Three Essays on the Economics of Coordination
This thesis is a collection of three essays about the economics of coordination. Coordination issues arise when, in presence of multiple equilibria, heterogeneously informed agents need to coordinate with each other towards a Pareto-superior outcome. Electoral outcomes, collective decision-making, currency attacks or polit- ical regime changes examples of coordination problems. The first chapter provides a game theoretic analysis of group decision making, investigating how an agent's communication behavior is affected by different voting systems. I show that in an ideal state where communication is noisy but agents can communicate without opportunity costs, agents will always reach unanimous consensus regardless of which voting system governs the deliberative process. I further show that under the more realistic case in which communication involves opportunity costs, voting systems shape an agent's communication behavior. Specifically, when the opportunity costs of communication are low, a voting system based on unanimity approximates the results of the ideal state. Conversely, when communication involves high opportunity costs, a voting system based on majority is more desirable. The second essay is an experimental test of the predictions developed in the first chapter. The experiment is designed to determine how different voting institutions in uence the process of communication of collective decision bodies when communication can be costly. In contrast with the existing literature, I have found that different voting institutions induce different decision outcomes. In particular, a voting system based on unanimity fosters subjects' communication and information sharing. Once subjects choose to communicate, I also have observed that communication unambiguously improves the quality of the decision outcome across each voting rule. The third and final essay provides a political regime-change interpretation of the organized crime phe- nomenon. Under the assumption that the a criminal organization in a society benefits of the support of individuals, I investigate the strategic interplay between a criminal organization and a large number of citizens who might be more inclined to support the criminal organization rather than reporting its illegal activities to the legal authority. Borrowing from the economic literature on coordination and regime change, I model a criminal organization as an autocratic regime and claim that illegal activities are used in order to raise citizens support.

Il coordinamento dell'aiuto pubblico allo sviluppo, evocato negli ultimi anni da più parti come la soluzione alla deludente efficacia degli aiuti è in realtà un argomento che nasce quasi contemporaneamente alle prime organizzazioni internazionali dedicate allo sviluppo . La funzione ambivalente delle Nazioni Unite, agente di mediazione diplomatica da un lato (mediazione tra stati e tra gruppi di potere all'interno dello stesso stato), e agente di sviluppo dall'altro, garantisce all'organizzazione un ruolo preminente nel coordinamento degli aiuti nei contesti di guerra e di post-conflitto. E' questa stessa ambivalenza che impone all'organizzazione un rapporto ufficiale con i territori sottosviluppati, incardinato nella relazione con i governi centrali degli stati. La critica radicale all'aiuto pubblico allo sviluppo individua tutte le distorsioni politiche ed economiche legate all'afflusso dei fondi, sottolineandone le aggravanti possibili laddove esista una discrasia tra gli obiettivi di sviluppo delle Nazioni Unite e quelli dell'élite che occupa le posizioni apicali dello stato. Questa ricerca attraverso un'analisi storica del contesto, mette in luce l'interazione tra il sistema degli aiuti e il sistema-paese in Tajikistan dall'ingresso delle organizzazioni ai giorni nostri. L'analisi dimostra infine che la struttura politico-economica radicata sul territorio, pur conservando i tratti di uno "stato predatorio" (tratti non alleviati bensì aggravati dalle distorsioni legate all'afflusso dei fondi per lo sviluppo), sfugge in realtà alla definizione stessa di "Stato". Questo dato rivela una debolezza insita nell'approccio metodologico del sistema degli aiuti che si fonda proprio sull'archetipo dello "Stato". ; The Official Development Assistance (ODA) coordination has been recently launched as a genuine mean to increase aid effectiveness. Actually, the "aid coordination" paradigm was born almost contemporaneously to the first international organizations dedicated to "development". The ambivalent function of the United Nation that acts both as an agent of diplomatic mediation (among states and among different lobbies within the borders of the same state), and as a development agent, guarantees to United Nations a preeminent role in the field of aid coordination in conflict and post-conflict contexts. It's this real ambivalence that compels the United Nations to deal with development countries through official relations with the central governments. The radical critique to development aid shows different political and economic distortions related to the incidence of foreign funds. At the same time, it underlines that wherever the goals of the official governments diverge from the development goals of the aid community these distortions might be even more burdensome for the country. This research, through an historical analysis, draws attention on the interaction among the development industry and the country-system in Tajikistan from the arrival of the international organizations to our days. The analysis demonstrates that the political and economic structure of the country, while maintaining the features of a "predatory state" (features which are not alleviated but worsened by the distortions brought about by the aid industry), simply do not comply with the definition of a "State". This result highlights an innate weakness of the aid industry methodological approach that is in fact, fully based on the political archetype of the "State".

Il pensiero giuridico di Kelsen: normativismo e diritto privato

The paper takes into account a feature of Hans Kelsen's juridical thinking that has been so far rather underestimated: the weight of normativism on his theory of private law. The author closely connects Kelsen's critical approach to the notion of subjective right and further relates the legal norms to the institutions of the market economy. The interepretative assumptions of Kelsen are constantly confronted with the theoretical background that propelled the development of the modern constitutional state based on the rule of law.
Stanley Cavell e la pretesa come paradigma di razionalità
Since Rawl's A theory of justice, political philosophy has been haunted by the moral and epistemic problem of justification. The growing awareness of the irreducibility of human disagreement has increased a sense of uneasiness towards the ambivalence of pluralism (a requirement for the flourishing of individuals and a constant source of conflict) that, in turn, has fostered the hope that rationality, in its public use, could help us in grounding the social order on more stable basis. Although Stanley Cavell is not usually considered a significant participant in this debate, through his work he has developed an original and strong interpretation of the nature of justification and rationality. Cavell's search for a new conception of rationality starts from an analysis of the rationality immanent to the use of ordinary language. This model of explanation, whose origins are to be found in the teaching of Wittgenstein and Austin, is then extended and articulated through an analysis of aesthetic judgment. This vantage point is successively used by Cavell in order to redefine the epistemological categories of political and moral philosophy. Cavell's moral and political philosophy is based on an original account of practical rationality and justification built over the concepts of claim, articulation and expression. As Cavell himself has never offered a complete account of his theory of rationality, in this paper I provide a wide reconstruction of the linguistic, aesthetic and moral steps through which this theory has been developed.

Autorita ed efficienza: e possible un'economia del diritto pubblico?

This article explores the possibility of applying the tools of economic analysis of law, which are traditionally used in the field of private law, to public law as well. The first part investigates constitutional law issues, addressed by prevailing approaches through the social contract framework, by applying an agreement model to a general public good such as the State. This model is typically based on games with features of the 'prisoner's dilemma.' Through the analysis of constitutional preferences that may transform such dilemma in a game with full cooperation equilibrium, two types of preferences are compared: 'utilitarian based on impartiality principle' & 'rawlsian based on difference principle'; it is shown that this second type better facilitates the constitutional agreement. With the objective of utilizing more easily economic theory tools, the article then attempts to apply the distinction between private & public good to that between private & public rights. In particular, both public goods & public rights can be assimilated as they are non-excludable & non-transferable through exchanges or contracts. Moreover, an attempt is made to define an economic counterpart to the juridical notion of 'general interest' which is the basis for those norms in the fields of public & administrative law envisaging the direct intervention of the State to remedy market failures, both at constitutional & sub-constitutional level. Hence the question of what are the most efficient legal procedures to solve such problems is addressed. Using above all the case of negative externalities related to private goods, the article discusses in particular when it is more efficient to resort to administrative interventions rather than judicial ones; or otherwise allowing such problems to be dealt with through private bargaining between injured & injurers. In this respect the latest literature of economic analysis of law often favors private bargaining in the spirit of Coase's thinking. However, it is here put forward that in terms of cost-benefit analysis economic theory reaches much less radical conclusions often supporting the higher efficiency of legal rules & administrative types of intervention. In the final part of the article, different legal systems (minimal, neoliberal, welfarist) are compared by way of analyzing their rationale & limitations from an efficiency point of view. Riassunto: Michel Foucault, nelle lezioni tenute presso il Collége de France nel 1976, presenta una genealogia dei discorsi concernenti la guerra e la teoria della razza considerate nel loro sviluppo storico a partire dalla fine del XVI secolo. Il faut défendre la société di Foucault propone un modello specifico relativo alla funzione svolta dalla teoria della razza, interpretata adesso come tecnica di normalizzazione della diversità e non più come "evento eccezionale" sviluppata nell'epoca dei totalitarismi. Il Sistema di Revenue Management strumento per lo sviluppo turistico sostenibile delle destinazioni
Businesses interact constantly with the environment, realizing several and heterogeneous exchanges. Organizations can be considered a system of different interests, frequently conflicting and the satisfaction of different stakeholders is a condition of success and survival. National and international literature attempts to explain the complex connection between companies and environment. In particular, the Stakeholder Theory considers crucial for businesses the identification of different stakeholders and their involvement in decision-making process. In this context, profit can not be considered the only purpose of companies existence and business aims become more numerous and different. The Stakeholder Theory is often utilized as framework for tourism studies, in particular in Sustainable Tourism Development research. In fact, authors consider sustainable the tourism development able to satisfy interests of different stakeholders, traditionally identified as local community and government, businesses, tourists and natural environment. Tourism businesses have to guarantee the optimal use of natural resources, the respect of socio-cultural tradition of local community and the creation of socio-economic benefits for all stakeholders in destinations. An obstacle to sustainable tourism development that characterizes a number of destinations worldwide is tourism demand seasonality. In fact, its negative impact on the environment, economy and communities may be highly significant. Pollution, difficulties in the use of public services, stress for residents, seasonal incomes, are all examples of the negative effects of seasonality. According to the World Tourism Organization (2004) the limitation of seasonality can favour the sustainability of tourism. Literature suggests private and public strategies to minimize the negative effects of tourism seasonality, as diversification of tourism products, identification of new market segments, launching events, application of public instruments like eco-taxes and use of differential pricing policies. Revenue Management is a managerial system based on differential pricing and able to affect price sensitive tourists. This research attempts to verify if Revenue Management, created to maximize profits in tourism companies, can also mitigate the seasonality of tourism demand, producing benefits for different stakeholders of destinations and contributing to Sustainable Tourism Development. In particular, the study attempts to answer the following research questions: 1) Can Revenue Management control the flow of tourist demand? 2) Can Revenue Management limit seasonality, producing benefits for different stakeholders of a destination? 3) Can Revenue Management favor the development of Sustainable Tourism? The literature review on Stakeholder Theory, Sustainable Tourism Development, tourism seasonality and Revenue Management forms the foundation of the research, based on a case study approach looking at a significant destination located in the Southern coast of Sardinia, Italy. A deductive methodology was applied and qualitative and quantitative methods were utilized. This study shows that Revenue Management has the potential to limit tourism seasonality, to mitigate negative impacts occurring from tourism activities, producing benefits for local community and to contribute to Sustainable Tourism Development.

Policy ethnography approaches provide useful qualitative data that offer a nuanced and realistic ground-level view of policies, too often analyzed abstractly from the top. However, the ambition of these approaches must not be limited to producing more precise information. Drawing on fieldwork on the control of welfare recipients in France shows that ethnography, and more specifically direct observation, is particularly suited to uncovering the structural characteristics of the new wave of public policies sweeping through advanced societies in the wake of demise of the Fordist-Keynesian compact. Indeed, among other consequences, the "desobjectification" of the collective categories built during the process of welfare state development leads to more astringent and intense controls of recipients. These controls are based on loose criteria defined in situated practices and interactions. The ethnographic capture and analysis of the concrete practices of the agents of welfare bureaucracies enable us to track and critique the more abstract transformations of the social state in the age of "workfare." Such fieldwork provides an illustration of the empirical and theoretical potentials of critical policy ethnography. ; Gli approcci in termini di policy ethnography sono utili per la raccolta di materiale qualitativo che offre una visione sfumata e realistica di politiche spesso analizzate dall'alto e in modo astratto. Tuttavia, la loro ambizione non deve limitarsi a procurare informazioni più dettagliate. A partire da un'inchiesta sul controllo degli assistiti sociali in Francia, vedremo come il lavoro etnografico sul campo, e in particolare l'osservazione diretta, possano rivelarsi in grado di svelare alcune caratteristiche strutturali dell'intervento pubblico. John Maynard Keynes, capitalismo cognitivo, basic income, no copyright: È possibile un nuovo "new deal"?
The paper argues why in the nowadays context of accumulation, named Cognitive Capitalism (CC), from an economic point of view, it is not possible a political compromise (nee deal) as it was in the fordist era. Starting from ch. 24 of Keynes' General Theory, we discuss how the keynesian conditions for a the development of a social pact between workers and entrepreneurs, with the intermediation by the State, are overcome by the structural change of the accumulation and valorisation process. Fordist new deal was based on three main variables: i) the existence of a State-nation able to implement nationalwide and autonomous political economies; ii) the possibility to measure productivity gains in material terms, and, iii) the existence of stable industrial relations, with high degree of representation of national differing social interests. In CC, globalization and finanziarisation strongly reduce the role played by States, the shifting towards immaterial production, based on knowledge and cognitive labour, leads to the impossibility provide an effective measure of productivity, whose dynamics is more and more depending on social factors. Further, the prevailing individual bargain on collective bargain negatively affects the relevance of industrial elations and especially the capacity of tradeunionism. The structural instability of CC could be minimize, first, by the introduction of a limit to intellectual property rights, able to socialize knowledge ad better exploit learning and network economics at the basis of accumulation process. Secondly, by the introduction of a basic income, able to compensate the unfair income distribution due to the capital gains allocation. Nevertheless, both of these measures, cannot be constituent of a new social pact, since they are incompatible with private property statements and with the discipline of work as condition for its exploitation. Therefore, as usual, only social crisis and conflict can provide a solution.

The Green Mobility concept involves great affair of technological, sociology-cultural and political innovation. This may be analyzed in a managerial perspective on the background of the Resource Based Theory and its VRIO framework on the hypothesis that the community organization management works in directions of social and economical growth in a perspective of social as environmental long term sustainability.The basic assumption of the RBT lies in the concept sustainable competitive advantage that belongs to a firm or an organization on the basis of the availability of resources with the attributes of Value, Rare, Inimitable in a specific Organization. In this perspective, any local community have specific view of applying served customer functions of resources in technological, socio-cultural and organizational way according to its ability in building up on knowledge, that is a specialization of way of producing and, last, living (Marshall 1920). By this view, change in lifestyle and people's behaviors comes from innovation process (Schumpeter 1942) in technologies, in socio-cultural view, in political organization, other words, in knowledge and in scientific progress. These three areas (technologies, society, policy) are powered by capacity of innovation and changing and this is the competitive advantage of goods producing, of political and social organizing, that will be a competitive advantage in achievement in best levels of lifestyle, that is the way of communities evolution. Also, technologies changes produce as a result a change in served customer functions, in people's behaviors, in political and law organization (shumpeterian revolution), change in socio-cultural ways produces as a result a change in organizational way of economy and law (social revolution), change in political way produces change in social organization, economy, people's behaviors. So we try to work in this perspective that is the hypothesis that evolution of communities is a result of technological, socio-cultural and political revolution over the time, last, in knowledge heritage (Rullani 2004). This is according to falsificationist methodological perspective. And every change was almost hard change for the resistance to innovation coming from human behavior as a specialization way of life. Resource Based View can offer a framework for managing this change in the perspective of sustainability competitive advantage of local system when resources' achievement works in ecological and environmental safeguard perspective. Efficiency and environment safeguard are the attributes of Mobility systems as a resource that may generate sustainable competitive advantage in goods and peoples mobility for a local system in the future. ; Il tema della mobilità verde (trasporti ecosostenibili) va affrontato in maniera sistemica in quanto l'innovazione non interessa solo il sistema e le tecniche di trasporto, ma coinvolge anche aspetti socio-culturali e politici. L'analisi del problema in una prospettiva manageriale, secondo i principi della Resource Based Theory, può aiutare a comprendere la necessità dell'azione di una governance territoriale e come essa può ottenere i vantaggi competitivi del territorio in termini di sviluppo sostenibile ed ecocompatibile nel lungo termine.Il concetto di base che si vuole sostenere in questa analisi è quello del vantaggio competitivo associato, questa volta, non alla singola azienda o gruppo di aziende, ma all'intero territorio o distretto geografico, industriale e socio-culturale. Nella Teoria del Distretto (Marshal 1920, Becattini 1989) si afferma il concetto di vantaggio competitivo delle imprese come effetto dell'influenza del territorio, delle risorse, delle esperienze e conoscenze sedimentate nel corso del tempo dalle popolazioni locali nella generazione delle capacità produttive e distintive delle imprese di quel distretto. In una parola, il territorio influenza le capacità imprenditoriali. Ogni impresa possiede un vantaggio competitivo derivante dall'utilizzo delle risorse del territorio, che pertanto possiedono delle qualità di Valore, Rarità, Inimitabilità e Organizzabilità (VRIO Management). Ogni comunità locale possiede una specifica "cultura" o modo di concepire la realtà produttiva. Le funzioni d'uso delle risorse derivano dalla capacità di utilizzare la "conoscenza sedimentata", e tutto ciò si traduce nella specializzazione produttiva e, infine, negli stili di vita. Dato questo assunto, per introdurre un cambiamento negli stili di vita e nei comportamenti di un territorio, è necessario un processo di innovazione (Schumpeter 1943) di carattere sistemico che deve interessare non solo l'aspetto tecnologico ma anche quello socio-culturale e quello politico-normativo. Tecnologia, società e politica sono le tre aree che sono alimentate dalla capacità di continua innovazione e ciò rappresenta il vantaggio competitivo che una comunità locale consegue tanto nella organizzazione dei fattori della produzione quanto nella generazione del livello di benessere locale e vivibilità ambientale. In altri termini, secondo l'impostazione comportamentista (Nelson e Winter 1982), questo è lo schema dell'evoluzione. Si può assumere, così, che l'innovazione tecnologica comporta come effetto il cambiamento delle funzioni d'uso, dei comportamenti degli utenti (consumatori) e del sistema politico-normativo (rivoluzione schumpeteriana); ancora, i cambiamenti di tipo socio-culturale investono di conseguenza, oltre l'assetto economico, anche la sfera politica e normativa (rivoluzioni sociali); infine i cambiamenti originati nella sfera politico-normativa impattano sull'organizzazione dell'economia e della società oltre che sui comportamenti umani (rivoluzioni politiche). Delle tre sicuramente la rivoluzione tecnologica è quella che più velocemente e intensamente ha interessato economia, società e sfera giuridico-politica.In questa prospettiva si vuole avvalorare l'ipotesi, in impostazione falsificazionista, secondo cui lo sviluppo locale è il risultato di una capacità di intendere i cambiamenti nel campo tecnologico, socio-culturale e politico nel corso del tempo e ciò rappresenta il patrimonio della Conoscenza (Rullani 2004). D'altra parte il processo di innovazione incontra delle resistenze al cambiamento, generate dalle "routines", o modi di comportamento comunemente diffusi. Il cambiamento, quindi, può operare solo in conseguenza di una valutazione positiva dei costi-benefici relativi all'introduzione dell'innovazione. L'analisi del problema dello sviluppo dei sistemi di trasporto nella direzione della compatibilità ambientale, della riduzione dell'inquinamento e dell'alta velocità può essere visto come un tipico problema manageriale nella prospettica teorica dei sistemi territoriali. I trasporti, infatti, rappresentano la risorsa fondamentale per il funzionamento e lo sviluppo economico tanto di un Paese quanto dei suoi distretti produttivi. Pertanto, l'applicazione dello schema del VRIO Management, secondo l'impostazione della Resource Based Theory, è una prospettiva utile per concepire lo sviluppo del vantaggio competitivo territoriale, in un'ottica di governance del territorio di tipo sistemico, basato sull'innovazione ecocompatibile dei sistemi logistici .

L'analisi del problema in una prospettiva manageriale, secondo i principi della Resource Based Theory, può aiutare a comprendere la necessità dell'azione di una governance territoriale e come essa può ottenere i vantaggi competitivi del territorio in termini di sviluppo sostenibile ed ecocompatibile nel lungo termine.Il concetto di base che si vuole sostenere in questa analisi è quello del vantaggio competitivo associato, questa volta, non alla singola azienda o gruppo di aziende, ma all'intero territorio o distretto geografico, industriale e socio-culturale. Nella Teoria del Distretto (Marshal 1920, Becattini 1989) si afferma il concetto di vantaggio competitivo delle imprese come effetto dell'influenza del territorio, delle risorse, delle esperienze e conoscenze sedimentate nel corso del tempo dalle popolazioni locali nella generazione delle capacità produttive e distintive delle imprese di quel distretto. In una parola, il territorio influenza le capacità imprenditoriali. Ogni impresa possiede un vantaggio competitivo derivante dall'utilizzo delle risorse del territorio, che pertanto possiedono delle qualità di Valore, Rarità, Inimitabilità e Organizzabilità (VRIO Management). Ogni comunità locale possiede una specifica "cultura" o modo di concepire la realtà produttiva. Le funzioni d'uso delle risorse derivano dalla capacità di utilizzare la "conoscenza sedimentata", e tutto ciò si traduce nella specializzazione produttiva e, infine, negli stili di vita. Dato questo assunto, per introdurre un cambiamento negli stili di vita e nei comportamenti di un territorio, è necessario un processo di innovazione (Schumpeter 1943) di carattere sistemico che deve interessare non solo l'aspetto tecnologico ma anche quello socio-culturale e quello politico-normativo. Tecnologia, società e politica sono le tre aree che sono alimentate dalla capacità di continua innovazione e ciò rappresenta il vantaggio competitivo che una comunità locale consegue tanto nella organizzazione dei fattori della produzione quanto nella generazione del livello di benessere locale e vivibilità ambientale. In altri termini, secondo l'impostazione comportamentista (Nelson e Winter 1982), questo è lo schema dell'evoluzione. Si può assumere, così, che l'innovazione tecnologica comporta come effetto il cambiamento delle funzioni d'uso, dei comportamenti degli utenti (consumatori) e del sistema politico-normativo (rivoluzione schumpeteriana); ancora, i cambiamenti di tipo socio-culturale investono di conseguenza, oltre l'assetto economico, anche la sfera politica e normativa (rivoluzioni sociali); infine i cambiamenti originati nella sfera politico-normativa impattano sull'organizzazione dell'economia e della società oltre che sui comportamenti umani (rivoluzioni politiche). Delle tre sicuramente la rivoluzione tecnologica è quella che più velocemente e intensamente ha interessato economia, società e sfera giuridico-politica.In questa prospettiva si vuole avvalorare l'ipotesi, in impostazione falsificazionista, secondo cui lo sviluppo locale è il risultato di una capacità di intendere i cambiamenti nel campo tecnologico, socio-culturale e politico nel corso del tempo e ciò rappresenta il patrimonio della Conoscenza (Rullani 2004). D'altra parte il processo di innovazione incontra delle resistenze al cambiamento, generate dalle "routines", o modi di comportamento comunemente diffusi. Il cambiamento, quindi, può operare solo in conseguenza di una valutazione positiva dei costi-benefici relativi all'introduzione dell'innovazione. L'analisi del problema dello sviluppo dei sistemi di trasporto nella direzione della compatibilità ambientale, della riduzione dell'inquinamento e dell'alta velocità può essere visto come un tipico problema manageriale nella prospettica teorica dei sistemi territoriali. I trasporti, infatti, rappresentano la risorsa fondamentale per il funzionamento e lo sviluppo economico tanto di un Paese quanto dei suoi distretti produttivi. Pertanto, l'applicazione dello schema del VRIO Management, secondo l'impostazione della Resource Based Theory, è una prospettiva utile per concepire lo sviluppo del vantaggio competitivo territoriale, in un'ottica di governance del territorio di tipo sistemico, basato sull'innovazione ecocompatibile dei sistemi logistici .

NATURA DELLE COSE E METODO GIURIDICO
This dissertation concerns the legal and jurisprudential issue of the "nature of things". In the first and second chapters I provide an analysis of some of the main uses of the expression 'nature of things' in italian legal science and jurisdiction, focusing on their frequent occurrence in commercial and administrative law. Then, in the following two chapters, I try to develop an explanatory model of a legal method based on the notion of nature of things, as a means to determine the content of a legal system. In chapter III my central aim is to show that even lawyers who subscribe to this method, use it only when an identification of the relevant legal issues is already available. It's only in a subsequent moment - which following Mario Jori I call 'determination' of the content of law – that in these lawyers' view the appeal to the nature of things bears its fruits, i.e. the possibility to improve our understanding of law through the study of social practices picked out by some legal concepts. Finally, in chapter IV, I focus on the peculiar treatment of legal concepts implied by this method. I maintain that we ought to refer to Kripke and Putnam thesis that conceptaul content depends upon the true nature of the things referred to rather than upon the descriptions or the criteria commonly associated to a concept. In this case, the criteria that can be defeated by the account of the true nature of a phenomenon are the ones established by the legislator. Unlike Kripke and Putnam, however, judges and lawyers who use the notion of nature of things enlarge the scope of this theory from natural kind concepts – for which it was originally conceived – to "social kind" concepts.

Il tema della mobilità verde (trasporti ecosostenibili) va affrontato in maniera sistemica in quanto l'innovazione non interessa solo il sistema e le tecniche di trasporto, ma coinvolge anche aspetti socio-culturali e politici. L'analisi del problema in una prospettiva manageriale, secondo i principi della Resource Based Theory, può aiutare a comprendere la necessità dell'azione di una governance territoriale e come essa può ottenere i vantaggi competitivi del territorio in termini di sviluppo sostenibile ed ecocompatibile nel lungo termine. Tourism is a Spatial Phenomenon ; Il turismo è un fenomeno spaziale
Tourism and activities it generates are combined with the territorial factor giving rise to the process of using the service in which, essentially, the delivery and consumption of tourism, an entity largely immaterial, are simultaneous in a geographical context chosen by the consumer and defined tourist destination. If clarification of the concept of tourism and tourism product was essential to explain to some extent the reasons for the offer (why tourism activities born and develop?), the opportunity to single out, among the various definitions that have been proposed in the literature, the characteristic features of the destination seems equally significant to get to the explanation of why management system offered (comprehensive and complex product). The basic questions are: What drives tourists to go from s place of habitual residence to a place in which the natural, environmental and cultural region are completely different from starting? What does turning a geographical place into a tourism destination? Because some tourists prefer certain destinations than the other? What is the impact of tourism in terms of territorial and urban mobility? The transport system can be considered a resource-generating competitive advantages? The framework of the article is represented by the Marshallian theory of industrial district which puts the land and its resources behind the development of the local system. It tries to overlay the framework VRIO (Value, Rarity, inimitably, Organization), derived from the Resource Based View, in determining whether a particular resource area can generate a sustainable competitive advantage and lasting. Stakeholder Theory is the framework that leads the analysis of the impact of tourism development policy on local businesses and the framework of Corporate Social Responsibility leads in environmental issues. Against this background, in this paper will be exhibited in the various contributions of the literature on tourism systems starting from the basic that tourist is a person who drives a process of spending a part of his income in a place other than in his habitual residence. The choice of the destination to enjoy the tourist facilities and carry out the complementary activities of consumption is the result of a complex decision-making process based on selection among alternative competitive solutions that are able to respond to a set of needs and aspirations to equal costs and level of services required. Then you will be taken into consideration of the manner in which a geographic location becomes a tourist destination and the way in wich the structural characteristics (accommodation services, catering, equipment) and infrastructure (accessibility geographical, social and economic) are able to express a point of "emotional" for tourists; the encounter between supply and demand is seen according to the post-Fordist framework of "Mutual Value" that drives the service process in tourism businesses and the way in which an assets (tangible and intangible) may be able to generate a competitive advantage in the market. Hereinafter the tourism phenomenon is related to the concept of territorial mobility to highlight the impact that it creates on environmental and urban planning, and the need to monitor and plan the phenomenon for structural and infrastructural adjustment of the territory in the way of sustainability. Finally will be exposed some cases of urban and extra-urban mobility in tourism according to a perspective that sees the urban and suburban transport a real resource (VRIO) generating competitive advantage for the local system. ; Il turismo e le attività da esso generate si combinano con il fattore territoriale dando luogo al processo di fruizione del servizio turistico caratterizzato essenzialmente dalla contestualità dell'erogazione e del consumo di un'entità in buona parte immateriale in un contesto geografico scelto dal consumatore e definito destinazione turistica. Se la chiarificazione del concetto di turismo e di prodotto turistico è risultata essenziale per spiegare in un certo senso le ragioni dell'offerta (perché nascono e si sviluppano le attività turistiche?), altrettanto significativa sembra l'opportunità di enucleare, tra le varie definizioni che sono state proposte nella letteratura specialistica, gli elementi caratteristici della destinazione turistica per arrivare alla spiegazione delle ragioni del management del sistema di offerta (prodotto complesso e globale). Le domande di fondo sono: Cosa spinge i turisti a partire dal luogo di abituale dimora per recarsi in una località che presenta caratteristiche naturali, ambientali e culturali completamente diverse dalla regione di partenza? Cosa fa trasformare un territorio in una destinazione? Perché alcuni flussi turistici prediligono determinate destinazioni rispetto alle altre? Quale è l'impatto sul piano della mobilità territoriale ed urbana? Il sistema dei trasporti può essere considerato una risorsa generatrice di vantaggi competitivi per una destinazione turistica? Il framework dell'articolo è rappresentato dalla teoria marshalliana del distretto industriale che pone il territorio e le sue risorse alla base dello sviluppo del sistema locale. Ad esso si tenta di sovrapporre il framework VRIO (Valore, Rarità, Inimitabilità, Organizzazione), derivato dalla Resource Based View, per stabilire se una determinata risorsa del territorio, nel caso di specie il sistemi di trasporto urbano ed extraurbano, può generare un vantaggio competitivo sostenibile e duraturo. Per l'analisi delle problematiche dell'impatto sul territorio delle politiche di sviluppo turistico e del Destination Management è utile il riferimento alla Stakeholder Theory ed un approccio Corporate Social Responsability (CSR). Date queste premesse, nel paper vengono esposti i vari contributi della letteratura specialistica sui sistemi turistici partendo dall'assunto di base che il turista è un soggetto che attiva un processo di spesa di parte del suo reddito in un luogo diverso dalla sua abituale dimora. La scelta della destinazione in cui fruire dei servizi turistici e svolgere le attività collaterali di consumo è il frutto di un processo decisionale complesso basato sulla selezione competitiva tra soluzioni alternative che siano in grado di rispondere ad un insieme di bisogni ed aspirazioni a parità di costi e di livello di servizi richiesti. Successivamente viene preso in esame il modo con cui una località geografica diviene destinazione turistica e come le caratteristiche strutturali (servizi di alloggio, ristorazione, accessori) ed infrastrutturali (accessibilità geografica, sociale ed economica) possano essere in grado di esprimere un richiamo "emozionale" per il turista; l'incontro tra domanda ed offerta viene visto in un'ottica postfordista secondo il framework "Mutual Value" che assegna un ruolo fondamentale alla componente dei servizi presente nell'offerta di vendita dei beni (materiali ed immateriali) per generare un vantaggio competitivo sul mercato. In prosieguo il fenomeno turistico viene messo in relazione al concetto di mobilità territoriale per evidenziare l'impatto che esso genera sul piano ambientale ed urbanistico e la necessità di monitorare il fenomeno e pianificare le azioni di adeguamento strutturale ed infrastrutturale del territorio nella direzione della sostenibilità. Infine verranno esposti dei casi di mobilità urbana ed extraurbana di tipo turistico secondo una prospettiva che vede il trasporto urbano ed extraurbano una vera e propria risorsa (VRIO) generatrice di vantaggio competitivo per il sistema locale.
