Die Arbeit untersucht vor dem Hintergrund der gesetzlichen Neuregelung der Präimplantationsdiagnostik (PID) durch § 3a ESchG, ob die Regelung eine rechtssichere Handhabung der PID in Deutschland ermöglicht. Ein besonderer Fokus liegt dabei auf der Frage, ob das Ansinnen des Gesetzgebers, die PID lediglich in engen Grenzen zuzulassen, durch § 3a ESchG realisiert werden konnte. Die Arbeit hat darüber hinaus das Ziel, die Debatten um die PID mit Blick auf die sie betreffenden unterschiedlichen Disziplinen zu spiegeln: Der Ansatz ist trotz des rechtlichen Schwerpunkts daher ein interdisziplinärer. Die PID wird folglich nicht nur einfachgesetzlich, sondern auch aus medizinischer, ethischer und verfassungsrechtlicher Perspektive betrachtet. Bei der Untersuchung des Statuts des Embryos in vitro erfolgt dabei eine umfassende Analyse der Rechtswirklichkeit, wie sie in den gesetzlichen Regelungssystemen zum vorgeburtlichen Lebensschutz und in der Rechtsprechung des BVerfG Ausdruck findet.

The R Companion to Elementary Applied Statistics includes traditional applications covered in elementary statistics courses as well as some additional methods that address questions that might arise during or after the application of commonly used methods. As the Muslim women's question was articulated by men in the 'reform' movement (as in other communities), the participation of women was also by their (male) design; many times, women's reform activities were seen as evidence of their own (male) progress. This paper examines the role of women initiated in the reform movement and the 'role model' they were expected to play, especially if educated and wedded to one active in 'reform.' The paper takes up the study of Wahid Jahan in reform, wife of Sheikh Abdullah, a pioneer in Muslim women's education at Aligarh in the early twentieth century. Initiated in reform by her husband, and expected to follow his guidelines in all-important matters like being a 'good wife', her life would still be worthwhile to explore if the wife's commitment and initiatives moved beyond the expectations or dictates of her husband. The paper thus, through biographical writings on Wahid Jahan, seeks to examine the larger question of reform normative and wife's agency; whether it was possible for a wife as subordinate partner in reform and agent at home, to extend spaces for women both in the family and the school, or to separate herself from her roles.

Der Erfolg von Restrukturierungen hängt regelmäßig entscheidend von der steuerlichen Behandlung von durch Sanierungsmaßnahmen ausgelösten Gewinnen ab. Die Anwendung der zu diesem Zweck geschaffenen Steuerbefreiung des § 3a EStG ist jedoch aufgrund zahlreicher Auslegungsfragen konfliktträchtig. Die Arbeit zeigt daher umfassend die bekannten und neu entstanden Probleme hinsichtlich ihres Anwendungsbereichs, der Voraussetzungen und Rechtsfolgen auf, entwickelt auf Basis der einschlägigen Literatur praxisgerechte Lösungen und bietet so eine verlässliche Hilfe für die Sanierungspraxis. In einem zweiten Schwerpunkt widmet sich die Arbeit einer Prüfung der Vereinbarkeit von § 3a EStG mit dem allgemeinen Gleichheitssatz des Art. 3 Abs. 1 GG.
