This article discusses some of the effects of the North American Free Trade Agreement (NAFTA) on Mexico's economy, society, & politics. The author argues that since the agreement went into effect in 1994, & in spite of the grave financial crisis that led to a significant devaluation in Dec 1994, there was an accelerated expansion of Mexican exports & an increase in foreign investment, further, the main macroeconomic variables show signs of recovery. However, NAFTA's impact on different economic activities & on different regions varies. Large transnational & Mexican enterprises have benefited more than small enterprises; northern Mexico more than southern Mexico. Not only small entrepreneurs but the Mexican society at large agree that these macroeconomic indicators have yet to be evident at the microeconomic level, in jobs or in family income. Economic liberalization & NAFTA affect the Mexican political system as actors, movements, & parties take advantage of them & interact more intensely both domestically & in external forums; as a result, domestic policy adopts an international dimension. NAFTA offers new opportunities but also implies important challenges. The necessary modernization of the private sector will have to meet the challenge of competing in the global economy while maintaining the competitive advantages of NAFTA & the agreements Mexico signed with several Latin American countries & the European Union. Most important is achieving economic modernization without social exclusion -- which has been the case thus far -- within the framework of a more efficient, dependable, & transparent State, & a more democratic society. 10 Tables, 4 Graphs. The study of the process preceding the July 2002 political shift in Mexico's government has been mainly focused on electoral issues. Therefore, several institutions of the political system that played a key role during the transition to democracy remain largely unknown, including governorships & the federal Congress, whose functioning experienced relevant changes & had an unprecedented bearing on the process. This paper explores the new political role of state governments, which was not due to a constitutional change, but rather was the result of two features of the process of change itself, namely, the expansion of pluralism & the gradual restraint of presidentialism. The author argues that the process of change prompted reactions from state governors that varied according to their PAN or PRD affiliation -- when they were still opposition -- or to their PRI origins -- the party still in power. The new institutional arrangement created before the political shift, in the midst of the electoral race, had an impact on the last PRI administration, but it also shaped a new relationship with the first democratic government, as it dismantled the foundations of ancient subordination. A secondary outcome of political change restructuring was the growth of local autonomies, whose manifestation varied according to governors' party membership. PRI governors were the major beneficiaries, as PAN governors -- the opposition -- focused their activities on administrative issues, while the former profited from a party network developed since the regime's inception. A positive upshot of this change for Mexico was that the president's bearing on politics management shrank. However, by putting the party's control in the hands of governors, a decisive element was transferred to a non-homogeneous & also conservative sector, deeply identified with the authoritarian regime. Having accomplished the political shift, the threat now is the likely re-emergence of ancient cacicazgos & the growth of a practice aimed at blocking federal government policies. 4 Tables. El texto de este artículo tiene por objeto dar noticia y ofrecer una
visión general de la última propuesta de Reglamento presentada por la Comisión
Europea en materia de protección de datos, con la intención de destacar aquellos
elementos más innovadores en relación con la normativa actualmente vigente.
No pretende ser un análisis exhaustivo del articulado que sin lugar a dudas en el
momento de su aprobación definitiva merecerá un estudio más pormenorizado,
pero sí destacar aquellas cuestiones que, a criterio de la autora, pueden ser más
llamativas o suponer un cambio de paradigma y que aunque a día de hoy todavía
no hayan entrado en vigor, sí dejan entrever el enfoque final que pueda acabar

a general vision about the last proposal of Regulation drafted by the European
Commission regarding the data protection with the intention of highlighting
those more innovatives elements in relation to the current legislation. It does not
pretend to be an exhaustive analysis of the articles, which will be necessary in
any case once the Regulation is enacted, but to emphasize those questions which
the author considers more striking or that mean a change of paradigm. Albeit the
regulation is not in force yet, it seems to suggest the final approach that may prevail
on the matter.
Los derechos de acceso, participación y tutela judicial, así
como la difusión de información en materia ambiental han sufrido una
gran evolución como consecuencia de la ratifi cación del Convenio de
Aarhus. Tanto la Unión Europea como los diferentes Estados han ratifi cado
este Convenio. No se puede menos que afi rmar el carácter democráticamente
avanzado de esta normativa, aunque la distancia entre norma y
realidad parece agrandarse en esta materia. Así lo pone de manifi esto el
autor cuando evidencia la utilización de instrumentos como la validación
legislativa, es decir, la intervención de los Parlamentos para legalizar en
algunos casos, o permitir en otros, intervenciones que los Tribunales han
considerado ilegales. En este punto la participación se niega radicalmente,
imponiéndose vía parlamentaria decisiones de ordenación del territorio
que deberían adoptarse por otros procedimientos y, en especial,
respetando los procesos participativos de la población. Las nuevas tecnologías
de la información ofrecen los instrumentos necesarios para lograr
que el acceso y la difusión de la información sean más fácilmente
realizables. En materia ambiental se ha producido un avance importante,
aunque la confrontación entre los derechos a la información y la obligación de difusión de los poderes públicos no se cumple con la debida efi -
cacia, tal como se evidencia en este estudio al realizar un análisis de las
páginas web que deben tener un contenido informativo ambiental determinado.
Concluye el autor llamando la atención sobre la necesidad de
modifi car la cultura democrática existente para que los derechos de acceso
y participación y la difusión de la información en materia de ordenación
del territorio y el medio ambiente se apliquen adecuadamente. Ingurumen arloan, sarbide, partaidetza eta tutoretza judizialeko

arloan, behar bezala aplika daitezen. The rights to access, participation and judicial protection
together with the dissemination of information in environmental matters
have undergone a great evolution because of the ratifi cation of the
Aarhus Convention. Both the EU and different States did ratify this Convention.
The democratically advanced nature of this Convention has to
be stated, although the gap between rule and reality seems to become
wider in this area. That is what the author points out by showing the use
of instruments as the legislative convalidation, that is, the intervention
by Parliaments to legalize in some cases, or authorizing in others, actions
considered illegal by the courts. Regarding this point, participation is radically
vetoed, and decisions on zoning which should have been adopted
by means of other procedures, specially by observing participative procedures,
are imposed by the Parliaments. New technologies of information
offer the necessary instruments to attain that access to and dissemination
of information are easy. There has been an important advance in
the environmental fi eld although the confrontation between the rights to
information and the obligation of dissemination by the public authorities
is not fulfi lled with the due effectiveness, as it is proved by the analysis
of the web sites which must have a specifi ed informative content. The
author fi nishes this article attracting our attention to the need of change
in the existing democratic culture so as to apply properly the rights of
access and participation and the dissemination of the information in the
fi eld of zoning and environment.
El trabajo señala la importancia del sector turístico para la Comunidad
Foral y plantea la necesidad de reformar en profundidad su regulación para
adaptarla a la Directiva de Servicios, apuntando diversas líneas de actuación. La
transposición de la directiva a la legislación turística efectuada por la Ley Foral
6/2010 fue parcial e incompleta, limitándose a introducir la figura de la declaración
responsable, como único requisito de inicio de la actividad e inscripción registral.
Por ello el autor propone reformar en profundidad la Ley Foral de Turismo para incorporar
a la misma, de manera conjunta y coordinada, las principales propuestas
y líneas de actuación que marca la Directiva, así como las nuevas realidades y
figuras turísticas que están surgiendo con fuerza en los últimos años en el sector

indar handiz sortzen ari diren errealitate eta figura berriak bezala. This paper highlights the importance of the tourism sector to the
Foral Community of Navarra and it sets out the need for an in depth reform of the
actual regulation in order to adapt it to the Directive of Services, pointing several
lines of action. The transposition of the Directive into the tourism legislation, by
virtue of the Foral Act 6/2010, was partial and incomplete, since it only introduced
the statement of responsibility, as the sole requirement for business start ¿ ups
and registration. The author proposes, therefore, a fundamental reform of the
Foral tourism legislation incorporating into it, in a cohesive and coordinated
manner, the main lines of actions which have been set out by the Directive and the
new realities and upcoming forms of tourism which are emerging strongly in the
last years in the tourism sector.
El trabajo analiza los elementos de argumentación en los que se
sustenta la STS de la Sala Tercera de 12 Febrero 2009, a la luz de la anterior doctrina
legal y jurisprudencial en materia de carreteras. Esta sentencia parece apuntar
a una nueva doctrina sobre la conceptualización de los peajes desde el punto
de vista de la reserva de ley a la que se sujetan las prestaciones patrimoniales de
carácter público, especialmente sobre aprovechamientos especiales o privativos
del dominio público. De confirmarse esta nueva doctrina las consecuencias para
el negocio de las autopistas, públicas o concesionadas, y para otras tarifas de naturaleza
privada sobre bienes demaniales, pueden ser considerables. El autor disiente
de la interpretación de la doctrina constitucional que efectúa la sentencia,
aportando lo que pueden ser elementos de una interpretación más coherente con

den interpretazioa ipintzen du mahai gainean. This works analyzes the elements of reasoning which serve as basis
for the Supreme Court Third Chamber ruling from February 12th, 2019 in the light
of the former legal and caselaw doctrine regarding roads. This judgment seems to
point at a new doctrine on the concept of tolls from the point of view of the reservation
as to legislation to which are bound the patrimonial provisions of public character,
in particular on special explotations or privative of the eminent domain. If this
new doctrine is confirmed, the consequences for the motorways bussines, publics
or in franchise, and for the private tariffs over public goods, might be important. The
author disagrees with the interpretation about the constitutional doctrine carried out
by the judgment, contributing with what can be considered elements of a more coherent
interpretation with the historical tradition in the field.
Un análisis de las novedades que presenta la Ley del Parlamento
Vasco 2/2006, de 30 de junio, de Suelo y Urbanismo en la regulación del estatuto
de la propiedad del suelo urbano, tanto de los criterios para su clasificación y categorización,
como los deberes establecidos para los propietarios de este tipo de
suelo. Asimismo, se destaca cómo el nuevo régimen del suelo urbano tiene incidencia
en los procesos de revisión y modificación del planeamiento vigente, haciéndose
hincapié en el estudio de las siguientes medidas: a) los límites mínimos
y máximos a la edificabilidad urbanística; b) las reservas para dotaciones públicas;
c) las limitaciones a los cambios de planeamiento. La autora anuncia una huida de
la actividad urbanística hacia el suelo urbano que requiere de menos obras de urbanización,
reservas para dotaciones y usos protegidos que el suelo urbanizable. Lurzoruari eta hirigintzari buruzko Eusko Legebiltzarraren ekainaren

erreserba gutxiago behar baititu. An analysis of the new features in the Basque Parliament Act 2/2006,
of June 30th, on Land and Urbanism of the regulation of the rules of the urban land,
both by the criteria of its classification and designation and the duties established for
the new land owners of this type of land. Likewise, it is emphasized how the new regime
on city land has an impact on the process of revision and change in current planning,
stressing the study of the following measures: a) minimum and maximum limits
to the development potential; b) reserves for the public equipment; c) limitations
to changes to the planning. The author announces an escape by the urban activity
towards the city land which requires less urban works, equipment reserves and protected
uses than building land.
Se analiza la necesidad de mantener la figura de los Patrimonios Municipales de Suelo, como «patrimonio separado» y con destino básicamente a la construcción de viviendas de protección pública. El autor defiende que la figura no sólo no ha perdido vigencia, sino que resulta de absoluta actualidad, porque la adquisición y disponibilidad pública de suelo es imprescindible para que los poderes públicos y, en concreto, los Ayuntamientos, puedan llevar adelante una política decidida de renovación urbana, de nuevas dotaciones, de reserva de espacios naturales y de promoción de vivienda protegida y, sobre todo, en alquiler. Pero sugiere determinados cambios legislativos, principalmente en la regulación autonómica, tanto en relación con los recursos que deben adscribirse obligatoriamente al PMS como en sus destinos, que deberían tener como fin, ante todo, la construcción, mantenimiento y mejora de la ciudad. It is analyzed the need of keeping the institution of city council propiertorship of land, as a «separate patrimony» and basically with the purpose of building social housing. The author argues that the institution is not only valid but also absolutely relevant because the public purchase and availability of land is essential for public authorities, and to be precise, for city councils in order to carry out a resolute policy of urban reorganisation, of new equipments, of reservation of open spaces and of promotion of subsidized housing and, above all, of social housing to rent. But he suggests specific legislative changes, mainly in the Autonomous regulation, both in relation to resources that should be attached to cities council propiertoship of land and in relation to its purposes, which should have as purpose, above all, the building, maintenance and improvement of the city.
El autor, desde la experiencia de haber participado en la elaboración de la legislación estatal de suelo, sitúa la ordenación territorial y urbanística sobre cimientos bien ajustados al orden constitucional, de tal suerte que huye de confiar la definición de la convivencia sobre el territorio al mero resultado del libre juego de las fuerzas que operan en el mercado. La regulación del derecho de iniciativa para la actividad de ejecución de la urbanización, en ejercicio del derecho de libre empresa ¿cuando la actividad no deba o vaya a ser realizada por la Administración¿ se debe llevar a cabo mediante un procedimiento con publicidad y concurrencia y con criterios que salvaguarden una adecuada participación de la comunidad en las plusvalías derivadas de las actuaciones urbanísticas. Asimismo, destaca el nuevo régimen de valoración del suelo de conformidad con el régimen básico de la propiedad aplicable al suelo rural o urbanizado. The author, with the experience of having participated in the drafting of the State legislation on land, places the rules on zoning and development on pillars clearly adjusted to the constitutional order and therefore avoids the definition of the management of the soil to the mere result of the free competition of market forces. The regulation of the right of initiative for the execution of urban development, within the exercise of freedom of
enterprise ¿when action must not or is not to be executed by the Administration¿ has to be carried out by means of a public and competitive procedure following criteria that protect an appropriate participation of the community in the capital gain derived from that same urban development. Likewise, he underlies the new regime of land valuation in conformity with the basic provisions on property applicable to rural and developed land.

En lo referido al sistema de distribución de competencias, la Sentencia
del Tribunal Constitucional 31/2010, de 28 de junio, sobre el Estatuto de Autonomía
de Cataluña, cierra la posibilidad de que las normas estatutarias modulen la
estructura competencial entre el Estado y la Comunidad Autónoma pese al teórico
protagonismo que el sistema constitucional confiere a las disposiciones estatutarias
en la articulación del bloque de la constitucionalidad y en la asunción de competencias.
En la doctrina emanada de la resolución 31/2010, el Tribunal Constitucional refuerza
su monopolio interpretativo sobre categorías generales en la definición funcional
de competencias (la llamada por el autor «hiperconstitucionalización» de la
estructura competencial) diluyendo el concepto de exclusividad aplicado a las competencias
reconocidas a las Comunidades Autónomas, renunciando a un concepto
general material-formal de legislación básica estatal y restringiendo el alcance de
las competencias ejecutivas de los mismos entes autonómicos. Eskumenak banatzeko sistemari dagokionez, ekainaren 28ko
31/2010 Epaiak, Kataluniako Autonomia Estatutuari buruzkoak, estatutu-arauek Estatuaren
eta autonomia erkidegoaren arteko eskumen-egitura modulatzeko aukera
bertan behera uzten du, nahiz eta sistema konstituzionalak estatutuen xedapenei
nolabaiteko protagonismo teorikoa ematen dien konstituzionaltasunaren blokea egituratzean
eta eskumenak hartzean. Hala, 31/2010 Ebazpenak erakusten duenez, Auzitegi
Konstituzionalak kategoria orokorren gaineko interpretazioaren monopolioa
berresten du, eskumenen definizio funtzionala egiterakoan (egileak eskumen-egituraren

autonomia-erakunde horien eskumen betearazleen irismena mugatzen du. As far as the allocation of powers is concerned, the 31/2010 ruling by
the constitutional Court, from June 28th, about the Statute of Autonomy of Catalonia,
opens the door to the possibility that the Statute norms modulate the competences
framework between the State and the Autonomous Community despite the theoretical
prominence awarded to the Statute provisions for the articulation of the block
of constitutionality and the assumption of competences. As the doctrine from the
31/2010 ruling by the Constitutional Court states, the Constitutional Court enhances
its interpretative monopoly on the general categories regarding the functional definition
of competences (the so called by the author hiperconstitutionalization of the
competences framework) wakening down the concept of exclusivity applied to the
competences recognized to the Autonomous Communities, renouncing to a general
material-formal concept for the State basic legislation and restricting the scope of the
executive competences of the Autonomous entities.
Se trata de realizar una síntesis de la problemática de la aplicación del art.149.1.1 CE como fuente de competencias urbanísticas del Estado, tanto con anterioridad a la entrada en vigor de la Ley 8/2007, como tras su aprobación, en la medida en que la nueva legislación estatal se erige como auténtica legislación básica en materia de urbanismo. Se aboga por una diferencia neta entre las valoraciones de suelo y las valoraciones de los derechos urbanísticos, así como en deslindar los derechos urbanísticos del derecho de propiedad del suelo. En tal sentido se defiende que los derechos urbanísticos se deben valorar de forma independiente y objetiva según la edificabilidad real prevista, y todo ello podrá materializarse o compensarse, según proceda con los deberes, dotaciones o gastos que sea necesario emprender, de tal suerte que podría articularse un sistema más objetivo y transparente de fundamentos materiales de igualdad para edificar el urbanismo del futuro.
Artikulu honek Espainiako Konstituzioaren 149.1.1 art.ren ezarpenak dakartzan arazoen sintesi bat egitea du lehen helburu. Izan ere, aipatu xedapena Estatuak hirigintza arloan dauzkan eskuduntzen iturri da, bai 8/2007 Legea indarrean sartu aurretik, bai indarrean sartu ondoren ere. Lan honetan, halaber, ezberdintasun argi baten alde egiten da: lurraren balioespenaren eta lur gainean edo zorupean sortzen diren hirigintza eskubideen artekoa, alegia. Honetara, hirigintza-eskubideak era objektiboan balioetsi behar direla defendatzen da, betiere, aurreikusitako benetako eraikigarritasuna aintzat hartuz. Eta hori guztia gauzatu edo konpentsatu ahal izango da egokitzat jotako moduan, aurreikusitako gastuak konpentsatuz. Hortaz, modu
honetan taxutu ahal izango litzateke objektiboagoa, gardenagoa eta materialki berdintasunean oinarritzen den sistema bat, betiere etorkizuneko hirigintza eraikitzeko xedearekin. The author tries to do a synthesis on the problems about the application of art. 149.1.1 as a source of State planning powers, either previously to the current legislation or after its enactment, as long as this new state legislation arises as the real basic legislation in the field of planning. It is pleaded for a clear difference between land valuations and valuations of rights of use of land, so as to clearly setting apart rights on use of land from rights to property of land. From that point of view, it argues that rights of use of land should be valued in a independent and objective way depending on the provided real buildable area, and all of it might be materialized or compensated, according to obligations, equipments and expenses that might be
necessary to undertake. Therefore, a more objective and open system could be articulated on the basis of material foundations of equality for the construction of planning in the future.
En este trabajo se exponen las reflexiones del abate Sieyès sobre la necesidad
de configurar un órgano de defensa de la Constitución. Sieyès ¿creador intelectual
de la distinción entre Poder Constituyente y poderes constituidos, y uno de los fundadores,
por tanto, del constitucionalismo contemporáneo¿ no sólo defendió siempre la necesidad
de establecer un procedimiento especial de reforma de la Constitución ¿aspecto este que
fue destacado por otros autores¿ sino que llevó a cabo también el diseño de un órgano
de defensa de la Constitución. En el contexto revolucionario francés, el abate de Frejús fue
el único en advertirlo. El órgano de defensa de la Constitución se configura como la clave
de bóveda de su modelo político y el corolario lógico del concepto de Poder Constituyente,
como fundamento del Estado Constitucional, por él alumbrado. Esta necesidad la advirtió
por vez primera en un importante discurso pronunciado el 2 de Termidor. Dos semanas
después desarrolló su idea en otro discurso proferido en la Convención Nacional, concretamente
el 18 de Thermidor del año III. En él, Sieyès se plantea la necesidad de crear un
«guardián de la Constitución» para que esta pueda configurarse como una norma jurídica
vinculante, y de obligatorio cumplimiento. Sieyès fue el primero en establecer con gran rigor
técnico, y con un muy elevado nivel de detalle, el diseño básico de esa magistratura,
tanto en lo que se refiere a su composición como a sus funciones. Y lo hizo anticipándose
a muchas ideas que son hoy patrimonio común del Derecho Constitucional europeo. Entre
ellas cabe destacar la configuración de la Justicia Constitucional como una institución protectora
de las minorías, como un órgano de integración política, como la suprema instancia
jurídico-política para la resolución de los conflictos constitucionales, y como una jurisdicción
de la libertad. Lan honetan, Konstituzioa defendatzeko organo bat osatzearen beharrari
buruz Sieyès apaizak egindako hausnarketak azaldu dira. Sieyès botere eratzailearen

bera garatu zuen Konbentzio Nazionalean eman zuen beste hitzaldi batean. Sieyèsek Konstituzioa
nahitaez bete beharreko arau juridiko loteslea izateko «Konstituzioaren zaindari»
bat sortu behar zela planteatu zuen. Sieyès izan zen magistratura horren oinarrizko diseinua
egiten lehena, zehaztasun tekniko eta xehetasun maila handiekin, bai osaerari bai funtzioei
zegokienez. Eta egun Europako Zuzenbide Konstituzionalaren ondare diren ideia asko aurreratu

gatazkak ebazteko instantzia gorena eta askatasun jurisdikzioa izatea. This work sets forth the critical thoughts of the Abate Sièyes regarding
the need to set up a body for the protection of the Constitution. Sièyes ¿the intelectual
author of the distinction between constituent power and constituted power, and one
of the fathers of the contemporary constitutionalism¿, did not only stand up for the
need to establish a special procedure for the reform of the Constitution ¿a facet which
was emphasyzed by another authors¿ but also he carried out the design of a body for
the defense of the Constitution. In the framework of the revolutionary french context,
the Abate from Frejús was the only one to notice it. The body for the defense of the
Constitution was envisaged as the cornerstone of his political model and the logic corollary
of the notion of constituent power, as the basis for the Constitutional state figured out by
him. This necessity was notized for the first time in an important speech pronounced the 2
of Thermidor. Two weeks later, he developed his idea in another speech issued before the
National Convention, specifically the 18 of Thermidor of the third year. Sièyes sets the need
to establish a «guardian for the Constitution» in order to become a binding legal rule of
compulsory observance. Sièyes is the firt one to establish with great technical rigour and
with a high level of details, the basic design of that court both regarding its membership
and its tasks. And he did it so foreseeing many ideas which are nowadays common ground
for the European Constitutional law. Among them it can be emphasyzed the configuration
of constitutional justice as a protective institution for minorities, as a body of political
integration, as the supreme instance for the resolution of constitutional conflicts and as a
jurisdicition for freedom.
