The article highlights the problematic issues related to the harmonization of national legislation with international standards in the framework of the proposed NAPC "Anti-Corruption Strategy for 2020-2024". The legislation of foreign countries (Republic of Tajikistan, Republic of Belarus, Republic of Moldova, Republic of Poland, Germany) on the issue of civil service (conflict of interest, ethics of civil servants) is analyzed. The scientific opinion on the definition of "legal liability of a civil servant and the result of illegal behavior" is presented. Internationaldocuments regulating the introduction of the concepts "public office'", "civil servant", "principles of combating corruption" were studied. To comply with international obligations under universal and regional treaties, to prevent corruption, the following ways are proposed: development of guidelines for civil servants on resolving conflicts of interest and adherence to ethical norms in their activities, taking into account the standards proposed by regional documents; bringing the perpetrators to justice for corruption and other corruption-related offenses; quarterly coverage of information on the websites of public authorities on coordinated and preventive policies to combat corruption (implementation of pre-developed and implemented roadmaps); conducting open competitions for positions in the civil service with representatives of society (public councils, the media); involvement of international specialists and national specialists with knowledge of international law in competition (supervisory) councils, which take care of the process of selection of persons for public service in Ukraine. ; У статті висвітлено проблемні питання, пов'язані з гармонізацією національного законодавства з міжнародними стандартами в рамках запропонованої НАЗК «Антикорупційної стратегії на 2020-2024 роки». Проаналізовано законодавство іноземних країн (Республіки Таджикистан, Республіки Казахстан, Республіки Білорусь, Республіки Молдова, Республіки Польща, Німеччини) щодо питання проходження державної служби (конфлікт інтересів, етика державних службовців). Представлено наукову думку щодо визначення поняття «юридична відповідальність державного службовця в результаті протиправної поведінки». Вивчено міжнародні документи, якими регламентовано введення понять «державна посада», «державний службовець», «принципи боротьби з корупцією». Для дотримання міжнародних зобов'язань за універсальними та регіональними договорами, попередження корупції запропоновано такі шляхи вирішення проблеми: розроблення методичних рекомендацій для державних службовців з питань розв'язання конфліктів інтересів і дотримання етичних норм у своїй діяльності з урахуванням стандартів, запропонованих регіональними документами; притягнення винних осіб до відповідальності за вчинення корупцій-них діянь та інших правопорушень, пов'язаних із корупцією; щоквартальне висвітлення інформації на сайтах органів державної влади щодо скоординованої та попереджувальної політики з приводу подолання корупції (виконання заздалегідь розроблених і впроваджених дорожніх карт); проведення відкритих конкурсів з метою зайняття посад в органах державної служби з представниками суспільства (громадськими радами, ЗМІ); залучення міжнародних фахівців і національних фахівців зі знаннями міжнародного права до конкурсних (спостережуваль-них) рад, які опікуються процесом добору осіб на публічну службу в Україні.

The article analyzes the decisions of the European Court of Human Rights in terms of the activities of persons serving in the state, in particular, the judiciary. The cases of the European Court of Human Rights have been investigated: Magyar Helsinki Bizottsag v. Hungary, Thoma v. Luxemburg, CENTRE FOR DEMOCRACY AND THE RULE OF LAW v. Ukraine. The role of organizations performing the important function of the watchdog of democracy (publicwatchdog) has been established. It is emphasized that "courts - guarantors of justice, whose role is fundamental in a state where the rule of law is recognized and enforced - should enjoy public trust". This requires scrutiny by nongovernmental organizations and the media of both the activities of the judiciary and staff providing justice services. The research focuses on the activities of the courts, through the prism of public trust - an open court -the judge. The study focuses on Article 11 of the Convention for the Protection of Human Rights and Fundamental Freedoms and reveals its content through the rulings of the European Court of Human Rights. The author also draws attention to the position of the Council of Europe on the judiciary and emphasizes the thesis "justice is an important component of democratic societies". This is consistent with universal standards of justice and human rights. It is concluded that the option "publicwatchdog" is a valid in democratic society for the improvement of state institutions, and the European Court of Human Rights confirms this in its practice. The judge is a figure of modern society, and therefore the public interest in such a figure is justified in order to establish confidence in the whole judiciary and to shape a democratic Ukraine. At the same time, the author notes that the public interest in the judiciary exists due to public organizations, media, citizens and lawyers who study the work of courts (judges), analyze the current state of justice, report on the level of "access to justice". ; У статті проаналізовано рішення ЄСПЛ у розрізі діяльності осіб, що перебувають на службі в держави, зокрема судової влади. Досліджено справи ЄСПЛ Magyar Helsinki Bizottsag v. Hungary, Thoma v. Luxemburg, CENTRE FOR DEMOCRACY AND THE RULE OF LAW v. Ukraine. Установлено роль організацій, що здійснюють важливу функцію «сторожового пса демократії» (publicwatchdog). Наголошено, що «суди - гаранти справедливості, роль яких є основоположною в державі, де визнається й діє принцип верховенства права, - повинні користуватися довірою громадськості». Для цього необхідний контроль з боку недержавних громадських організацій і ЗМІ як діяльності судової влади, так і персоналу, який надає послуги з правосуддя. Досліджується діяльність судів через призму «довіра суспільства - відкритий суд - особа судді». У дослідженні приділяється увага статті 11 Конвенції про захист прав людини і основоположних свобод, розкривається її зміст за допомогою рішень ЄСПЛ. Також автор звертає увагу на позицію Ради Європи щодо судових органів і підкреслює тезу «правосуддя є важливим компонентом демократичних суспільств». Це узгоджується відповідно до універсальних стандартів щодо правосуддя та прав людини. Зроблено висновок, що опція «publicwatchdog» є чинною в демократичному суспільстві для вдосконалення державних інститутів, ЄСПЛ підтверджує це в практиці. Суддя є фігурою сучасного суспільства, а отже, суспільний інтерес до такої фігури є виправданий для утвердження довіри до всієї судової влади й формування демократичної України. При цьому автор зазначає, що саме завдяки громадським організаціям, ЗМІ, громадянам та адвокатам, які вивчають роботу судів (суддів), аналізують сучасний стан правосуддя, повідомляють про рівень «доступу до правосуддя» та загальну практику в судах за окремими категоріями справ, формується думка про судову владу.
