As electric restructuring spreads rapidly across countries and states, leading industry experts are increasingly concerned that in many instances policy makers are pushing their proposals into practice more quickly than policy analysts can provide answers to difficult questions of market design. In this process, different structures for organizing this industry are evolving without a firm basic understanding of their implications for long-term market performance. There is a risk that, in the process, we may be inadvertently locked into an inferior market design that will be costly to change. Designing Competitive Electricity Markets develops some guiding principles to be used when evaluating alternative proposals for reorganizing the US electric power industry. Preliminary versions of the papers in this book were presented at a Workshop convened by the Electric Power Research Institute and held at Stanford University in March 1997. The authors are prominent economists, operation researchers, and engineers who have been instrumental in the development of the conceptual framework for electric power restructuring both in the United States and in other countries. Rather than espousing a particular market design for the industry's future, each author focuses on an important issue or set of issues and tries to frame the questions for designing electricity markets using an international perspective. The book focuses on the economic and technical questions important in understanding the industry's long-term development rather than providing immediate answers for the current political debates on industry competition. Extensive issues are covered, including: the role of the system operator; the problems of ensuring longer-term investment in expanding the transmission system, and in industry research and development; the problems in pricing that are created by arbitrarily segmenting related markets; the relationship between efficiency in the near and long term; ownership rights and incentives; and designing experiments to better understand the operation of different auction mechanisms. The intended audience for this volume includes policy-makers, policy-oriented academics, and corporate leaders with an interest in designing workable and more efficient electricity markets. The arguments in each chapter are based upon sound economic principles but do not require expertise in mathematical modeling or technical economic analysis

Inhaltsangabe:Einleitung: Das Stück, Titel: "New Economy", ist nicht vorbei, aber wir befinden uns mittlerweile im zweiten Akt. Die neuen Hauptdarsteller sind hier die Größen Umsatz und Gewinn. Eine euphorische und aktionsgeladene Szenerie des ersten Aktes wurde zurückgelassen und die Geschichte hat sich bis dato weit von ihrem Eingangsmotiv "Fantasie, Fun und Firlefanz ziemlich entfernt. [...D]as Leitmotiv zum zweiten Akt des Dot-com-Schauspiels heißt P2P, für: Path to Profitability." Die Akteure treten hierzu von der mittlerweile ramponierten Bühne der New Economy herunter und mischen sich unter das Publikum. Ab jetzt läuft das Stück "genau wie das richtige Leben in der Old Economy: Man muss profitabel arbeiten und nicht erst viel Geld verbrennen." Für die Mehrzahl der Zuschauer hat es den Anschein, das Theater habe sein Ende gefunden und "die Realität Einzug gehalten[. ... Viele] haben erst jetzt begriffen, dass die Regeln der Old Economy auch für die neue Wirtschaft gelten", dass das Publikum und die Schauspieler den gleichen Gesetzen unterliegen - das sollte daraus gelernt werden. Sie beschäftigt sich, exemplarisch an der New Economy, mit der Frage, weshalb strategisches, rationales Handeln in Märkten radikalen Änderungen unterworfen ist und oftmals retrospektiv als unverständlich und irrational geschrieben wird. Um dieser Frage nachzugehen greift die Arbeit auf insgesamt 34 Experteninterviews zurück, welche in der Zeit von Mitte 2001 bis Anfang 2002 im Rahmen eines Forschungsseminars ["Soziologie der Internetfirma. Ein Blick auf die Hinterbühne der New Economy." Leiter: Stefan Kühl in Kooperation mit Alexander Schulze-Fielitz. Am Institut für Soziologie der Ludwig-Maximilians-Universität München.] erhoben wurden. 22 der Interviews fanden in 11 verschiedenen Internet-Firmen der New Economy statt, welche 12 bis 300 Mitarbeiter beschäftigten. Weitere 12 Interviews wurden mit Vertretern von 9 Venture Capital Firmen gehalten, um eine andere Perspektive auf die Unternehmen zu ermöglichen und um der einflussreichen Rolle, welche das Risikokapital zu dieser Zeit gespielt hat, gerecht zu werden. Zusätzlich fanden, in Form von Sekundäranalysen, große Teile der Fachliteratur des untersuchten Zeitraums Verwendung. Anhand des auf diese Weise vertieften Einblicks entstand die Einsicht, dass sich die "hypeartige" Entwicklung der New Economy weder durch Veränderungen der ökonomischen Rahmenbedingungen, noch durch das strategische Handeln der einzelnen Unternehmen in ihrer vollen Ausprägung fassen lässt. Vielmehr bietet die Betrachtung der, der New Economy zugrundeliegenden, handlungsleitenden Annahmen eine Erklärung von wesentlich tiefgreifenderer Stärke. Diese Herangehensweise beweißt sich sowohl in der Analyse der Beziehungsverhältnisse zur "äußeren Umwelt" der Unternehmen (Mitbewerber, Medien, Kapitalgeber und Investoren usw.), wie auch darin, die Veränderung der inneren Arbeitsprozesse (Entscheidungsverhalten, Motivation, Klima usw.) zu fassen. Des weiteren deckt sie eine der Betriebswissenschaft völlig fremde Methodik auf, wie Unternehmen auf veränderte Unsicherheit und Komplexität im Markt reagieren und wie "flexibel" Vorstellungen rationalen Handelns in diesem Zusammenhang sein können. Um die Auswirkungen herrschender "Rationalitätsannahmen" auf das Handeln der einzelnen Unternehmen, Organisationen und Institutionen der New Economy theoretisch zu fassen, zu systematisieren und zu erklären, fand die noch junge Theorieperspektive des Neo-Institutionalismus Verwendung. Der Anspruch der Arbeit, eine Dynamik nachzuzeichnen, hat auch eine relativ großzügige bis gar erweiternde Auslegung der verwendeten Theorieperspektive des Neo-Institutionalismus zur Folge, da dieser nicht die Eigenschaft nachgesagt wird, Wandel konsistent fassen zu können. Insofern findet auch eine tiefergehende, oft eng am praktischen Beispiel orientierte Theoriediskussion statt. Nach Ausschnitten aus der soziologischen Diskussion des Rationalitätsbegriffs, folgt in 11 Seiten kapp eine Zusammenfassung der neo-institutionalistischen Theorie und eine Klärung der wichtigsten Begriffe. Auf eine kurze Erläuterung des methodischen Vorgehens folgt dann der Hauptteil der Arbeit, welcher die Entwicklung der New Economy anhand eines aus dem Interviewmaterial entwickelten typischen Unternehmens nachzeichnet und neo-institutionalistisch erklärbar macht. Hierbei wird sehr eng am original Interviewtext entlang vorgegangen, was einen starken Einblick in die jeweilige Situation der Personen und des Unternehmens gewährt. Lost and Forgotten presents an historical overview of one regional development of Chinese studies / Sinology from the seventeenth century to the present time. The book focuses on the description and evaluation of contributions by scholars who originated from Austria and the Austro-Hungarian monarchy.
Contributions that were made in Austria and achievements of emigrants are treated in separate chapters. The account of the development of Chinese studies from the time when Sinology was institutionalised at Vienna University (1972) deals with the institutions involved.
Apart from published material, the author also includes a wealth of unpublished research work found in libraries and archives in Austria, the United Kingdom, and the United States. The book incorporates detailed investigations of the source material, descriptions of state-of-the-art research at the time, and a discussion of these contributions in the light of the international Sinological discourse past and present. Book reviews, personal correspondence, discussion of personal affiliations and feuds offer further insights into the intellectual background of these scholars, their aims, concerns and methodological approaches. - Diese Darstellung der Geschichte der österreichischen Chinastudien beschreibt die Beiträge in Österreich wirkender und aus Österreich stammender Chinawissenschaftler aus der Sicht der internationalen Entwicklung des Faches von den Anfängen im 16. Jahrhundert bis zur Gegenwart.

Die Darstellungsweise ist in vier Hauptperioden gegliedert. Die Beiträge der in Österreich tätigen Wissenschaftler und der Emigranten und Auswanderer werden in getrennten Kapiteln diskutiert. Die Beschreibung der Chinastudien in Österreich seit der universitären Institutionalisierung des Faches im Jahr 1972 ist institutionsgeschichtlich angelegt.

Das Hauptinteresse dieser Studie liegt in den fachspezifischen Publikationen, deren Rolle und Einschätzung im Rahmen der internationalen Entwicklung der Chinastudien. Vom wissenschaftlichen Werk der einzelnen Forscher ausgehend, wurden ihre Quellen lokalislert und the oftmals durchaus kontroversen Diskussionen, die ihre Beiträge hervorriefen, analysiert. Neben den Forschungsergebnissen standen methodisches Vorgehen und die Quellenlage, welche die einzelnen Beiträge prägten, im Zentrum der Darstellung. Der Einbettung der Forscher in die internationalen Chinawissenschaften und ihren Verbindungenslinien wurde dabei besonderes Augemnerk gewidmet.

Im Rahmen dieser Studie wurden zahlreiche bisher unbearbeitete und teils auch unbekannte Nachlässe gesichtet und eingearbeitet. Neben der Großzahl, der heute in erster Linie aus fachgeschichtlicher Sicht interessanten Arbeit konnte manche in Vergessenheit geratene und bis heute relevante Schrift ausfindig gemacht werden.

Auch wenn der aus Österreich stammende Beitrag zur internationalen Entwicklung des Faches als eher bescheiden einzustufen ist, so konnten im Rahmen dieser Studie, einige kleine Beiträge eruiert werden, in denen seinerzeitige wissenschaftliche Ansätze und Methoden aus anderen Fächern in der Sinologie Anwendung fanden. Diese Beiträge wurden sowohl im wissenschaftsgeschichtlichen Kontext ihrer Entstehungszeit als auch aus heutiger Sicht diskutiert.

Eine kritische Positionierung der Arbeiten der in Österreich tätigen und der aus Österreich stammenden Wissenschaftler innerhalb der deutschsprachigen Chinawissenschaften und Sinologie hatte bisher nicht stattgefunden. Diese in London entstandene Studie geht über die Entwicklung in den deutschsprachigen Ländern weit hinaus. Sie zeigt auf, welch enormes Potential für eine positivere Entwicklung der Chinawissenschaften und der Sinologie Österreich und danit der gesamten deutschsprachigen Entwicklung verloren ging.

Mit Vergessen und verloren wird die bisher umfangreichste und detaillierteste Monographie über eine nationale Entwicklung der Chinawissenschaften in Europa vorgelegt.

In a lengthy new concluding chapter labeled "A Reply to Critics," Lon L. Fuller extends and clarifies his definition of the relation between law and morality put forward in the first (1964) edition of The Morality of Law. His original argument distinguishes between the morality of duty and the morality of aspiration, both of which bear on the design and operation of social institutions: the former by setting the necessary preconditions of any purposive social endeavor, the latter by suggesting the directions for such endeavor. In the revised edition, Fuller takes accurate aim at the school of legal philosophy called the New Analytical Jurists and continues his long-running debate with his major intellectual antagonist, H.L.A. Hart. Although the author calls the new chapter "A Reply to Critics," his expressed reason for undertaking it indicates that it is more than that: "As critical reviews of my book came in, I myself became increasingly aware of the extent to which the debate did indeed depend on 'starting points' - not on what the disputants said, but on what they considered it unnecessary to say, not on articulated principles but on tacit assumptions. What was needed, therefore, it seemed to me, was to bring these tacit assumptions to more adequate expression than either side has so far been able to do." Even as the evidence of global warming mounts, the international response to this serious threat is coming unraveled. The United States has formally withdrawn from the 1997 Kyoto Protocol; other key nations are facing difficulty in meeting their Kyoto commitments; and developing countries face no limit on their emissions of the gases that cause global warming. In this clear and cogent book-reissued in paperback with an afterword that comments on recent events--David Victor explains why the Kyoto Protocol was never likely to become an effective legal instrument. He explores how its collapse offers opportunities to establish a more realistic alternative. Global warming continues to dominate environmental news as legislatures worldwide grapple with the process of ratification of the December 1997 Kyoto Protocol. The collapse of the November 2000 conference at the Hague showed clearly how difficult it will be to bring the Kyoto treaty into force. Yet most politicians, policymakers, and analysts hailed it as a vital first step in slowing greenhouse warming. David Victor was not among them. Kyoto's fatal flaw, Victor argues, is that it can work only if emissions trading works. The Protocol requires industrialized nations to reduce their emissions of greenhouse gases to specific targets. Crucially, the Protocol also provides for so-called "emissions trading," whereby nations could offset the need for rapid cuts in their own emissions by buying emissions credits from other countries. But starting this trading system would require creating emission permits worth two trillion dollars--the largest single invention of assets by voluntary international treaty in world history. Even if it were politically possible to distribute such astronomical sums, the Protocol does not provide for adequate monitoring and enforcement of these new property rights. Nor does it offer an achievable plan for allocating new permits, which would be essential if the system were expanded to include developing countries. The collapse of the Kyoto Protocol--which Victor views as inevitable--will provide the political space to rethink strategy. Better alternatives would focus on policies that control emissions, such as emission taxes. Though economically sensible, however, a pure tax approach is impossible to monitor in practice. Thus, the author proposes a hybrid in which governments set targets for both emission quantities and tax levels. This offers the important advantages of both emission trading and taxes without the debilitating drawbacks of each. Individuals at all levels of environmental science, economics, public policy, and politics-from students to professionals--and anyone else hoping to participate in the debate over how to slow global warming will want to read this book.

Every United Nations member state is part of the human rights treaty system through the ratification of at least one of the six major human rights treaties, rendering universal participation a reality. For human rights victims, the treaty system is of central importance because international legal standards may offer benefits which political fora may not: the potential to generate remedies, attention, accessiblity. At the same time, the implementation mechanisms associated with the human rights treaties were designed at a time when the argument that international interest in human rights was an interference in domestic jurisdiction was at its peak. The challenge for the 21st Century is to move the theory of universality of international human rights standards towards effective implementation of human rights obligations. This book is a major contribution to the effort to focus attention on effective implementation of the human rights treaties. The contributors examine the major implementation shortfalls of the UN human rights treaty system, and offer concrete recommendations as to where future implementations efforts should be placed. The contributors are in a unique position to formulate and share their insights. They are drawn from among all of the constituencies involved in the human rights treaty system: the treaty bodies themselves, the NGO community, the UN secretariat, regional human rights regimes, UN agencies, UN human rights actors from the Human Rights Commission, the judiciary and academia. Main description: With the publication of French Philosophy of the Sixties, Alain Renaut and Luc Ferry in 1985 launched their famous critique against canonical figures such as Foucault, Derrida, and Lacan, bringing under rigorous scrutiny the entire post-structuralist project that had dominated Western intellectual life for over two decades. Their goal was to defend the accomplishments of liberal democracy, particularly in terms of basic human rights, and to trace the reigning philosophers' distrust of liberalism to an "antihumanism" inherited mainly from Heidegger. In The Era of the Individual, widely hailed as Renaut's magnum opus, the author explores the most salient feature of post-structuralism: the elimination of the human subject. At the root of this thinking lies the belief that humans cannot know or control their basic natures, a premise that led to Heidegger's distrust of an individualistic, capitalist modern society and that allied him briefly with Hitler's National Socialist Party. While acknowledging some of Heidegger's misgivings toward modernity as legitimate, Renaut argues that it is nevertheless wrong to equate modernity with the triumph of individualism. Here he distinguishes between individualism and subjectivity and, by offering a history of the two, powerfully redirects the course of current thinking away from potentially dangerous, reductionist views of humanity.Renaut argues that modern philosophy contains within itself two opposed ways of conceiving the human person. The first, which has its roots in Descartes and Kant, views human beings as subjects capable of arriving at universal moral judgments. The second, stemming from Leibniz, Hegel, and Nietzsche, presents human beings as independent individuals sharing nothing with others. In a careful recounting of this philosophical tradition, Renaut shows the resonances of these traditions in more recent philosophers such as Heidegger and in the social anthropology of Louis Dumont.Renaut's distinction between individualism and subjectivity has become an important issue for young thinkers dissatisfied with the intellectual tradition originating in Nietzsche and Heidegger. International law governing the settlement of disputes through law-based forums, such as courts, tribunals and arbitral tribunals, is fraught with limitations that are becoming especially apparent with respect to disputes that involve the protection of the environment. However despite the deficiencies of the law, international courts and tribunals have issued judgements in disputes involving the protection of the environment. At the global level the International Court of Justice (ICJ), the Appellate Body of the World Trade Organization (WTO) and the Tribunal for the Law of the Sea (ITLOS) have handed down decisions in relevant cases. In addition other legal forums can also be called upon to decide cases involving international environmental law. Such forums include the Environmental Chamber of the ICJ and the Permanent Court of Arbitration (PCA) under its general facilities and under the Environmental Facility that it is planning to establish. Similarly, special bodies, such as the United Nations Compensation Commission (UNCC), may decide on cases. Moreover, regional forums such as the European Court of Human Rights (ECHR), the Inter-American Court of Human Rights and the Court of Justice of the European Community (ECJ) have ruled on cases involving international environmental law. Despite these developments, calls for the establishment of an international environmental court at the global level persist. Several arguments have been advanced to justify the establishment of an international environmental court, for example the very many pressing environmental problems that exist today and the need for a bench consisting of experts in international environmental law to consider these problems, the need for individuals and groups to have access to environmental justice at the international level, the need to enable international organizations to be parties to disputes related to the protection of the environment and the need for dispute settlement procedures that enable the common interest in the environment to be addressed. Arguments against the establishment of an international environmental court have been advanced as well. These arguments include the following: the proliferation of international courts and tribunals would result in the fragmentation of international law, existing courts and tribunals are, or can be, well equipped to consider cases involving environmental issues and disputes involving international environmental law also involve other aspects of international law. This publication explores the arguments for and against the establishment of an international environmental court, examining topics such as the definition of an international environmental dispute and the concomitant expertise required on the bench, fragmentation and its root causes, access to justice and the representation of community interests. The author argues that the establishment of an international environmental court is not the most desirable option and she suggests that it might be more fruitful if we consider developments in environmental law, as well as in other relevant areas of international law, from a different perspective, namely, that of administrative law and reassess the relationship between international and national law. Such an approach, she argues is warranted if, inter alia , viable means for resolving environmental disputes that may arise are to be identified

Inhaltsangabe:Zusammenfassung: In der vorliegenden Arbeit wird Politisches Marketing (PM) als strategisch orientierter Ansatz, der die theoretische Basis für erfolgreiche Politikvermittlung bietet, vorgestellt. In diesen konzeptionellen Rahmen sind Teile der traditionellen Kampagnenliteratur ebenso wie praktische Methoden des kommerziellen (Konsumgüter-) Marketings eingebettet. Kurzum soll mit dem präsentierten Konzept so etwas wie die "Theory of everything" auf dem Gebiet der politischen Überzeugungsarbeit geboten werden. Um die Vorteile dieses PM-Ansatzes und die Eigenarten des PMs besser zu verstehen, wird in den zwei Kapiteln des Teiles I der vorliegenden Arbeit die historische Entwicklung des PMs und die Einordnung des PMs in verschiedene Bereiche der Marketinglehre skizziert. Der zweite Teil widmet sich der Entwicklung und Erläuterung eines Modells des PMs, das die Vorteile eines strategisch orientierten PM-Ansatzes realisiert. Dieser zweite Teil ist entsprechend den Modellkomponenten in vier Sub-Teile mit jeweils mehreren Handlungsfeldern gegliedert: Determinanten des PMs (Sub-Teil II.1), der PM-Prozeß (Sub-Teil II.2), die Instrumente des PMs (Sub-Teil II.3) und Politische Marktforschung als Handlungsgrundlage des PMs (Sub-Teil II.4). Das entwickelte Modell strukturiert nicht nur die im Rahmen dieser Arbeit präsentierte PM-Theorie. Darüber hinaus dient es als konzeptionelle Grundlage für eine Studie, die den Ist-Zustand der PM-Praxis in Österreich und Deutschland umfassend (52 Bundes- und Landesparteien retournierten den Fragebogen) erhebt. Dadurch gewinnt der PM-Praktiker wertvolle Vergleichswerte, die es ihm erlauben, seine PM-Aktivitäten mit denen anderer Parteien zu vergleichen. In the year 1999 the project of the inventarisation of the historic gardens in Austria, financed by the Austrian Science Fund FWF was finished with the manuscript "Historic Gardens in Austria. Gardens and Parks from the Renaissance to 1930". Since 1984 this project was in charge of the author with some other co-workers at the Technical University of Vienna, Department of Landscape Planning and Garden History. This first Austrian inventory tended to consider public and private gardens, parks and artistically formed landscapes of all nine Austrian states from the Renaissance to about 1930 in a systematic manner. In the years of the inventarisation over 1750 historic gardens and parks were discovered, photographed and described.
For the publication this numerous and mostly unknown quantity of gardens and parks was arranged in typological groups: gardens and parks of ecclesiastic dwelling-houses as monasteries, convents and cloisters, episcopal and provost buildings, parsonages, gardens and parks of profane buildings as castles, chateaus, palaces, manor-houses, country-houses, villas, dwelling-buildings, development houses, farmhouses, mills, factories, public buildings (monumental buildings) of culture (museum, theatre), education (school, university, botanic garden, arboretum), healing and welfare work (hospital, sanatorium, old people´s home, residential home, youth welfare home), administration (office, embassy), catering and hotel industry and tourism ( hotel, inn, restaurant), sport, recreation and leisure ( swimming-bath, shooting-stand, amusement park, leisure centre), public gardens and parks (without any main-building) as green places, village parks, town parks, village woods, town woods, parks of a spa, memorial parks, promenades, green outside staircases.
With the elaboration of the results of the inventarisation, with the consideration of the trade literature, historic maps, plans, views, pictures and other source materials it was possible to present the first documentation of the existing historic gardens and parks in Austria in three volumes, published 2002-2004 (Böhlau Verlag, Wien-Köln-Weimar). This first survey makes known the rich existence of historic garden substance, is available to further scientific research on Austrian garden art and garden culture and affords first informations to protect and preserve this important cultural heritage. - 1999 konnte das vom Fonds zur Förderung der wissenschaftlichen Forschung finanzierte Projekt "Inventarisierung der historischen Gärten Österreichs" mit der Vorlage des Manuskriptes "Historische Gärten Österreichs. Erste Erfassung der Garten- und Parkanlagen von der Renaissance bis um 1930" beendet werden. Seit dem Jahr 1984 wurde dieses Projekt am Institut für Landschaftsplanung und Gartenkunst der Technischen Universität Wien gemeinsam mit Mitarbeitern durch die Verfasserin bearbeitet. Diese erstmals für Österreich durchgeführte Bestandsaufnahme hatte zum Ziel, öffentliche und private Parks, Gärten und künstlerisch gestaltete Landschaftsteile aller österreichischen Bundesländer in einem zeitlichen Entstehungsrahmen von der Renaissance bis gegen 1930 systematisch zu erfassen. Bisher lag eine solche Übersicht der noch erhaltenen Anlagen in Österreich nicht vor; es konnten im Laufe der Bestandsaufnahme vor Ort über 1700 historische Gärten und Parks inventarisiert werden.

Mit der Ausarbeitung der Ergebnisse der Erfassung, mit der Bearbeitung der Primär- und Sekundärliteratur, historischer Karten, Pläne und Ansichten und sonstiger Quellen kann somit die erste Dokumentation des vorhandenen Bestandes an historischen Gärten und Parks in Österreich vorgewiesen werden. Diese flächendeckende Übersicht macht den reichen Bestand an historischer Gartensubstanz bekannt, stellt Grundlagen für die weitere wissenschaftliche Beschäftigung mit der österreichischen Gartenkunst und Gartenkultur zur Verfügung und bietet Informationen für Maßnahmen zur Sicherung und Erhaltung dieses wichtigen kulturellen Erbes.

In a set of cases decided at the end of the nineteenth century, the Supreme Court declared that Congress had "plenary power" to regulate immigration, Indian tribes, and newly acquired territories. Not coincidentally, the groups subject to Congress' plenary power were primarily nonwhite and generally perceived as "uncivilized." The Court left Congress free to craft policies of assimilation, exclusion, paternalism, and domination. Despite dramatic shifts in constitutional law in the twentieth century, the plenary power case decisions remain largely the controlling law. The Warren Court, widely recognized for its dedication to individual rights, focused on ensuring "full and equal citizenship"--An agenda that utterly neglected immigrants, tribes, and residents of the territories. The Rehnquist Court has appropriated the Warren Court's rhetoric of citizenship, but has used it to strike down policies that support diversity and the sovereignty of Indian tribes. Attuned to the demands of a new century, the author argues for abandonment of the plenary power cases, and for more flexible conceptions of sovereignty and citizenship. The federal government ought to negotiate compacts with Indian tribes and the territories that affirm more durable forms of self-government.
