The concept of regulatory administrative and legal guarantees of legality of activities to ensure the economic interests of Ukraine ; Поняття регулятивних адміністративно-правових гарантій законності діяльності щодо забезпечення економічних інтересів України
The article is devoted to the definition of the concept of regulatory administrative and legal guarantees of legality of activities to ensure the economic interests of Ukraine, the definition on this basis of areas for improvement of administrative legislation and the science of administrative law. It is pointed out that the development of a single theoretical basis for regulatory administrative and legal guarantees of activities to ensure the economic interests of Ukraine is insufficient. Given the ephemerality of economic processes, it is argued that it is necessary to build a flexible system of administrative and legal support of these interests, the necessary basis for which is determined by the formulation of the definition of the guarantees. It is substantiated that the concept of regulatory administrative and legal guarantees of the legality of activities to ensure the economic interests in general and the interests of Ukraine in particular, has not received due attention in the pages of scientific literature. Relevant directions of scientific researches are determined, in particular – concerning: essence of administrative-legal guarantees in separate spheres of administrative legal relations; ensuring certain areas of economic interests of the state; ensuring legality in the implementation of public administration, as well as – administrative and legal relations in general. The definition of the category of regulatory administrative and legal guarantees of legality of activities to ensure the economic interests of Ukraine is defined as a system of administrative legal measures and measures aimed at maintaining and ensuring the rule of law in the activities of economic interests of Ukraine. It is proved that such a regime is a systemic guarantee of human rights and freedoms, as it provides the ability of the state to guarantee the implementation of these rights. It is substantiated that the formulated definition makes it possible to detail the provisions on the outlined guarantees, in particular to carry out their systematization, which is a promising area for further study. ; Стаття присвячена визначенню поняття регулятивних адміністративно-правових гарантій законності діяльності щодо забезпечення економічних інтересів України, визначенню на цій основі напрямів вдосконалення адміністративного законодавства та науки адміністративного права. Вказано на недостатність опрацювання єдиної теоретичної основи регулятивних адміністративно-правових гарантій діяльності щодо забезпечення економічних інтересів України. З огляду на швидкоплинність економічних процесів стверджується про необхідність побудови гнучкої системи адміністративно-правового забезпечення вказаних інтересів, необхідною основою чого визначено саме формулювання дефініції розглядуваних гарантій. Обґрунтовується, що поняття регулятивних адміністративно-правових гарантій законності діяльності щодо забезпечення економічних інтересів загалом та вказаних інтересів України зокрема не отримало належної уваги на сторінках наукової літератури. Визначено дотичні напрями наукових досліджень, зокрема щодо: сутності адміністративно-правових гарантій в окремих сферах адміністративних правовідносин; забезпечення окремих сфер економічних інтересів держави; забезпечення законності у здійсненні публічного адміністрування, а також адміністративно-правових відносинах загалом. Визначено дефініцію категорії «регулятивні адміністративно-правові гарантії законності діяльності щодо забезпечення економічних інтересів України» як систему передбачених регулятивними нормами адміністративного права адміністративно-правових засобів та заходів, спрямованих на підтримання та забезпечення режиму законності у діяльності суб'єктів забезпечення економічних інтересів України. Доведено, що такий режим постає системною гарантією забезпечення прав і свобод людини, оскільки передбачає спроможність держави щодо гарантування реалізації вказаних прав. Обґрунтовано, що сформульована дефініція дає змогу деталізувати положення щодо окреслених гарантій, зокрема здійснити їх систематизацію, що є перспективним напрямом подальшого дослідження.
