บทคัดย่องานวิจัยเรื่องรูปแบบกระบวนการบังคับคดีผู้ประกันที่มีประสิทธิภาพของสำนักงานศาลยุติธรรม : ศึกษากรณีศาลในสังกัดสำนักงานอธิบดีผู้พิพากษา ภาค 4 มีวัตถุประสงค์การวิจัยเพื่อศึกษาสภาพปัญหาและอุปสรรคของกระบวนการบังคับคดี ผู้ประกันของศาลในสังกัดสำนักงานอธิบดีผู้พิพากษา ภาค 4 เพื่อศึกษาประสิทธิภาพกระบวนการบังคับคดีผู้ประกันของศาลในสังกัดสำนักงานอธิบดีผู้พิพากษา ภาค 4 และเพื่อศึกษารูปแบบกระบวนการบังคับคดีผู้ประกันที่มีประสิทธิภาพของศาลในสังกัดสำนักงานอธิบดีผู้พิพากษา ภาค 4 ผลการวิจัยพบว่า 1) ปัญหาและอุปสรรคของกระบวนการบังคับคดีผู้ประกันของศาลในสังกัดสำนักงานอธิบดีผู้พิพากษาภาค 4 ได้แก่ การไม่สามารถบังคับคดีกับผู้ประกันกรณีบุคคลได้ใช้ตำแหน่งประกันตัวผู้ต้องหาหรือจำเลย การขายทอดตลาดที่ดินไม่พอชำระหนี้ การขาดหน่วยงานที่รับผิดชอบในการบังคับคดีผู้ประกันและขาดบุคลากรและเครื่องมือในการออกสืบทรัพย์ 2) ประสิทธิภาพกระบวนการบังคับคดีผู้ประกันของศาลในสังกัดสำนักงานอธิบดีผู้พิพากษา ภาค 4 พบว่า การบังคับคดีกับผู้ประกันที่ผิดสัญญาประกันผู้ต้องหาหรือจำเลยยังขาดประสิทธิภาพ เนื่องจากยังมีหนี้ค้างชำระอยู่เป็นจำนวนมาก แต่บังคับคดีได้น้อยและบางคดีไม่สามารถติดตามบังคับคดีได้ อยู่ระหว่างขอจำหน่ายหนี้สูญต่อกรมบัญชีกลาง และ 3) รูปแบบกระบวนการบังคับคดีผู้ประกันที่มีประสิทธิภาพของศาลในสังกัดสำนักงานอธิบดีผู้พิพากษา ภาค 4 ได้แก่ (1) ผู้ต้องหาหรือจำเลยได้รับการปล่อยชั่วคราว โดยมีหลักประกันที่น่าเชื่อถือเพื่อให้บังคับคดีหลักประกันได้เพียงพอต่อการชำระหนี้ (2) ในแต่ละศาลควรมีหน่วยงานภายในรับผิดชอบในการบังคับคดีผู้ประกันโดยเฉพาะโดยจัดตั้งเป็นกลุ่มงานบังคับคดีผู้ประกัน (3) แก้ไขกฎหมายให้สามารถยึดหรืออายัดสิทธิเรียกร้องจำพวกเงินเดือน ค่าจ้างฯ ของข้าราชการ ลูกจ้างและพนักงานของรัฐได้ตามจำนวนที่ศาลเห็นสมควร เพื่อให้สามารถบังคับค่าปรับกับผู้ประกันนำเงินส่งคลังเป็นรายได้แผ่นดินได้อย่างมีประสิทธิภาพ (4) ควรสนับสนุนให้มีการนำอุปกรณ์อิเล็กทรอนิกส์ (Electronic Monitoring : EM) มาใช้ในคดีบางประเภทกับผู้ต้องหาหรือจำเลยซึ่งสมัครใจโดยไม่ต้องใช้หลักประกัน อันเป็นมาตรการเสริมและลดขั้นตอนการบังคับคดีกับผู้ประกันในอนาคตต่อไป คำสำคัญ : รูปแบบ, กระบวนการบังคับคดี, ประสิทธิภาพการดำเนินงานAbstractThis study aims to see the problems and obstacles of the legal proceedings of the courts subject to the Office of Chief Justice, Region IV for the Execution of Bail, to the efficiency of the legal proceedings of the courts subject to the Office of Chief Justice, Region IV for the Execution of Bail and to the patterns of the effective the legal proceedings of the courts subject to the Office of Chief Justice, Region IV for the Execution of Bail.
