This paper wants to explore more about the prospects and challenges of the development of Islamic insurance in Indonesia. Islamic insurance industry in Indonesia has very good prospects for growth, the demand for insurance products based on shariah will continue to increase. This is supported by a large population of Indonesia and also as the largest Muslim country in the world. However, this industry will also experience a very strong obstacle because of the global economic downturn, as it also conditions the people are not educated about insurance, the free market has begun to be applied, resources are less about Islamic insurance, lack of capital and other on.Therefore it needs the government's role to help to continue to grow, with regulations that support this industry
Perkembangan industri asuransi di Indonesia makin berkembang, hal ini dapat dilihat dari makin meningkatnya kesadaran masyarakat untuk ikut berasuransi. Menangkap peluang tersebut, maka saat ini banyak perusahaan asuransi bermunculan dengan menawarkan banyak produk dan jenis asuransi yang kompetitif. Asuransi syariah menjadi salah satu pilihan masyarakat yang dianggap sangat diminati karena dianggap lebih baik daripada asuransi konvensional. Dalam praktiknya perusahaan asuransi tidak semuanya memahami prinsip-prinsip dasar asuransi syariah sehingga pada praktiknya tidak sesuai dengan prinsip-prinsip tersebut. Untuk itu perlu ada kajian yang lebih dalam terkait dengan teknis dan prinsip asuransi syariah yang saat ini dijalankan oleh perusahaan-perusahaan asuransi syariah. Maka perlu diketahui pula oleh para nasabah, calon nasabah dan terutama perusahaan asuransi syariah mengenai prinsip General Takaful System (GTS). Diharapkan perusahaan tersebut benar-benar menjalankan prinsip asuransi syariah sesuai dengan Al-Quran, Hadist dan Peraturan Perundang-undangan yang berlaku di Indonesia agar tercapai kesejahteraan bersama.The development of insurance industry in Indonesia is growing, it can be seen from the increasing awareness of the public to participate in insurance. Then it needs to be known also by its customers, prospective customers and especially the Islamic insurance company regarding the principle of General Takaful System (GTS). It is expected that the company is actually running the principles of Islamic insurance in accordance with the Al-Qur'an, Hadist and legislations in force in Indonesia in order achieve common prosperity.

Asuransi Takaful Umum Cabang Pontianak.Secara khusus penelitian ini bertujuan untuk menganalisa pengaturan akad-akad asuransi syariah dan kedudukan para pihak dalam asuransi syariah yang ditinjau menurut syariat Islam, peraturan perundang-undang dan menurut hukum ekonomi syariah serta untuk mengetahui penyelesaian sengketa dalam asuransi syariah.Metode Penelitian yang digunakan adalah Metode Normatif, yaitu metode yang digunakan untuk memecahkan masalah-masalah hukum melalui data sekunder terlebih dahulu, kemudian dilanjutkan dengan mengadakan penelitian terhadap data Primer di lapangan.Dari hasil penelitian tentang pelaksanaan akad pada PT. This study aims to identify problems, solutions and strategies in decision making of fintech innovation insurance, with the approach method is Analytic Network Process (ANP). The data collections which are depth interview and questionnaire were collected from the respondent. The results showed that the priority issues faced in fintech innovation insurance are human aspect which consists of human resource lacks and regulatory challenges; product aspect which consists of product penetration and asset market penetration fractional shari'ah. Solutions which are needed in fintech innovation insurance are aspect human which consists of resource and regulation minimalism; product aspect which consists of product research and product innovation. Strategies in fintech innovation insurance are socialization, education, cooperation and digital marketing. Socialization gives the most influence on fintech innovation insurance to introduce fintech in facing digital era. Education needs to be held periodically as well as in the process of fintech to get the assistance of the Otoritas Jasa Keuangan (OJK) as a regulatory to comply with the government policy. Ministry of agriculture has released regulation Nomor 40 Tahun 2015, on this regulation was arranged types and facility agriculture assurance will protect farmers from losses profit because failed in harvesting because disaster act of god, diseases, and climate extreme change. Abstrak;Perkembangan, Pelembagaan dan legalisasi ekonomi Syariah di Indonesia dapat dikatakan sangat pesat setelah mendapat dukungan pemerintah dalam bentuk regulasi ekonomi yang berprinsipkan pada prinsip-prinsip ekonomi syariah. Perkembangan pesat tersebut dapat terlihat dalam berbagai bidang ekonomi yang menerapkan sistem ekonomi syariah, seperti perbankan Syariah, asuransi Syariah, sukuk (Obligasi syariah), pasar modal Syariah, keuangan publik, dan lain-lain. Fakta berbeda perkembangan dan pertumbuhan praktik ekonomi syariah dapat dilihat dalam kurun waktu di mana pemerintah belum berpihak pada ekonomi syariah, yaitu sebelum reformasi. Realitas yang demikian, memberikan harapan besar yang menumbuhkan optimisme bagi umat Islam untuk terus berupaya mengembangkan ekonomi syariah di Indonesia, terlebih lagi dukungan pemerintah yang diwujudkan dalam berbagai regulasi dan political will semakin nyata mendukung pengembangan ekonomi syariah di Indonesia. In connection with the Decisions and Recommendations of the Ulama 'MUI Fatwa Commission in Indonesia concerning the Implementation of National Health Insurance by BPJS Health agreed to clarify the illegitimate issues that developed in the community and that the government establish rules, systems, and format the modus operandi of BPJS Health in accordance with the principles sharia. Based on these considerations it is necessary to stipulate a fatwa on the Guidelines for the Implementation of Health Social Security in accordance with Islamic Sharia to be used as a guideline. So on December 22, 2015, the National Sharia Council of the Indonesian Ulema Council decided and established the DSN-MUI Fatwa No.98 / DSN-MUI / XII / 2015 concerning Guidelines for Implementing Sharia Health Social Security. The method applied in this qualitative research is descriptive method, which is research intended to investigate the conditions, conditions or other things that have been mentioned, the results of which are presented in the form of research reports, the data of which is obtained through interviews, documentation, and literature studies. The implementation of health insurance coverage at BPJS Health Bandung both in terms of membership, registration, fees, services, and the mechanism for payment of fines is carried out properly and in accordance with the existing legislation. However, it is not in accordance with the provisions in the DSN-MUI Fatwa No.98 / DSN-MUI / XII / 2015 concerning Guidelines for Sharia Health Social Security Implementation because it has not fulfilled all the elements of its contract, does not have a Social Security Fund holding account in Islamic banks, earns income from interest, the development and placement paths of DJS are not clear and the investment is not in a place that is in accordance with sharia.

It includes generalinsurances, life insurances and reinsurances (on the basis of its function).Based on its basic policy, it includes term life insurances, whole life insurances,two beneficial insurances, insurances of investment unit (unit linked). Basedon its belongings, it includes national private-owned insurances, state-ownedinsurances, foreign corporations-owned insurances, and multiplicity-ownedinsurances. Based on the nature of its implementation, it includes voluntaryand compulsory insurances. Based on the business support activities, it includesinsurance brokers, reinsurance brokers, insurance loss assessor, consultingactuary, and insurance agents. Mean while, mechanisms of Takaful (shari'ainsurances) include underwriting, insurance policies, premiums, managementof premiums, claims and insurance coverage.
