В статье на основе изучения нормативных документов и исторической литерату-ры рассмотрено положение женщины в монгольском советском обществе. Автор пришла к выводу, что ряд принятых государством мер в социальной и образовательной сферах благоприятно отразились на положении монгольской женщины. Проведена огромная работа по ликвидации безграмотности среди женского населения страны. Повышение уровня образования способствовало активному участию женщин в трудовой деятельности. Монгольские женщины добились значительных успехов в общественном производстве, некоторые из них стали ударниками труда. В социалистическом монгольском обществе женщина стала экономически активным, полноправным участником общественных отношений, принимала участие в государственно-управленческой деятельности. Экономическая независимость позволила женщине обрести большую свободу и в семейных отношениях. ; On the basis of the study of legislative documents and historical literature, the articleinvestigates the situation of women in the Mongolian Soviet society. The author concluded that a number of actions undertaken by the State in the social, educational spheres had a positive effect on the position of Mongolian women. Huge work to eliminate illiteracy among the female population was done. The increase of the education level contributed to the participation of women in the professional labor activity. Mongolian women made significant gains in social production. In the Mongolian socialist society, women became economically active, full members of social relations, participating in public management. Economic independence allowed women to gain greater freedom in the family.
На основе изучения Конституции и законодательных актов МНР рассматривается правовое положение женщины. Автор отмечает, что государство обеспечивало женщинам социальную защиту и старалось создать условия для большего вовлечения женщин в общественную жизнь. Особое внимание уделялось правам и интересам беременных женщин и матерей в социалистической Монголии. Законодательством МНР закреплялось их право на пособия, определенные льготы и гарантировалось сохранение рабочего места на период беременности и рождения ребенка. Семейный кодекс МНР предоставлял женщинам равные права в семейной жизни, защищал их имущественные интересы. ; By the beginning of the 60s of the 20th century as a result of the accelerated development of the productive forces MPR has evolved from an agrarian to an industrial-agrarian country. By 1960, the MPR was completed in cooperation of individual arat households, established a unified socialist economic system. Significant advances have been made in the sphere of education, culture and health. July 6, 1960 the new Constitution of the MPR was approved. According to the Constitution, a woman was given equal rights with men in all spheres of economic, state, cultural, social and political life. Obstruction of any form of equality for women was forbidden by law. In the future, in accordance with the principles enshrined in the Constitution, was published in the MPR series of fundamental laws. Labour laws provide women with men equal rights to work and to pay for it. Any discrimination against women was forbidden. Also banned women's work in jobs with difficult and dangerous conditions. For pregnant women could be shortened working day or they could be transferred to lighter work. Forbidden to their dismissal, and they were not allowed to work overtime and night. For breastfeeding mothers, provided additional breaks for breastfeeding. Pregnant women and mothers are paid an allowance during maternity leave, as well as childbirth allowance for care and feeding. Special attention was paid to the socialist Mongolia maternal and child health, this area was under the protection of the state. In the country the network of women's and children's consultation centers, maternity homes, sanatoriums and rest homes, improve their conditions of work and life, as well as carry out other measures. Family Code establishes the basic principles of the matrimonial system and relations between the members of the family: monogamy, voluntary marriage, the equality of men and women; secured obligation of parents to raise and support their children, the age of marriage for men and women has been set at 18. Thus, according to Mongolian law, the woman was a full-fledged member of society who has the right to self-realization in all kinds of human activity. The woman has got equal rights with men to work and pay for it. And this is largely determined by the nature of family relationships. The family begins to build the type of egalitarian family where the husband and wife have separate earnings; the woman was no longer economically dependent on her husband. In general, the Mongolian legislation against women has been designed to ensure their social protection from the state, creating a comfortable environment for mothers and pregnant women. Ensuring equality and support for a woman, the state created the necessary conditions for the development of women as individuals and active participant in the socio economic activities.
В статье на основе изучения законодательных актов рассмотрены некоторые аспекты правового положения монгольских женщин на современном этапе. В условиях демократических преобразований, перехода к рыночной экономике монгольские женщины получили дополнительные возможности в самореализации. В то же время они стали наиболее уязвимой частью населения. Принятие нового Закона о труде в 1999 году было призвано защитить права женщин в новых рыночных условиях. Во время переходного периода появились новые для монгольского общества проблемы: насилие в семье, торговля людьми. Для решения этих вопросов при активном участии неправительственных женских организаций был принят ряд законов и внесены поправки в действующее законодательство. Важно отметить, что законодательство страны преобразовывалось в соответствии с положениями международных соглашений, к которым присоединилась Монголия ; The article based on the study of legislative acts considers some aspects of the legal status of Mongolian women at this stage. In the conditions of democratic reforms and transition to the market economy, Mongolian women have had additional opportunities for selfrealization. On the other hand, they have become the most vulnerable part of the population.The adoption of the new Labour Law in 1999 was intended to protect the rights of women in the new market conditions. During the transition period, there were new problems for the Mongolian society: domestic violence and human trafficking. To resolve these issues, a number of laws have been adopted and existing legislation has been amended with the active participation of nongovernmental women's organizations.It is important to note that the legislation of the country was transformed according to the provisions of the international agreements ratified by Mongolia.
В статье на основе изучения нормативных документов и исторической литературы рассмотрены изменения правового положения женщины, закреплённого в Конституциях Монголии 1924, 1940, 1960 и 1992 гг. Автор пришла к выводу, что права и возможности женщин на конституционном уровне в настоящее время значительно расширились. В социалистическом монгольском обществе государство активно обеспечивало социальную поддержку и защиту женщин, что и было закреплено в Конституциях 1940, 1960 гг. В современном монгольском обществе женщина стала экономически активным, полноправным участником общественных отношений, принимает участие в государственно-управленческой деятельности. Вместе с тем автор отмечает, что женщина часто сталкивается с дискриминацией. ; On the basis of the study of legislative documents and historical literature the paper investigates the legal status of women as fixed in the 1924, 1940, 1960 and 1992 constitutions of Mongolia. The author concluded that women's rights and opportunities at the constitutional level are now greatly enhanced. In the socialist society the Mongolian government actively provided social support and protection for women, which was proclaimed in the Constitutions of 1940, 1960. In modern Mongolian society women became economically active, enjoying full rights of the society members, participating in the state administration system. However, the author notes that a woman often deals with discrimination.
