As regards the legal content of the Charter, it should be noted that it does not implement fundamental rights that are absolutely new. The content and extent of the fundamental rights, once again reaffirmed in the Charter, arise from constitutional traditions and international obligations common to all Member States, including the ECHR, the case law of the CJEU and the European Court of Human Rights. National courts face difficulties resulting from the application and assurance of the fundamental rights at different levels, i.e. by the Charter, the ECHR, national constitutions and finally by the concept of the fundamental rights as general principles of Union law. Although the European and national concepts of fundamental rights are based on common legal traditions and have to be presumed as compatible, in judicial practice the question arises as to which level a national court has to comply with, or whether the court has to follow the system of fundamental rights that ensures the highest protection of fundamental rights? The Melloni judgment suggests that a national court does not have the right to apply the system that is the most favourable to the person, but has to observe the EU standards of fundamental rights.In practice many national court use the Charter in three main possible ways: as a source of interpretation of national law, direct application of the Charter provisions, and as a means to verify the arguments of the parties to the proceedings. It has to be noted also that in all three cases the Charter may be referred or applied by national courts far beyond the scope of its application, i.e. not necessarily in the field of the application of the EU law or national legislation implementing the latter. These features are also characteristic to the jurisprudence of Lithuanian national courts, in particular the Supreme Administrative Court. Der Verfassungskonvent zur Reform der Europäischen Union hat an vielen Stellen Veränderungen am bestehenden System vorgenommen. Neben den genannten Vorschlägen geht der Verfassungsentwurf natürlich auch auf die anderen Organe und Institutionen der EU ein. Erwartungsgemäß hat sich die Debatte über die institutionelle Architektur der Europäischen Union als die härteste im Konvent herausgestellt. Die zum Teil hitzigen Auseinandersetzungen unterstreichen, wie sehr sich die Vorstellungen darüber, was die Europäische Union ist und wie sie dementsprechend organisiert sein soll, noch unterscheiden. Das Ergebnis, das schließlich doch die Zustimmung des Konvents fand, spiegelt daher auch in allen Einzelfragen den Kompromiss zwischen den unterschiedlichen Lagern wider: ein Präsident des Europäischen Rates, der dank seiner gekappten Machtressourcen kaum seinen Namen verdient hat, der aber potentiell die Arbeit des Europäischen Rates kohärenter gestalten und nach außen vertreten kann; ein Kommissionspräsident, der durch die Schaffung eines gelungenen Wahlmodus und die Ausweitung seiner personellen Macht legitimatorisch und organisatorisch gestärkt ist, der seine Position aber erst neben seinem neuen "Nebenbuhler" finden muss; ein Außenminister, der die Außenpolitik der EU verkörpern soll, der sich zwischen Rat und Kommission seine Kompetenzen aber erst erarbeiten muss; schließlich Ministerrat und Europäisches Parlament, deren legislative und exekutive Aufgaben zwar klarer definiert sind, deren Funktionen sich aber nach wie vor nicht ohne weiteres in nationale Systemmodelle oder institutionelle Leitbilder einpassen lassen. Zwar deutet die Stärkung der klassisch supranationalen Institutionen Kommission und Parlament auf eine Föderalisierung der institutionellen Architektur hin, allerdings folgen insbesondere die institutionellen Innovationen eines gewählten Ratspräsidenten und eines nicht eindeutig der Kommission zugeordneten Außenministers eher einer intergouvernementalen Logik. Zur Stärkung der demokratischen Legitimation will der Konvent vor allem den Einfluss des Europäischen Parlaments im Gesetzgebungsprozess weiter ausbauen. Die neu eingeführten Europäischen Gesetze und Europäischen Rahmengesetze sollen künftig gemeinsam mit der Ratsformation "Allgemeine Angelegenheiten und Gesetzgebung" nach dem Mitentscheidungsverfahren erlassen werden. Damit würde - trotz mancher weiterhin bestehender Schwachstelle in der Legitimationskette zwischen den Bürgern und den Entscheidungsinstanzen - das demokratische Fundament der Europäischen Union deutlich gestärkt und die Kontrollverbindungen innerhalb und zwischen den einzelnen Akteuren der europäischen Mehrebenendemokratie im Gesetzgebungsprozess fester geknüpft als zuvor. Um eine effiziente Entscheidungsfindung zu ermöglichen, soll der Rat als Regelverfahren zu qualifizierten Mehrheitsentscheidungen übergehen. Das Quorum für qualifizierte Mehrheits-entscheidungen soll zudem ab 2009 auf eine Mehrheit der Staaten, die zugleich drei Fünftel der Bevölkerung vertreten, verändert werden. Das wären große Schritte in die richtige Richtung - allerdings gibt es im Entwurf selbst noch immer zu viele Ausnahmen, die auch weiterhin der Einstimmigkeit unterliegen. Auch die Kommission soll effizienter werden und ab 2009 aus ihrem Präsidenten, dem neu zu schaffenden Außenminister als Vizepräsidenten, 13 Europäischen Kommissaren sowie aus je einem nicht stimmberechtigten Kommissar aus den übrigen Mitgliedstaaten bestehen. Der Europäische Rat soll Organstatus, neue Kompetenzen und einen auf zweieinhalb Jahre gewählten hauptamtlichen Präsidenten erhalten, um die Effizienz und Kontinuität der Ratsarbeit zu verbessern. Damit werden eine Reihe von Weichenstellungen vorgeschlagen, die aufgrund der aufgezeigten Defizite aber weiter optimiert werden müssen. So etwa bei den Bestimmungen zum EuGH, der Europäischen Zentralbank oder dem Ausschuss der Regionen, der beispielsweise im Rahmen des Frühwarnsystems des Subsi-diaritätsprotokolls ein Klagerecht in all denjenigen Fallen erhalten soll, in denen er über Anhörungsrechte verfügt. Die institutionellen Reformen des Konvents werden kaum dazu beitragen können, dass die Bürger Europa besser verstehen. Insgesamt ist das politische System der EU zwar sinnvoll weiterentwickelt worden - das Zusammenspiel der einzelnen Institutionen und Akteure auf EU-Ebene bleibt aber komplex und wenig transparent. Allerdings liegt das auch in der Natur der Sache. Man darf gespannt sein, ob mutige Einschnitte wie die Verringerung der Anzahl stimmberechtigter Kommissare, die neue doppelte Mehrheit von Staaten und Bevölkerung bei Ratsentscheidungen oder die Abschaffung des halbjährlichen Rotationssystems der EU-Ratspräsidentschaft die Nabelschau der Regierungskonferenz überdauern. Es werden in jedem Fall sowohl bestehende Probleme ungelöst bleiben als auch durch die Veränderungen des Vertrags über die Verfassung - sobald dieser in Kraft getreten ist - Defizite ganz neuen Formats zu Tage treten. Dieser Probleme wird sich ein weiterer Konvent und eine erneute Regierungskonferenz annehmen müssen.
