Magistrsko diplomsko delo z naslovom Glavna obravnava v upravnem sporu kot človekova pravica celovito obravnava vprašanje (ne)izvedbe glavne obravnave v upravnem sporu. Mednarodni in slovenski predpisi predvidevajo javne sodne postopke z neposrednim ustnim obravnavanjem zadev. Prvi odstavek 6. člena Evropske konvencije o varstvu človekovih pravic in temeljnih svoboščin določa, da je javna obravnava sestavni del pravice do poštenega sojenja. Ustava Republike Slovenije posredno ureja glavno obravnavo v upravnem sporu, in sicer zlasti v 22. členu (enako varstvo pravic), 23. členu (pravica do sodnega varstva) in 24. členu (javnost sojenja). Glavno obravnavo kot zakonsko materijo podrobneje urejajo določbe Zakona o upravnem sporu in Zakona o pravdnem postopku. Izhajajoč iz ugotovitev Evropskega sodišča za človekove pravice, Ustavnega sodišča Republike Slovenije in Vrhovnega sodišča Republike Slovenije v magistrskem diplomskem delu zagovarjam dosledno izvedbo glavne obravnave, predvsem v primeru spornega dejanskega stanja in ko stranka njeno izvedbo izrecno zahteva. Vrhovno sodišče Republike Slovenije in Ustavno sodišče Republike Slovenije sta v novejši sodni praksi zavzela enotno stališče, da ima glavna obravnava v upravnem sporu enako naravo in smisel kot glavna obravnava v katerem koli drugem sodnem postopku. Ustavno sodišče Republike Slovenije je pravico do glavne obravnave v upravnem sporu opredelilo kot samostojno človekovo pravico, ki jo zagotavlja 22. člen Ustave Republike Slovenije. Pravica ni absolutna, zato morajo biti posegi vanjo zakonsko določeni ter prestati ustavna testa legitimnosti (tretji odstavek 15. člena Ustave Republike Slovenije) in sorazmernosti (2. člen Ustave Republike Slovenije). ; The master's thesis titled The main hearing in an administrative dispute as a human right comprehensively deals with issues regarding decision-making in an administrative dispute. International and Slovenian legal acts envisage public legal procedures with direct oral proceedings. The right to an oral hearing is an integral part of the right to a fair trial, as guaranteed by Article 6 of the European Convention on Human Rights. The Constitution of the Republic of Slovenia indirectly regulates the right to a main hearing in an administrative dispute, especially in Article 22 (Equal Protection of Rights), Article 23 (Right to Judicial Protection) and Article 24 (Public Nature of Court Proceedings). The right to a main hearing is specified in the Administrative Dispute Act and the Contentious Civil Procedure Act. Building on the findings of the European Court of Human Rights, the Constitutional and the Supreme Court of the Republic of Slovenia, the master's thesis advocates for the consistent execution of the main hearing, particularly in cases where facts are being disputed and when a party explicitly demands it. The Constitutional and the Supreme Court of the Republic of Slovenia agreed that the main hearing possesses the same nature and meaning in an administrative dispute as it does in any other judicial proceeding. The Constitutional Court of the Republic of Slovenia has declared the right to a main hearing in an administrative dispute as an independent human right, which is guaranteed by Article 22 of the Constitution. As the right is not absolute, the absence of the main hearing is only permissible in duly justified cases prescribed by law and when the Constitutional tests of legitimacy (paragraph 3 of Article 15 of the Constitution) and proportionality (Article 2 of the Constitution) are passed.
V pričujočem delu se avtorica loteva raziskovanja terapevtovega doživljanja terapevtskega odnosa in sicer skozi prizmo navezanosti. Teoretični uvod tako predstavlja podrobno predstavitev teorije navezanosti od Bowlbyja naprej. Avtorica pregleda zgodovino koncepta kot tudi njegov razvoj in etiologijo. Drugi del teoretičnega uvoda je sestavljen iz predstavitve koncepta terapevtskega delovnega odnosa in njegove implikacije za terapevtsko delo. Avtorica se znova poglobi v razumevanje koncepta in skuša slediti njegovemu razvoju. Delo nato preide na raziskovalni del. Avtorico je zanimalo, kako terapevti doživljajo terapevtski odnos skozi lečo navezanosti. Za ta namen je terapevtski odnos razdelila na tri faze – fazo prednavezanosti, ki jo zaznamuje vzpostavljanje kontakta in učenje pravil terapevtskega dela, sledi ji faza oblikovanja navezanosti, kjer je dinamika že utečena, klienti pa opažajo prve spremembe v svojem življenju, in zadnja faza, torej faza navezanosti, ki jo oblikuje visoka stopnja zaupanja, jasna komunikacija med klientom in terapevtom in dobra delovna aliansa. Avtorica je za namen naloge intervjuvala osem terapevtov in podatke, pridobljene v teh intervjujih analizirala s pomočjo kvalitativne metode fenomenološke raziskave. Ugotovitve so pokazale, da se doživljanje terapevtov v veliki meri sklada z do sedaj aktualno teorijo. V fazi prednavezanosti so terapevti poročali o tem, da se odnos šele oblikuje, zaupanje vzpostavlja, komunikacija še usklajuje. V fazi oblikovanja navezanosti terapevti poročajo o naraščajočem zaupanju in opažanju sprememb in v zadnji fazi poročajo o močni navezanosti in z rastjo odnosa vedno bolj enakovreden odnos med terapevtom in klientom. To je tudi obdobje, ko klient in terapevt načrtujeta zaključek. Raziskovalno delo je avtorici ponudilo vpogled v globoko doživljanje terapevtskih odnosov s strani terapevta, spoznala je izzive, s katerimi se terapevti srečujejo pri svojem delu, pa tudi dobrobiti terapevtskega dela. V svojem delu je avtorica izpostavila tudi pomanjkanje informacij s področja raziskovanja terapevtske perspektive. ; In the current master thesis, the author is exploring a therapists' perception of psychotherapy process through the lens of attachment. The theoretical part consists of precise description of ontogeny of the attachment theory from his beginner, John Bowlby. The author follows the history and etiology of the mentioned concept. The other part of the master thesis consists of presentation of the working alliance concept and its indication for therapeutic work. Author tries to get an overall understanding about the concept, its origins and current implications. In the current master thesis, the author was interested in therapists' perception of psychotherapy relationship through the attachment perspective. To enquire about it she divided the attachment process on three main stages – the preattachment stage, characterized by first contact and establishment of communication, second stage, namely attachment in the making stage, where the trust and therapy framework is already established and clients can see first changes, and last, third phase that is the attachment phase, where therapist and clients have high level of trust, good communication and good working alliance. Author interviewed eight therapists and analyzed the information from the interviews via phenomenological research. Results have shown that the way therapists from the research see their relationships folds well with the current theory from the field. In the preattachment stage the therapist spoke about the way the relationship has yet to be built, the trust has yet to be gained and communication is still on shaky grounds. In the second, attachment in the making phase, therapists observe deeper trust, clients start seeing changes in their lives and in the last, attachment phase they describe the relationship as of one of strong attachment. With continuation of the relationship the relationship itself become more of an equal one and is, as such, slowly transcending into the conclusion phase. The research work enabled the author to see the depth of the therapists' experiencing of the relationships they make with their clients, she get to know the challenges of the therapeutic relationships and also the benefits of it. As a conclusion, the author exposes the lack of information available on research done of exploring the therapists' perspective.
Uradniški svet je samostojen in neodvisen organ, ki je bil ustanovljen z namenom depolitizacije državne uprave. Člani Uradniškega sveta določijo standarde in normative ter merila za izbiro kandidatov, ki se prijavijo za položaj najvišjih javnih uslužbencev. Kadar slišimo pojem politizacije se nam takoj ustvari nekakšna slika kako politika skozi politično kadrovanje poskuša vplivati na delovanje državne uprave in tako uveljaviti svoje interese in cilje. Politizacija ni nov pojav in tudi ne redek, z njo se srečujemo vsak dan in na vseh nivojih upravljanja (lokalnem, nacionalnem in nadnacionalnem). Avtor zaključnega dela raziskuje spolitiziranost Uradniškega sveta, cilj naloge pa je kako in na kakšen način se odraža spolitiziranost Uradniškega sveta in kako le ta vpliva na imenovanje najvišjih javnih uslužbencev v Sloveniji. Na podlagi vprašalnika, intervjujev ter analize dela je avtor prišel do ugotovitev, da lahko zasledimo obrise spolitiziranosti Uradniškega sveta. Bolj kot spolitiziranost Uradniškega sveta pa se kaže kako in na kakšen način poskuša politika imenovati najvišje javne uslužbence. ; Officials Council is body outside the government and was established to depoliticize administration in Slovenia. Members of Officials Council set standards, norms and criteria for the selection of candidates for the position of senior civil servants. When we hear the notion politicization, we immediately think how politics try to influence and enforce their interest threw a form of political recruitment in administration. Politicization is not a new phenomenom and it is not uncommon. We can find politicization at every level of governance (local, national and even transnational). The author researches the politicization of the Officials Council. In particular, he is interested in how and in what way the politicization of the Officials Council is reflected and how it affects the appointment of the highest civil servants in Slovenia. Through in-depth interviews, questionnaire and analysis of the work of Officials Council the author found out that we can see politicization of the Officials Council, but more than that we can see how politics try to affect on appointing the high-ranking civil servants.
The question of inequality of men and women became a world problem in second half of the 20th century and the solution has been sought by important international organisations (OZN), European Union and individual states. Assuring same options for both sexes in all departments and on all levels of life became one of preferential tasks of European Union since we can still find different forms (open and hidden) of gender discrimination in modern states. In the fist part author presents key features of male centred traditional social order in western civilisation, main characteristics and bearers of ensuring same opportunities for both genders stretching from global to European level. Informal and formal education have important role with the process of abolishing discrimination. Educators carry new patterns of relationship between sexes and it is therefore important that they are educated and also lifelong educated, especially those who are on key positions and make decisions in all areas of life. Author therefore in the second part presents some approaches and usages of such education in members of European Union and in Slovenia. ; Vprašanje družbene neenakosti žensk in moških je v drugi polovici 20. stoletja postalo svetovni problem, ki so se ga resno lotile pomembne mednarodne organizacije (OZN) in državne skupnosti (EU) ter posamezne države. Zagotavljanje enakih možnosti za oba spola na vseh področjih in na vseh ravneh življenja je postalo ena prednostnih nalog EU, kajti v sodobnih družbah še obstajajo različne oblike (odkrite in zlasti prikrite) diskriminacije po spolu. Avtorica v prvem delu razkriva ključne značilnosti moškosrediščnega tradicionalnega družbenega reda v zahodni civilizaciji ter predstavlja glavne značilnosti in nosilce zagotavljanja enakih možnosti žensk in moških od globalne do evropske ravni. Pomembno vlogo pri odpravljanju diskriminacije imata formalno in neformalno izobraževanje. Ker pa morajo biti tudi izobraževalci in nosilci novih vzorcev odnosov med spoloma izobraženi, je pomembno vseživljenjsko izobraževanje odraslih, zlasti tistih, ki zasedajo ključne položaje odločanja na vseh področjih življenja. Zato avtorica v drugem delu prispevka predstavlja nekatere pristope in prakse takšnega izobraževanja v drugih državah članicah EU ter v Sloveniji.
Avtorica v magistrskem delu obravnava vpliv Listine Evropske unije o temeljnih pravicah na upravni postopek v državah članicah. V začetku prikaže razvoj varstva temeljnih pravic v okviru Skupnosti, zatem podrobneje predstavi temeljne značilnosti Listine ter povzame ugotovitve o uporabi Listine v državah članicah, ki izhajajo iz poročil o temeljnih pravicah Agencije Evropske unije za temeljne pravice. Že v začetnih poglavjih na relevantnih mestih opozori na prednosti in slabosti Listine, ki bi utegnile vplivati na upravni postopek. V nadaljevanju se posveti kritični obravnavi vpliva, ki ga imata na nacionalni upravni postopek dve najbolj procesno naravnani pravici iz Listine, in sicer pravica do dobrega upravljanja (41. člen Listine) in pravica do učinkovitega pravnega sredstva in nepristranskega sodišča (47. člen Listine). Nato na primerih iz sodne prakse Sodišča Evropske unije in nacionalnih sodišč prikaže, kako Listina vpliva na ugotovitveni postopek, obveznosti upravnih organov pred izdajo odločbe, možnost sodne kontrole nad upravnimi akti ter na pravnomočno zaključene zadeve. ; The thesis examines the impact of the Charter of Fundamental Rights of the European Union on the administrative procedure in Member States. In the introductory chapters, the developments in the protection of fundamental rights within the European Communities are outlined and the main features of the Charter are presented in greater detail. The key findings on the application of the Charter in the Member States are drawn from the annual fundamental rights reports that are prepared by the European Union Agency for Fundamental Rights. Throughout the entire thesis, strengths and weaknesses of the Charter that would have a significant impact on the administrative procedure are referenced where relevant. Further on, the Author critically examines the impact of the right to good administration (article 41 EU Charter) and the right to an effective remedy and to a fair trial (article 47 EU Charter), both of procedural character, on the national administrative procedure. Finally, referring to examples acquired from the recent case law of the Court of Justice of the European Union and national case law, the Author demonstrates how the Charter impacts the fact assessment procedure, the obligations of administrative bodies throughout the proceeding, the possibility of judicial review of administrative action and the impact on final administrative decisions.
Avtor v članku opredeli štiri faze razvoja prebivalstva v mestu Maribor. Hitri rasti števila prebivalstva v 60. letih 20. stoletja je sledila stagnacija v 80. letih in nato depopulacija v 90. letih in po letu 2000. V primerjavi z drugimi večjimi mesti v Sloveniji je bila depopulacija najbolj intenzivna prav v Mariboru (med letoma 1981 in 2008 se je število prebivalcev zmanjšalo za okoli 12 %). Naravni prirast je v mestu konstantno negativen vse od leta 1985 dalje, selitveni prirast pa je bil negativen med letoma 1992 in 2007. Maribor med večjimi slovenskimi mesti izkazuje tudi najbolj neugodno starostno sestavo prebivalstva z najvišjim deležem starega prebivalstva in najvišjim indeksom staranja, po zadnjem popisu prebivalstva pa zaostaja za drugimi mesti tudi po deležu prebivalstva z višje ali visoko šolsko izobrazbo, čeprav je drugo največje univerzitetno mesto v Sloveniji. Glede na ugotovljene demografske značilnosti se bo v naslednjih dveh desetletjih v mestu bistveno povečal delež prebivalstva v starosti nad 65 let, kar bo zahtevalo nove oblike organiziranja dejavnosti v mestu in prilagajanja starejši populaciji. ; Author identified four stages of demographic development in the city of Maribor (Slovenia). Population growth in the 1960s was followed by stagnation of population in the 1980s and depopulation in the 1990s and after 2000. In Maribor, compared with other major cities in Slovenia, depopulation have been more intensive (between 1981 and 2008, the population decreased by about 12 %). Natural growth is constantly negative from 1985 onwards, and net migration was negative between 1992 and 2007. Maribor is also showing the most unfavorable age structure of the population with the highest proportion of the elderly population and the highest aging index. Furthermore, according to the last census it lags behind other towns in the share of population with high school education, although it is the second largest university town in Slovenia. Considering the established demographic characteristics, and significant increase of the share of the population over 65 years in the next two decades, this will require new ways of organizing activities in the city and its adaption to the elderly population.
Dogajanje v času komunistične revolucije bistveno vpliva tako na stanje kot tudi na razumevanje sodobne slovenske družbene situacije. V disertaciji avtorica v luči idejnega nasprotja med krščanstvom in komunizmom ter na podlagi konflikta, ki se je obenem razvil v obdobju revolucije, razišče vzroke in podlage za omenjeni vpliv. Avtorica v delu pokaže na temeljno povezanost sodobnega položaja in komunistične revolucije na Slovenskem. Kot pojmovni okvir ter orodje za razumevanje izbere Girardovo mimetično teorijo in teorijo o grešnem kozlu. Girard namreč kulturo opisuje kot mimetični cikel, kjer posameznik posnema drugega (tako se začne že v samem otroštvu, ko otrok posnema starše in s tem postane družbeno bitje). Posnemanje je gonilo vsake družbe. Poleg tega pa posnemanje lahko omogoči tudi uničenje družbe, kulture. Girard vpelje grešnega kozla kot razrešitev konflikta, kjer imata dva subjekta enako željo in se skupaj obrneta proti grešnemu kozlu, ki zanju predstavlja vzrok mimetične krize, in je njegovo žrtvovanje pogoj za ponovno vzpostavitev družbenega reda in socialne varnosti. Ta teo-retični okvir omogoča tudi raziskovanje preteklih družbenih konfliktov, posebej pa tudi njihovih posledic v sodobnosti, vključno z vidiki spravnih procesov ter tranzicijske pra-vičnosti. Zato ga avtorica plodno uporabi pri omenjenem raziskovanju. Kot dve nasprotujoči idejni podlagi avtorica predstavi krščanstvo in komunizem, ki sta že v svojem idejnem temelju diametralno nasprotni, posebej pa ju prikaže preko Girar-dove teorije. Krščanstvo s krističnim pojmovanjem osebne svobode izstopi iz cikličnosti mehanizma grešnega kozla, komunizem pa prav nasprotno temelji na mimetičnosti. Žrt-vena znamenja v Girardovem pojmovanju, ki opravičijo umor grešnega kozla, temeljijo na dejstvih, ki postanejo sprejemljiva za umor, ne glede na (ne)resničnost le-teh. Implementacija Girardove teorije na slovensko situacijo zajema dva ključna vidika. Prvi vidik je žrtvovanje nasprotnikov komunistične revolucije z žrtvenimi znamenji kolabo-racije, nemirov … Omenjeno žrtvovanje omogoči vzpostavitev totalitarnega komunisti-čnega režima v kraljevini Jugoslaviji in s tem tudi na Slovenskem. Komunizem kot tota-litarni režim ne dopušča alternative, človeka uniformira in osami. Obenem vzpostavi totalni nadzor in teror. Krščanstvo po drugi strani človeka opolnomoči z bogopodobnos-tjo in s tem edinstvenostjo, nedotakljivostjo, nezamenljivostjo ter svobodo. Drugi vidik pa zadeva dejstvo, da konflikt iz časa komunistične revolucije še vedno ni razrešen ter je vladavina prava in vzpostavitev demokratične družbe še vedno nedokon-čan projekt. Kljub demokratični državni ureditvi in propadu komunizma kot dolgoroč-nega družbenopolitičnega in ekonomskega sistema avtorica poudari dva izziva sodobne družbe na Slovenskem. Prvi je prisotnost komunistične ideologije v razmišljanju in delovanju posameznikov, drugi izziv pa je nezadostna uveljavitev tranzicijske pravično-sti. Omenjeni vidiki analize temeljijo najprej že v samem idejnem nasprotju in zasnovi tako komunizma kakor tudi krščanstva. Krščanstvo in komunizem sta v svojem temelju različna. Poseben poudarek je na vidikih dojemanja človeka kot svobodnega in razumskega bitja v obeh idejnih okvirih. Komunizem s komunistično revolucijo nastopi proti človeku, proti človekovemu dostojanstvu in proti človekovi svobodi in s tem krščanstvo postavi v obrambno držo. S tem pa tudi Cerkev, ki je kot ene vidnejših institucij komunistična revolucija ni prevzela in obvladovala, postane braniteljica človekovega življenja in človekovih pravic, obenem pa je postavljena nasproti komunistični revoluciji. Krščanstvo in tudi Cerkev se posluži različnih načinov obrambe in upora, ki niso vselej povsem skladni s krščanskim naukom. Metode obrambe so bile: krščanska drža v odnosu do vojne, do sočloveka, do okupatorja in do revolucionarnih sil, fizična obramba, sodelovanje tako z okupacijskimi kakor tudi revolucionarnimi silami, kulturna, medijska in politična udejstvovanja. Kljub temu je revolucionarno nasilje eskaliralo predvsem v zadnjih letih druge svetovne vojne in prvih letih po revoluciji. Situacije, v katere so bili postavljeni posamezniki na Slovenskem, niso bile enoznačne ali enostavne. Ni šlo zgolj za izbiro med revolucionarno ali protirevolucionarno stranjo, temveč so bile okoliščine zaradi okupacijskih sil bolj zapletene. Ljudem je grozilo neodobravanje, preganjanje ali nasilje z vseh strani. Komunistična partija je monopolizirala odpor proti okupacijskim silam. Že zametki kakršnekoli druge neodvisne organizacije upora so bili lahko kaznovani. Nemalo kristjanov je z namenom domoljubnosti ali nezmožnosti izognitve mobilizaciji postalo del osvobodilnega gibanja, ne glede na ideološko podlago gibanja ali organizacije, ki je gibanje organizirala. Cerkev kljub temu ni bila preveč zaželen partner v uporu, o čemer priča tudi Kardeljevo navodilo: "Duhovne v četah vse postreljajte" (Griesser-Pečar 1996, 109). Ne zgolj navodilo, tudi načrtno degradiranje duhovnikov z zaporom, priporom, deportacijami in usmrtitvami so priča odnosu komunistične partije do cerkvenih dostojanstvenikov. Revolucionarno nasilje je pustilo neslutene posledice ne zgolj v tedanjem obdobju, temveč tudi za sedanji čas, pri čemer pri avtoričinem raziskovanju teh posledic pomembno vlogo igrajo tudi osebne zgodbe, odgovornost na osebni ter družbeni ravni in medgeneracijski prenos travm, ki onemogočajo pravo tranzicijo iz totalitarnega v demokratični sistem. Tranzicija in tranzicijska pravičnost je torej mehanizem, ki si prizadeva v polnosti izpeljati tranzicijo na osebni in družbeni ravni ter vzpostaviti zaupanje v državne institucije, delovanje državnih struktur. Situacija na Slovenskem sicer nakazuje na nekatere pozitivne učinke tranzicijske pravičnosti, kot sta denacionalizacija in odprtje arhivov. Še vedno pa umanjka uveljavitev pravičnosti na osebni ravni, pri čemer so pomemben vidik spravni procesi ter prekinitev medgeneracijskega prenosa travm. Podobno kot na osebni ravni umanjka pravičnost v javni sferi, na primer pluralizacija medijskega prostora, urejene gospodarske pobude, dialog med različnimi družbenimi skupinami, vključno z vstopanjem verskih skupnosti v javno razpravo, vzpostavljanjem zaupanja v državne institucije ipd. Pogled na komunistično revolucijo na Slovenskem skozi prizmo Girardovega grešnega kozla ponudi edinstven okvir, ki poveže razumevanje komunistične revolucije in komu-nističnega sistema s sodobnim položajem slovenske družbe. Po eni strani Girardov mehanizem grešnega kozla lahko razumemo kot dopolnjenega v komunistični revoluciji, po drugi strani pa mehanizem stremi k dopolnitvi v smislu celovite uveljavitve tran-zicijske pravičnosti. ; The events during the communist revolution significantly influence the state and understanding of the contemporary Slovenian social situation. In the dissertation, in the light of the ideological contradiction between Christianity and Communism, and on the basis of the conflict that developed during the revolution, the author explores the causes and grounds for this influence. In this work the author shows the fundamental connection between the contemporary situation and the communist revolution in Slovenia. She chooses Girard's mimetic theory and scapegoat as a conceptual framework and tool for understanding. Girard describes culture as a mimetic cycle, where the individual imitates the other (this starts from the very childhood, when the child imitates his parents and thus becomes a social being). Imitation is the driving force of every company. In addition, imitation can also become a destruction of society, culture. Girard therefore implements the scapegoat as a conflict resolution where the two entities share the same desire and together turn against the scapegoat, which causes them a mimetic crisis and its sacrifice is a condition for restoring social order and social security. This general theoretical framework also makes it possible – to explore past social conflicts, and in particular their consequences in the present, including aspects of reconciliation processes and transitional justice. Therefore, the author fruitfully uses it in the mentioned research. The author embraces Christianity and communism as two opposing ideological bases, which are already diametrically opposed in their conceptual bases, and are especially illuminated by Girard's theory. Christianity, with its cristian notion of personal freedom, stands out from the cyclical nature of the scapegoat, but communism is, on the contrary, based on mimeticism. Victims of character in Girard's conception that justify the murder of a scapegoat are based on facts that become acceptable for murder, regardless of the (un) reality of them. The implementation of Girard's theory on the Slovenian situation thus encompasses two key aspects. The first aspect is the sacrifice of the opponents of the communist revolution with the sacrificial signs of collaboration, riots, … This sacrifice makes it possible to establish a totalitarian communist regime in Yugoslavia, and thus in Slovenia. Communism, as a totalitarian regime, does not allow an alternative, it uniforms and isolates man. At the same time, it establishes total control and terror. Christianity, on the other hand, empowers man with uniqueness, inviolability, irreplaceability and freedom. Another aspect concerns the fact that the conflict from the communist revolution has still not been resolved, and that the rule of law and the establishment of a democratic society are still, in the eyes of many Slovenians, an unfinished project. Despite the democratic state system and the collapse of communism as a long-term socio-political and economic system, the author emphasizes two challenges of contemporary society in Slovenia. The first is the presence of communist ideology in the thinking and action of individuals, and the second challenge is the insufficient implementation of transitional justice. The aforementioned aspects of the analysis are based first of all on the very conceptual contradiction and conception of both communism and Christianity. Christianity and communism are fundamentally different. Particular emphasis is placed on aspects of the perception of man as a free and rational being in both conceptual frameworks. Communism, by communist revolution, stands against man, against human dignity and against human freedom, thereby placing Christianity in a defensive posture. In doing so, the Church, which as one of the most prominent institutions has not been taken over and controlled by the Communist Revolution, becomes a defender of human life and human rights, while at the same time it stands against the Communist Revolution. Christianity, as well as the Church, uses various methods of defense and rebellion that are not always completely in line with Christian teaching. The methods of defense were the Christian stance in relation to war, to fellow human beings, to the occupier and to the revolutionary forces, physical defense, cooperation with both occupation and revolutionary forces, cultural, media and political activities. Nevertheless, revolutionary violence escalated, especially in the last years of World War II and the first years after the revolution. The situations in which individuals in Slovenia were placed were not straightforward or straightforward. It was not merely a choice between a revolutionary or a counter-revolutionary party, but the circumstances were more complex rather than straightforward because of the occupying forces. People were threatened with disapproval, persecution or violence from all sides. The Communist Party monopolized resistance to the occupation forces. The rudiments of any other, independent organization of resistance could have been punished. Quite a few Christians, for the sake of patriotism or inability to evade mobilization, became part of the liberation movement, regardless of the ideological basis of the movement or the organization that organized the movement. The church was not, however, a much-desired partner in the resistance, as evidenced by Kardelj's instruction: "Shoot the priests in the troops." (Griesser-Pečar 1996, 109) Not only the instruction, but also the deliberate degradation of priests through imprisonment, detention, deportation and execution, are witnesses to the Communist Party's attitude towards Church dignitaries. Revolutionary violence has left unprecedented consequences not only in that time but also in the present, with the author's exploration of these consequences also playing a significant role in personal stories, personal and social responsibility, and the intergenerational transmission of traumas that they preclude a real transition from a totalitarian to a democratic system. Transition and transitional justice is thus a mechanism that seeks to fully complete the transition on a personal and social level, and to establish trust in state institutions, the functioning of state structures. Although the situation in Slovenia points to some of the positive effects of transitional justice, such as denationalization, the opening of archives, it still lacks the enforcement of justice on a personal level ; for example, with regard to aspects of media pluralization, orderly economic initiatives, dialogue between different social groups, including the entry of religious communities into public debate, building confidence in state institutions, etc. The view of the communist revolution in Slovenia through the prism of Girard the scapegoat offers a unique framework that connects the understanding of the communist revolution and the communist system with the contemporary position of Slovene society. On the one hand, Girard's mechanism of the scapegoat can be understood as supplemented in the communist revolution, and on the other, the mechanism seeks to supplement in the sense of the full implementation of transitional justice.
Evropska unija (EU) je Bosni in Hercegovini (BiH) obljubila podpis stabilizacijsko-pridružitvenega sporazuma pod pogojem, da BiH prestrukturira svoj razdrobljen policijski sistem po treh načelih EU, ki predvidevajo centralizirano in enotno policijo. Ker pa policije v različnih državah članicah EU niso vedno centralizirane, so lokalni akterji izkoristili argument neenotnih standardov pri upravičevanju odpora do predvidene reforme. V magistrskem delu raziskujem razsežnosti učinkov, ki jih ima odsotnost skupnega normativnega okvira na prizadevanja mednarodne organizacije po prenosu norm v tretje države. Raziskava temelji na preseku teoretskih sklopov reforme varnostnega sektorja¬ ter prenosa norm ; skozi to prizmo analiziram pristop EU k reformi varnostnega sektorja ter študijo primera reforme policije v BiH, z modelom zunanjih spodbud pa učinke neenotnih standardov v državah članicah EU na to reformo. Foucaultovski pristop k fenomenu prenosa norm omogoča, da proces pogojevanja razumemo kot dinamično in kompleksno razmerje moči med EU in lokalnimi akterji. Ugotavljam, da lahko odpor lokalnih akterjev do prenosa norm resno ošibi moč EU, kadar ta ne temelji na močnih normativnih temeljih. V primeru reforme policije v BiH je visoki predstavnik za BiH, avtor treh načel EU, zanemaril, da EU pri svojem zunanjem delovanju nastopa kot normativna moč. Ob odsotnosti normativnega okvirja, torej odsotnosti enotnih standardov na področju policije, pa je bila moč EU ohromljena, posledica tega pa je bila neuspešna reforma policije v BiH. ; The reform of a fragmented police system according to three European Union (EU) principles, which foresee a centralized and unified police force, was set as a condition by the EU to sign the Stabilization and Association Agreement with Bosnia and Herzegovina (BiH). However, as the police in the different EU Member States are not always centralized, local actors have used the argument of divergent standards to justify their resistance to the envisaged reform. This Master's thesis effects of the absence of a common normative framework within an international organization on the norm diffusion to a third country. The research is based on the convergence of theories dealing with security sector reform and norm transfer. Through such a lens, I analyse the EU approach to security sector reform and contextualise it via the study of police reform in BiH. The Foucault's approach to norm transfer understands the process of conditionality as a dynamic and complex power relation between the EU and local actors. Findings show that genuine resistance from local actors can seriously undermine the EU's normative power when the latter is not based on strong normative foundations. In the case of police reform in BiH, the author of the three EU principles – the High Representative for BiH – neglected the EU's role of normative power in its external action. The absence of a normative framework, in this case, the absence of harmonized standards regarding policing undermined the power of the EU and resulted in the failure of police reform in BiH.
Temporary or permanent, local or international, voluntary or forced, legal or illegal, registered or unregistered migrations of individuals, whole communities or individual groups are an important factor in constructing and modifying (modern) societies. The extent of international migrations is truly immense. At the time of the preparation of this publication more than 200 million people have been involved in migrations in a single year according to the United Nations. Furthermore, three times more wish to migrate, mostly from sub-Saharan Africa towards some of the most economically developed areas of the world according to the estimates by the Gallup Institute (Esipova, 2011). Some authors, although aware that it is not a new phenomenon, talk about the era of migration (Castles, Miller, 2009) or the globalization of migration (Friedman, 2004). The global dimensions of migration are definitely influenced also by the increasingly visible features of modern societies like constantly changing conditions, instability, fluidity, uncertainty etc. (Beck, 2009; Bauman, 2002).The extent, direction, type of migrations and their consequences are affected by many social and natural factors in the areas of emigration and immigration. In addition, researchers from many scientific disciplines who study migrations have raised a wide range of research questions (Boyle, 2009, 96), use a variety of methodological approaches and look for different interpretations in various spatial, temporal and contextual frameworks. The migrations are a complex, multi-layered, variable, contextual process that takes place at several levels. Because of this, research on migrations has become an increasingly interdisciplinary field, since the topics and problems are so complex that they cannot be grasped solely and exclusively from the perspective of a single discipline or theory. Therefore, we are witnessing a profusion of different "faces of migration", which is reflected and at the same time also contributed to by this thematic issue of the journal Ars & Humanitas.While mobility or migration are not new phenomena, as people have moved and migrated throughout the history of mankind, only recently, in the last few decades, has theoretical and research focus on them intensified considerably. In the last two decades a number of research projects, university programs and courses, research institutes, scientific conferences, seminars, magazines, books and other publications, involving research, academia as well as politics and various civil society organizations have emerged. This shows the recent exceptional interest in the issue of migration, both in terms of knowledge of the processes involved, their mapping in the history of mankind, as well as the theoretical development of migration studies and daily management of this politically sensitive issue.Migration affects many entities on many different levels: the individuals, their families and entire communities at the local level in the emigrant societies as well as in the receiving societies. The migration is changing not only the lives of individuals but whole communities and societies, as well as social relations; it is also shifting the cultural patterns and bringing important social transformations (Castles 2010). This of course raises a number of questions, problems and issues ranging from human rights violations to literary achievements. Some of these are addressed by the authors in this thematic issue.The title "Many faces of migration", connecting contributions in this special issue, is borrowed from the already mentioned Gallup Institute's report on global migration (Esipova, 2011). The guiding principle in the selection of the contributions has been their diversity, reflected also in the list of disciplines represented by the authors: sociology, geography, ethnology and cultural anthropology, history, art history, modern Mediterranean studies, gender studies and media studies. Such an approach necessarily leads not only to a diverse, but at least seemingly also incompatible, perhaps even opposing views "on a given topic. However, we did not want to silence the voices of "other" disciplines, but within the reviewing procedures actually invited scientists from the fields represented by the contributors to this volume. The wealth of the selected contributions lies therefore not only in their coherence and complementarity, but also in the diversity of views, stories and interpretations.The paper of Zora Žbontar deals with the attitudes towards foreigners in ancient Greece, where the hospitality to strangers was considered so worthy a virtue that everyone was expected to "demonstrate hospitality and protection to any foreigner who has knocked on their door". The contrast between the hospitality of ancient Greece and the modern emergence of xenophobia and ways of dealing with migration issues in economically developed countries is especially challenging. "In an open gesture of hospitality to strangers the ancient Greeks showed their civilization".Although the aforementioned research by the United Nations and Gallup Institute support some traditional stereotypes of the main global flows of migrants, and the areas about which the potential migrants "dream", Bojan Baskar stresses the coexistence of different migratory desires, migration flows and their interpretations. In his paper he specifically focuses on overcoming and relativising stereotypes as well as theories of immobile and non-enterprising (Alpine) mountain populations and migrations.The different strategies of the crossing borders adopted by migrant women are studied by Mirjana Morokvasic. She marks them as true social innovators, inventing different ways of transnational life resulting in a bottom-up contribution to the integrative processes across Europe. Some of their innovations go as far as to shift diverse real and symbolic boundaries of belonging to a nation, gender, profession.Elaine Burroughs and Zoë O'Reilly highlight the close relations between the otherwise well-established terminology used in statistics and science to label immigrants in Ireland and elsewhere in EU, and the negative representations of certain types of migrants in politics and the public. The discussion focusses particularly on asylum seekers and illegal immigrants who come from outside the EU. The use of language can quickly become a political means of exclusion, therefore the authors propose the development and use of more considerate and balanced migration terminology.Damir Josipovič proposes a change of the focal point for identifying and interpreting the well-studied migrations in the former Yugoslavia. The author suggests changing the dualistic view of these migrations to an integrated, holistic view. Instead of a simplified understanding of these migrations as either international or domestic, voluntary or forced, he proposes a concept of pseudo-voluntary migrations.Maja Korać-Sanderson's contribution highlights an interesting phenomenon in the shift in the traditional patterns of gender roles. The conclusions are derived from the study of the family life of Chinese traders in transitional Serbia. While many studies suggest that child care in recent decades in immigrant societies is generally performed by immigrants, her study reveals that in Serbia, the Chinese merchants entrust the care of their children mostly to local middle class women. The author finds this switch of roles in the "division of labour" in the child care favourable for both parties involved.Francesco Della Puppa focuses on a specific part of the mosaic of contemporary migrations in the Mediterranean: the Bangladeshi immigrant community in the highly industrialized North East of Italy. The results of his in-depth qualitative study reveal the factors that shape this segment of the Bangladeshi diaspora, the experiences of migrants and the effects of migration on their social and biographical trajectories.John A. Schembri and Maria Attard present a snippet of a more typical Mediterranean migration process - immigration to Malta. The authors highlight the reduction in migration between Malta and the United Kingdom, while there is an increase in immigration to Malta from the rest of Europe and sub-Saharan Africa. Amongst the various impacts of immigration to Malta the extraordinary concentration of immigrant populations is emphasized, since the population density of Malta far exceeds that of nearly all other European countries.Miha Kozorog studies the link between migration and constructing their places of their origin. On the basis of Ardener's theory the author expresses "remoteness" of the emigratory Slavia Friulana in terms of topology, in relation to other places, rather than in topography. "Remoteness" is formed in relation to the "outside world", to those who speak of "remote areas" from the privileged centres. The example of an artistic event, which organizers aim "to open a place like this to the outside world", "to encourage the production of more cosmopolitan place", shows only the temporary effect of such event on the reduction of the "remoteness".Jani Kozina presents a study of the basic temporal and spatial characteristics of migration "of people in creative occupations" in Slovenia. The definition of this specific segment of the population and approach to study its migrations are principally based on the work of Richard Florida. The author observes that people with creative occupations in Slovenia are very immobile and in this respect quite similar to other professional groups in Slovenia, but also to the people in creative professions in the Southern and Eastern Europe, which are considered to be among the least mobile in Europe. Detailed analyses show that the people in creative occupations from the more developed regions generally migrate more intensely and are also more willing to relocate.Mojca Pajnik and Veronika Bajt study the experiences of migrant women with the access to the labour market in Slovenia. Existing laws and policies push the migrants into a position where, if they want to get to work, have to accept less demanding work. In doing so, the migrant women are targets of stereotyped reactions and practices of discrimination on the basis of sex, age, attributed ethnic and religious affiliation, or some other circumstances, particularly the fact of being migrants. At the same time the latter results in the absence of any protection from the state.Migration studies often assume that the target countries are "modern" and countries of origin "traditional". Anıl Al- Rebholz argues that such a dichotomous conceptualization of modern and traditional further promotes stereotypical, essentialist and homogenizing images of Muslim women in the "western world". On the basis of biographical narratives of young Kurdish and Moroccan women as well as the relationships between mothers and daughters, the author illustrates a variety of strategies of empowerment of young women in the context of transnational migration.A specific face of migration is highlighted in the text of Svenka Savić, namely the face of artistic migration between Slovenia and Serbia after the Second World War. The author explains how more than thirty artists from Slovenia, with their pioneering work in three ensembles (opera, ballet and theatre), significantly contributed to the development of the performing arts in the Serbian National Theatre in Novi Sad.We believe that in the present thematic issue we have succeeded in capturing an important part of the modern European research dynamic in the field of migration. In addition to well-known scholars in this field several young authors at the beginning their research careers have been shortlisted for the publication. We are glad of their success as it bodes a vibrancy of this research area in the future. At the same time, we were pleased to receive responses to the invitation from representatives of so many disciplines, and that the number of papers received significantly exceeded the maximum volume of the journal. Recognising and understanding of the many faces of migration are important steps towards the comprehensive knowledge needed to successfully meet the challenges of migration issues today and even more so in the future. It is therefore of utmost importance that researchers find ways of transferring their academic knowledge into practice – to all levels of education, the media, the wider public and, of course, the decision makers in local, national and international institutions. The call also applies to all authors in this issue of the journal. ; Začasne ali stalne, lokalne ali mednarodne, prostovoljne ali prisilne, legalne ali ilegalne, registrirane ali neregistrirane migracije posameznic in posameznikov, celih družbenih skupnosti ali posameznih skupin predstavljajo pomemben dejavnik v konstruiranju in spreminjanju (sodobnih) družb. Razsežnosti mednarodnih migracij so resnično ogromne, saj je bilo vanje v času nastajanja te publikacije po ocenah Združenih narodov v enem letu vključenih več kot 200 milijonov ljudi. Po ocenah Gallupovega inštituta pa se jih še trikrat toliko želi preseliti, največ iz podsaharske Afrike ter proti nekaterim gospodarsko najbolj razvitim območjem sveta (Esipova, 2011). Nekateri avtorji zato, čeprav ob zavedanju, da ne gre za nov fenomen, govorijo o dobi migracij (Castles, Miller, 2009) ali o globalizaciji migracij (Friedman, 2004). Zagotovo je na globalne razsežnosti migracij vplivalo tudi to, da so vse bolj vidne značilnosti sodobnih družb nenehno spreminjanje razmer, nestabilnost, fluidnost, negotovost ipd. (Beck, 2009; Bauman, 2002).Na obseg, smeri in vrste migracij ter na njihove posledice vplivajo številni družbeni in naravni dejavniki, tako na območjih odseljevanja kot tudi na območjih priselitev. Poleg tega si raziskovalke in raziskovalci iz številnih znanstvenih disciplin, ki proučujejo migracije, v raziskavah zastavljajo »neverjetno raznovrstna« vprašanja (Boyle, 2009, 96), uporabljajo različne metodološke pristope in iščejo različne interpretacije, in sicer v različnih prostorskih, časovnih in vsebinskih okvirih. Vse bolj prihaja do izraza, da so migracije kompleksen, večplasten, spremenljiv in kontekstualen proces, ki poteka na več ravneh. Prav zaradi tega spoznanja je raziskovanje migracij postajalo vse bolj interdisciplinarno polje, saj so teme in problemi tako kompleksni, da jih ni mogoče zagrabiti zgolj in izključno iz perspektive ene same znanosti ali teorije. Zato smo priča pravemu bogastvu »obrazov migracij«, ki ga odraža ter obenem k njemu tudi prispeva pričujoča tematska številka revije Ars & Humanitas.Čeprav mobilnost oziroma migracije niso nov pojav, saj so se ljudje selili in preseljevali skozi celotno zgodovino človeštva, pa se šele v zadnjem času, v zadnjih nekaj desetletjih, z njimi resno teoretsko in raziskovalno ukvarjamo. V zadnjih dveh desetletjih so se pojavili številni raziskovalni projekti, univerzitetni programi in predmeti, raziskovalni inštituti, znanstvene konference, posveti, revije, knjige in druge publikacije, pri katerih sodelujejo tako raziskovalna in akademska sfera kot tudi politika in različne civilnodružbene organizacije. To priča o v zadnjem času izjemnem zanimanju za vprašanje migracij, tako kar zadeva poznavanje samih procesov in njihovo mapiranje v zgodovini človeštva kot tudi teoretski razvoj migracijskih študij in vsakodnevno urejanje tega politično občutljivega vprašanja.Migracije zadevajo številne subjekte na številnih ravneh: posameznice in posameznike, njihove družine ter celotne skupnosti tako na lokalni ravni v družbi emigracije kakor tudi na vseh teh ravneh v imigrantski družbi. Z migracijami se spreminjajo ne samo življenja posameznikov in posameznic, ampak se spreminjajo celotne skupnosti oziroma družbe in družbeni odnosi, zamikajo se kulturni vzorci, prihaja do pomembnih družbenih transformacij (Castles, 2010). Ob tem se seveda odpirajo številne teme, problemi in vprašanja, ki se gibljejo v širokem razponu od kršenja človekovih pravic do literarnih presežkov. Nekaterih od njih se dotikajo tudi prispevki v pričujoči tematski številki.Povezovalni naslov prispevkov v tej tematski številki revije, »Številni obrazi migracij«, smo si sposodili iz že omenjenega poročila Gallupovega inštituta o globalnih selitvah (Esipova, 2011). Temeljno vsebinsko vodilo pri izbiri prispevkov je bila raznovrstnost, kar nakazuje tudi pregled znanstvenih disciplin, iz katerih prihajajo avtorji: sociologija, geografija, etnologija in kulturna antropologija, zgodovina, umetnostna zgodovina, sodobne sredozemske študije, študiji spola in medijski študiji. Tak pristop nujno pripelje ne le do raznolikih, ampak tudi do vsaj navidezno neskladnih, morda celo nasprotnih pogledov na obravnavane tematike. Vendar nismo želeli utišati glasov iz »drugih« znanstvenih disciplin, temveč smo raje v recenzentske postopke povabili znanstvenike s področij, s katerih so tudi avtorji. Bogastvo zbranih prispevkov torej ni v njihovi medsebojni skladnosti in potrjevanju, temveč prav v mnogoterosti pogledov, zgodb in interpretacij.Prispevek Zore Žbontar obravnava odnos do tujcev v antični Grčiji, kjer je bilo gostoljubje do tujcev tako častivredna vrlina, da je vsak moral »izkazati gostoljubje in zaščititi kateregakoli tujca, ki je potrkal na vrata«. Zlasti je izzivalen kontrast med gostoljubjem v antični Grčiji in sodobnim pojavljanjem ksenofobije ter načini soočanja z migracijsko problematiko v gospodarsko razvitih državah. »Antični Grki so v odprti gesti gostoljubja do tujcev prepoznali svojo civiliziranost.«Čeprav omenjene raziskave Združenih narodov in Gallupovega inštituta podpirajo nekatere uveljavljene stereotipe o glavnih globalnih tokovih migrantov ter o območjih, o katerih »sanjajo« potencialni migranti, Bojan Baskar opozarja na sočasen obstoj tudi drugačnih migracijskih želja, tokov migracij in njihovih interpretacij. Posebej se osredotoči na preseganje in relativizacijo stereotipov in teorij o nemobilnem in nepodjetnem (alpskem) hribovskem prebivalstvu in migracijah.O tem, kako različne strategije pri prehajanju, prestopanju in prečkanju meja razvijejo migrantke, piše Mirjana Morokvasic. Označi jih kot prave socialne inovatorke, ki izumijo različne načine transnacionalnega življenja in tako od spodaj navzgor prispevajo k integrativnim procesom po vsej Evropi. V svoji inovativnosti gredo nekatere tako daleč, da premikajo različne, tako realne kot simbolne meje pripadanja naciji, spolu in poklicu.Elaine Burroughs in Zoë O'Reilly izpostavita tesno povezanost med sicer uveljavljeno terminologijo, s katero v statistiki in tudi znanosti označujejo imigrante na Irskem in širše v EU, ter negativnimi reprezentacijami nekaterih tipov migrantov v politiki in javnosti. Razpravo navežeta zlasti na iskalce azila in nezakonite priseljence, ki pridejo iz držav zunaj EU. Raba jezika lahko hitro postane politični način izključevanja, zato predlagata razvoj in uporabo obzirnejše in pravičnejše migracijske terminologije.Za spremembo izhodišča opredeljevanja in interpretacije sicer dobro proučenih selitev v nekdanji Jugoslaviji se zavzame Damir Josipovič. Predlaga zamenjavo dualističnega pogleda na te migracije s celostnim. Namesto njihovega poenostavljenega razumevanja kot mednarodnih in notranjih ali prostovoljnih in prisilnih migracij pa se zavzema za koncept psevdoprostovoljnih migracij.Na zanimiv fenomen zamikanja ustaljenih vzorcev spolnih vlog opozori tekst Maje Korać-Sanderson, katere zaključki izhajajo iz študije družinskega življenja kitajskih trgovcev v tranzicijski Srbiji. Medtem ko številne študije ugotavljajo, da skrbstveno delo v zadnjih desetletjih v imigrantskih družbah v glavnem opravljajo migrantke, njena študija ugotavlja, da v Srbiji kitajske trgovke skrb za svoje otroke večinoma zaupajo lokalnim ženskam srednjega razreda. Ta obrat vlog pri »delitvi dela« v skrbstveni sferi, ugotavlja avtorica, je v prid obema vpletenima stranema.Specifičen del mozaika sodobnih migracij v Sredozemlju, bangladeške skupnosti imigrantov na visoko industrializiranem severovzhodu Italije, razkriva Francesco Della Puppa. Izsledki poglobljenega kvalitativnega proučevanja odstirajo dejavnike, ki oblikujejo ta segment bangladeške diaspore, izkušnje migrantov ter učinke selitve na njihove družbene in biografske trajektorije.Izsek iz bolj tipičnih sredozemskih migracijskih procesov na primeru priseljevanja na Malto predstavita John A. Schembri in Maria Attard. Ugotavljata zmanjševanje števila selitev med Malto in Veliko Britanijo ob hkratnem povečevanju priseljevanja iz ostalih držav Evrope in podsaharske Afrike. Med učinki priseljevanja na Malto izpostavita izredno zgoščenost priseljenega prebivalstva, ki presega gostote celotnih prebivalstev v nekaterih evropskih državah.Miha Kozorog obravnava povezavo med migracijami in konstruiranjem krajev, iz katerih te migracije izvirajo. S pomočjo Ardenerjeve teorije »odročnost« izrazito emigracijske Benečije izrazi ne toliko v topografskem kot v topološkem smislu, v razmerju do drugih krajev. »Odročnost« nastaja v razmerju z »zunanjim svetom«, s tistimi, ki govorijo o »odročnih krajih« iz privilegiranih središč. Na primeru umetniškega dogodka, s katerim želijo organizatorji »odpreti tak kraj zunanjemu svetu« in »spodbuditi produkcijo bolj svetovljanskega kraja«, pokaže zgolj začasnost učinka tega dogodka na zmanjšanje »odročnosti«.O temeljnih časovnih in prostorskih značilnostih selitev »prebivalcev z ustvarjalnim poklicem« v Sloveniji piše Jani Kozina. Pri opredeljevanju tega specifičnega dela prebivalstva in pristopa k proučevanju njegovega migriranja se opre zlasti na dela Richarda Floride. Ugotavlja, da so prebivalci z ustvarjalnim poklicem v Sloveniji prostorsko zelo nemobilni in po tem kriteriju precej podobni ostalim poklicnim skupinam v Sloveniji, obenem pa tudi prebivalcem z ustvarjalnimi poklici v južni in vzhodni Evropi, za katere velja, da so med najmanj mobilnimi v Evropi. Podrobnejše analize pokažejo, da se ustvarjalci bolj razvitih regij načeloma intenzivneje selijo in so tudi v večji meri pripravljeni na selitev.O izkušnjah migrantk pri dostopu do trga delovne sile v Sloveniji govori članek Mojce Pajnik in Veronike Bajt. Obstoječa zakonodaja in posamezne politike namreč migrantke potiskajo v položaj, ko, če hočejo priti do zaposlitve, pristajajo na manj zahtevna dela. Pri tem so tarče stereotipnih reakcij in praks diskriminiranja tako na podlagi spola kot tudi starosti, pripisane etnične in religiozne pripadnosti ali kakšne druge okoliščine, še posebej dejstva, da so migrantke. Obenem pa prav zadnje vpliva na to, da s strani države niso deležne nikakršne zaščite.Migracijske študije pogosto domnevajo, da so ciljne države »moderne«, države izvora pa »tradicionalne«. Razprava Anıl Al-Rebholz ugotavlja, da takšna dihotomija pojmovanja modernega in tradicionalnega dodatno spodbuja stereotipne, esencialistične in homogenizirajoče predstave o muslimanskih ženskah v »zahodnem svetu«. Na podlagi biografskih pripovedi mlade Maročanke in Kurdinje ter razmerij med materami in hčerami prikaže raznolike strategije opolnomočenja mladih žensk v transnacionalnem migracijskem kontekstu.Specifični obraz migracij prinaša tekst Svenke Savić, namreč obraz umetniških migracij med Slovenijo in Srbijo po drugi svetovni vojni. Avtorica v njem ugotavlja, da je v treh ansamblih (opernem, gledališkem in baletnem) več kot trideset umetnic in umetnikov iz Slovenije s svojim pionirskim delom pomembno zaznamovalo razvoj gledališke umetnosti v Srbskem narodnem gledališču v Novem Sadu.Verjamemo, da nam je uspelo v pričujočo tematsko številko ujeti pomemben del sodobnega evropskega raziskovalskega utripa s področja migracij. Poleg uveljavljenih znanstvenikov s tega področja se je v ožji izbor prispevkov uvrstilo tudi več mladih avtoric in avtorjev, ki začenjajo raziskovalne kariere. Njihov uspeh nas veseli, saj obeta živahnost tega raziskovalnega področja tudi v bodoče. Obenem nas veseli, da so se vabilu odzvali predstavniki tako številnih znanstvenih disciplin ter da je število prispevkov, ki smo jih prejeli, znatno presegalo največji možni obseg revije. Spoznavanje in razumevanje številnih obrazov migracij sta pomembna koraka proti celovitemu znanju, potrebnemu za uspešno soočanje z izzivi migracijske problematike danes in, kot kaže, še posebej v prihodnosti. Zato je izjemnega pomena, da raziskovalci najdemo načine prenosa svojih znanstvenih spoznanj v prakso – na vse ravni izobraževanja, v medije, širše strokovne javnosti ter seveda tudi odločevalcem v lokalnih, državnih in mednarodnih ustanovah. Poziv velja tudi vsem avtorjem prispevkov v tej številke revije.
POVZETEK MEDNARODNI KAZENSKI PREGON IN ČLOVEKOVE PRAVICE TUJIH TERORISTIČNIH BORCEV Avtor: Rok Petročnik Mentorica: izr. prof. dr. Vasilka Sancin V magistrski nalogi sem raziskoval nastanek fenomena tujega terorističnega borca, njihov mednarodni kazenski pregon in kršitve njihovih temeljnih človekovih pravic v domačih kazenskih pregonih. Varnostni svet OZN je leta 2014 na podlagi VII. poglavja Ustanovne listine OZN sprejel Resolucijo 2178, ki podaja opis tujega terorističnega borca, vendar ne loči med oboroženimi spopadi in terorizmom. Resolucija 2178 opisuje tujega terorističnega borca kot posameznika, ki potuje v tujino z namenom izvedbe ali sodelovanja v terorističnem napadu, medtem ko je tuji borec posameznik, ki odpotuje v tujino z namenom pridružitve oboroženim spopadom. V raziskavi sem prišel do sklepa, da trenutno ne obstaja mednarodni kazenski pregon tujih terorističnih borcev, saj pregon izvajajo države same pred nacionalnimi sodišči. Varnostni svet OZN je pregon tujih terorističnih borcev preložil na države članice OZN, in sicer z vzpostavitvijo različnih odborov za nadzor izvajanja sankcij Varnostnega Sveta, kot so Sankcijski odbor 1267 in Skupina za analitično podporo in nadzor sankcij. V primerih Nada, Ahmed in Abdelrazik so nacionalna sodišča zaradi kršitev temeljnih človekovih pravic s sodbami razveljavila državne upravne akte, ki so vpeljevali sprejete protiteroristične resolucije Varnostnega sveta. Podobno je naredilo sodišče EU v primeru Kadi, kjer je bila razveljavljena uredba, ki je vpeljala sankcije Varnostnega sveta. Sodbe nacionalnih in sodišč v EU so bile glavni dejavnik za spremembo mednarodnopravnega okvirja terorizma OZN in za posledično večji poudarek na spoštovanju temeljnih pravic, ki jih zagotavlja Evropska konvencija o človekovih pravicah. ; ABSTRACT INTERNATIONAL PROSECUTION AND HUMAN RIGHTS OF FOREIGN TERRORIST FIGHTERS Author: Rok Petročnik Mentor: Vasilka Sancin, PhD, Professor In master's thesis i explored the emergence of the foreign terrorist fighter phenomenona, international prosecution of foreign terrorist fighters, and the violation of the fundamental rights of foreign terrorist fighters in domestic prosecutions. UN Security Council in 2014 adopted Resolution 2178 under Chapter VII of the UN Charter. However, while the Resolution outlines the description of a foreign terrorist fighter, it fails to distinguish between armed conflicts and terrorism. Resolution 2178 defines foreign terrorist fighters as individuals who travel to a state other than their states of residence or nationality for the purpose of the perpetration, planning, or preparation of, or participation in, terrorist acts or the providing or receiving of terrorist training, including in connection with armed conflict, while foreign fighter is an individual who travels abroad with intention to join armed conflict. The research led to the conclusion that there is currently no international prosecution of foreign terrorist fighters because states carry it out before national courts. UN Security Council has placed the burden of prosecuting foreign terrorist fighters on UN Member States by establishing different committees monitoring the implementation of the Security Council sanctions, such as the 1267 Committee and the Analytical Support and Sanctions Monitoring Team. In the cases of Nada, Ahmed and Abdelrazik, national courts due to violations of fundamental rights, repealed national administrative acts that introduced the adopted UN Security Council counter terrorism resolutions. The Court of Justice of the EU made a similar decision in the case of Kadi by repealing the regulation introducing the UN Security Council sanctions. Judgements of national and EU courts were the main factor in changing the UN terrorism framework in terms of international law, thus shifting the focus on the respect of fundamental rights as guaranteed by the European Convention on Human Rights.
