Constitutional support for reforming the administrative and territorial structure of Ukraine ; Конституційно-правове забезпечення реформування адміністративно-територіального устрою України
The state of constitutional support for reforming the administrative and territorial system of Ukraine is analyzed in the article. In particular, the relevant provisions of the draft Law of Ukraine "On Amendments to the Constitution of Ukraine (concerning decentralization of power)" № 2217a of July 1, 2015 (revoked - August 29, 2019) (hereinafter - the Draft Law), in the context of their compliance with the constitutions of European countries, are investigated. At the same time, it is concluded that the new version of Article 133 of the Constitution of Ukraine, which was proposed in the Draft Law, largely than the current wording of this article corresponded to the method of establishment of the system of administrative and territorial structure in foreign constitutions. This method determines only the types of administrative and territorial units, without their list of names and specific elements of their legal status (constitutions of the Italian Republic, the Kingdom of Spain, Hungary, Belgium, the Portuguese Republic, and the Kingdom of the Netherlands). Thus, the provisions of the Draft Law concerning the administrative and territorial structure of Ukraine generally corresponded to the practice of constitutional provision of these issues in European countries. In addition, the draft Law of Ukraine "On the Principles of the Administrative and Territorial System of Ukraine" № 8051 of February 22, 2018 (hereinafter - the Draft Law) (revoked - August 29, 2019) is analyzed. It is emphasized that the importance of this Draft Law was in the fact that it carried out the decommunization of the national legislation concerning the administrative and territorial system. It actually repealed the Decree of the Presidium of the Verkhovna Rada of theUSSR "On the procedure for resolving issues of administrative and territorial structure of the Ukrainian SSR" of March 12, 1981, which today remains valid in the part that does not contradict the Constitution of Ukraine. It is noted that the Draft Law № 8051 did not approve the new administrative and territorial structure of Ukraine, but determined the procedure for its formation. It will not be possible to overcome the chaos in matters concerning the administrative and territorial structure of the country and successfully complete the reform of decentralization of power in Ukraine without such a legislative act. It is concluded that, despite the completion of the unification of communities in Ukraine, the formation of districts, the relevant state administrations will continue to function at the oblast and rayon levels. It is not present in any European state and contradicts the ratified European Charter of Local Self-Government. Thus, it is necessary to make appropriate changes to the Constitution of Ukraine for a completely developed reform of local self-government and territorial organization of power in our state. ; У статті проаналізовано стан конституційно-правового забезпечення реформування адміністративно-територіального устрою України. Зокрема, досліджено відповідні положення проекту закону України «Про внесення змін до Конституції України (щодо децентралізації влади)» № 2217а від 1 липня 2015 року (відкликаний 29 серпня 2019 року), у контексті їхньої відповідності конституціям європейських країн. Зроблено висновок, що нова редакція статті 133 Конституції України, яка була запропонована в зазначеному законопроекті, більшою мірою, порівняно із чинною редакцією цієї статті, відповідала способу закріплення системи адміністративно-територіального устрою в конституціях закордонних країн, коли визначаються лише види адміністративно-територіальних одиниць, без їх поіменного переліку, а також окремі елементи їхнього правового статусу (конституції Італійської Республіки, Королівства Іспанія, Угорщини, Бельгії, Португальської Республіки, Королівства Нідерланди). Отже, положення законопроекту, які стосувалися адміністративно-територіального устрою України, загалом відповідали практиці конституційного забезпечення цих питань у європейських країнах. Крім того, піддано аналізу проєкт закону України «Про засади адміністративно-територіального устрою України» № 8051 від 22 лютого 2018 року (відкликаний 29 серпня 2019 року). Наголошено, що важливість даного законопроекту полягала в тому, що він, по суті, проводив декому-нізацію вітчизняного законодавства в частині адміністративно-територіального устрою, фактично скасовував Указ Президії Верховної Ради Української Радянської Соціалістичної Республіки «Про порядок вирішення питань адміністративно-територіального устрою Української Радянської Соціалістичної Республіки» від 12 березня 1981 року, який натепер залишається чинним у частині, що не суперечить Конституції України. Зазначено, що законопроект № 8051 не затверджував нового адміністративно-територіального устрою України, а визначав порядок його формування, зроблено висновок, що без такогого законодавчого акта не вдасться подолати хаос у питаннях, що стосуються адміністративно-територіального устрою країни, та успішно завершити реформу децентралізації влади в Україні. Підсумовано, що, незважаючи на завершення в Україні об'єднання громад і утворення районів, на обласному та районному рівнях будуть продовжувати функціонувати відповідні державні адміністрації, чого немає в жодній європейській державі і що суперечить ратифікованій Європейській хартії місцевого самоврядування. Отже, для повноцінної реформи місцевого самоврядування та територіальної організації влади в нашій державі необхідне внесення відповідних змін до Конституції України.
