglo. Por su parte, el trabajo de Letizia Vazquez, Sergio Andrés Kaminker y Renata Hiller reconstruye el modo en que una política pública nacional impacta de manera diferencial en distintos territorios de acuerdo con los contextos socioeconómicos locales y los diferentes actores. Los resultadosdiferenciales del programa en dos localidades permiten afirmar la importancia de los entramados locales a la hora de formular una política de alcance nacional. La economía popular, o economía social, ha probado ser en sus múltiples expresiones y ámbitos de desarrollo, mucho más que un recurso de sobrevivencia para los excluidos del mercado de trabajo por la dinámica regresiva del neoliberalismo. Los artículos de Claudia Cabrera y de María Victoria Deux Marzi enfocan desde ángulos variados la rica problemática que ofrece la articulación entre organización popular, inserción en relaciones mercantiles y modalidades de intervención estatal. La investigación de Cabrera en el conurbano bonaerense tiene por objeto el análisis de las estrategias de reproducción social de los hogares de la economía popular que habitan en barrios a los que accedieron por fuera del mercado inmobiliario formal. De acuerdo a la autora la economía popular encuentra en el territorio sus condiciones de posibilidad; hay por lo tanto una racionalidad de adaptación al medio por parte de quienes se incorporan a ella; esto significa que no es posible explicar las particularidades de las estrategias de reproducción de los hogares por fuera de los territorios que ellos habitan. Frecuentemente la especificidad de los modos de inserción laboral en estos contextos entra en colisión con los sistemas taxonómicos de encuadre de las ocupaciones de los trabajadores; de ahí la inadecuación de las categorías estadísticas convencionales para dar cuenta de la variedad de situaciones concretas que se presentan, planteando de esta manera un desafío teórico y metodológico a las formas convencionales de investigación social. El artículo de Deux Marzi reconstruye las políticas del Estado nacional de promoción de la economía popular entre 2015 y 2019, un periodo de gobierno de fuerte contraste, en este como en otros muchos aspectos de las políticas públicas, con el que le precedió. Su mirada abarca tanto a los organismos públicos que durante ese periodo gestionaron las políticas referidas al sector, como los programas ejecutados, los actores involucrados y las variadas modalidades de intervención. Destaca la autora la orientación predominante de las intervenciones carentes de un abordaje más amplio e integrador de las varias modalidades de la economía popular, que podrían haber potenciado las estrategias productivas y laborales. Obviamente, el paradigma predominante en las concepciones teóricas y filosóficas de la administración neoliberal -centradas en el individualismo, la competencia interindividual, el emprendedorismo- iban en contra de la dimensión comunitaria y solidaria que es una de las características centrales de los esquemas de la economía popular. Los dos artículos siguientes, aunque dedicados a diferentes temas, plantean la necesaria adecuación de las grandes categorías intelectuales que orientan el diseño de las instituciones y las políticas públicas, con la necesidad de achicar el desfase de esos diseños y su efectiva implementación, producto de una variedad de factores derivados de los escenarios o los actores involucrados de diversa manera en esta dimensión de la política. Matías Mattalini presenta un estudio de caso del sistema de promoción y protección de los derechos de la niñez y la adolescencia en la provincia de Buenos Aires. En él distingue diversos paradigmas o modelos de abordaje: representaciones sociales devenidas en prácticas, dispositivos y estructuras que abordan la problemática según la visión dominante de una época. El autor adopta la postura de la convivencia de paradigmas asumiendo que, al explorar la cotidianeidad institucional de las organizaciones dedicadas a esta problemática, emerge una pluralidad de prácticas que tienden a instaurar desde abajo una institucionalidad basada en la corresponsabilidad institucional. Apelando a las categorías de análisis de la filosofía política de Raymond Williams, María Alejandra Bowman y Mariana Tosolini centran su mirada en la implementación de dos políticas públicas de la historia reciente argentina, en sendos momentos de profunda diferenciación sociopolítica e ideológica, presentes en las políticas bajo examen: la Campaña de Reactivación Educativa de Adultos para la Reconstrucción desarrollada entre los años 1973 y 1975, y el Programa Jóvenes con Más y Mejor Trabajo creado en 2008. De acuerdo a las autoras, las categorías analíticas de Williams contribuyen a despejar la dinámica de resignificación de las políticas, entre las definiciones formuladas desde las instancias estatales, las intervenciones administrativas de los gestores de las políticas, y los sentidos que los sujetos asignan a las prescripciones normativas a partir de sus vínculos con las instituciones, a sus concepciones de mundo y al modo en que estas son vividas. Una proposición cuyo alcance va mucho más allá de las políticas examinadas, en cuanto apunta al desfase conceptual y operativo que suele existir entre el diseño de las políticas y su efectiva implementación.
The instrumental use of Muslim women's experiences as a symbol and justification for Western countries interventions is not a new business and was not employed for the first time in the post September 11th "war on terror" campaigns. Indeed, the production of stereotypes of Muslim women in political platforms can be tracked back to different colonial enterprises. Clearly, as Lughod (2002) has highlighted, the consistent resort to a cultural framing through the equation women/religion/suffering has always been a tool to hide political and economic interests and consequently to bury more complex political and historical developments. In the academic sphere, debates on Muslim women also widened. However, as Lila Abu-Lughod (2002) contended, the efforts were almost put solely on denouncing the great violent and oppressive contexts where those women were living under the barbaric violations perpetrated to them by Islamist movements. Otherwise, if a scholar tried to problematize the cultural framing of Muslim women's questions, she (or he) would very likely be accused of cultural relativism (Lughod, 2002). Therefore, a sole and unproblematic focus on the suffering of Muslim women is not only futile, but also contributes to reify the old Orientalist perceptions on Islam and Muslim women, and to provide intellectual foundations for Western imperialist wars. The objective of this article, on the contrary, is to raise another set of questions, which I believe to be more urgent. These questions aim at both unpacking Muslim women as a discursive category, and understanding the major challenges their experiences impose on secular feminist conceptions of agency. I contend that addressing these questions is more urgent for different reasons. Firstly, I argue vigorously that apart from the obsessive and somehow blind criticism that religion is inherently patriarchal and consequently oppressive to women, scholarship especially from within feminist theory remained oblivious to a more systematic and self-reflexive engagement with religion and Muslim women. In addition, I argue that surprisingly, even in a period of post-Orientalist deconstruction, which supposedly would have already dismissed those essentialist and repressive accounts of Muslim women and Islam, subtle but very important remnants can still be found on the so called "corrective" postcolonial feminist scholarship on Muslim women. Indeed, there is a plurality of work on Muslim women in the social sciences. However, they are scattered and apparently separated by their own agendas and claims, with very few attempts at dialogue or debate. Hence, a systematic account of this diversity has been missing, one which could provide an up to date appraisal of the state of scholarship and activism on Muslim women, and build a firm foundation for advancing knowledge both of the subject itself and on interdisciplinary efforts like the one I advance here. Therefore, while doing a systematic and critical literature review, oriented specifically by an interdisciplinary approach, I expect this article to fill part of this gap and raise crucial questions in order to build knowledge of the intersection between Muslim women's studies and feminist theory. It is here where more research is certainly needed in order to reduce the gulf that exists between both areas. The introduction of this article outlines briefly the ways through which Muslim women have been approached as a discursive category, constructing stereotypes of Muslim women in political platforms, as well as on the academic stage. Politically, the production of stereotypes can be tracked back to different colonial enterprises and more recently to the interventions by Western countries that comprised the "war on terror" campaign. On the academic stage, these stereotypes were reproduced in the sole efforts to denounce the great violent and oppressive contexts where those women are living, as previously mentioned. The first section is concerned with the exclusion of religion and more specifically of Muslim women's experiences from history and feminist knowledge production, including IR feminist studies. I acknowledge that the ontological and epistemological openness in feminist and gender studies in international relations and other areas ensured the recognition of the existence of differences and of multiple "layers" of identities which affect sexed bodies in distinct ways. These were crucial to challenge Eurocentric narratives as the only legitimate source of knowledge production. However, I put forward in this section that despite a greater plurality in feminist studies, there is still a silence from feminist theorists regarding religious women's experiences, and hence, the importance of religion to women (Salem, 2013). Using the work of Phyllis Mack (2003) I argue that one of the reasons for this gap resides in the metanarrative of secularization, which is the basis of secular feminist scholarship. Within this analytical framework, I analyse how the conceptions of agency and emancipation underlying the different strands of secular feminism are limiting to the different voices and experiences of Muslim women. The second section addresses the challenges Islamic feminism imposes to feminist notions of agency. As religion is seen as inherently patriarchal and oppressive to women, Islamic feminism or any other effort to pursue gender equality from within an Islamic framework would be taken as contradictory or incompatible. By locating the struggle within a religious framework, and at the same time claiming for the existence of what seems to be the untouchable foundations of Islam, Islamic feminists are cast away from secular feminisms. I argue that those experiences of activists and scholars make serious challenges to the notions of agency based on rationality and secularity as the only pillars whereby women can struggle for and reach gender equality. As a result, Islamic feminism(s)'s experiences also help to unsettle and complicate some binaries which feminist theory has been contributing to reify, such as secular/spiritual; reason/obscurantism; science/religion; freedom/oppression; modern/backward. In the third section, the article discusses some of the piety women's movements anchored on Saba Mahmood's work on pietistic agency, firstly in order to highlight the inability of most feminist scholarship in capturing the diversity of Muslim women's voices; second to denounce the perilous nature of encapsulating women's agency solely within "the entelechy of liberatory politics". These movements advance very different agendas and orientations from the Islamic feminist ones. Those agendas are precisely what denounce the subtle but very important remnants of Orientalist assumptions, particularly its adherence to secular-liberal values, and the teleological conceptions of modernity (Lakhani, 2008). I conclude the article arguing that rather than neglecting the important achievements feminism promoted in the lives of women in different parts of the world, the main intention of this work was to provincialize (to borrow the expression from Chakrabarty) the secular and liberal accounts of agency, feminism, empowerment, freedom and so on, locating them in the historical, political and cultural context that produced the desires that animate them. ; Este artículo tiene la intención de abordar algunas preguntas importantes que apuntan tanto a desempacar a las mujeres musulmanas como una categoría discursiva, como a comprender los principales desafíos que sus experiencias imponen a las concepciones feministas seculares de la agencia. Por un lado, aparte de una crítica ciega de que alguna manera la religión es intrínsecamente patriarcal y, en consecuencia, opresiva para las mujeres, la producción intelectual feminista, incluyendo la producción feminista en el campo de las Relaciones Internacionales (RI), ha sido ajeno a las experiencias de las mujeres musulmanas y aparentemente indiferente a un compromiso y diálogo sistemáticos con el tema de la mujer y la religión. Además, a pesar de la capacidad de los feminismos poscoloniales, en su mayoría ancorados en lentes de deconstrucción pos orientalista, para capturar la "diferencia" en las voces de las mujeres musulmanas, parece que aún permanecen remanentes sutiles pero muy importantes de interpretaciones represivas de las mujeres musulmanas en esta literatura supuestamente "correctiva". Ciertamente, existe una gran pluralidad de trabajos sobre mujeres musulmanas. Sin embargo, están dispersos y aparentemente separados por sus propias agendas y reclamos, con muy pocos intentos de diálogo o debate. Por consiguiente, falta un relato sistemático de esta diversidad, que podría proporcionar un significativo estado del arte de la producción intelectual y el activismo sobre las mujeres musulmanas, construyendo una base firme para avanzar en el conocimiento tanto sobre el tema en sí, como sobre esfuerzos interdisciplinarios como el que se intenta hacer en este trabajo. Por lo tanto, mientras se hace una revisión sistemática y crítica de la literatura, orientada específicamente por un enfoque interdisciplinario, es esperado que este artículo llene parte de esta brecha y plantee preguntas cruciales para construir conocimiento sobre la intersección de los estudios de las mujeres musulmanas y la teoría feminista, donde más investigación es ciertamente necesaria para reducir el abismo que existe entre ambas áreas. La introducción de este artículo describe las formas en que se ha abordado a las mujeres musulmanas como una categoría discursiva. La primera sección se ocupa de la exclusión de la religión y más específicamente de las experiencias de las mujeres musulmanas de la historia y la producción de conocimiento feminista. La segunda sección aborda los desafíos que el feminismo islámico impone a las nociones feministas de agencia. Posteriormente, el artículo analiza algunos de los movimientos de mujeres piadosas anclados en el trabajo de Saba Mahmood sobre la agencia pietista, en primer lugar, para resaltar la incapacidad de la mayoría de los estudios feministas para captar la diversidad de las voces de las mujeres musulmanas; en segundo lugar, para denunciar lo peligroso de encapsular la agencia de las mujeres únicamente dentro de "la entelequia de la política liberadora".
Política monetaria en el Imperio Romano Tardío (284-711) tiene por objeto de determinar la naturaleza, causas y efectos de las mutaciones monetarias en esas coordenadas históricas. Se analiza cada una de las alteraciones, y se relaciona con su momento histórico, para comprenderlas y explicarlas según la política, administración, legislación y fiscalidad coetáneas. Se plantea en primer lugar, con carácter de introducción, la motivación y el objetivo de la tesis: la necesidad de un estudio riguroso que que permita acceder a una bibliografía tan abundante como compleja y alivie la ausencia de una síntesis interpretativa significativa acerca de este tema, basada en teoría económica y monetaria, que sirva de marco para comprender el proceso histórico. Partiendo del declive terminal del denario y del antoniniano durante la llamada crisis del siglo III, así como de las transformaciones económicas y políticas, fenómenos bien estudiados, proseguimos realizando una breve aproximación al problema historiográfico planteado por la diferencia de criterios a la hora de valorar las reformas monetarias de Diocleciano en relación con las anteriores y posteriores. A continuación, se repasa el marco teórico de la naturaleza de la moneda romana tardoimperial, empezando con los propios conceptos de dinero e inflación, y el grado de monetización de su economía, desarrollando la discusión historiográfica sobre esta cuestión, así como la situación administrativa y fiscal del Imperio Romano hacia el año 300. Se concluye la existencia de una economía que puede ser estudiada mediante la moderna ciencia económica y una disparidad entre los ingresos y los gastos que había de ser cubierta mediante la emisión de moneda inflacionaria. Sentadas estas bases, se prosigue con el repaso de la evolución del sistema monetario y las inyecciones de liquidez durante la Tetrarquía, las sucesivas guerras civiles y la época de Constantino (293-337), así como sus efectos, el más notorio de los cuales fue la subida de los precios. We analyze each one of those alterations, relating them to their historical moment, in order to understand and explain them within the politics, administration, legislation, and fiscality. The motivation and purpose of the thesis is firstly featured in the introduction: the need for a rigorous study that alleviates the absence of a significant interpretative synthesis on this topic, based on monetary and economic theory, that can be used as a framework for understanding the historical process and allows access to such an abundant and convoluted bibliography. Starting from the terminal decline of the denarius and the antoninianus, and the crisis of the third century, well studied phenomenons, we continue with a brief approach to the historiographic conundrum raised by the difference of criteria when assessing the monetary reforms of Diocletian in relation to the preceding and subsequent ones. Next, we study the theoretical framework of the nature of the Late Roman coinage, beginning with the concepts of money and money inflation themselves, the degree of monetization of its economy, reviewing the historiographic controversy on this matter, and the administrative and fiscal situation of the Roman Empire at the edge of the year 300. We conclude the existence of an economy that can be studied through modern economic science, and a disparity between the income and the expenses that had to be covered by the issue of inflationary currency. Once these bases are in place, we continue surveying the evolution of the monetary system and the injections of liquidity during the Tetrarchy, the following civil wars, and the era of Constantine (293-337), as well as its effects, the most notorious of which was the raising of prices. The evolution of contemporary administration and taxation is not neglected. Then we analyze the new devaluations and failed attempts to restore a strong billon coinage, and the evolution of gold and silver, under the dynasty of Constantine (337-367), followed by a period of political turmoil, and an absolute degradation of the small coins, which lost all its silver content, contemporary of the collapse of imperial power in the West, but that the pars orientalis managed to cope (367-498). Finally, after reviewing the restoration of a strong and stable bronze coin under Anastasius and Justinian (498-538), we detail the terminal years of Roman currency and taxation, with a succession of devaluations and ephemeral attempts of deflation over decades of wars against Iran and against Islam, that brought the end of the ancient world and the transformation of the late Roman State into an properly medieval epigonous, the Byzantine Empire (538-711). In the final section of general and particular conclusions we recapitulate how we have achieved an exact knowledge of the late Roman monetary policy and its overlapping with contemporary historical facts, based on an adequate understanding of the concepts of money and inflation, as well as the breakthroughs of each chapter.
President Obama enters the second half of his first year with very high approval ratings (high 50s to mid-60s) and nearly unanimous support within his own party. He continues to fight his battles for long-term change with discipline and rigor, ignoring possible distractions but also exercising pragmatism and the art of compromise. After his initial successes on the stimulus bill, tobacco regulation, employment discrimination and children's' health coverage, and in spite of questions raised on the mounting deficit, he recently managed to get the House to pass major legislation on energy and climate change, albeit by a narrow vote (219 to 212). His main strategy has been to lay out the general principles and parameters of his final objective and then let Congress write the legislation and fill in the details, thus giving legislators some latitude. Some question whether this strategy involves too much compromise, too many concessions to the other party and to interest groups, to the point that the final product is a watered down version of his initial proposal which will result too weak to solve the core problems. The irony for Obama is that some parts of his proposals that were considered central and non-negotiable are now on the table. A main example is the public option in health care legislation, according to which a government plan would compete with the rest of the private insurers, and consumers would be able to choose which one to buy. This type of competition would bring down the costs, which is one main purpose of health care reform. Republicans are adamantly opposed to this, but even some Democrats in Congress are becoming skeptical about it (the latter, mostly because they will have to face conservative constituencies in the next legislative elections of 2010), and even Obama now appears ready to compromise, if absolutely necessary. In contrast, there is immense support for this initiative all across the country. Does that mean that the actual center of the political public spectrum is today more to the Left than Congressmen and Senators of both parties recognize it to be? Or just that people really want change in health care, and cannot any longer be cowed into a corner by the boogey man of Big Government? Of course, there is a third and perhaps more obvious interpretation and that is that health industry groups exert more influence on Congress than the public itself. But at this time and on this issue the public is more mobilized and demanding than ever before, so Congress should take heed.Similarly, while Obama gets a positive response from the public as he continues to stitch together a broader view of how his proposals on health, energy and the stimulus package all fit together in the creation of a new foundation for the economy, the Republican Party appears bent on opposing him indiscriminately, denying him every possible venue to bipartisanship. That is the only position of strength for a weakened party.The "Party of No", as Rahm Emmanuel calls it, continues to block, sometimes successfully, every initiative the Democrats put on the table. There is a total absence of alternative policy proposals; instead, Republicans are just saying no to comprehensive change. Even as most interest groups convinced that change in health care and energy policies is inevitable are taking part in the negotiations, the Republican Party directive to its senators in the Senate Finance Committee -where health legislation is being discussed- is not to deal at all. The result is that Democrats are being pushed toward one concession after another, and that bad politics are getting in the way of good policy. This is an enormous achievement, if one considers the Republicans' lack of leadership and the personal woes of some of its potential leaders. But they have made no gains in the center and very few with independents. And unexpected events continue to shake the party's foundations.During the sleepy summer days around the Fourth of July, when most Americans go on vacation or take time off to prepare their cookouts and load up on beer and fireworks, the public was jolted by two stunning political developments, both coming from the Republican side and both bringing to a melodramatic end the careers of two potential presidential candidates: the five-day disappearance of South Carolina Governor Stanford, and Sarah Palin's resignation as Governor of Alaska. Governor Stanford, a "straight arrow" Republican with a picture-perfect family which he often paraded in front of the cameras, had always portrayed himself as a family man and a model of fiscal rectitude, going to the extreme of refusing to take the money allocated to his state as part of the stimulus package. After disappearing for five days during which his wife and aides claimed not to "know his exact location, but he was probably hiking along the Appalachian Trail and had turned off his Blackberry", he re-emerged and walked straight into the trap of a press conference. In front of the cameras, he rambled for twenty minutes about his life as a governor, husband of a wonderful woman and dad of four great boys, and asked for forgiveness for letting them all down …in the pursuit of an affair with an Argentine woman he had met in the world-renown resort of Punta del Este, Uruguay, in 2001. After explaining that this was not, in the end, a reckless act of adultery nor an irresponsible abandonment of office, but "a true love story" during which he had found his "soul mate", the Governor decided not to resign and to "try to fall in love again with his wife and continue his political career". We won't cry for him, neither here or in Argentina, but we wish him good luck. While infidelity and other human foibles are not limited to one side of the aisle, for the Republican Party, which claims a monopoly on morality and family values, the last two years must have been a hard trial: from Representative Mark Foley's "sexting" of underage male pages in Congress, to Senator Larry Craig's gay sex soliciting in a public restroom, to Senator Ensign's infidelity to Governor Sanford's Rio de la Plata escapade (unknowingly paid for by South Carolina taxpayers), the party has had its hands full with spinning the unspinnable, and will have a difficult time if it insists on exclusively continue carrying the torch for family values .And then there is Sarah Palin, who, in an equally rambling, bizarre and juvenile statement delivered in her well-known unique and colorful syntax and diction, decided to stun her party, her base and the country as a whole by resigning her governorship 18 months before the end of her term. (Please, no more scandals!)Whatever her motive, her timing for the GOP could not have been worse: not only was Palin the most galvanizing force for the Evangelical Christian base of the party, but with her departure, the party has lost three strong presidential candidates in one month. If we add to this the lamentable performance by Governor Bobby Jindal, another Republican rising star, when he responded to Obama's first State-of-the Union address, the party's presidential candidate landscape is quite deserted. Of course it is still early to talk about 2011 primaries, but considering that the two main pillars of the party, namely fiscal responsibility and family values, have been demolished,(the first by George W. Bush and the second by the peccadilloes and tribulations above recounted), there is a lot of heavy lifting the party must do to become competitive again. Like the Tories since 1997, the Republicans will probably have to lose two or three national elections before they can redefine themselves, charter a new course and become competitive again. The paradox of Republican opposition is that in the short term they have no other recourse but to strongly oppose Obama in the hope of chipping away some of his aura, while in the long term their big demographic problems with the young, women and minorities will force them to move to the center, modernize conservatism, abandon their unerring defense of pure, unrestrained capitalism and speak the language of community and common endeavors. Debemos enfrentar justamente con el aporte de la ciencia, la innovación y la tecnología, pero sobre todo con enfoque humanista y solidario, la construcción nuevos escenarios nacionales e internacionales apoyados en redes sociales solidas soportadas por una plataforma jurídica capaz de legitimar las necesidades de convivencia de manera igualitaria, equitativa, justa socialmente hablando, con un enfoque de derechos que genere confianza, trasparencia, inclusión y seguridad jurídica. Los directores tanto del Instituto como de la Revista de Derecho no escatimaron esfuerzos para hace posible en el actual contexto de pandemia y de crisis, sanitaria, humanitaria, alimentaria y climática mundial, esta nueva edición, justamente porque lo que necesitamos como países es, más ciencia, más investigación y más reflexión de nuestras realidades, lograr propuestas para superar los desafíos del SXXI. Los catorce (14) artículos que se desprenden muchos de investigaciones más amplias y dos (2) ensayos en temáticas de actualidad, logran un abanico de temáticas jurídicas que marcan la región como el país y el derecho español, los cambios que estamos sufriendo como sociedades y de que forma nos afectan en, nuestro estado de derecho, nuestra democracia y nuestro estado de derechos humanos en general. Bajo enfoque metodológicos diversos muchos sobre derecho comparado. En materia penal , se hace referencia a temáticas fundamentales como lo es el articulo número uno (1) con la "…la responsabilidad penal de las personas jurídicas en el nuevo Código Penal…, es un modelo que ha fracasado y poco sostenido por la Dogmática y por la jurisprudencia." ; el artículo dos (2) igualmente se logra "comparar desde una perspectiva jurídico-científica el rol de la Comisión Internacional Contra la Impunidad en Guatemala (CICIG) y de la Misión de Apoyo Contra la Corrupción y la Impunidad en Honduras (MACCIH)."; el articulo cinco (5) como propuesta se plantea "…promover la base de una Teoría del "ISN" (Interés Superior del Niño) que permita estudiar los supuestos que sustentan los derechos vinculados al interés superior del niño. Ostentando su derecho a una protección especial, durante el proceso penal, por su alta condición de vulnerabilidad…" ; el artículo número seis (6) analiza la perspectiva de genero en el nuevo código penal "…normativa penal aprobada a la luz de los desarrollos doctrinales en la materia, con el propósito de determinar, si la inclusión de estos elementos es suficiente para afirmar que el nuevo Código Penal cuenta con una perspectiva de género…"; articulo número siete (7) hace los análisis de los delitos y penas en el "… nuevo Código Penal contenido en el Decreto 130-2017, siendo ya el quinto Código Penal que rige los delitos y las penas en nuestro país; hecho histórico que consideramos no debe pasar inadvertido en la actividad académica, más aún cuando sabemos previo a su entrada en vigencia existió una gran polémica sobre la conveniencia o no de este nuevo orden normativo…" concluyéndose en esta temática con el articulo número nueve (9) tema que relaciona la corrupción privada en donde se hace "… la ponderación entre los intereses jurídicos que dicho delito debe proteger. Asimismo, la percepción que tiene la ciudadanía hondureña con respecto al delito de corrupción privada, con relación a introducir el tema en la dinámica hondureña." En materia de derechos humanos interesantes ilustraciones ; el articulo tres (3) presenta una publicación de caso marcando los "…elementos más relevantes del estudio y análisis de realizados en la resolución de la Novena Sala Regional Metropolitana del Tribunal Federal de Justicia Administrativa de los Estados Unidos Mexicanos, en la que reconoce la condición de refugiado a un solicitante de nacionalidad guatemalteca que se identifica como gay en un contexto de violencia y discriminación por orientación sexual e identidad de género, elaborando una definición de refugiado incluyendo un componente de género de conformidad de la normativa de origen tanto nacional -México- como internacional en materia de asilo …"; artículo número ocho (8) La tutela efectiva de derechos fundamentales "…determinar si la persona jurídica es beneficiaria o no de derechos fundamentales en Honduras, …examinando a su vez la doctrina constitucional sobre la teoría de atribución de titularidad de estos derechos, para así observar la realidad jurídico – constitucional hondureña a la luz de los principios y fines del texto fundacional…"; articulo número doce (12) Con énfasis en desarrollo sostenible y riesgo ambiental tenemos "…El estudio se justifica habida cuenta de las directrices establecidas por esta rama del derecho que permiten una transversalidad con las pautas del Derecho Ambiental, revelando algunos desafíos a los que se enfrenta la planificación frente a los riesgos emergentes y, la necesidad de promover la protección del medio ambiente para las generaciones actuales y futuras…"; articulo número catorce (14) como parte del estudio del contexto actual de pandemia sanitaria se presenta el examen de la responsabilidad internacional de China "…un hecho internacionalmente ilícito, la responsabilidad internacional de organismos internacionales universales y regionales en la dispersión del Covid-19 ya sea por acción u omisión, en estricta consonancia con la implicación de colaboración inexacta por parte de China en el estudio y divulgación oportuna de las consecuencias patológicas del Síndrome Respiratorio Severo Agudo Coronavirus 2 (SARS-CoV2 por sus siglas en inglés) en el ser humano, …" En materia civil ,un interesante trabajo publicado, en el artículo número cuatro (4) ,el proceso monitorio como medio efectivo para tutelar el derecho de crédito "…visión comparativa del monitorio español a efecto de conocer algunas reformas que se han producido en el mismo para procurar una mayor efectividad en su aplicación, todo esto considerando que la Ley de Enjuiciamiento Civil española sirvió de inspiración para la creación del CPC( Código Procesal Civil)."; así como el articulo número once (11) y su argumento del "…Secreto Industrial, actualmente con la competitividad tan desmesurada en el mercado internacional y nacional, cada vez se vuelve más utilizada por empresas de diferentes rubros, misma que por su esencia de secreto es muy codiciada para su obtención de manera ilícita, la normativa actual es insuficiente para hacerle frente a estas diversas prácticas de mala fe comercial, ya que la vulneran directamente, a diferencias de otras figuras de la propiedad industrial que cuentan con mecanismos protectorios,…" Al amparo de la temática de interpretación jurídica con un enfoque histórico, nos presenta en el artículo número diez (10) una publicación sobre los orígenes de interpretación constitucional en materia tributaria "…la crisis gestada en la Alcaldía Mayor de Tegucigalpa por la interpretación que varios pueblos indígenas dieron a ciertos artículos de la Constitución Política de la Monarquía Española, durante su segundo periodo de vigencia a partir de 1820…"; articulo número trece (13) la prueba anticipada analizada a través del "…derecho comparado para demostrar cual es la noción, que el mundo está teniendo en cuanto a la relevancia de las partes para resolver sus conflictos, asimismo ofrezco el mecanismo de la prueba anticipada como una nueva noción, con características de autonomía con la mera intención de información, influenciada principalmente por el derecho brasileño procesal vigente y de origen de Common Law." Finalmente en cuanto a la presentación de artículos científicos se refiere, se el problema del soborno como una crisis mundial. Esta práctica perniciosa ha estado presente a lo largo de toda la historia de la humanidad. En esta investigación se busca explorar los planteamientos éticos sobre el soborno así como sus efectos devastadores en la democracia y en el desarrollo de un país. Cerrando con dos ensayos uno sobre la inconstitucionalidad de la inmunidad parlamentaria derivada de la reforma a la ley orgánica del congreso nacional y el otro sobre las mujeres en política: hacia la reivindicación de los derechos políticos-electorales. Se reconoce el valioso esfuerzo de todos los investigadores al igual que a la dirección de la revisita por tan importante edición. Esperando sean citados los autores, en los trabajos futuros de investigación de los lectores y puedan llenar de valor las publicaciones.
The article by Chantal Medici that opens this issue of the magazine discusses critical contributions to the conventional theory of collective action inherited from the works seminars of Charles Tilly and the assumption of the sharpness of a hypothetical boundary between the public and the private, grouping them into three types of approach: those that emphasize the institutional activism of the State, those that do it in the construction of networks or communities of political attention and those that give special to the public / private articulation in the construction of the problem and in its implementation. Revised contributions are connected with a variety of approaches from Political Science, in particular the thesis of Lindblom on the relationship between states and markets in policymaking public, Migdal's statement about "the State in society" or, in our America, the Carlos Matus' theory on the complexity of the social game. Sofya Surtayeva's text shows the strategic role of the State in gestation and development of a public policy in a highly complex matter, in a country on the semi-periphery of the capitalism. Almost two decades ago our compatriot Hugo Notcheff demonstrated the close linking the dependent character of Argentine capitalism and the consequent fragility of science and technology policy, with the guidance of the economic leadership towards the appreciation of its capital by means of obtaining extraordinary profits from the exploitation of natural resources, the availability of cheap labor and the obtaining of subsidies and other state-owned, much more than the stimulus to innovation technological scientist and a policy aimed at its development. The corollary is a modernization of the economy based on the importation of innovations from the central economies, favored by close integration with foreign capital, with an effect on the fragility of scientific and technological development policies and the preservation of dependency. Taking as a common thread the role of the National Atomic Energy Commission in the development of nanotechnology the author shows the peculiarities of a process of innovation in a double facet: the promotion of an area of knowledge and the promotion by the CNEA of its own approach more akin to a sustainable development strategy and greater national autonomy. The article also provides a detailed approach to plurality of actors and interests, the relevance of leadership in the definition of politics and the gravitation of all this in the scientific-technological development and the insertion in the subject and the gravitation of the different possible responses in the insertion of Argentina in the global system. In this line of elaboration, Mariano Gil describes the public policies implemented in the province of Santa Fe to address problematic substance use. His work highlights the various public, private and community actors that intervene with unequal effectiveness in the construction of the problem, the incidence of that construction in the actions and organisms that will have to face it, the modifications that the adopted policy undergoes as it is being implemented and that same implementation introduces changes in the settings, in the subjects to whom it is addressed, in the state apparatuses and in the agents who are in charge of implementation. Bureaucrats, political decision-makers, non-governmental organizations, families, public security organizations, professionals and health technicians make up a wide range of subjects that intervene in the management of politics. For his part Miguel Alfredo and Pablo Granovsky deal with two experiences of training centers professional within the framework of actors that intervene at the intersection between education policies, labor policies and categorical organizations: the management cases of professional training policies of the UOCRA (Unión Obrera de la Construcción of the Argentine Republic) and the SMATA (Union of Mechanics and Transport Related Automotive). The article by Pablo Schamber and Francisco Suárez offers a detailed analysis of an experience of state / social actors articulation in the execution of a policy urban environment, through the inclusion of informal collectors of recyclable waste in the state policy of waste management. An experience that, in the opinion of authors, surpasses any other existing in the world. Beyond the specificity of their study topics, the three articles highlight the plurality of actors who participate from both "side" of the public-private differentiation in each of these topics, in the effort to configure a policy that is forever tool of a construction of power that, insofar as it institutionalizes some form of transaction between those who participate, is projected towards more broader than the specific ones. The promotion of public education is normally presented as a way for the reduction of levels of social inequality: a typical "window of opportunity". Judith Pinos Montenegro discusses this issue in her work on the promotion of basic education in Ecuador during the governments of the Citizen Revolution. The polysemy of the word equality stands out as it appears in official documents, increased due to the multiethnic nature of Ecuadorian society and the cultural contradictions and of class that are registered between public and private education. Jose Candelario Osuna García addresses the issue from the perspective of the temporary displacement of thousands of low-income Mexican families for work reasons, which leads to the interruption of the school career of the children and young people involved in these migrations and relativizes in this regard, the principle of equality in access to the right to education. Article focuses on the Education Program for Migrant Populations prepared by the government of the state of Baja California, in order to minimize the risks in terms of training school and cultural derived from the insertion of families in the cross-border structure of the labor market and the productive system. It is easy to see then that the mode of insertion in the social matrix conditions the effective access to rights. Poor peasants, migrant workers, native populations referred to in the preceding texts see their opportunities reduced education because of the position they occupy in that social matrix; in the absence of intervention state inequalities are strengthened because the educational system does not comply with these subjects the promotional function that should contribute to a change in their position in the structure. The political regime, with its own conception of equality, reinforces and expands or limits and neutralizes the dominant system of inequalities. Aristotle twenty-five centuries ago He emphasized that the prevailing ideas regarding equality and inequality and their causes vary according to the political regime, that is, to the organization and distribution of power. By changing the political regime, sooner or later the ideas of equality change, and therefore justice promoted by the State and public policies. The assumption in Uruguay in March 2020 of a neoliberal government implied important changes in policies social in general and care in particular, in sharp contrast to those that characterized to the fifteen previous years of government of the Broad Front. Ximena Baráibar Ribero analyzes the conceptualization of the new government's policy of assistance to populations in situation of poverty: a set of actions to encourage individual self-improvement and personal responsibility of those affected, and a residual role of the State. Poverty and inequality are, in the intellectual design of the new authorities, individual phenomena both in its causes as well as its effects. Social policies would have no other purpose than to facilitate a transit to individual opportunities that are assumed discursively, not discussed as reality and leave aside the question of the social, that is, collective, factors that create conditions for the gestation and development of individual situations. Carlos M. Vilas director ; El artículo de Chantal Medici con que se inicia este número de la revista discute contribuciones críticas a la teoría convencional de la acción colectiva heredera de los trabajos seminales de Charles Tilly y del supuesto de la nitidez de una hipotética frontera entre lo público y lo privado, agrupándolas en tres tipos de abordaje: las que ponen énfasis en el activismo institucional del Estado, las que lo hacen en la construcción de redes o co[1]munidades de políticas y las que dan especial atención a la articulación público/privado en la construcción del problema y en su implementación. Las contribuciones revisadas entroncan con una variedad de enfoques desde la Ciencia Política, en particular la tesis de Lindblom sobre la relación entre estados y mercados en la formación de las políticas públicas, el planteo de Migdal sobre "el Estado en la sociedad" o, en nuestra América, la teoría de Carlos Matus sobre la complejidad del juego social. El texto de Sofya Surtayeva muestra el rol estratégico del Estado en la gestación y desarrollo de una política pública en un asunto de alta complejidad, en un país de la semiperiferia del capitalismo. Hace casi dos décadas nuestro compatriota Hugo Notcheff demostró la estrecha vinculación del carácter dependiente del capitalismo argentino y la consiguiente fragilidad de la política de ciencia y tecnología, con la orientación de la cúpula del poder económico hacia la valorización de su capital por la vía de la obtención de ganancias extraordinarias de la explotación de recursos naturales, la disponibilidad de trabajo barato y la obtención de subsidios y otras preferencias estatales, mucho más que del estímulo a la innovación científico tecnológica y a una política encaminada a su desarrollo. El corolario es una modernización de la economía basada en la importación de innovaciones provenientes de las economías centrales, favorecida por la estrecha integración con capitales extranjeros, con efecto en la fragilidad de las políticas de desarrollo científico y tecnológico y la preservación de la dependencia. Tomando como hilo conductor el papel de la Comisión Nacional de Energía Atómica en el desarrollo de la nanotecnología la autora muestra las particularidades de un proceso de innovación en una doble faceta: el impulso a un área de conocimiento y la promoción por la CNEA de un enfoque propio más afín a una estrategia de desarrollo sostenible y mayor autonomía nacional. El artículo brinda asimismo una detallada aproximación a la pluralidad de actores e intereses, la relevancia del liderazgo en la definición de la política y la gravitación de todo ello en el desarrollo científico-tecnológico y la inserción en el tema y la gravitación de las diferentes respuestas posibles en la inserción de Argentina en el sistema global. En esta línea de elaboración, Mariano Gil describe las políticas públicas ejecutadas en la provincia de Santa Fe para el abordaje del consumo problemático de sustancias. Su trabajo destaca los varios actores públicos, privados y comunitarios que intervienen con desigual eficacia en la construcción del problema, la incidencia de esa construcción en las acciones y organismos que habrán de encararlo, las modificaciones que la política adoptada experimenta a medida que va siendo implementada y esa misma implementación introduce cambios en los escenarios, en los sujetos a quienes se dirige, en los aparatos del estado y en los agentes que tienen a cargo la implementación. Burócratas, decisores políticos, organizaciones no gubernamentales, familias, organismos de seguridad pública, profesionales y técnicos de la salud integran un arco amplio de sujetos que intervienen en la gestión de la política. Por su parte Miguel Alfredo y Pablo Granovsky se ocupan de dos experiencias de centros de formación profesional en el marco del entramado de actores que intervienen en la intersección entre políticas de educación, políticas laborales y organizaciones categoriales: los casos de gestión de políticas de formación profesional de la UOCRA (Unión Obrera de la Construcción de la República Argentina) y del SMATA (Sindicato de Mecánicos y Afines del Transporte Automotor). El artículo de Pablo Schamber y Francisco Suárez ofrece un detallado análisis de una experiencia de articulación estado/actores sociales en la ejecución de una política ambiental urbana, a través de la inclusión de los recolectores informales de residuos reciclables en la política estatal de gestión de los residuos. Una experiencia que, a juicio de los autores, supera cualquier otra existente en el mundo. Más allá de la especificidad de sus temas de estudio, los tres artículos destacan la pluralidad de actores que participan desde uno y otro "lado" de la diferenciación público-privada en cada uno de esos temas, en el empeño de configurar una política que es siempre herramienta de una construcción de poder que, en la medida en que institucionaliza alguna forma de transacción entre quienes participan, se proyecta hacia ámbitos más amplios que los específicos. El fomento de la educación pública es presentado normalmente como una vía para la reducción de los niveles de desigualdad social: una típica "ventana de oportunidades". Judith Pinos Montenegro discute este asunto en su trabajo sobre la promoción de la educación básica en Ecuador durante los gobiernos de la Revolución Ciudadana. Destaca la polisemia del vocablo igualdad como aparece en los documentos oficiales, incrementada por la naturaleza pluriétnica de la sociedad ecuatoriana y las contradicciones culturales y de clase que se registran entre la educación pública y la privada. José Candelario Osuna García encara el tema desde la perspectiva del desplazamiento temporal de miles de familias mexicanas de bajos ingresos por razones laborales, que lleva a la interrupción de la trayectoria escolar de los niños, niñas y jóvenes involucrados en esas migraciones y relativiza a su respecto el principio de igualdad en el acceso al derecho a la educación. El artículo enfoca el Programa de Educación para Poblaciones Migrantes elaborado por el gobierno del estado de Baja California, con el fin de minimizar los riesgos en materia de formación escolar y cultural derivados de la inserción de las familias en la estructura transfronteriza del mercado de trabajo y el sistema productivo. Fácilmente se advierte entonces que el modo de inserción en la matriz social condiciona el acceso efectivo a derechos. Los campesinos pobres, los trabajadores migrantes, las poblaciones originarias a quienes se refieren los textos precedentes ven reducidas sus oportunidades de educación por la posición que ocupan en esa matriz social; en ausencia de intervención estatal las desigualdades se potencian porque el sistema educativo no cumple respecto de esos sujetos la función promocional que debería contribuir a un cambio en su posición en la estructura. El régimen político, con su propia concepción de la igualdad, refuerza y expande o acota y neutraliza el sistema dominante de desigualdades. Hace veinticinco siglos Aristóteles destacó que las ideas predominantes en materia de igualdad y desigualdad y sus causas va[1]rían de acuerdo al régimen político, es decir a la organización y distribución del poder. Cambiando el régimen político, cambian antes o después las ideas de igualdad, y por tanto de justicia promovidas desde el Estado y las políticas públicas. La asunción en Uruguay en marzo 2020 de un gobierno de corte neoliberal implicó cambios importantes en las políticas sociales en general y asistenciales en particular, de fuerte contraste con las que caracterizaron a los quince años precedentes de gobierno del Frente Amplio. Ximena Baráibar Ribero analiza la conceptualización de la política del nuevo gobierno de asistencia a poblaciones en situación de pobreza: un conjunto de acciones de estímulo a la superación individual y la responsabilidad personal de los afectados, y un papel residual del Estado. Pobreza y desigualdad son, en el diseño intelectual de las nuevas autoridades, fenómenos individuales tanto en sus causas como en sus efectos. Las políticas sociales no tendrían otro fin que facilitar un tránsito a oportunidades individuales que se asumen discursivamente, no se discuten como realidad y dejan de lado la pregunta sobre los factores sociales, es decir colectivos, que crean condiciones para la gestación y desarrollo de las situaciones individuales.
