Auf der Grundlage von vier Fallbeispielen aus den Bereichen Rechtsprechung, Sozialpolitik, Beschäftigtenkontrolle und Bonitätsprüfung wird dargelegt, dass Algorithmen sowohl zur Politisierung der 'materiellen' sowie der 'reflexiven' gesellschaftlichen Ordnung genutzt werden. ; This contribution argues that algorithms are not only depoliticizing, but can also serve as vehicles for politicization. AbstractAlgorithmen beeinflussen in vielen Bereichen unser tägliches Leben. Dies macht es unumgänglich, die Anwendung von Algorithmen im hoheitlichen, wie auch im privatrechtlichen Gebrauch zu normieren, wozu es auch rechtstheoretischer Überlegungen bedarf. Bevor man ein so umfassendes Thema jedoch normieren kann, gilt es grundlegende Überlegungen in Bezug auf die Funktionsweise, die Arten, wie auch das Wesen algorithmusbasierter Programme anzustellen. Hierzu wird am Anfang dieser Arbeit das Wesen der Rechtstheorie herausgearbeitet und mit anderen Bereichen des Rechts verglichen. Ein in rechtlicher Hinsicht grundlegender Bestandteil solcher Überlegungen stellt die rechtstheoretische Auseinandersetzung als Fundament jeder weiteren, rechtlichen Überlegung dar. Es gilt darzulegen, inwieweit etwa der Wille des Gesetzgebers eine Rolle bei der Anwendung solch algorithmusbasierter Systeme spielt, wie und durch welche Normen die Wirksamkeit einer Regulierung erreicht und auch dauerhaft gewährleistet werden kann. Zudem wird behandelt, inwieweit Bias, also fehlerhafte Datensätze, eine Rolle im Umgang mit Algorithmen spielen und wie man mit diesen umgehen kann, um rechtstheoretische, wie auch moralische Grundsätze bei der Anwendung solcher Systeme zu wahren. Auch auf moralischer Ebene muss die Anwendung von Algorithmen abgehandelt werden. Dabei gilt es das Wesen positiver Rechtsordnungen mit denen naturrechtlicher zu vergleichen und zu hinterfragen, inwiefern die Moral begrifflich vom Recht zu trennen ist bzw. welche Denkansätze nötig sind, um eine bestmögliche Abgrenzung zu schaffen. Diese Themen werden anhand bedeutender Rechtstheoretiker wie Kelsen, Hart und Fuller behandelt. This makes it inevitable to standardize the application of algorithms in sovereign as well as in private law use, which also requires legal-theoretical considerations. Before such a comprehensive topic can be standardized, however, fundamental considerations must be made with respect to the functioning, the types, and also the nature of algorithm-based programs. For this purpose, the essence of legal theory is elaborated at the beginning of this thesis and compared with other areas of law. A fundamental component of such considerations from a legal point of view is the legal-theoretical discussion as the foundation of every form of further legal consideration. It is pointed out to what extent the will of the legislator plays a role in the application of such algorithm-based systems, how and by which norms the effectiveness of a regulation can be achieved and also permanently guaranteed. In addition, it will be discussed to what extent biases, i.e. incorrect data sets, play a role in dealing with algorithms and how these can be dealt with in order to preserve legal-theoretical as well as moral principles in the application of such systems. The application of algorithms must also be dealt with on a moral level. In this context, it is important to compare the nature of positive legal systems with those of natural law and to question the extent to which morality can be conceptually separated from law or which approaches are necessary to create the best possible distinction. These issues will be addressed using major legal theorists such as Kelsen, Hart, and Fuller. Der digitale Wandel und das damit zusammenhängende exponentielle Wachstum von künstlicher Intelligenz ist längst allgemein spür- und wahrnehmbar geworden. Für Staat und Verwaltung eröffnet sich dabei ein umfassendes und neues Repertoire an Möglichkeiten.Diese Arbeit setzt sich deshalb kritisch mit der Frage auseinander, welche Implikationen Algorithmen auf den Rechtsstaat hinsichtlich eines materiellen Rechtsstaatsdenkens haben können. Um diese Frage zu beantworten, sollen auch die umfassenden Möglichkeiten für den Einsatz von algorithmusbasierten Systemen im Staat beispielhaft dargestellt werden. Diese reichen von intelligenten Überwachungssystemen zur vorausschauenden Kriminalitätsbekämpfung bis hin zur tatsächlichen aktiven Entscheidungsfindung und -fällung durch einen Algorithmus. Insbesondere in letzterem Fall wird im Zuge dieser Arbeit hinterfragt, ob und inwieweit die Ablösung einer richterlichen oder behördlichen Einzelfallentscheidung eines Menschen durch eine automatisierte maschinelle Entscheidung sowohl technisch machbar als auch verfassungsrechtlich zulässig sein kann. Kern der Arbeit stellt deshalb die Erörterung der verfassungsrechtlichen Grenzen bzw Anforderungen an einen Algorithmus im Rechtsstaat dar. Ein besonderer Fokus wird diesbezüglich auf den verfassungsrechtlichen Maßstab sowohl des Legalitätsgrundsatzes gem Art 18 Abs 1 B-VG als auch des Diskriminierungsverbotes gem Art 7 B-VG gelegt. Um die gesetzlichen Anforderungen überhaupt erst auf algorithmusbasierte Prozesse übertragen zu können, wird vorher noch der Versuch unternommen, auf die technischen Implikationen der algorithmusbasierten Problemlösung im Detail einzugehen und die wichtige Rolle des privaten Sektors herauszuarbeiten. Abschließend soll aus mediendemokratischer Sicht noch untersucht werden, ob die Art, wie Informationen im Internet üblicherweise selektiert werden, im Einklang mit demokratisch- und rechtsstaatlichen Überlegungen steht. ; The digital change and the exponential growth of artificial intelligence associated with it have long since become generally perceptible. They thus open up a comprehensive and new repertoire of possibilities for government and administration. This thesis therefore critically examines the question of what implications algorithms can have for the rule of law. In order to answer this core question, the various possibilities for the use of algorithm-based systems within the state are going to be presented and discussed. Especially with regards to algorithm-based decision-making processes, this thesis questions whether and to what extent the replacement of a judicial decision of a human being by a fully automated decision can be both technically feasible and constitutionally permissible. Therefore, the core of this work is the discussion of the constitutional limits and requirements for an algorithm in a constitutional state. In this respect, a special focus is placed on the constitutional standard of both the principle of legality according to Article 18 (1) B-VG and the prohibition of discrimination according to Article 7 B-VG (principle of non-discrimination). In order to be able to transfer the legal requirements to algorithm-based processes in the first place, an attempt is made to go into the technical implications of algorithm-based problem-solving in detail and to stress the important role of the private sector. New military technologies are animated by fantasies of perfect knowledge, lawfulness, and vision that contrast sharply with the very real limits of human understanding, law, and vision. Thus, various kinds of violent acts are proliferating while their precise nature remains unclear. Especially man-machine ensembles, guided by algorithms, are operating in ways that challenge conceptual understanding. War and Algorithm looks at the increasing power of algorithms in these emerging forms of warfare from the perspectives of critical theory, philosophy, legal studies, and visual studies. The contributions in this volume grapple with the challenges posed by algorithmic warfare and trace the roots of new forms of war in the technological practices and forms of representation of the digital age. Together, these contributions provide a first step toward understanding--and resisting--our emerging world of war.
