INSTANCES AS A GENERAL CONDITION OF APPEAL PROCEEDINGS IN THE CRIMINAL PROCEDURE OF RUSSIA ; ИНСТАНЦИОННОСТЬ КАК ОБЩЕЕ УСЛОВИЕ АПЕЛЛЯЦИОННОГО ПРОИЗВОДСТВА В УГОЛОВНОМ ПРОЦЕССЕ РОССИИ
The general condition for level arrangement is that for the appeal (Art. 389.3 CPC RF),cassation (Art. 401.3 CPC RF) and supervisory procedure for (Art. 412.3 CPC RF) judicialdecisions examination by legislator a strict sequence of complaints, recommendations of thecourts of different judicial instances is established. Persons having the right to make appeal,cassation and supervisory complaints or recommendations make complaints to a higher court in relation to the court which renders the decision appealed and only after resolutionof the complaint, recommendations on the merits in the lower court trial related participantshave the right to seek for judicial protection of violated interests and rights to a highercourt.The article considers the level arrangement as a general condition of the revision ofdecisions of courts of first instance, which are not yet in force. The author points out controversialprovision that lodging and review of decisions of lower courts can only be in ahigher court. We consider the difference between the concepts "link in the judicial system"and the "judicial instance".The authors stand for a point of view, according to which the consideration of complaintsabout the decisions of the courts of a certain level in the same court (but of anotherinstance), as well as the existence of a hierarchy of different instances in one link of thejudicial system does not violate the right to appeal to a higher court decisions trial, as enshrinedin Art. 50 of the Constitution of the Russian Federation. The authors consider discussionson single and panel hearing in the court of appeal analyzing different views of thescientists and experts and come to the conclusion that the order of single and panel hearingin the court of appeal is the most effective at present. ; Общее условие инстанционности заключается в том, что для апелляционного(ст. 389.3 УПК РФ), кассационного (ст. 401.3 УПК РФ) и надзорного порядка про-верки (ст. 412.3 УПК РФ) судебных решений законодателем установлена строгаяочередность рассмотрения жалобы, представления судами различных судебныхинстанций. Лица, имеющие право принесения апелляционных, кассационных, над-зорных жалоб или представлений, приносят жалобы в вышестоящий суд по отно-шению к суду, вынесшему обжалуемое решение и только после разрешения жало-бы, представления по существу в суде нижестоящей инстанции заинтересованныесубъекты вправе обратиться за судебной защитой нарушенных интересов и прав ввышестоящую судебную инстанцию.В статье рассматривается инстанционность как общее условие пересмотра невступивших в законную силу решений судов первой инстанции в апелляционномпорядке. Указываются на спорность положения о том, что обжалование и рассмот-рение решений нижестоящих звеньев судебной системы необходимо и возможнотолько в вышестоящем суде. Рассматривается различие понятий «звено судебнойсистемы» и «судебная инстанция». Отстаивается точка зрения, в соответствии скоторой рассмотрение жалоб на решения судов определенного звена в том же са-мом суде, но только в другой инстанции, а также существование различных по ие-рархии инстанций в одном звене судебной системы не нарушает право на обжало-вание судебных решений в вышестоящий суд, закрепленное в ст. 50 КонституцииРФ. Авторы рассматривают дискуссию единоличного и коллегиального рассмотре-ния дел в апелляционной инстанции, подробно анализируя различные мнения уче-ных и практиков по этому вопросу и приходят к выводу, что порядок единоличногои коллегиального рассмотрения дел в апелляционной инстанции, действующий внастоящее время наиболее оптимален.
