The practice of abortion, which has attained some very high figures indeed, surpassing the total number of deaths due to war or to the widespread genocide, makes modern society worthy of being qualified as humanicidal. The author of this paper, after pointing out the contradiction of a society which considers infanticide to be a crime a yet permits abortion, refers to the growing separation between legality and natural reality. Whereas the biological and genetic sciences demonstrate with irrefutable facts that there exists an independent human being from the very moment of fecundation, the legislative bodies on the other hand cling to criteria which is conventional (birth, v.gr. etc.), and thereby deny the unborn the right to life. An important fact to bear in mind is that in the question of abortion the rights and interests of the victim are completely ignored: the only interests upheld are those of the mother, or those of the State. This demonstrates that the root cause of abortion is in reality selfishness and haughtiness with regard to the most helpless of human beings. In this paper the principal pro-abortion arguments (ideological, socio-economical, eugenic, etc.), are studied, and in each case the inconsistency of the argument in question is pointed out. The common denominator of all of them is to make the unborn the scapegoat for unjust structures and unjust acts, a lack of love, or the rejection of all that which signifies a burden in the eyes of the man of today. Abortion is finally considered here as the last stage of the commercialization of sex, and of man's irresponsibility with regard to the use of the reproductive faculty. ; Advertencia previa. – 1. There is a clear progress and legal, political and social construction around abortion and its decriminalization, the bill passed by the Chamber of Deputies in Chile, is the first concrete and legislative act that a government performs after the amendment that in 1989, the dictator Augusto Pinochet formalized in article 119 of the health code, prohibiting abortion in all its forms. While this progress is seen in the adoption of the project seeking to decriminalize abortion in Chile, it is possible to note that compulsory motherhood clearly exceeds the three proposed causes; danger to the mother's life, lethal fetal inviability and pregnancy resulting from rape. Women will continue to abort in precarious and clandestine conditions, suppressed by the patriarchal system to a violent and accusing space, conditioned by archaic and sexist regulations, being tried by a murderous state. ; Existe un claro avance y construcción legal, política y social en torno al aborto y su despenalización, el proyecto de ley aprobado por la Cámara de Diputados en Chile, es el primer acto concreto y legislativo que efectúa un gobierno después de la modificación que en 1989, el dictador Augusto Pinochet formalizó en el artículo 119 del código sanitario, prohibiendo el aborto en todas sus formas. Si bien, ese progreso se observa en la aprobación del proyecto que busca despenalizar el aborto en Chile, es posible señalar que la maternidad obligatoria supera claramente las tres causales propuestas; peligro para la vida de la madre, inviabilidad fetal de carácter letal y embarazo producto de una violación. Socorristas en Red (feminists who abort) is a network of around fifty feminist organizations that attend abortions with medication in Argentina. Carrying out a risky political action within the struggles for the legalization, decriminalization, and legitimation of abortion, the network is configured as a feminist collective strategy supported by a series of political agreements where care assumes a prominent place. Based on the analysis of interviews and observations, this investigation delves into the notions of women's health care developed by the socorristas in two Patagonian provinces, Río Negro and Neuquén. We propose to analyze the network of collective practices that put into action a definition that stresses and challenges traditional notions of care. ; Socorristas en Red (feministas que abortamos) es una red de alrededor de cincuenta organizaciones feministas que realizan acompañamientos de abortos con medicación en Argentina. Desde el socorrismo se realiza una acción política arriesgada dentro de las luchas por la legalización, despenalización y legitimación del aborto que se configura como una estrategia colectiva feminista apoyada en una serie de acuerdos políticos donde el cuidado asume un lugar destacado. A partir del análisis de entrevistas y observaciones, en este artículo nos adentramos en las nociones de cuidado de la salud de las mujeres que desarrollan las socorristas de dos provincias patagónicas, Río Negro y Neuquén. Nos proponemos analizar el entramado de prácticas colectivas que ponen en acto una definición que tensiona y desafía las nociones tradicionales de cuidado. ; Socorristas en Red (feministas que abortamos) é uma rede de cerca de cinquenta organizações feministas que realizam acompanhamentos de aborto médico na Argentina. Com base na análise de entrevistas e observações, neste artigo, abordamos as noções de assistência à saúde de mulheres desenvolvidas pelas socorristas de duas províncias da Patagônia, Río Negro e Neuquén. Propomos analisar a rede de práticas coletivas que colocam em ação uma definição que enfatiza e desafia as noções tradicionais de cuidado.
This paper examines the roles of culture and virtues in medical ethics. It argues that principlism, which is the general approach to medical ethics in Western societies, is not comprehensive enough to fully understand how medical moral dilemmas are resolved in Western and non-Western societies. This is because principlism overlooks the importance of culture and virtues in the medical profession. To fully understand the nature of medico-ethical decision-making, we need to shift focus from principles to the virtues of the medical profession itself and the cultures of the societies within which medicine is practiced. I illustrate these claims with the example of abortion in Islamic ethics.
El presente trabajo de investigación, aborda el debate en torno a la reciente descriminalizacióndel aborto en la ciudad de México, capital de la República Mexicana, denominado por las leyesvigentes como interrupción legal del embarazo durante las primeras 12 semanas de gestación. Si bien desde la cultura mesoamericana el aborto procurado o consentido fue construido como un delito, los esfuerzos humanistas, especialmente durante la segunda mitad del siglo XX, han venido pugnando en todo el mundo, atendiendo a los derechos de las mujeres, a descriminalizar esta práctica social. Pero en realidades como la latinoamericana y especialmente en México, dado el sincretismo cultural con una Europa del sur radicalmente defensora de la moral y práctica del catolicismo renacentista, las reacciones del conservadurismo hoy identificado con la derecha política del país, que además se declara católica,han propiciado modificaciones legislativas en las entidades en donde gobiernan para mantener al abortobajo la amenaza punitiva. Por razones electorales, otras opciones políticas, incluido el PRD partido quegobierna en la ciudad de México, se han vinculado a esa cruzada. ; This paper approaches the debate concerning the recent decriminalization of abortion inMexico City, which is labeled, according to the existing legal norms, as lawful interruption of pregnancywithin the first twelve weeks of carriage. Even though, since Mesoamerican culture, consented abortion was constructed as a crime, the humanist efforts, especially during the second half of the 20th century, has fought worldwide looking out for women rights for the decriminalization of this social practice. But, in realities such as the Latin-American and particularly the Mexican one, because of its cultural syncretismwith a southern Europe as a radical defender of morality and Renaissance Catholic practices, the reactions of the conservative wing, today identified with the right political wing of our country, that has declared itself catholic, have brought about legal reforms in the States in which it governs, that hold abortion underpunitive threat. The following essay aims to convey a theoretical analysis that evidences the imbalance that underlies the discussion concerning abortion, regarding with rights and the fact of being a woman. The theoretical proposal responds to a framework of discussion among a biopolitical interstice, feminism and juridical theory, that is intended to convey the idea of exceptionalism that occurs over women's bodies when discussing the relationship among abortion, life and rights. Thinking of the idea of exceptionalism as guaranteeing will entail reconsidering the correspondence among women and legal order. ; La investigación tiene como finalidad dar cuenta de un análisis teórico que evidencie el desajuste que subyace a la discusión respecto del aborto, en relación a los derechos y el habitarse mujer. El emplazamiento teórico responderá a un marco de discusión entre intersticios biopolíticos, feminismos y teoría jurídica, que pretenden dar cuenta de una cierta idea de excepcionalidad que acontece en el cuerpo de las mujeres al momento de discutir la relación entre aborto, vida y derechos. Pensando la noción de excepcionalidad como garante que conllevará a replantearse la correspondencia de la mujer y el ordenamiento jurídico.
A la luz de los textos de la antropóloga Rita Segato, en este artículo se analizan los dispositivos que sustentan la falta de tratamiento legislativo de los proyectos que buscan legalizar el aborto en la Argentina. Se abordan, para esto, los sustentos simbólicos para la falta de inscripción legal de esta práctica, las tensiones que allí se despliegan, los sujetos en pugna y los terrenos de disputas. Asimismo, se analiza el papel del Estado –el traspaso del colonialismo al Estado moderno y sus implicancias en la privatización de las prácticas abortivas– y el rol de la ley como herramienta discursiva del mismo y como forma de sujeción de las mujeres. ; Under the light of the texts of the anthropologist Rita Segato, this article pretends to analyze the devices that sustain the lack of legislative treatment of the projects that pretend legalize the abortion in Argentina. The text aims to view the symbolic supports to the lack of legal registration about the abortion practice, the tensions in which they are deployed, the subjects in conflict, and the presented areas disputed, too. As of yet, there is no public statement from Executive informing whether it will sponsor any of existing proposals or it will introduced its own initiative. It remains a challenge if women's reproductive autonomy will be at the centre of the debate. ; Este artículo mostrará los caminos que se han seguido, con variadas perspectivas, para reformar la regulación del aborto en Chile. Al cierre de la edición de este artículo, se están tramitando propuestas de ley en el Congreso para regular el aborto por causales y un proyecto de Código Penal que tuvo entre sus antecedentes el aborto por plazo, que está recogido en la reciente iniciativa de un grupo de senadores. En este escenario, hasta el momento el Ejecutivo no ha dado luces sobre si avanzará con un proyecto propio o adherirá a algunos de los existentes. Cada una de estas posibilidades presenta interrogantes y múltiples desafíos para obtener su aprobación. This paper critically analyzes conscientious objection in the context of the new regulation of pregnancy termination in Chile. It affirms that adequate regulation should not be blind to the hostile context in which abortion rights have been enacted and the difficulties experienced. The bioethical requirements that seek to balance the interests involved must consider the legal regulation of the interests at stake, the context in which they are implemented and, fundamentally, the effectiveness of the solutions adopted. Attention should be paid to the risks involved in the proliferation of objections that are not serious and to the political use of conscientious objection to prevent the implementation of women's reproductive rights. Indescribing the process of entrenchment, strengthening and expansion of the conscientious objection in Chile, we show how this process has overprotected consciousness and the risks of undermining the effectiveness of the new abortion law, hindering and dilating the enjoyment of rights entrenched by the law. In response, regulatory measures are proposed to reverse this situation, which are obtained mainly from the bioethical literature on the subject and that look at the adverse context of the guarantee of women's sexual and reproductive rights. ; Este trabajo analiza críticamente el estado de la objeción de conciencia en el contexto de la nueva regulación de la interrupción delembarazo en Chile. Plantea que una adecuada regulación no debe ser ciega al contexto hostil en que dichas prestaciones han sido establecidas y las dificultades que el proceso para su establecimiento ha experimentado.Las exigencias bioéticas que buscan equilibrar los intereses involucrados de manera abstracta deben ser puestas en relación tanto con la regulación jurídica de los intereses en juego como con el contexto donde estos se insertan y, fundamentalmente, orientarse a garantizar la efectividad de las soluciones adoptadas. En particular, debe ponerse atención a los riesgos que conlleva la proliferación de objeciones que no revisten seriedad y a la utilización política de la objeción de conciencia con miras a impedir la implementación de los derechos reproductivos de las pacientes. Al describir el proceso de instalación, fortalecimiento y expansión de la objeción de conciencia en Chile, mostramos cómo esta ha implicado una sobreprotección a la conciencia y los riesgos de minar la efectividad de la nueva ley de interrupción del embarazo, entorpeciendo, dilatando y dificultando el disfrute de las prestaciones contempladas por la legislación. En respuesta, se proponen medidas regulatorias para revertir esta situación, que son obtenidas principalmente de la literatura bioética sobre la materia y que miran el contexto adverso a la garantía de los derechos sexuales y reproductivos de las mujeres.

This article intends to show that an adequate reading of general human rights theory should include abortion rights through the first two trimesters of pregnancy, noting that basic liberties can only be limited for the sake of liberty itself. It also intends to respond to those who claim that the abortion issue cannot be resolved, since the exact point in embryonic development that separates legitimate and illegitimate abortion cannot be determined. Potent moral arguments exist for an approach capable of reducing uncertainty and establishing a basis for legal reforms. ; Ninguna otra persona, en ninguna situación, es obligada a realizar el acto supererogatorio que se exige a la mujer embarazada. Aun cuando una adecuada aplicación de la teoría general de los derechos humanos permite reconocer el derecho al aborto durante los dos primeros trimestres del embarazo sobre la base de que los derechos sólo pueden restringirse por mor de los propios derechos. Este trabajo se propone recuperar una tradición de estudios del campo de la psicología que parte de pensar la problemática del aborto voluntario (en adelante AV) en función del deseo, el placer, los imaginarios sociales y las representaciones. En particular, pensamos la manera en que los estereotipos y las relaciones de género afectan a las decisiones de mujeres y hombres de llevar adelante conductas de prevención y cuidado de la salud reproductiva. Temática relacionada con el embarazo no deseado y, por consiguiente, con el aborto. En esta línea de reflexiones, podemos ubicar los trabajos de Martha Rosenberg (2017, 2013), Ana María Fernández (2012) y Débora Tájer (2006), quienes anudan la problemática del AV con el psicoanálisis, el feminismo y la política. Especialmente, nos centraremos en aquellas significaciones imaginarias sobre el aborto que se configuran en dispositivos políticos mediante mecanismos de culpabilización y fragilización que recaen sobre el cuerpo de las mujeres y personas gestantes. ; This paper aims to recover a tradition of studies in the field of psychology that starts from thinking about the problem of voluntary abortion (hereinafter AV) based on desire, pleasure, social imaginary and representations. In this line of reflections, we can place the works of Martha Rosenberg (2017, 2013), Ana María Fernández (2012) and Débora Tájer (2006), who tie the problem of VA with psychoanalysis, feminism and politics. The research aims to carry out a critical analysis of the revictimization of abortion due to rape in Ecuador, addressing the criminalization that women who decide to interrupt a pregnancy may suffer, since it is classified as a crime in Ecuadorian legislation. The figures of the criminalization of abortion are worrying, in the same way the intrafamily rapes, it is evident that the legislation punishes the victims when they try to abort an embryo product of a violation. Regarding the methodology, we worked under a quantitative, documentary-bibliographic approach. Regarding the results, it is considered as an alternative, despite the fact that the proposal did not prosper before the Assembly, via constitutional opinion applying interpretative parameters; determine if the criminalization of abortion is constitutional. Revictimization cannot be allowed in a constitutional state of rights and justice, as women's rights are violated, even considered human rights. ; La investigación tiene como objetivo realizar un análisis crítico de la revictimización del aborto por violación en Ecuador, abordando a la criminalización que pueden sufrir las mujeres que decidan interrumpir un embarazo, ya que está tipificado como un delito en la legislación ecuatoriana. Las cifras de la penalización del aborto son preocupantes, de igual forma las violaciones intrafamiliares, se evidencia que la legislación castiga a las víctimas cuando pretenden abortar un embrión producto de una violación. En cuanto a la metodología, se trabajó bajo un enfoque cuantitativo, de tipo documenta-bibliográfico. En relación a los resultados se considera como una alternativa, a pesar que la propuesta no prosperó ante la Asamblea, vía dictamen constitucional aplicando parámetros interpretativos; se determine si la penalización del aborto es constitucional. La revictimización no puede ser permitida en un estado constitucional de derechos y justicia, al violentarse derechos a la mujer incluso considerados derechos humanos.
