En septiembre de 1955, un movimiento encabezado por las Fuerzas Armadas junto con la adhesión de numerosos sectores civiles, dieron fin al gobierno peronista mediante un golpe de estado. Luego del mismo, y del fracaso del proyecto conciliador del General Eduardo Lonardi, el presidente Pedro Eugenio Aramburu habilitó una serie de acciones tendientes a revisar el "régimen depuesto". En este marco surgieron las denominadas Comisiones Investigadoras con la finalidad de obtener herramientas justificadoras de la persecución y proscripción del peronismo. En este trabajo analizaremos los expedientes que elaboró la denominada "Comisión n° 22", la cual tuvo a su cargo la investigación sobre lo actuado en YPF durante el gobierno peronista, enfocándonos en los tipos de denuncias que se hallaron en los mismos. La hipótesis que guía este artículo es que no solamente la Revolución Libertadora impugnaba la politización de YPF, que la habría llevado a la decadencia y por ende a la "entrega del petróleo", sino que lo que resultaba ahora inadmisible era la fidelidad al peronismo que todavía expresaban los agentes de la empresa estatal luego de 1955. From the creation of the free software in 70s, as an application that allows toshare information across the access not restricted to its source code, in anepoch where the copyright's laws did not exist that they were controlling andpenalizing for modifying a program, which was prosecuted was the diffusionof a legacy for the humanity who did not have an unique owner, in the sameway as the basic laws of the physics or the mathematics. Its currentpromotion has called the attention of governments who have adopted it,because as advantages as, the possibility of saving money in theimplementation of nacional technologies, for safety questions, or for the socialidealism of sharing without economic restrictions. Nevertheless, in theVenezuelan intellectual property legislation, the program of computationconstitutes a work from which there arises a series of exclusive rights fromuse and development for his author, that conceived this way, they constitute alimitation to the proper nature of a " free software ", and opposite to thisproblematics, one has worked in order to know each of these rights and theirapplicability in the above mentioned creation, to show a wide vision of thelegal repercussions that affect in the conditions, rights and obligations ofauthors and users of a opened standards software, identical to the IntellectualProperty Rights. For it there was adopted an investigation of documentarytype by bibliographical design and the method of documentary observation oflegal texts that regulate the intellectual property in the country, allowing toobtain results across a juridical applicable hermeneutics in the method ofdogmatic juridical analysis, concluding that the problematic circumscribe to noin the protection of the moral rights but the ones of exploitation. ; Desde la creación del software libre a partir de los años 70, como unaaplicación que permite compartir su información a través del acceso norestringido a su código fuente, en una época donde no existían las leyes decopyright que controlaran y penalizaran por modificar un programa, lo que seperseguía era la difusión de un legado para la humanidad que no tuviera unpropietario único, de la misma manera que las leyes básicas de la física o lasmatemáticas. Su actual promoción ha llamado la atención de gobiernosquienes lo han adoptado por ventajas como, la posibilidad de ahorrar dineroen la implementación de tecnologías a nivel nacional, por cuestiones deseguridad, o por un ideal social de compartir sin restricciones económicas.Sin embargo, en la legislación sobre propiedad intelectual venezolana, elprograma de computación constituye una obra de la que dimana una serie dederechos exclusivos de uso y explotación para su autor, que concebidos así,constituyen limitación a la naturaleza propia de un "software libre", y frente aesta problemática se ha trabajado con el objeto de conocer cada uno de esosderechos y su aplicabilidad en dicha creación, para mostrar una visión ampliade las repercusiones legales que inciden en las condiciones, derechos yobligaciones de autores y usuarios del software bajo estándares abiertos,acorde con el Derecho de Autor. Para ello se adoptó una investigación detipo documental con diseño bibliográfico y el método de observacióndocumental de textos legales que regulan la propiedad intelectual en el país,permitiendo obtener resultados a través de una hermenéutica jurídicaaplicable en el método de análisis dogmático jurídico y concluyendo que laproblemática radica no en la protección de los derechos morales sino en losderechos de explotación.

En este texto se revisita el concepto de autor a la luz de reflexiones como las suministradas por pensadores como Roland Barthes, Jacques Derrida, Hannah Arendt o Claude Lefort. El objetivo no consiste en continuar las tesis de «la muerte del autor» o las posiciones de la «estética de la recepción», sino en problematizar la misma idea de soberanía y en repensar la autoría desde un concepto diferente, si bien etimológicamente muy cercano, como es la autoridad. Para ello, se releerá el concepto de autor desde una perspectiva que, al menos parcial y potencialmente, se hallaba presente en su sentido premoderno, se explorará la compleja relación que el autor y su obra tienen con la tradición y la herencia y, finalmente, se examinará el rol activo y productivo que pueden llegar a desarrollar los lectores. ; In this paper, I will retake the concept of author from the reflections and the perspective of thinkers such as Roland Barthes, Jacques Derrida, Hannah Arendt or Claude Lefort. I do not intend to defend here the thesis of «the death of author» or the assumptions of the «reception theory». Instead, I want to problematize the notion of sovereignty in itself and to rethink the concept of authorship from the point of view of authority. To this purpose, I will reread the concept of author from a perspective that, at least partially and potentially, was present in its pre-modern sense, I will tackle the intricate relationship that both author and its work have with tradition and heritage, and finally I will examine the active and productive role that readers can have.

RESUMEN: La familia Kati es una de las más notables de la ciudad de Tombuctú, posiblemente el centro político, económico y cultural más importante del África Occidental subsahariana a partir del siglo XIII. A esta familia perteneció el que ha sido generalmente considerado autor del Taʾrīj al-Fattāš, Maḥmūd Kāti. Esta crónica es una fuente esencial para el conocimiento de la historia del que los autores árabes medievales llamaron Bilād al-Sūdān, el País de los Negros. El objetivo de este artículo es revisar la tradición mantenida en el seno de la familia de que el padre de Maḥmūd Kāti, descendiente de un antiquísimo linaje andalusí, se instaló en el Sudán Occidental en el último tercio del siglo XV, procedente de la Península Ibérica.ABSTRACT: The Kati family happens to be one of the most dignitary in the city of Timbuktu, which is probably the most important political, economic and cultural center of the Western Sub-Saharan Africa since 13th century on. The mostly considered author of theTaʾrīj al-Fa ttāš, Maḥmūd Kāti, was part of this family. This chronicle is an essential source for the knowledge of the history of which Medieval Arabian writers called Bilād al-Sūdān, the Country of Black People. The aim of this article is to review the tradition kept within the family, that Maḥmūd Kāti's father, descendant of a very old Andalusi lineage, settled in Western Sudan in the last third of 15th century, coming from the Iberian Peninsula.

Nacido en 1536, Juan de Mariana estudió artes y teología en la Universidad de Alcalá y, a los diecisiete años, ingresó en la recién aprobada Compañía de Jesús. Llamado a Roma por el segundo prepósito general jesuita, Diego Laínez, enseñó en esta ciudad, en Sicilia y en París, hasta regresar, en 1574, a España. El problema:¿De qué manera el segundo párrafo del artículo 22 del Código Penal colisiona con el artículo 2 numeral 2 de la Constitución Política del Estado? Siendo el objetivo:Explicar de qué manera el segundo párrafo del artículo 22 del Código Penal colisiona con el artículo 2 numeral 2 de la Constitución Política del Estado. El material y método de la investigación:Se aplicó un cuestionario estructurado a una muestra de 10 jueces, 10 fiscales y 50abogados por variable, El diseño fue no experimental transversal. Para el análisis estadístico se usó estadística descriptiva.Siendo el resultados:Que el segundo párrafo del artículo 22 del Código Penal, colisiona con el artículo 2 numeral 2 de la Constitución Política del Estado. Llegando a la siguiente conclusión: Que es necesario realizar una modificatoria al artículo 22 del Código Penal, debiendo suprimirse el segundo párrafo del artículo antes indicado, por contravenir expresamente a la Constitución Política del Estado. ; The problem: How does the second paragraph of article 22 of the Penal Code collide with article 2, number 2 of the Political Constitution of the State? The research material and method: A structured questionnaire was applied to a sample of 10 judges, 10 prosecutors and 50 lawyers per variable. The design was non-experimental transversal. For the statistical analysis, descriptive statistics were used. The object of this work is the tacit submission before civil or commercial courts of States members of the European Union. Theirs advantages, requirements and consequences are object of a meticulous analysis that shows the problems of legal interpretation with they will have to face the legal operators. ; El objeto de este trabajo es la sumisión tácita ante tribunales civiles o mercantiles de Estados miembros de la Unión Europea. Sus ventajas, requisitos y consecuencias se someten a un minucioso análisis que muestra los problemas interpretativos con los que tendrán que enfrentarse los operadores jurídicos.

A partir del significado de "archivo" que encontramos en la Arqueología del saber, de Michel Foucault, y las interpretaciones que de él hace Giorgio Agamben en Lo que queda de Auschwitz, exponemos algunas consideraciones sobre el concepto de autor en los que hemos denominado "archivos del mal", refiriéndonos con esta expresión a los conjuntos documentales producto de situaciones o regímenes propicios a crear escenarios de violencia disímiles. Estos archivos que, generalmente, se originaron en el ejercicio de unas funciones institucionales, forman parte hoy día de los fondos llamados comúnmente "centros de memoria histórica" y son necesarios poner en marcha el ejercicio de los derechos democráticos. La biografía de Ildefonso Nalda Nájera, que murió en el Campo de Concentración de Mauthausen y el Archiv der KZ-Gedenkstätte Mauthausen, que ahora custodia documentos y objetos relacionados con el Campo de Concentración, constituyen el modelo que ha guiado este artículo. ; Based on the meaning of "archive" found in the L'archéologie du savoir by Michel Foucault and the interpretations that Giorgio Agamben makes of it in Quel che resta di Auschwitz, we present some considerations on the concept of author that we have called "archives of evil". These archives were mostly originated in the exercise of institutional functions. Today they are part of the funds of the commonly called "historical memory centers", regulated by the exercise of democratic rights. The biography of Ildefonso Nalda Nájera, who died in the Mauthausen Concentration Camp, and the Archiv der KZ-Gedenkstätte Mauthausen, that nowadays holds documents and objects related to the Concentration Camp, constitute the model that has guided this article.
