Здійснено аналіз конституційності ухваленого Закону № 317–VIII. Розглянуто зв'язок між Законом 317–VIII і концепцією озброєної демократії. Наведені пропозиції щодо подальших змін в Законі № 317–VIII. Закон № 317–VIII спрямований на досягнення легітимної мети, є необхідним для подальшого демократичного поступу України. При цьому він не позбавлений окремих недоліків в частині дотримання в його окремих положеннях принципу верховенства права, пов'язаних і з вимогами пропорційності та правової визначеності. Осуществлен анализ конституционности принятого Закона № 317–VIII. Рассмотрена связь между Законом 317–VIII и концепцией вооруженной демократии. Приведены предложения относительно дальнейших изменений в Законе № 317–VIII. Закон № 317–VIII направлены на достижение легитимной цели, необходим для дальнейшего демократического развития Украины. При этом он не лишен отдельных недостатков в части соблюдения в его отдельных положениях принципа верховенства права, связанных с требованиями пропорциональности и правовой определенности. Analyzing constitutionality of Law № 317–VIII was carried out. The relationship between Law 317–VIII and the concept of militant democracy is considered. Proposals for further amendments to the Law № 317–VIII are presented. Law № 317–VIII is aimed at achieving the legitimate goal, is necessary for further democratic progress of Ukraine. At the same time, he is not deprived of certain shortcomings in respect of the observance in his separate provisions of the principle of the rule of law, related to the requirements of proportionality and legal certainty.
The article clarifies the relationship between the constitution and the basic law. There is a constant debate in the literature about when the first constitutions appeared in the world. The question also arises as to who from the very beginning turned to the concept of constitution in the doctrinal sense, describing the corresponding already existing concept or proposing to introduce the constitution as a certain ideal model in practice. At the same time, disputes over the relationship between the constitution and the basic law, the modern content of the constitution as a state and legal phenomenon do not subside. It is concluded that the doctrine of the constitution was formed gradually, evolutionarily. The Constitution began to be perceived as a state system or a form of government, not immediately identifying it with a separate written formal source with the appropriate name. In parallel, the doctrine of the basic laws developed, which meant precisely the rules and regulations, although their form could be different. It is concluded that before the emergence of constitutions in the formal sense, it is especially important to emphasize its genesis - it grew out of material significance, being supplemented at a certain historical stage by the formal meaning. The term "constitution" has gradually supplanted the term "fundamental law", although in some countries it has remained in use for various historical reasons as a synonym for the constitution. German-speaking countries have a long tradition of using the term "fundamental law". Today in the Federal Republic of Germany, the constitution is called the "Fundamental Law". The corresponding motivation for the name was due, according to the authors, to the temporary nature of the act adopted after the Second World War in 1949 (which has remained in force to this day). The current Constitution of Hungary in 2011 is also called the "Fundamental Law". Spanish-speaking states also have their own analogue of the "fundamental law", which is used as a synonym for the constitution - "Carta Fundamental". ; У статті з'ясовано сутність конституції як основного закону. В літературі постійно точаться дискусії щодо того, коли саме у світі з'явилися перші конституції. Так само постає питання про те, хто від самого початку звернувся до поняття конституції в док-тринальному розумінні, описуючи відповідне вже наявне поняття або пропонуючи запровадити конституцію як певну ідеальну модель на практиці. Паралельно не вщухають спори щодо співвідношення конституції та основного закону, сучасного змісту конституції як державно-правового явища. Робиться висновок про те, що вчення про конституцію формувалося поступово, еволюційно. Конституцію почали сприймати як державний устрій або форму правління, не одразу ототожнюючи її з окремим писаним формальним джерелом з відповідною назвою. Паралельно розвивалося вчення про основні закони, під якими розумілися саме норми й правила, хоча їх форма могла бути різною. Робиться висновок про те, що до появи конституцій у формальному значенні особливо важливо підкреслити її ґенезу: вона виросла з матеріального значення, будучи доповненою на певному історичному етапі значенням формальним. Термін «конституція» поступово витіснив термін «основний закон», хоча у деяких країнах досі залишився у вжитку з різних історичних причин як синонім конституції. Досить великутрадицію вживання терміна «основний закон» мають німецько-мовні країни. Сьогодні у Федеративній Республіці Німеччина конституція названа саме «Основний Закон». Відповідна мотивація щодо назви була обумовлена, за задумом авторів, тимчасовим характером дії ухваленого після Другої світової війни у 1949 році акта (який зберіг свою чинність досі). Сьогоднішня Конституція Угорщини 2011 року має також назву «Основний Закон». Іспаномовні держави також мають свій аналог «основного закону», що вживається як синонім конституції, а саме "Carta Fundamental".
The article examines the subject of legislative regulation and its limits in the context of regulatory regulation of prices (tariffs). The French experience of constitutional regulation and the practice of the Constitutional Council on the subject of legislative regulation are analyzed. Proposals have been made for a narrow interpretation of the parliament's right to determine the principles of domestic and foreign policy by adopting a separate law on such principles. It is assumed that the definition of the principles of domestic and foreign policy is implemented through the adoption of a special Law of Ukraine of July 1,2010 Verkhovna Rada of Ukraine "On Principles of Domestic and Foreign Policy" № 2411-VI, other laws adopted by the Verkhovna Rada of Ukraine laws (paragraph 1 of part 1 of Article 85). The conclusion on inexhaustibility of a subject of legislative regulation by article 92 of the Constitution of Ukraine is made. It is concluded that the Government has the right to exercise individual legal regulation in the field of tariffs, the relevant term is actively used in legal theory in the context of legal regulation or legal regulation mechanism and means the implementation of law enforcement. Naming of four spheres in item 3 of Article 106 of the Constitution of Ukraine (prices, finances, investments and taxes) means a single approach to them. It is hardly logical to see the price sphere in this list as a special one that has a special status from the point of view of its normative regulation, one that should be based on by-laws, while other spheres should be based on legislative regulations. In addition, the Practice of the CCU of 2004 refutes the idea of exclusively "principles" (principles, principles) in the regulation of prices and tariffs (the decision of the CCU of March 16,2004 № 6-rp/2004) (the case of printed periodicals) and the decision of 15 April 2004 № 10-rp/2004 (case on determining the minimum price for sugar). ; У статті досліджено предмет законодавчого регулювання і його межі в контексті нормативного регулювання цін (тарифи). Проаналізовано французький досвід конституційного регулювання і практику Конституційної Ради щодо предмета законодавчого регулювання. Висловлені пропозиції щодо вузької інтерпретації права парламенту стосовного визначення засад внутрішньої і зовнішньої політикишляхом ухвалення окремого закону про такі засади. Припускається, що визначення засад внутрішньої і зовнішньої політики реалізоване шляхом ухвалення Верховною Радою України спеціального Закону від 1 липня 2010 року № 2411-УІ «Про засади внутрішньої і зовнішньої політики», інші ж закони, ухвалені Верховною Радою України, охоплюються компетенцією парламенту щодо ухвалення законів (пункт 1 частини 1 статті 85). Зроблено висновок щодо невичерпності предмета законодавчого регулювання статтею 92 Конституції України. Зроблено висновок про те, що Уряд має право здійснювати саме індивідуальне правове регулювання у сфері тарифів, відповідний термін активно використовується в теорії права в контексті теорії правового регулювання або механізму правового регулювання й означає здійснення правозастосуван-ня. Поіменування чотирьох сфер у пункті 3 статті 106 Конституції України (ціни, фінанси, інвестиції і податки) означає єдиний підхід щодо них. Навряд чи логічно вбачати цінову сферу в цьому переліку як якусь особливу, що має особливий статус з погляду її нормативного регулювання, таку, що має базуватися на підзаконній реґламентації, водночас інші сфери мають базуватися на реґламентації законодавчій. Крім того, практика Конституційного Суду України 2004 року спростовує ідею виключно «засад» (принципи, начала) у регулюванні цін і тарифів (рішення Конституційного Суду України від 16 березня 2004 року № 6-рп/2004 (справа про друковані періодичні видання), а також рішення від 15 квітня 2004 року № 10-рп/2004 (справа про визначення мінімальної ціни на цукор).

The article clarifies the connection between political populism and the concept of constituent power, the attitude to it and the practice of using this concept. The issue of political populism is gradually coming to the fore in modern constitutional and legal studies in the West. This is explained by a certain reversal, which came as a surprise after the long-term dominance of the concept of "the end of history" by F. Fukuyama. Modern populists have authoritarian traits, demonstrate calls to fight traditional elites, and use specific constitutional concepts to help them realize their own ideologies. The spread of populism, which may involve a different palette of political forces and views, is a real problem. A common feature of populism is anti-pluralism. At the same time, populism embodies its anti-pluralist views in specific legal mechanisms related to the special interpretation and use of the concepts of people's sovereignty, constituent power and constitutional identity. Often populist leaders and forces try to subjugate the anti-pluralist logic and the judiciary itself. The experience of foreign countries, especially Hungary and Venezuela, should demonstrate the dangers that can potentially await Ukraine in this regard. Manipulation of the concept of constituent power is possible by excluding the opposition from this process and implementing their own narrow party and anti-pluralist ideas in the text of the new Basic Law, or by using the instruments of convening the Constituent Assembly and referendum to fight legitimate branches of government. The text of the Constitution of Ukraine also does not have a special procedure for the adoption of a new constitution either in a referendum or a constituent assembly, instead of a proposal to adopt a new constitution outside the relevant procedure, based solely on Art. 5 of the Constitution, are heard constantly. Moreover, this was directly provided for in the recognized unconstitutional Law "On the All-Ukrainian Referendum" of 2012. ; У статті з'ясовано зв'язок між політичним популізмом і концепцією установчої влади, ставлення до неї і практику використання цієї концепції. Проблематика політичного популізму поступово виходить на перший план у сучасних конституційно-правових дослідженнях на Заході. Пояснюється це певним розворотом, який став несподіваним після домінування протягом досить тривалого часу концепції «кінця історії» Ф. Фукуями. Сучасні популісти мають авторитаристські риси, демонструють заклики до боротьби з традиційними елітами, а також використовують конкретні конституційні концепції, що допомагають їм реалізовувати власні ідеологеми. Поширення популізму, що може охоплювати різну палітру політичних сил і поглядів, є справжньою проблемою. Загальною ознакою популізму варто визнати антиплюралізм. Водночас популізм втілює свої антиплюралістичні погляди в конкретних юридичних механізмах, пов'язаних із особливим трактуванням і використанням концепцій народного суверенітету, установчої влади і конституційної ідентичності. Часто популістські лідери і сили намагаються підкорити антиплюралістичній логіці й безпосередньо собі судову владу. Досвід зарубіжних країн, передусім Угорщини й Венесуели, має продемонструвати небезпеки, які потенційно можуть очікувати в цьому плані Україну. Маніпулювання концепцією установчої влади можливе шляхом вилучення із цього процесу опозиції і втілення власних вузькопартійних і антиплюралістичних ідей у тексті нового Основного Закону або ж використання інструментів скликання Установчих зборів і референдуму для боротьби з легітимними гілками влади. У тексті Конституції України також немає спеціальної процедури ухвалення нової конституції ані на референдумі, ані установчими зборами, натомість пропозиції ухвалити нову конституцію поза відповідною процедурою, спираючись тільки на ст. 5 Конституції, лунають постійно. Ба більше, це прямо передбачалося визнаним неконституційним Законом «Про всеукраїнський референдум» 2012 р.
The article considers the role of reservations of the Constitutional Court of Ukraine in the procedure of amending the Constitution of Ukraine. It is alleged that genetic constitutional control arose from the need for the constitutional review body to verify the acts of parliament for constitutionality. However, now there is a significant practice of participation of bodies of constitutional jurisdiction in the consideration in the form of control over bills on amendments to the constitution. At the same time, this approach has its pros and cons. It is concluded that historically the expression of various opinions of a recommendatory nature in the motivating part of the conclusion on the compliance of the bill with Articles 157-158 of the Constitution is an invention of the CCU itself, which it began to apply in 2000. The legislator, formulating the term "warning" on the conclusion of the CCU on amendments to the Constitution of Ukraine, meant only those cases where the bill complies with Art. 157-158 of the Constitution of Ukraine only partially, for example, a number of provisions correspond to them, and a number - no. From this point of view, the argumentation expressed by the CCU in the motivating part, in the "negative" conclusion, ie in which the CCU found a violation of Art. 157-158, can help to correct the bill correctly and has the right to receive the status of "reservations". It is concluded that the doctrinal, recommendatory function of the CCU in this regard is not entirely correct, as the CCU must play a role - to indicate the limits of what is allowed, but in no case to express professional or expert wishes. The only consequence of such wishes is the need to "consider" them in parliament, but by no means the obligation to take them into account. However, such a dual nature of the conclusions, outside the verification criteria set out in Art. 157-158 of the Constitution of Ukraine, becomes more political. Again, the CCU is not an expert involved as an advisory body, but an entity whose legal positions must be binding. ; У статті розглянуто роль застережень Конституційного Суду України в процедурі внесення змін до Конституції України. Стверджується, що генетично конституційний контроль з'явився у зв'язку з необхідністю органу конституційного контролю перевіряти на відповідність конституції акти парламенту. Проте нині сформувалася значна практика участі органів конституційної юрисдикції у розгляді в формі контролю за законопроектами про внесення змін до конституції. Водночас цей підхід має свої позитивні і негативні сторони. Зроблено висновок про те, що історично висловлення різного роду думок рекомендаційного характеру у мотивувальній частині висновку щодо відповідності законопроекту статтям 157-158 Конституції - винахід самого КСУ, який він почав застосовувати з 2000 року. Саме такі думки згодом набули статусу «застережень» у його рішеннях. Законодавець, формулюючи термін «застереження» щодо висновку КСУ про внесення змін до Конституції України, мав на увазі лише ті випадки, коли законопроект відповідає статтям 157-158 Конституції України лише частково, наприклад низка положень їм відповідають, а інші - ні. З цієї точки зору аргументація, висловлена КСУ у мотивувальній частині, у «негативному» висновку, в якому КСУ знайшов порушення статей 157-158, може допомогти правильно відкоригувати законопроект і має право отримати статус «застережень». Доктринальна, рекомендаційна функція КСУ в цьому плані є не зовсім коректною, оскільки КСУ має виконувати певну роль - вказувати межі дозволеного, проте в жодному разі не висловлювати фахові або ж експертні побажання. Єдиний наслідок таких побажань - це лише необхідність їх «розгляду» парламентом, проте в жодному разі не обов'язок урахування. Проте така дуальна природа висновків поза критеріями перевірки, визначеними статтями 157-158 Конституції України, стає більше політичною. Знову ж таки КСУ - це не експерт, який залучається як дорадчий орган, а суб'єкт, юридичні позиції якого повинні мати обов'язковий характер.
Traditionally, when we talk about amending the constitution, we mean the transformation of its text. However, it would be too formalistic to see the constitution in its textual expression outside the practice of application, interpretation, and so on. Given the doctrinal approaches, the factor of interpretation clearly affects the content of the constitution, and the change of the already formed interpretation – even more so. Different terms are used to denote the influence of interpretation on the content of the constitution: development, transformation, change of the constitution. Constitutional courts play a key role in interpreting the Constitution in countries where there is a model of specialized constitutional review. However, as is well known, the CCU exercises a number of powers in accordance with the Constitution of Ukraine, with separate powers regarding the official interpretation of the Constitution of Ukraine and the verification of a number of legal acts for compliance with the Constitution of Ukraine. It would be worthwhile to pay attention once again to the authority to officially interpret the Constitution of Ukraine by improving it and linking it to specific practical problems of law enforcement, or to abandon it altogether. Thus interpretation by the Constitutional Court should be carried out, however casually, – at consideration of a concrete case by the constitutional control. According to the position of the Venice Commission, it is precisely the constituent power that manifests itself through the mouths of the constitutional courts, which determines a high degree of their legitimacy. Thus, in any case, it is necessary to recognize the fact of transformation of the constitution by its judicial interpretation. It is always necessary to understand the alternative, which is the development of the constitution through the acts of the ordinary legislator. Moreover, the legitimacy of the legislature to speak on behalf of the constituent power is much less than that of the constitutional courts, if we take the approach of P. Rosanvallon. That is why the development of the constitution through its interpretation should not be contrasted with the concept of constituent power. ; Традиційно, коли говоримо про внесення змін до конституції, ми маємо на увазі трансформацію її тексту. Проте було б надто формалістично вбачати конституцію в її текстуальному вираженні поза практикою застосування, тлумачення тощо. З огляду на доктринальні підходи, чинник тлумачення однозначно впливає на зміст конституції, а зміна вже сформованого тлумачення і поготів. На позна-чення впливу тлумачення на зміст конституції вживають різні терміни: «розвиток», «трансформа-ція», «зміна» конституції. Ключову роль у тлумаченні конституції в тих країнах, де існує модель спеціалізованого консти-туційного контролю, відіграють конституційні суди. Проте, як відомо, Конституційний Суд України відповідно до Конституції України здійснює низку повноважень, окремо зафіксовано повноваження щодо офіційного тлумачення Конституції України і щодо перевірки на відповідність Конституції України низки правових актів. Варто було б ще раз звернути увагу на повноваження щодо офіційного тлумачення Конституції України шляхом його вдосконалення і прив'язки до конкретних практичних проблем правозастосу-вання або ж відмовитися від нього взагалі. Тлумачення Конституційним Судом має здійснюватися, проте казуально – під час розгляду конкретної справи, шляхом конституційного контролю. Відповідно до позиції Венеціанської комісії, устами конституційних судів якраз і проявляє себе установча влада, що зумовлює високий ступінь їхньої легітимності. Отже, за будь-яких умов варто визнати факт перетворення конституції шляхом її судового тлумачення. Варто завжди розуміти альтернативу, якою є розвиток конституції шляхом актів звичайного законодавця. Причому легітимність промовляти від імені установчої влади в законодавчої влади є значно меншою, ніж у конституційних судів, якщо поділяти підхід П. Розанваллона. Саме тому розвиток конституції шляхом її тлумачення не варто протиставляти концепції установчої влади.
The article considers the status of the Constitutional Court of Ukraine as a judicial authority. The content of the discussion between Hans Kelzen and Karl Schmitt on the nature of the constitutional court is revealed. The content and consequences of the 2016 constitutional reform regarding the status of the Constitutional Court of Ukraine have been clarified. Arguments concerning the compliance of the Constitutional Court of Ukraine with the criteria of Art. 6 of the European Convention on Human Rights. It is concluded that the way of creating a separate constitutional court, which was chosen in Europe as a result of the "victory" of Hans Kelzen's arguments over the arguments of Karl Schmitt, is hardly worth revising. Such a revision calls into question the very existence, authority and role of the Constitutional Court in the mechanism of protection of human rights, as well as the legal force of its decisions, its own jurisdiction, its institutional independence, which is ensured by judicial status (according to Kelzen), creates uncertainty system through potential competition with the Supreme Court as the "highest court in the judicial system of Ukraine" (Part 3 of Article 125 of the Constitution in its current version). The relevant concern (regarding competition with the Supreme Court) found its concrete expression in the recognition of the last Constitutional Court of Ukraine as a political body, as well as the Supreme Court's objection to the extension of Art. 6 of the European Convention on Human Rights. Recognition of the out-of-court status of the Constitutional Court of Ukraine or its political rather than legal nature diminishes its role and does not contribute to the smooth functioning of judicial mechanisms for the protection of human rights. The European Court of Human Rights has repeatedly recognized national constitutional courts as a "court established by law" within the meaning of Article 6 of the Convention. The judicial status of the Constitutional Court of Ukraine was not disputed by the Venice Commission, on the contrary, it was approved. ; У статті розглянуто статус Конституційного Суду України як судового органу влади. Розкрито зміст дискусії між Гансом Кельзеном і Карлом Шміттом щодо природи конституційного суду. З'ясовано зміст і наслідки конституційної реформи 2016 року в частині статусу Конституційного Суду України. З'ясовано аргументи щодо відповідності Конституційного Суду України критеріям ст. 6 Європейської конвенції з прав людини. Зроблено висновок про те, що шлях створення окремого конституційного суду, який був обраний в Європі внаслідок «перемоги» аргументів Ганса Кель-зена над аргументами Карла Шмітта, навряд чи варто піддавати ревізії. Така ревізія ставить під сумнів сам факт існування, авторитет і роль Конституційного Суду в механізмі захисту прав людини, а також юридичну силу його рішень, власну юрисдикцію, його інституційну незалежність, що забезпечується саме судовим статусом (за Кельзеном), створює невизначеність щодо місця в судовій системі шляхом потенційної конкуренції з Верховним Судом як «найвищим судом у системі судоустрою України» (ч. 3 ст. 125 Конституції в чинній редакції). Відповідне занепокоєння (щодо конкуренції з Верховним Судом) набуло свого конкретного вияву під час визнання останнім Конституційного Суду України політичним органом, а також заперечення Верховним Судом поширення на Конституційний Суд України ст. 6 Європейської конвенції з прав людини. Визнання позасудового статусу Конституційного Суду України або ж його політичного, а не правового характеру принижує його роль і не сприяє злагодженому функціонуванню судових механізмів захисту прав людини. Європейський суд із прав людини неодноразово визнавав національні конституційні суди «судом, встановленим законом» саме в розумінні відповідної ст. 6 Конвенції. Судовий статус Конституційного Суду України не заперечувався Венеціанською комісією, навпаки - він схвалювався.
