Late Antiquity Profiles, held in Parma on 22 and 23 November 2018. They allow the reader to understand more closely the status of the military, the impact of their role in legal life and their link with civilian life.
The article proposes a linguistic analysis of the Italian law on informed con-sent and advance healthcare directives (or living wills). The study investigates the sty-listic features of the legal text. The analysis examines how the contents are organised within the text and considers the vocabulary regarding its accessibility. L'articolo intende valutare le criticità di una nuova tecnica decisoria della Corte costituzionale, introdotta per la prima volta nel 2018 per la risoluzione del caso Cappato. Con l'ordinanza n. 132 del 2020 la Corte costituzionale ha emesso una decisione con la quale ha rinviato la valutazione della legittimità costituzionale in tema di diffamazione a mezzo stampa al 22 giugno 2021. Dopo aver inquadrato la diffamazione a mezzo stampa nell'ordinamento italiano e la giurisprudenza della Corte europea dei diritti dell'uomo in relazione alla pena detentiva per i c.d. reati di opinione, si cerca di valutare quali siano le ragioni che hanno condotto la Corte costituzionale ad adottare tale decisione e, infine, come questa nuova tecnica decisoria si ponga nel delicato rapporto tra Corte costituzionale e legislatore ; The Constitutional Court, with its ruling n. 132/2020, postponed until the 22 of June 2021 the valuation about the fact that the prison sentence is applied as a punishment for libel. In the article, the author sets the libel in the framework of the Italian legal system and recalls the jurisprudence of the European Court of Human Rights. At the end, the author analyses the reasons that led the Constitutional Court to issue the ruling and the relationship between Parliament and the Constitutional Court in relation to this new decisional technique
Nella prefazione del volume 22 della Rivista Internazionale di Tecnica della Traduzione abbiamo voluto realizzare un'analisi critica dei lavori in esso contenuti. Si tratta di quattordici saggi scritti in italiano (sette), spagnolo (cinque), inglese (uno) e francese (uno) da ricercatori che lavorano presso università italiane e straniere. I contributi si occupano di studi nell'ambito della traduzione letteraria, della traduzione di testi scientifici, promozionali, giornalistici e turistici, della linguistica contrastiva italiano-spagnolo e italiano-inglese, della lessicologia, della linguistica dei corpora, della terminologia e dell'analisi linguistica di testi medici e di discorsi politici. Infine, un'autrice si è soffermata sull'importanza della traduzione di alcune classi di parole tra due lingue affini come l'italiano e lo spagnolo. Questa ricerca è particolarmente importante perché di solito a queste classi di parole spesso non si presta la dovuta attenzione.
Utatane (Fitful Slumbers, ca. 1260) describes a frustrated love affair with a nobleman of high rank from the perspective of a lonely woman who longs for the past. It is a sort of memoir narrated in the first person and written in a style that recalls court diaries and tales of the Heian period (794-1185). The conventions of court poetry, the lives and the female characters depicted in the Genji monogatari (The tale of Genji, XI sec.) and other stories are taken up by the Nun Abutsu and used cleverly in the text as productive ways to narrate her own life. Through a close reading of Utatane, this paper will focus on a few scenes that reveal why Genji monogatari in particular was considered a "literary encyclopedia" for women's creative inspiration in Kamakura period (1185-1333). The examination of some of the numerous literary allusions borrowed from Murasaki Shikibu's masterpiece will help the reader to understand why Nun Abutsu's intertextual strategies are so effective and what they tell us about her and other medieval women in a period of great political and social change.

This article analyzes some questiones quodlibetales (1296-1297) delivered by Peter of Trabibus, a Florentine Franciscan of Santa Croce. He reflects on and attempts to regulate Florentine society in times of unprecedented political and economic dynamism. Dealing with the definition of "new" sins, these questions examine tantalizing cases pertaining to economic life outside the convent, and which thus constitute matters of great juridical and political interest. The critical edition of Petrus of Trabibus' questions 17 to 22, Quodlibet 2, here published for the first time, completes this contribution.
L'avvio innanzi al Collegio di Garanzia dello Sport delle procedure arbitrali relative alle controversie nascenti in dipendenza dei contratti di mandato tra agenti sportivi ed assistiti, per effetto della recente emanazione del Regolamento CONI in materia, ai sensi dell'art. 22, comma 2, del Regolamento Agenti Sportivi, ha riproposto all'attenzione degli interpreti la questione della assoggettabilità degli agenti alla normativa federale e, in specie, al vincolo di giustizia sportiva. La questione viene affrontata nel presente lavoro sotto lo specifico angolo visuale afferente alla possibilità o meno di considerare la clausola compromissoria, inserita nei contratti di mandato tra agenti sportivi ed assistiti, come abusiva ai sensi della normativa contenuta nel Codice del Consumo, ovvero della disciplina di cui all'art. 1341, 2° comma, c.c. ; The arbitration proceedings before the Sports Guarantee Board, concerning disputes arising from the mandate contracts between sports agents and clients, recently started as a result of the recent issue of the CONI Regulation, pursuant to art. 22, par. 2, of the Sporting Agents Regulations, brought again to the attention of the interpreters the question of agents being subject to federal legislation and, in particular, to the constraint of sports justice. The issue is addressed in this paper under the specific perspective relating to the possibility or not of considering the arbitration clause, included in the mandate contracts between sports agents and clients, as abusive pursuant to the legislation on consumerism in the Consumer Code, or to the regulation on abusive clauses in art. 1341, par. 2, of the Civil Code.
Il contributo analizza la disciplina della prescrizione dell'illecito da reato di cui all'art. 22 d. lgs. n. 231 del 2001, nell'ottica di valutare la sua coerenza con riferimento alla cornice normativa del Decreto 231, e la sua ragionevolezza rispetto alla vigente regolamentazione del codice penale. In tale prospettiva emerge una disciplina alquanto singolare, che, oltre ad essere inidonea a fornire adeguate opzioni interpretative sul versante dogmatico, svela una forte divergenza rispetto a quella della prescrizione del reato; divergenza non giustificabile alla luce della dominanza genetica marcatamente penalistica che qualifica l'illecito dell'ente. Di qui un momento di frizione con l'art. 3 Cost., che risulta solo parzialmente attenuato dalla recente riforma della prescrizione del reato attuata con la l. n. 3 del 2019. ; This paper analyses the discipline of the statute of limitations on offence resulting from a crime pursuant to art. 22 d. lgs. n. 231 of 2001, with the aim of evaluating his coherence with reference to the legislative framework of the Decreto 231, and his reasonableness regarding the current regulation of the Italian criminal code. In this perspective a very peculiar discipline emerges, which, besides being unhelpful in giving adequate interpretative options on the dogmatic side, reveals a strong divergence with respect to the discipline of the statute of limitations on crimes: a divergence that has no justification in the light of the criminal genetic dominance that qualify the offence of the company. Hence, a contrast with the art. 3 Cost. arises, which is only partially mitigated by the recent reformation of the statute of limitations on crime, introduced by Law n. 3 of 2019.
In this article the author explores the cultural movement called Afrofuturism, tracing its origins, features, simbology, and its historical and political meanings. Starting from the (supposed) discoursive gap between African and African American people on one side and technology and science fiction on the other, this paradigm addresses themes related to the intersection of African Diaspora and African cultures with technology and science fiction, with the aim to recover the history of slavery and racism through the projections into alternative space-time contexts. In particular, the author explores the feminist afrofuturism perspective in order to examine the specific oppression and cultural production of African and African American women. In doing so, the author analyzes the development of afrofuturism in Italy, focusing on the work of the singer and beatmaker Karima 2G.
Sebbene l'Arte e la produzione artistica siano state da sempre una costante sociale, culturale ed economica nel nostro Paese, solo nell'ultimo secolo si sono susseguite una serie di regole legislative volte a determinare la protezione e la gestione della trasmissione dei diritti dei beni nei quali l'arte è impressa. Ci si è accorti, infatti, che le forme d'arte, costituendo valore fondamentale della cultura intera del nostro popolo, dovevano essere preservate e controllate in maniera tale da non disperdere le tracce solcate da chi ci ha preceduto. Dopo un'attività legislativa secolare e propedeutica, nel 2004, con il d.lgs del 22 gennaio n. 42, è stato emanato il Codice dei beni culturali e del paesaggio, testo che tutt'ora racchiude la protezione di tutti i valori che anzitutto la Costituzione ha sancito e ha inteso proteggere. Il legislatore, con il Codice dei beni culturali, si è assunto il compito di definire puntualmente il concetto di bene culturale oggetto della protezione, ma purtroppo non restituisce una definizione esaustiva di un'altra possibile faccia della medaglia, i beni d'arte, per i quali la disciplina di settore deve essere ricercata in un coacervo di disposizioni eterogenee, a partire dalle norme relative alla protezione del diritto d'autore, la cui legge principale è quella del 22 aprile 1941, n. 633, la cosiddetta 'legge autore'.Se da una parte la legge autore tutela il diritto dell'artista a che gli vengano riconosciuti dei diritti di natura morale, insieme a quelli di natura patrimoniale che possono essere oggetto di trasferimento, e di conseguenza una protezione soggettiva di chi possiede quei beni, il Codice ha un'impronta più pubblicistica, tutelando i beni culturali, ben definiti da una serie di parametri che la legge stessa impone, regolando la pubblicità del passaggio di proprietà, l'interesse dello Stato alla protezione di questi e alla valorizzazione mediante forme via via più complesse.
This article conducts an analysis of the instruments providing financial support for Member States in conjunction with the rules on the protection of human health, in order to assess if the latter have oriented the reaction of the European Union and its Member States to the Covid-19. The crisis caused by the Covid-19 pandemic, in fact, is of dual nature: it is a threat to human health and, at the same time, it requires huge financial resources for the recovery. Firstly, the author analyzes the main elements of the crisis. Secondly, the author focuses on the horizontal clauses that should orient the response of the EU to the pandemic, including Art. 35 of the Charter of Fundamental Rights of the European Union. Finally, the author examines some instruments giving financial assistance to Member States that could be activated to face the pandemic, in particular the European Stability Mechanism (ESM) and the draft Recovery Fund announced by the European Commission.
Nowadays the urban regeneration is the main tool through which the Italian Regions strive for the limitation of land consumption. This new objective for planning is not only a way of balancing different general interests, but it is becoming a benchmark for social, economic, and cultural interests too. The essay examines the concrete samples of the urban regeneration in Italy by comparing those coming from the Regional legislators with the ones based on civic initiatives. The author underlines both positive aspects and negative sides of them both. At the end, nevertheless, the Author tries to draw a more general conclusion, by arguing the environmental sustainability is a comprehensive curb even beyond the normative provisions. That way he considers that environmental sustainability is the main driver for territorial policies.
[The particularly vulnerable victims' testimony in the light of directive2012/29/EU] The particularly vulnerable victim called to witness has beenregulated in the code of criminal procedure by legislative decree no. 212/2015 which has transposed directive 2012/29/EU. The Author analyses this category of people and then he studies the protective measures when this type of victim takes on the role of "acquainted with the facts" or witness. He also highlights the most relevant questions, caused by the wording of European directive or by negligence in its national transposition. Finally the Author remarks that the legislator has frequently reformed the testimony of "weak" people, but there is a fundamental problem, which has never been solved (on the contrary, it has been exacerbated): the lack of coherence in the rules of the code.
This article carries out an analysis on the rules on passive electorate under EU Law, particularly in the framework of the European citizenship, focusing on the prerogatives of the European Parliament in this field. Following the analysis of the legal framework, the author examines on the case-law of the European Court of Justice, underlining the narrow approach usually adopted by the latter. In the second part of the article, however, the paper takes under consideration a judgement and an order issued in December 2019, regarding the election of some members of the Junts per Catalunya Party, which are interesting because the Court has interpreted the powers of the European Parliament in a broader sense. Starting from those decisions, the author makes some reflection on the necessity to strengthen the autonomy of the European Parliament trough an electoral reform.
