The experience of organizing and exercising control and supervision over the US Special Services under the conditions of challenges and threats to national security, defense and interests of the state at the end of the XX – beginning of the XXI century is analyzed and generalized. It has been established that the US Special Services are within the limits and possibilities clearly outlined by national legislation under the close supervision and control of government institutions and the public defined by it. Such conditions allow them to professionally perform the tasks assigned to them within the framework of the legislative field of the state, allied and international obligations, respect for human rights and freedoms. A specific feature of the functioning of the system of control and supervision over US Special Services is a clear division of areas of its implementation by independent branches of government with simultaneous supervision over them and Special Services by public organizations and independent institutions. Somewhat more in terms of the number and scope of surveillance and control measures over the Special Services from other branches of government belongs to its executive branch – the president and the government. Extremely large control powers have been vested in US law to the Director of National Intelligence (DNI), that in effect and scope is the second official over Special Services after the country's president. The role and place in the structure of the US Special Services of the Inspector General, who is appointed by the President, is unusual for Special Services of other countries, who subordinated and reports only to him. He is a member of DNI Directorate staff and conducts independent investigations, audit, inspections and special reviews of programs and activities of intelligence community (IC), the implementation of which is organized, lead and controlled by its head – the Director of National Intelligence. It draws attention, despite the constant terrorist threats and challenges to US security, the principled approach of independent institutions, organizations and the public to the concern for compliance with human rights and freedoms by Special Services in the performance of professional tasks both, within the country and abroad. ; Проаналізовано й узагальнено досвід організації і здійснення контролю та нагляду над спеціальними службами США в умовах викликів і загроз національній безпеці, обороні та інтересам держави у кінці ХХ – на початку ХХІ століття. Встановлено, що спеціальні служби США перебувають у чітко окреслених національним законодавством рамках обмежень та можливостей під пильним наглядом і контролем визначених ним інститутів влади та громадськості. Такі умови дозволяють їм у межах законодавчого поля держави, союзних та міжнародних зобов'язань, поваги до прав та свобод людини фахово виконувати визначені завдання. Характерною особливістю функціонування системи контролю та нагляду над спецслужбами США є чіткий розподіл сфер його реалізації незалежними гілками влади країни при одночасно здійснюваному над ними та спецслужбами нагляді громадських організацій та незалежних установ. Дещо більше за кількістю та обсягом наглядових і контролюючих заходів над спецслужбами від інших гілок влади належить її виконавчій гілці – Президенту та Уряду держави. Надзвичайно великими контролюючими повноваженнями наділений Директор національної розвідки (ДНР) – по суті, обсягу та значенню – другої після Президента країни посадової особи. Нетиповою для спецслужб інших країн світу є роль і місце в структурі спецслужб США Генерального інспектора, який призначається на посаду Президентом країни, підпорядковується і звітує лише йому, але перебуває в штаті Управління ДНР і здійснює незалежні розслідування, перевірки, інспекції та спеціальні огляди програм і заходів розвідувального співтовариства (РС), виконання яких організовує, очолює і контролює його керівник – Директор національної розвідки. Привертає увагу, незважаючи на постійні терористичні загрози та виклики безпеці США, принциповий підхід незалежних установ, організацій і громадськості до турботи щодо дотримання спецслужбами під час виконання фахових завдань як всередині держави, так і за кордоном прав і свобод людини.

This article analyses and generalizes the experience of organizing and exercising control and supervision over the activities of Special Services of the Federal Republic of Germany (Germany) under the conditions of challenges and threats to its national security, defence and interests in the late XX – early XXI century, a number of inherent features is identified. It is established that the control and supervision over the Special Services of Germany is organized and exercised by the institutions of Legislative, Executive and Judicial power, its representative bodies, independent institutions and public organizations determined by the legislation. A notable feature of this process is the joint control of the government and parliament over the observance of human rights and freedoms by Special Services when performing their professional tasks via a single Federal Commissioner defined by law. Another feature is the approach to allowing Special Services to choose the methods of obtaining intelligence data – through the balance of the criteria of "admissibility" (violation of human rights and freedoms) and "necessity" (obtaining information in a way that violates human rights and freedoms, and not others). The scope of rights and powers defined by the legislation of Germany to the Special Committee on Confidential Affairs of the Bundestag is not inherent to legislation of other countries. Having information on planned professional activities and tasks of special services, it forms their budget, evaluates its implementation and, if necessary, investigates misuse of accountable funds. In Germany, as in no other country, the right of the Judiciary to supervise the activities of Special Services is limited – only the consideration of civil claims for compensation for material damage caused by Special Services activities, and audits of their financial activities. ; Проаналізовано й узагальнено досвід організації і здійснення контролю та нагляду над діяльністю спеціальних служб Федеративної Республіки Німеччини (ФРН) в умовах викликів і загроз її національній безпеці, обороні та інтересам наприкінці ХХ – початку ХХІ століття, виявлено низку притаманних їм особливостей.Встановлено, що контроль та нагляд над спецслужбами ФРН організований і здійснюється визначеними законодавством інститутами законодавчої, виконавчої та судової влади, їх представницькими органами, незалежними установами і громадськими організаціями.Помітною особливістю цього процесу є спільний контроль уряду і парламенту над дотриманням спецслужбами прав і свобод людини під час виконання ними фахових завдань через визначеного законом єдиного Федерального уповноваженого.Наступною особливістю є підхід до надання дозволів спецслужбам на вибір способів добування розвідувальної інформації – через зваженість критеріїв «допустимості» (порушення прав і свобод людини) і «необхідності» (добування інформації саме способом з порушенням прав і свобод людини, а не іншим).Непритаманним законодавству інших країн світу є обсяг прав і повноважень, визначених законодавством ФРН Спеціальному комітету з конфіденційних питань Бундестагу, який, володіючи інформацією щодо планових фахових заходів та завдань спецслужб, формує їх бюджет, здійснює оцінку його виконання, а за потреби проводить розслідування щодо нецільового або неправомірного використання підзвітних коштів.У ФРН, як ні в якій іншій країні, обмежено право судової гілки влади на здійснення нагляду над діяльністю спецслужб – лише розгляд цивільних позовів щодо відшкодування матеріальних збитків, заподіяних діями спецслужб, та аудиторські перевірки їх фінансової діяльності.

Temporary occupation of the part of Ukrainian territory by the Russian Federation – the Autonomous Republic of Crimea and the city of Sevastopol, fomenting of armed conflict in certain districts of Donetsk and Luhansk regions and buildup of military power in immediate proximity to the Ukrainian border, the potential possibility of deploying tactical nuclear weapons in the territory of Crimea necessitated significant strengthen- ing of the force components of our state, including building up and strengthening the capabilities of national intelligence. There is a positive experience of the last mentioned. It is one of the most developed and peaceful countries in the world – Japan. Borrowing and implementation of its certain aspects by the heads of the corre- sponding departments and institutions of our state could have positive effects.After the victory in the Second World War, the United States dissolved the Imperial Army of Japan and its special services, including intelligence. Disarmed and occupied by the United States, Japan was forced to exist within the defined limits. This fact created incentives for the development and implementation of the doctrine of Yoshida, named after the then prime minister of the country Shigeru Yoshida. According to this document, Japan trusted its own security to USA, concentrating its efforts on the restoration and development of the national economy.After the end of the Cold War, Japan was in a difficult political and economic situation. As a result of economic reforms, China has evolved from a weak backward country into an aggressive and equally strong as leading world countries rival in the security and economy areas. Japan at this time somewhat lowered the pace of its own economic development. North Korea doubled its efforts to create and test nuclear-missile weapons.Due to the fact that the United States began to invest enormous resources in stabilizing security in the Middle East, they somewhat reduced its volume to Japan's security sector.There was an urgent need for early detection of threats and challenges to the military security of the state, mainly by their own forces now – national intelligence forces that were insufficient and unable to do so. The establishment of the national intelligence in Japan took place under complex contradiction: on the one hand – the urgent need to build up the structure and strengthen the professional intelligence capabilities to counter the growing challenges and threats to the state security; on the other – the intransigence of the coun- try's parliament and the public to amend the constitution of the country, where article 9 was determinant, and prohibited any increase in the country's military strength. The pragmatically-minded part of the parliament and government managed to gradually overcome it and create an effective national intelligence system. In this case, any clues and arguments were used.The main of them were the following:– emphasis on destructive and crushing consequences for the country of modern challenges and threats to its security, non-standard aspects of its manifestations and emergence;– use of any unfriendly action from the side of possible opponents of Japan (mainly North Korea, China, international terrorist organizations) to emphasize the need to strengthen and enhance the capabilities of national intelligence agencies;– use of Parliament's consent to strengthen the Self-Defense Forces of the country as a reason to build up and strengthen national intelligence agencies;– uncommon appeal for support to the leadership of the allied US.– In general, regarding mentioned above, the patriotically and pragmatically-minded part of the Japa- nese parliament and the government of the country have shown a great perseverance, rational systemacity and commitment in the pursuit of set goal. ; В статті проаналізовано досвід становлення національної розвідки в правовому полі держави (на прикладі Японії) в умовах викликів і загроз її безпеці та національним інтересам наприкінці ХХ, початку ХХІ століття.

Current military and political situation around Ukraine and immediately in it has considerably intensified the problem of providing its military security. Therefore, the decision of the national command authorities of our country to join the EU, to intensify cooperation with NATO and accession to it in the nearest future has become very significant. Much attention is given to reforming and adaptation of the special services and agencies to the NATO standards. However, the issue of intensifying control over their activity is missing. Considering experience of many countries, it poses a danger. Here, the experience of Canada as the country, which is one of the most successful and supportive to Ukraine, can be useful.Canada focuses much on providing and supporting national and regional security and interests in a current, very hard military and political situation. Trying to counter possible threats and challenges by preventive measures, this country has got a series of special services and agencies putting them together as the Intelligence Community. The Intelligence Community functions within the existing legal framework. First of all, it is based on the Laws on the Canadian National Defence, on the Information Security and an on Privacy and a number of others.At first, it became necessary to intensify control over the activity of national special services and agencies of Canada at the end of the 70s of the 20th century when they abused their power against Que- bec National Liberation Movement. Indignation and protests of the public considering their authorities excessive, led the parliament's taking adequate measures: to adopt several special laws and decrees, to form a number of committees, commissions and special bodies designed to control the activity of special services and agencies, their observation of national laws and human rights.Besides national control, the Canadian special services and agencies have their own (departmen- tal) codes of honour authorizing their officers to be wotrthy a given right to serve to the nativeland in the respective special departments and observe current national laws. The bright example of such a code is the Canadian Communications Security Establishment Ethics Charter.Thus, the Canadian special services and agencies (Intelligence Community) function within the legal framework under the control of respective supervising and overseeing agencies, institutions and commissioners which can be a model for our state. ; Проаналізовано досвід організації й здійснення контролю за діяльністю спеціальних органів та служб (розвідувального співтовариства) Канади в умовах викликів і загроз її національній безпеці і інтересам наприкінці ХХ, початку ХХІ століття.
