The research of theoretical and legal approaches to the concept and conditions of the settlement agreement, the historical-legal and comparative-legal analysis of the settlement agreement is implemented. The systematization of the civil procedure legislation regulating the content and the order of conclusion, approval, execution and appeal of the terms of the amicable agreement is carried out. Based on the analysis of case law, proposals for improving the settlement agreement are proffered. ; У роботі здійснено дослідження теоретико-правових підходів до поняття та умов мирової угоди, проведено історико-правовий та порівняльно-правовий аналіз мирової угоди. Проведено систематизацію цивільно-процесуального законодавство, що регулює зміст та порядок укладання, затвердження, виконання та оскарження умов мирової угоди. На основі аналізу судової практики запропоновано пропозиції щодо удосконалення мирової угоди.

The article is devoted to the study of the provisions of legislation, case law and doctrine on the legal nature of the settlement agreement in the civil process of Ukraine. Based on the analysis of the norms of the Civil Procedure Code of Ukraine, the key features of the amicable agreement have been identified. Three main approaches that have been established among scholars to understand the legal nature of the settlement agreement, such as: substantive, procedural and mixed. It is established that the mixed position is the most correct as it combines the main advantages of two previous points of view and at the same time allows to eliminate their lacks. ; Стаття присвячена дослідженню положень законодавства, судової практики та доктрини щодо правової природи мирової угоди у цивільному процесі України. На основі аналізу норм Цивільно-процесуального кодексу України виокремлено ключові ознаки мирової угоди. Досліджено три основні підходи, що встановились серед науковців, щодо розуміння правової природи мирової угоди, такі як: матеріально-правова, процесуальна та змішана. Встановлено, що змішана позиція є найбільш правильною, оскільки вона поєднує в собі основні переваги двох попередніх точок зору і в той же час дозволяє усунути їх недоліки.
