In the Common Law system judges have the power to create subsidiary laws: they make rules in strict sense. This Kind of power responds to a special way in which the Common Law develops and adapts itself to achieve the best rules for a given society. Understanding how the Australian law system works, as an example of a common law structure, and how judges interact with the parliament in the creation of the best rules of law -which makes the process coherent- is paramount for other legal systems that have a mixture of legal institutions from both civil and common law systems, as Colombia. Colombia has an unclear mixture of law systems, which generates an uncertainty of the application of the law producing both by judges and parliament, and serious structural law problems; so, understanding the basis of the common law system it is important to clarify the limits in the competence of each authority and the interaction between the law made by the Parliament and the one that the judges produce. ; In the Common Law system judges have the power to create subsidiary laws: they make rules in strict sense. In this paper, written as a tribute to the first edition of John Finnis' Natural Law and Natural Rights, the author examines some of the versions introduced by the Australian philosopher, in order to analyze, specify, develop and defend the notion of rule of law. He later goes on to give an assessment of Finnis' contributions, primarily of the ones regarding the ethical character of that institute, and the mastery with which he has integrated the classical-realistic tradition of the natural law theory, the methodological approaches of analytical jurisprudence and the contemporary reflection about the idea of a government limited by law. ; En el presente artículo, escrito en homenaje a los 40 años de la aparición de la primera edición de Natural Law and Natural Rights de John Finnis, se estudian varias de las versiones elaboradas por el iusfilósofo australiano para analizar, explicitar, desarrollar y defender la noción de rule of law. Luego de este desarrollo, se efectúa una valoración de las aportaciones de Finnis en este punto, en especial las referidas al carácter principalmente ético de ese instituto, y a la maestría con la que ha sabido integrar la tradición clásico-realista del iusnaturalismo, los planteos metodológicos de la analytical jurisprudence y la reflexión contemporánea sobre la idea del gobierno limitado por el derecho.

La Directiva 2000/78/CE establece un marco general para la igualdad de trato en el empleo, y prohíbe diversas formas de discriminación directa o indirecta, incluyendo la religión y las creencias del trabajador. La "Equality Act 2010" (Ley de Igualdad de 2010) traspone estas normas al Reino Unido bajo la lógica del principio de igualdad de trato. Las reglas o códigos de vestimenta dirigido a un grupo religioso determinado, como la prohibición a las mujeres musulmanas de vestir hiyab es un caso de discriminación directa; una regulación neutra que se aplique por igual a toda la plantilla puede producir una discriminación indirecta en aquellas personas que quieran utilizar determinadas ropas o símbolos asociados a su confesión religiosa tanto como la prohibición directa de uso de dichas prendas. La clave de la ley británica, en la mayor parte de los casos, será la eventual existencia de un objetivo legítimo en el empresario y el análisis de la proporcionalidad, a la luz del art. 9 de la Convención Europea de Derechos Humanos. En la Ley Australiana, por su parte, se prohíbe la discriminación por motivos religiosos en un nivel institucional, y se reconoce la libertad de culto en la sección 116 de la constitución. La regulación es más flexible, porque no existe protección de las creencias religiosas en la legislación de igualdad que ampare un derecho a vestir hiyab en el centro de trabajo. Ambas jurisdicciones tienen políticas socioeconómicas y organizativas en materia de gestión de la diversidad informadas por un marco multinivel que contribuye a la integración en el ámbito laboral de individuos y organizaciones. Este trabajo plantea una aproximación comparativa entre los dos sistemas de common law, en el que Reino Unido sigue un esquema de multinationalidad basado en la Ley de Igualdad y la Convención Europea de Derechos Humanos y Australia acepta la legislación federal y estatal, que tienen competencias concurrentes en materia legislativa. ; The Directive 2000/78/EU establishes a general framework for equal treatment in employment law and prohibits direct and indirect discrimination on several grounds, including religion or belief. The Equality Act 2010 implements this provision in the UK on the principle of equal treatment, and a rule or dress code that targets a specific religious group, such as a ban on Muslim women wearing hijab would be direct discrimination. A more neutral dress code which applies equally to all employees may have an indirectly discriminatory effect on those who wish to wear religious clothing or symbols at work such as a general ban on wearing religious clothing. The central issue in English law in most cases will be justification and whether the employer had a legitimate aim and if the ban was proportionate under Article 9 of the European Convention of Human Rights (ECHR). In Australian law there is a policy that bans religious discrimination on an institutional level and there is a free exercise clause under section 116 of the constitution. There is a more flexible policy because is no protection of religious belief in the equality legislation towards the hijab as a right of the employee in the workplace. Both jurisdictions have socio-economic as well as organisational policies on diversity management informed by a multilevel framework that contributes to integrating the individuals and organisations in the workplace. This paper adopts a comparative approach between the two common law systems where the UK follows a multinational framework based on the Equality Act and the ECHR case law and the Australian accept the federal and state law which have concurrent jurisdictions in the legal framework.

Genetic and genomic information requires strict regulations for its proper handling in order to avoid inappropriate disclosure and secondary discrimination, since it is directly related to fundamental rights and bioethical principles. Hence the need to evaluate the existing Colombian regulation, for which a systematic review of the literature was carried out on databases from 2000 to 2020, websites of the Congress of the Republic of Colombia, the Australian Law Reform Commission and the Constitutional Court of Colombia, to identify the shortcomings and the successes in the current jurisprudence of the management, control and accessibility of the Colombian population to tests and genetic information. Australia is taken as a reference to understand and propose improvements. It was found that in Colombia genetic information is classified as sensitive (Sentence C-334-10) with non-specific regulations without legislative norm. In contrast, Australia has specific bioethical guidelines, criminalization and protocols that cover the individual and collective implications described in the Privacy Legislation Amendment Act of 2006. It is necessary that a specific legal regulation be created for genetic and genomic information with emphasis on usage guidelines on privacy, disclosure and non-discrimination in Colombia. ; La información genética y genómica requiere regulaciones estrictas para su manejo adecuado con el fin de evitar la divulgación inapropiada y la discriminación secundaria, pues tiene una relación directa con los derechos fundamentales y los principios bioéticos. In recent decades, criminal justice and mental health legislation across the globe has sought to manage and prevent the problem of repeat sexual violence. Perhaps some of the most restrictive measures have been those aimed at the preventive detention of those sex offenders thought to pose an elevated risk of re-offense. This paper examines Sexually Violent Predator (SVP) legislation, deemed constitutional by the U.S. Supreme Court in Kansas v. Hendricks (1997), and compares this post-sentence civil commitment scheme with preventive detention statutes targeted at, or otherwise applicable to, sexual offenders in several of the Commonwealth nations. Specifically, this paper examines the Australian Dangerous Prisoners (Sexual Offenders) Act (2003), which was upheld in Attorney- General (QLD) v. Fardon (2004) and which, similar to SVP legislation in the U.S., allows for the post-sentence preventive detention of sex offenders deemed to be at high risk of serious sexual recidivism. Moreover, this paper reviews the Dangerous Offender legislation in Canada, which allows for indeterminate detention of offenders at sentencing, as well as the Dangerous and Severe Personality Disorder (DSPD) designation in England, which authorizes transfer to secure commitment facilities those offenders thought to pose a serious risk of harm to others. A brief discussion of these alternative schemes concludes the paper. ; En décadas recientes, la justicia penal y la legislación de salud mental en todo el mundo ha buscado manejar y prevenir el problema de se reiterada violencia sexual. Tal vez algunas de las medidas más restrictivas han sido aquellas dirigidas a la detención de aquellos abusadores sexuales que se supone son de un riesgo elevado de reincidencia. Este documento examina la Legislación del Depredador Sexual Violento (SVP) considerada constitucional por la Corte Suprema de los Estados Unidos en Kansas contra Hendricks (1997), y compara este plan de compromiso civil post sentencia con los estatutos de la detención preventiva dirigidos a, o en otros casos aplicados a, los abusadores sexuales en varias de las naciones de la Commonwealth. Este documento examina, precisamente, a los delincuentes peligrosos (abusadores sexuales) de Australia Acto (2003), el cual fue ratificado por la Fiscalía General (QLD) contra. This paper aims to address, from a legal analysis, the situation that arises between registered trademarks and the limitations imposed by domestic legislation, as long as the latter can be considered as an unjustified interference in relation to rights trade or imply a redefinition of the protection of trademarks. For this, the precedents of Canada, Australia and the European Union will be analyzed, in order to determine to what extent they could influence Argentina and its legislation. First, the impact of tobacco / cigarette packaging and the FCTC / FCTC will be analyzed. Next, we will continue with the jurisprudence analysis of the Australian Court, which meant a necessary precedent for European Union legislation and jurisprudence. Finally, the article will focus on the possible impact that both the FCTC / FCTC and the leading cases of Australia and the EU may have on Argentina and to what extent the country took action in this regard. ; Este artículo tiene por objetivo abordar, desde un análisis jurídico, la situación que se plantea entre a las marcas registradas y las limitaciones impuestas por la legislación interna, en tanto que esta última pueda llegar a ser considerada como una injustificada interferencia en relación a los derechos comerciales o implicar una redefinición de la protección de las marcas comerciales. Para ello se analizaran los precedentes de Canadá, Australia y la Unión Europea, a los fines de determinar hasta qué punto los mismos podrían llegar a influir en Argentina y su legislación. En primer lugar, se analizará el impacto que tiene el empaque del tabaco/cigarrillo y el CMCT/FCTC. Seguidamente, se continuará con el análisis de jurisprudencia de la Corte Australiana, que significó un precedente necesario para que legislación y jurisprudencia de la Unión Europea. Finalmente, el artículo se concentrará en el posible impacto que, tanto el CMCT/FCTC como los leading cases de Australia y de la UE, pueden tener sobre Argentina y en qué medida el país tomó acciones al respecto. ; Este artigo tem como objetivo abordar, a partir de uma análise jurídica, a situação que surge entre marcas registradas e as limitações impostas pela legislação nacional, desde que esta possa ser considerada uma interferência injustificada em relação aos direitos comercial ou implica uma redefinição da proteção de marcas registradas. Para isso, serão analisados os precedentes do Canadá, da Austrália e da União Europeia, a fim de determinar em que medida eles podem influenciar a Argentina e sua legislação. Primeiro, o impacto das embalagens de tabaco / cigarro e da FCTC / FCTC será analisado. Em seguida, continuaremos com a análise de jurisprudência do Tribunal Australiano, o que significou um precedente necessário para a legislação e jurisprudência da União Europeia. Por fim, o artigo focalizará o possível impacto que a FCTC / FCTC e os principais casos da Austrália e da UE possam ter na Argentina e em que medida o país tomou medidas nesse sentido.
