Die Arbeit unterzieht die im Nachgang an das Caroline-Urteil des EGMR aus dem Jahre 2004 geänderte Rechtsprechung des BGH zur Bewertung der Zeitgeschichtlichkeit von Bildnissen i.S.v. § 23 Abs. 1 Nr. 1 KUG einer detaillierten Kritik. Die Untersuchung zeigt, dass die Rechtsprechung des VI. Zivilsenats zum sog. abgestuften Schutzkonzept Ergebnisse erzielt, die weder den betroffenen Interessen gerecht werden, noch die notwendige Rechtssicherheit liefern. Es ergehen widersprüchliche Entscheidungen, die zudem in zunehmendem Maße nicht mehr nachvollziehbar begründet werden. Der Persönlichkeitsschutz wird dadurch in grundrechtlich nicht zu rechtfertigender Weise verkürzt. Überdies wird die Frage beantwortet, wie die Zeitgeschichtlichkeit von Bildnissen richtigerweise zu beurteilen ist. Besondere Behandlung erfährt die normative Bestimmung des legitimen Informationsinteresses, welches für die Grenzziehung zwischen Persönlichkeitsrecht und Veröffentlichungsfreiheit als maßgeblich angesehen wird. / »The German Federal Court of Justice and the So-Called Stepped Protection Concept Within the Framework of Sec. 22 and 23 par. 1 no. 1 KUG« -- This paper deals with the case law of the German Federal Court of Justice on the right to one's own image. It shows that the results of the case law are not in line with the interests at stake and the protection of personality is not sufficiently considered. The work answers the question of when contemporary historical events exist that allow the publication of images without the consent of the person depicted within the framework of the relevant standards of German law.

Die Sozialgerichtsbarkeit ist zentrale Institution des sozialen Rechtsstaats. Hier werden soziale Rechte verwirklicht und der Sozialstaat erfahrbar. Zugleich sind die Sozialgerichtsbarkeit und ihre vor- und nebengelagerten Bereiche Orte, an denen gesellschaftliche Konflikte ausgetragen werden. Als solche sind sie bisher nicht Gegenstand umfassender Forschung. Der Band ist ein Beitrag zur interdisziplinären Sozialpolitikforschung und bringt unterschiedliche Perspektiven auf die rechtlichen und gerichtlichen Handlungsformen des Sozialstaats zusammen.
