The article is focused on research of the phenomenon of torture in the XXI century. In the article, the author presents a thesis that explains not only the resumption of torture as a phenomenon in the second half of the XX century but also spreading of the phenomenon of torture in the XXI century with corresponding dispersal of social control networks and, consequently, increasing of types and kinds of deviants. Thus, on the one hand, national criminal justice systems cannot cope with this task – to deal with deviants only within the formal procedures enshrined in national law against the background of increasing classes, types, types and, consequently, the number of deviants. On the other hand, we have the data of numerous studies and surveys of the population of Europe and North America, where from 1/3 to 1/2 of citizens allow the use of torture against terrorists for the purpose of the same "security". The article concludes that the policy of preventing torture and combating social practices of torture in the XXI century is a reflection of a complex political dualistic process: an attempt to develop more "secure society" with corresponding failure to "secure" it. The article analyzes the models that explain the political preconditions for the use of torture in the second half of the XX – early XXI century for the purposes of "protection of society". Thus, scientists distinguish three models: 1) "security model"; 2) "stability model"; 3) "legitimation model". The article emphasizes that in the society of the XXI century torture exists within two interrelated political spheres, where the first of the spheres is a formalized policy of combating torture, which is shaped and implemented within universal regional and national structures. The second one is informal torture policy, which is shaped within the framework of post-modern modulation of panoptic risk management, where torture is an instrument of modern social control. ; Стаття присвячена дослідженню феномену тортур у ХХІ столітті. У статті автор презентує тезу, що пояснює не лише відновлення тортур як феномену у другій половині ХХ століття, проте й на додаток – поширення цього феномену тортур у ХХІ столітті, де особливого значення набувають питання щодо «розкидування» мереж соціального контролю та, як наслідок, збільшення класів, типів та видів девіантів. Так, з одного боку, національні системи кримінальної юстиції не можуть впоратися з таким завданням – поводитися з девіантами виключно у рамках формальних процедур, закріплених у національному законодавстві на фоні збільшення класів, типів, видів та, як наслідок, кількості девіантів. З іншого боку, дані численних досліджень та опитувань населення країн Європи та Північної Америки, де від 1/3 до 1/2 громадян допускають застосування тортур до терористів з метою того самого «убезпечення». У статті робиться висновок, що політика запобігання катуванням та боротьби з соціальними практиками катування у ХХІ столітті – це відображення складного політичного дуалістичного процесу: спроба ще більшого «убезпечення суспільства» з одночасним фіаско такого «убезпечення». У статті проаналізовано моделі, які пояснюють політичні передумови застосування тортур у другій половині ХХ – початку ХХІ столітті для цілей «захисту суспільства». Так, вченими виділяються три моделі: 1) «security model»; 2) «stability model»; 3) «legitimacy model». У статті наголошується, що в суспільстві ХХІ століття тортури існують у рамках двох взаємопов'язаних політичних сфер, де однією зі сфер виступає формалізована суб'єктна політика протидії тортурам, що формується та реалізується у рамках універсальних регіональних та національних структур, а другою сферою виступає безсуб'єктна політика тортур, яка формується у рамках постсучасної модуляції паноптичного менеджменту ризиків, де тортури є інструментом сучасної політики соціального контролю.

While criticizing the institutional and formal-instrumental approaches to the identification of the problem of torture and inhuman treatment in the XXI century and the solution of this problem, it is noted that these approaches are insufficient in their autonomous meaning. The dominance of institutional and instrumental approaches in the formation and implementation of policies of prevention of torture and the acquisition of monopoly characteristics by these approaches poses a problem in advance at the beginning of the strategy. Torture is primarily a political issue, and addressing it requires an analysis of the practice of torture as an impersonal policy with relevant statistical indicators that are now almost non-existent at both the international and national levels. ; Стаття присвячена дослідженню феномену тортур у ХХІ столітті. Домінування інституційного та інструментального підходів при формуванні та реалізації політики запобігання катуванням та набуття цими підходами монопольних ознак заздалегідь закладає проблему вже на початку відповідної стратегії. Катування – це проблема насамперед політична, і вирішення цієї проблеми потребує аналізу практики катувань як безсуб'єктної політики з відповідними статистичними методами та показниками, які сьогодні майже відсутні як на міжнародному, так і на національних рівнях.

The main idea of this paper refers to the resumption of torture as a phenomenon in ХХ century and also the spread of this undoubtedly disgusting phenomenon in the new Millennium. It is it linked to the category of «security», which has become a pagan cult of modern society. We believe that the views of Michel Foucault and Stanley Cohen on «net widening» can explain expansion of the phenomenon of torture in the XXI century through increased variations of classes and types ofdeviants for the aims of «security». On the one hand, national criminal justice systems cannot cope with dealing with numerous deviants within the framework of formal national legal procedures. On the other hand, citizens born at the time of III and, more importantly, IV modulation of social control demand more «security», so the ways and methods of achieving the appropriate level of security do not longer matter. This is confirmed by numerous sociological studies and surveys in Europe and North America showing that one third to one half of citizens allow the use of torture against terrorists forthesake of «security». All this happens in a context of total social control over space and thoughts. However, the main danger is that the practical possibility of torturing «terrorists» opens a «Pandora's box» to a wide prospect of torture against other «dangerous criminals» – sex offenders, members oforganized crime groups, etc. And this list tends to be expanded. It can be concluded that the «fight against torture» in XXI century is a reflection of a dualistic process: anattempt to develop «secure society» with a simultaneous fiasco of the nature of such «security». The use of torture on suspects is unfortunately happens even in Western democracies, but the extensive system of legal safeguards established in the second half of XX century has helped to make the use oftorture and inhuman treatment as rare as possible. It becomes possible due to activities of the Council of Europe, the CPT and the ECtHR (including through the expansion of the concepts of «torture» and«inhuman treatment»). It is worth emphasizing that torture is not a legal category, but primarily a political and economic one. Analysis of the phenomenon of torture within the formal framework of national criminal justice systems only is dangerous given also the highly questionable effectiveness and efficiency of torture. Recalling E. Durkheim and R. Merton on indicators of deviance and crime, which indicate the state ofanomie in society of the XXI century, it should be emphasized that the state of anomie largely depends on the saturation of the political body of modern society with the phenomenon of torture. In case of other types of crimes, the state tries to reduce the appropriate level of crime to a certain normal rate, influencing relevant individuals. However, in case of torture, we must point out that torture itself is one ofthe most dangerous forms of crime, committed mostly by agents of a state, on behalf of a state, using the powers granted by a state to achieve what they claim is in the public interest. That is why the fight against torture is often when, unfortunately, «the snake bites itself on the tail». And this is quite important problem for future researches. Therefore, the fight against torture should not be narrowly linked to policemen, prosecutors, judges orpunishments. The fight against torture is not also linked to crime detection rates. This should be considered, first of all, in a context of anti-discrimination, human rights, protection of social diversity andthe rights of relevant social groups, migration and social policy, transparency of public administration and accountability of law enforcement agencies, fair redistribution of income in society, state support forvictims of violent crimes. Today it is a common view that «torture is committed in an atmosphere of secrecy and does not like light». Therefore, prevention of torture starts with the policy of maximum openness of law enforcement agencies and complete, comprehensive, constantly updated state statistics on torture (unfortunately, it is almost non-existent in Ukraine). It is no coincidence that the European Parliament's resolution on torture by the CIA in Europe placed special emphasis on accountability: «Accountability for extraordinary renditions, abductions, illegal secret detentions and torture is essential in order to protect and promote human rights effectively, and to ensure legitimate and effective security policies based on the rule of law». In addition, zero tolerance for torture culture and careful selection of law enforcement officers should be paramount, where moral categories need to be an important part of professional compliance. Moreover, «moral» must be supported by message that torture does not work for the purpose of investigating crimes and also has great negative psychological effect, both for victims of torture and for state agents who open this «Pandora's box». Numerous studies show that only moral arguments are effective in motivating people to resist torture. An important question must be put: can torture be considered necessary to perform any of the tasks facing modern states to protect societies? Given the moral and ethical issues, we can express a strong negative answer. Given the more pragmatic arguments put forward by proponents of so called «enhanced interrogation techniques», it should be emphasized that even the alleged pragmatism is broken down into facts that indicate that information obtained under torture is often not, in fact, reliable information, and the price of such information will be too high both for the perpetrators themselves and for the taxpayers who internally support torture. ; Стаття присвячена дослідженню феномену тортур у ХХІ столітті. Головна теза, яка пояснює не лише відновлення тортур як феномену у ХХ столітті, проте й на додаток поширення цього феномену уновому тисячолітті, пов'язана з категорією «убезпечення». Так, для цілей пояснення феномену тортур у ХХІ столітті особливого значення набуває концепція розкидування мереж соціального контролю та, як наслідок, збільшення класів, типів та видів девіантів, яких потрібно контролювати для цілей «убезпечення». Можна зробити висновок, що «боротьба з катуванням» уХХІ столітті – це відображення дуалістичного процесу: спроба ще більшого «убезпечення суспільства» з одночасним фіаско такого «убезпечення». Застосування тортур до підозрюваних, нажаль, є поширеною практикою навіть у західних демократіях, але розгалужена система правових гарантій, створена у другій половині ХХ століття, допомогла зробити застосування катувань та нелюдського поводження максимально рідким явищем, наскільки це можливо, у чому на регіональному рівні це – велика заслуга Ради Європи, КЗК та ЄСПЛ.

The article is focused on the problem of the essence, forms, methods and limits of social control in the Postmodern society. The article contains an analysis of the views of the most famous scientists who laid the foundations of modern understanding of social control, and the author's proposals for the application of such views in the XXI century society. The main thesis of this study is that modern social control is more insightful, subtle and comprehensive (primarily due to its greater manufacturability). Therefore, there is a real danger of losing freedom in the Postmodern society. The article emphasizes the importance for the political science of the XXI century of the works of the French philosopher Michel Foucault and the American sociologist Stanley Cohen on the essence of social control on the example of the concept of punitive city, which serves as a model of modern society of technological social control. The article contains an analysis of transformation of different models of social control with the corresponding characteristics of each model. The article analyzes the application of the categories introduced by Michel Foucault in the XXI century ("rank", "exam", "discipline") and focuses on the relevance of such categories. The article provides practical examples of "encroachment on liberty" (such as mass surveillance cameras and information databases) and the dissemination of more insightful social control in the field of criminal justice. Attention is paid to examples of the application of the concept of Net Widening in national criminal justice systems. Attention is also paid to the "crisis of the rehabilitation ideal", which occurred after the publication in 1971 of the work of the American sociologist Robert Martinson. The article concludes that freedom is a kind of power. Power is seen not as a negative category associated with coercion, but as a positive category associated with the unlimited realization of the human's will in the society, without harm to themselves and others. Therefore, from this point of view, the classical formal approach to social control as a natural consensus, which emerged from nowhere and from nowhere, should be taken critically. Modern society is a society of subtle and transparent, but at the same time rigid power, which does not tolerate the power of truly free people. The main conclusion of this study will be the aggravation of the issue of voluntary renunciation of freedom in favor of "security", or, better said, the combination of "security" with "comfort" in accordance with the requirements of a globalized consumer society. ; Стаття присвячена проблемі сутності, форм, методів та меж соціального контролю у суспільстві Постмодерну. Стаття містить аналіз поглядів найбільш відомих вчених, які заклали підвалини сучасного розуміння соціального контролю, та авторські пропозиції щодо застосування таких поглядів у суспільстві ХХІ століття. Головню тезою цього дослідження є те, що сучасний соціальний контроль є більш проникливим, тонким та всеосяжним (передусім в силу своєї більшої технологічності), а відтак існує реальна небезпека втрати свободи у суспільстві Постмодерну. У статті робиться наголос на важливості для політичної науки ХХІ століття праць французького філософа Мішеля Фуко та американського соціолога Стенлі Коена щодо сутності соціального контролю на прикладі концепції карального (пунітивного) міста, яке служить моделлю сучасного суспільства технологічного соціального контролю. У статті міститься аналіз трансформації моделей соціального контролю з відповідними характеристиками кожної моделі. Стаття аналізує питання застосування у ХХІ столітті категорій, запроваджених Мішелем Фуко («ранг», «іспит», «дисципліна») і фокусує увагу на актуальності таких категорій. У статті надаються практичні приклади «посягання на свободу» (як-то камери відеоспостереження, інформаційні бази даних, розширення типології та класифікації девіантів) та поширення більш проникливого соціального контролю у сфері кримінальної юстиції. Окрема увага приділена прикладам застосування концепції net widening у національних системах кримінальної юстиції. Окрема увага приділяється «кризі реабілітаційного ідеалу», що настала після публікації у 1971 році праці американського соціолога Роберта Мартінсона. Стаття містить висновок, що свобода – це влада. Влада не як негативна категорія, пов'язана з примусом, а як категорія позитивна, пов'язана з необмеженою реалізацією своєї волі у суспільстві таких же вільних людей, без шкоди для себе та оточуючих. Тому з цієї позиції класичний формальний підхід до соціального контролю як до природнього консенсусу, який з'явився невідомо як і невідомо звідки, має сприйматися критично. Сучасне суспільство – це суспільство тонкої, прозорої, проте водночас жорсткої влади, яка не толерує владу дійсно вільних людей. Головним висновком цього дослідження буде саме загострення проблематики добровільної відмови від свободи на користь «безпеки», або, краще сказати, поєднання «безпеки» з «комфортом» відповідно до вимог споживацького глобалізованого суспільства.

The article is focused on the problem of the essence, forms, methods and limits of social control in the Postmodern society. The article contains an analysis of the views of the most famous scientists who laid the foundations of modern understanding of social control, and the author's proposals for the application of such views in the XXI century society. The main thesis of this study is that modern social control is more insightful, subtle and comprehensive (primarily due to its greater manufacturability). Therefore, there is a real danger of losing freedom in the Postmodern society.
