The article reveals the institutional and organizational dimensions of the legitimacy of public power.In the context of the Weberian tradition of understanding the legitimacy of order, it is determined that ensuring the legitimacy of individual political actors – individuals and organizations – is impossible without the legitimacy of the conventional and legal order. It is noted that not only the distinction between institutions and organizations, but also the refusal to reduce the whole organizational diversity of the "state" to a single actor is of utmost importance for ensuring the legitimacy of public power.It is emphasized that democratic rules of the political game should not just be declared by individual political players, but be recognized by the majority of citizens as at the level of convictions, and be implemented at the levels of daily life and political activity. This means that the social convention on the implementation of democratic institutions should become legitimate for all social activities and social relations. Using the Weberian category of "octroying", another legitimate way of establishing a new order for the post-authoritarian regimes is demonstrated. It is noted that artificially established institutions (the rules of the game that operate in the societies of consolidated democracy) are often not effective in the post-Soviet space and do not always contribute to the legitimacy of power. At the same time, the "constitutionalization" of the political process, even if it takes place through a vote in the parliament or is passed in a referendum, does not ensure the automatic establishment of democracy and legitimacy of public power.Based on the distinction of institutions and organizations (D. North), there are shortcomings in both electoral democracy and the octroying of the legal order in terms of the theory of legitimacy. It is determined that one of the main tasks for post-Soviet societies is to establish the legitimacy of the democratic order, without which the transition from the electoral democracy to the consolidated one cannot be completed.The necessity of simultaneous institutional and organizational political transformations to ensure the legitimacy of the social order and public power under conditions of democratization in Ukraine is substantiated. ; У статті досліджуються інституційний та організаційний виміри легітимності публічної влади.У контексті веберіанської традиції розуміння легітимності порядку визначено, що забезпечення легітимності окремих політичних акторів – індивідів та організацій – неможливе без легітимності конвенціонального та правового порядку. Зазначено, що для забезпечення легітимності публічної влади вкрай важливим стає не тільки розрізнення інститутів та організацій, а й відмова від зведення усього організаційного різноманіття «держави» до єдиного актора.Акцентовано, що демократичні правила політичної гри мають не просто декларуватись окремими політичними гравцями, а й бути визнані більшістю громадян як на рівні переконань, так і реалізовуватись на рівнях повсякденного життя та політичної активності. Це означає, що суспільна кон- венція щодо впровадження демократичних інститутів має стати легітимною для усіх соціальних дій та соціальних відношень. При цьому «конституціоналізація» політичного процесу, навіть якщо вона відбувається шляхом голосування у парламенті або приймається на референдумі, не забезпечує встановлення автоматичної демократії та легітимності публічної влади.Виходячи із розмежування інститутів та організацій (Д. Норт), відзначено недоліки як електоральної демократії, так і октроїрування правового порядку з погляду теорії легітимності. Визначено, що одним із головних завдань для пострадянських суспільств виступає встановлення легітимності демократичного порядку, без забезпечення якого неможливе завершення переходу від електоральної до консолідованої демократії.Обґрунтовано необхідність одночасних інституційних та організаційних політичних трансформацій для забезпечення легітимності соціального порядку та публічної влади в умовах демократизації в Україні.

The phenomenon of power not only plays a key role in politics, but it is also central to the entire complex of social relations.The problem of power is an inexhaustible topic for scientific research, philosophical reflection, literary reading and artistic interpretations. For this reason, any research of power needs preliminary explanations regarding its subject and the introduction of distinctions to narrow the problematic field. The first distinction in this research is the opposition of power and violence, which allows focusing on one of the traditions in interpretations of the legitimacy of public power. The second distinction in the understanding of power is between approaches of atomism (individualism) and holism (collectivism). This is the distinction between intelligent and selfish individuals who pursue private interests and individuals (also intelligent, but not extremely selfish), who are aimed at achieving the common good. It is noted that the legitimacy of power cannot be justified by the potential threat of the use of violence; therefore the only source of it is the support of citizens. Only public power can be legitimate. The third distinction is the subject of this research: the analysis of the features of liberal, republican and discursive traditions in the treatment of publicity, public sphere (space), legitimacy of public power, etc. The research of publicity or public sphere was initiated in the liberal tradition. The representatives of the liberal tradition stressed the need for openness, rationality, and criticism in relations between power and citizens. The representatives of the republican tradition continued the research of public sphere and public power in terms of inclusiveness (inclusion) in the ruling process of the majority of citizens, their equality to choose and be elected. They reminded that democracy is, first and foremost, a «shared cause» for all citizens. Public sphere is characterized by the versatility and the competitiveness of citizens who possess civil (republican) virtues.In the works of the German researcher J. Habermas, who argues with the liberals and the republicans, the normative ideal of publicity (or «public sphere» in the English translation of the Habermas's term «Offentlichkeit») is presented in terms of the discursive approach.Thus, the prerequisite for the legitimacy of public power is democratic elections, the result of which gives winners the right to power; the legitimacy of public power is substantiated in the moral and political discourse; the process of ensuring the legitimacy of public power requires communication based on rational arguments between power and citizens.To sum up, the legitimacy of public power is created and reproduced as a result of rational interaction in the public sphere between power and citizens. This allows overcoming both the selfishness of individuals and the compulsion of the state. ; У статті досліджується проблема легітимності публічної влади. Визначено особливості розуміння феномена публічності, публічного простору у ліберальній, республіканській та дискурсивній традиціях. Увагу зосереджено на підходах Ф. Гаєка, Дж. Ролза (ліберальна традиція), Г. Арендт (республіканська традиція), Ю. Габермаса (дискурсивна традиція). Відзначено специфіку обґрунтування легітимності публічної влади у кожній із цих традицій.

The article is devoted to the study of the legitimacy of power and control over violence in a transitional society. It is noted that the problem of violence in a transitional society has a special political weight and, therefore, a scientific relevance. The solution to this problem is directly related to the ability of the political class to ensure the legitimacy of power. In classical concepts of legitimacy, it is stated that only the state has a monopoly on violence. However, in transitional societies, individual groups and political organizations can also resort to violence to preserve power and property. According to the noninstitutional theory, this situation is a hallmark of limited access orders. ; Статтю присвячено дослідженню легітимності влади та контролю над насильством у перехідному суспільстві. Зазначено, що в умовах перехідного суспільства особливої політичної ваги, а відтак і наукової актуальності набуває проблема насильства. Її вирішення пов'язується зі здатністю класу забезпечити легітимність влади. У класичних концепціях легітимності наголошується, що лише держава має монополію на насильство. Проте у перехідному суспільстві до насильства можуть вдаватись і окремі групи та політичні організації з метою збереження влади та власності. Відповідно до неоінституційної теорії така ситуація є характерною ознакою суспільства обмеженого доступу.

The article is devoted to the study of the factors of the legitimacy of power in the Ancient World. Legitimacy is "the Sword of Damocles" of the era of antiquity; the doubts of citizens about the legitimacy of power is a direct way to its loss. That is why the rationale for the authority of power and the right to power become one of the central one for ancient philosophy and politics.The factors of the legitimacy of the power of the monarchy (religion, traditional domination), aristocracy (noble origin, military victories), tyranny (charismatic legitimacy of personal power), demos (collective legitimacy, rationalism) are singled out. "Ostracism" as an obvious result of the process of delegitimization of power is interpreted. The peculiarities of Pericles' reforms, which are based on rational organization of power, introduction of payment for work for the sake of public benefit ("mystophoria"), democracy, are noted.In the era of antiquity, firstly, in the political world history the need for power to be recognized, supported and legitimated was clearly articulated. Economic well-being, political stability and security of policies depended on the level of legitimacy of power. In the era of antiquity, the "Sword of Damocles" of needs for recognition and support hung over power, from this time onwards – forever. However, the authorities can choose what will be the basis of legitimate governance, what factors will determine the fate of power.The era of the early Archaic in Athens was characterized by the decisive influence of the aristocracy, whose power was based on wealth and economic strength. In addition, an important source of legitimacy of the aristocracy was religion.The citizens of the Athenian Police not only realized that they were the source of power, but also sought a foundation of power that would ensure its legitimacy. The abandonment of violence was the main aspect in this search for legitimacy.Solon, using his own authority, received extraordinary powers, i.e., he legitimized his own power both among the aristocracy and for the demos. One of the most important lessons of Solon's reforms for the legitimacy of the era of antiquity is that the authority of a centrist, who, as an archon, carried out reforms, lasted only for a year. The innovations, introduced by Solon, remained valid in Athens over the next dec- ades; instead, the problem of the legitimacy of the aristocracy's power was not solved.The archaic stage was characterized by the rule of the kings (basileans), whose legitimacy relied on royal origin and found its basis in traditional domination, religion, military valour and victories in the Panhelenic games. A very important, even decisive component of legitimacy was the identity of the Greeks as free citizens as opposed to the Persians who worshiped the king as God and their "hospitality", which became the foundation of cosmopolitan legitimacy.The classic stage of the development of the Athenian policy is the domination of the aristocracy, which from time to time gave power to tyrants. The governance of the latter represented a reliance on the charismatic type of legitimacy. They relied on their own authority, and their descendants could not сlaim to power. The tyrants, as charismatic leaders, introduced reforms, and most importantly, they actively fought against the aristocracy (the descendents of which, in fact, they were), considered the aristocracy as rivals in the struggle for power, and thus prepared the ground for strengthening the power of the demos.The democratic stage, which began with the reforms of Kimon and reached its peak during the reign of the "first citizen" Pericles, can be called a period of domination of a rational-legal type of legitimacy. After all, Pericles himself was a "great rationalist"; his power was based neither on tribal relations, nor on religion and tradition.This list is not exhaustive, but it allows us to see that in the era of ancient Greece, the boundary principles and fundamental ideas about the phenomenon of the legitimacy of power were formed. Its role in the political life of the policy was determined. All the risks, disadvantages and dangers of each type of legitimacy also appeared in the policy. In the end, the Athenians themselves developed and implemented the extreme form of delegitimization of the political leader – ostracism. ; Статтю присвячено дослідженню чинників легітимності влади у Стародавньому світі. Легітимність – це «Дамоклів меч» влади епохи Античності. Сумніви громадян щодо легітимності влади спричиняють її втрату. Обґрунтування авторитету влади, права на владу та чинників її визнання стає однією з центральних проблем для античної філософії та політики. Виокремлено чинники легітимності влади монархії (релігія, традиційне панування), аристократії (знатне походження, військові перемоги), тиранії (харизматична легітимність особистісної влади), демосу (колективна легітимність, раціоналізм). Інтерпретовано «остракізм» як наочний результат процесу делегітимації влади. Відзначено особливості реформ Перикла, в основі яких раціональна організація влади, введення оплати за працю задля суспільної користі («містофорія»), демократія.
