Die Begriffe ›Verfassung‹ und ›Öffentlichkeit‹ kennzeichnen normative Ordnungsformationen und zugleich tatsächliche Dynamiken von Politik, Gesellschaft, Wirtschaft und Kultur. ›Verfassung‹ kann ›Öffentlichkeit‹ garantieren, aber auch regulieren – etwa durch Kommunikationsrechte oder die Publizität parlamentarischer Institutionen. Wenn ›Verfassung‹ als gegenüber der übrigen Rechtsordnung höherrangige Grundordnung politischer Gewaltübung verstanden wird und ›Öffentlichkeit‹ als Sphäre der Kommunikation, in der ein Austausch von Informationen und Meinungen im Zusammenhang politischer Willensbildung erfolgt, dann lassen sich vielfache Beziehungen zwischen beiden Phänomenen ausmachen. Die vielschichtigen Verflechtungen von ›Öffentlichkeit‹ und ›Verfassung‹ werden in den vorliegenden Beiträgen im Zusammenhang unterschiedlicher Kontexte der europäischen Geschichte zum Gegenstand verfassungshistorischer Reflexion gemacht, die vom frühen Mittelalter bis zur Gegenwart reicht und damit auch der Analyse des geltenden Verfassungsrechts wichtige Grundlagen bietet. / »Constitution and Public Sphere« -- The terms ›constitution‹ and ›public sphere‹ assign both formations of normative orders as well as dynamics of politics, society, economy, and culture. The contributions of this edited volume address the manifold entanglements of ›public sphere‹ and ›constitution‹ from the perspective of European history and in different context.
