During the ideological and economic competition of the Cold War, development and foreign aid had become important mechanisms to exhibit the superiority of each economic system, and to attempt to tie recipient countries to either bloc. This strategic implementation of soft power was initially prevalent with regards to the newly independent countries in Africa and South East Asia during the 1950s and the 1960s. The influence of modernization theory and the previous efforts of the Eisenhower administration to strengthen diplomatic relations with Latin America coupled with the peril of communist expansion drove the newly-elected Kennedy administration to launch the Alliance for Progress (AFP) in 1961. This article is organized in three sections, whereby the first chapter examines the factors for the amount of aid given to Bolivia; the second chapter will examine the factors for Colombia; the third chapter will examine the factors for the Venezuelan case This article hopes to shed new light on this policy, by providing a more nuanced explanation for the factors and context for why these three countries received the aid they did, rather than just simply stating 'to contain communism,' as has been discussed in the existing literature. Containing communism, and preventing another Cuba, was at the epicentre of the AFP policy – however, as this article hopes to illustrate the mechanism and understanding for containing it differed depending on each country. By providing an in-depth analysis of the local context, it will show that the allocation of aid was never solely determined by one factor. Instead, the AFP policy was driven by an understanding of perceived gains (that being, strengthening social reforms to make the country a showcase for progressive democracy and act as a bulwark against communism) and perceived losses (that being, preventing another Cuba and communist revolution).
The article investigates amendments to the Criminal Procedure Code of Ukraine which were submitted by the Law of Ukraine No. 2548-VIII of 18.09.2018 'On Amendments to the Criminal Procedure Code of Ukraine Regarding Improvement of Ensuring the Rights of the Parties to Criminal Proceeding and Other Persons by Law Enforcement Agencies during Pre-Trial Investigation' regarding their reasonability to settle the relevant sphere of legal relationship. Attention has been drawn to the amended version of Art. 130 of the Criminal Procedure Code as well as to the compliance of this norm with similar prescriptions of the national legislation. It has been analyzed how the relevant procedures against the investigator and prosecutor if they caused damage being later compensated by the state to the parties of criminal proceedings were regulated. A new provision is evaluated according to its complexity and ability to ensure real effective regulation of the relevant sphere of legal relationships. The author proposes his own developments regarding systematical regulation of the relevant sphere of legal relationships as well as implementation of other provisions of substantive and procedural law. Provisions of an explanatory note to the Draft Law No. 8490 of 18.06.2018 'On Amendments to Some Legislative Acts of Ukraine Regarding Improvement of Ensuring the Rights of the Parties to Criminal Proceeding and Other Persons by Law Enforcement Agencies during Pre-Trial Investigation' regarding necessity to adopt the Law of Ukraine No. 2548-VIII of 18.09.2018. The author also proposes his own draft materials on possible development of the institute of compensation of damages caused by governmental officials.
The article dwells upon the role of national identity in its supporting of polity sustainable development as applied to multinational states. Although the growth in national identity impedes the regulation of social and political issues, a strong negative potential for the ethnogenesis is contained in several measures, like limitation of migration as a factor of polyethnic system formation, or popularization of «nationalist» and «assimilationist» concepts. The importance of maintaining national identity as a fundamental element of ethnogenesis, which plays a significant role in positive mutations to the ethnic structure, is explained from the rationalist point of view. The role of national identity in ethnogenesis is described as follows. National identity prompts the social system to perform actions aimed at aligning inner potentialsof nationally heterogeneous groups with respect to the environment, as well as ignites recovery processes up to new levels, according to the first law of thermodynamics. Recovery processes bring about institutional and functional transformations to nation-political systems, increasing their adaptiveness to the political environment, which leads to: a) formation of new institutional and functional mechanisms of ethnic groups co-existing within a polity; b) necrotisation of archaic political institutions and values; c) preservation of previously functioning institutional and functional mechanisms enabling ethnic groups to co-exist within a political system.Therefore, the collision of multiple national identities stimulates variability of a national group and contributes to its normal ethnogenesis. The more mosaic the national construction of a society is, the more intensively the ethnic groups develop sustainability mechanisms fitting them to variable environments and negative forces, both of external and internal nature.It should be noted that a key factor of relaxing negative energy, which is imminent to national identity, is defined as «the collective common», that reflects, on a personal level, in the phenomenon of civicism. Impeding civicism developments within a polyethnic environment would arrest positive mutations of a nation.Mechanisms of sustaining national identity and civicism-building, kept within limits guaranteeing normal ethnogenesis and maintaining social stability, are proposed.The article makes use of Aristotelian and systems-thinking methods of research. ; Вопросы обеспечения национальной идентичности занимают важное место в разработке стратегии достижения стабильного развития политий. Несмотря на то, что рост национальной идентичности создает сложности в регуляции социально-политических отношений, ограничение миграции как фактора формирования полиэтнических систем, популяризация «националистических» и «ассимиляционных» концепций обеспечения политической стабильности скрывают негативный потенциал для этногенеза.С рационалистских позиций объясняется важность поддержания национальной идентичности как базового элемента этногенеза, играющего первостепенную роль в позитивной мутации этноструктуры. Роль национальной идентичности в этногенезе раскрывается в положении: национальная идентичность вынуждает социальную систему совершать работу, направленную на выравнивание внутренних потенциалов в национальном плане неоднородных групп социума в отношениях к окружающей среде и запускать процессы их восстановления до нового уровня развития в соответствии с первым законом термодинамики. Восстановительные процессы вызывают институционально-функциональные трансформации политико-национальных систем, обеспечивая их наибольшую приспособляемость к политической среде, что приводит к: а) формированию новых институционально-функциональных механизмов существования этносов в политии; б) некротизации архаичных политических институтов и ценностей; в) сохранению ранее действовавших институционально-функциональных механизмов, обеспечивающих существование этносов в политической системе. Таким образом, столкновение национальных идентичностей стимулирует «изменчивость» национальной группы и способствует ее нормальному этногенезу. Чем мозаичнее национальная конструкция социума, тем интенсивнее этносы вырабатывают механизмы устойчивости к неблагоприятным факторам внутренней и внешней среды, вариабельному пространству. Отмечается, что условием сдерживания негативной энергии национальной идентичности является «коллективное общее», на личностном уровне проявляющееся в гражданственности индивидуумов. Сдерживание формирования гражданственности в полиэтнической среде приводит к купированию позитивной мутации нации. Предлагаются механизмы поддержания национальной идентичности и формирования гражданственности в рамках границ, обеспечивающих нормальный этногенез и социальную стабильность. В статье использованы системный и формально-логический методы исследования. Понятия «этнос» и «нация» рассматриваются как синонимичные. ; Питання забезпечення національної ідентичності займають важливе місце в розробці стратегії досягнення стабільного розвитку политий. Незважаючи на те, що зростання національної ідентичності створює труднощі в регулюванні соціальнополітичних відносин, обмеження міграції як фактора формування поліетнічних систем, популяризація «націоналістичних» і «асиміляційних» концепцій забезпечення політичної стабільності приховують негативний потенціал для етногенезу.З раціоналістських позицій пояснюється важливість підтримки національної ідентичності як базового елемента етногенезу, яка грає першорядну роль в позитивній мутації етноструктури. Роль національної ідентичності в етногенезі розкривається в положенні: національна ідентичність змушує соціальну систему здійснювати роботу, спрямовану на вирівнювання внутрішніх потенціалів в національному плані неоднорідних груп соціуму у відносинах до оточуючого середовища і запускати процеси їх відновлення до нового рівня розвитку у відповідності з першим законом термодинаміки. Відновлювальні процеси викликають інституційно-функціональні трансформації політико-національних систем, забезпечуючи їх найбільшу пристосованість до політичної середовищі, що призводить до: а) формування нових інституційно-функціональних механізмів існування етносів у політії; б) некротизації архаїчних політичних інститутів і цінностей; в) збереження діючих раніше інституційно-функціональних механізмів, що забезпечують існуванняетносів у політичній системі. Таким чином, зіткнення національних ідентичностей стимулює «мінливість» національної групи і сприяє її нормальному етногенезу. Чим мозаїчніше національна конструкція соціуму, тим інтенсивніше етноси виробляють механізми стійкості до несприятливих факторів внутрішнього та зовнішнього середовища, варіабельного простору.Зазначається, що умовою стримування негативної енергії національної ідентичності є «колективне спільне», яке на особистісному рівні проявляється у громадянськості індивідуумів. Стримування формування громадянськості в поліетнічному середовищі призводить до купірування позитивної мутації нації.Пропонуються механізми підтримки національної ідентичності і формування громадянськості в рамках кордонів, що забезпечують нормальний етногенез та соціальну стабільність.У статті використані системний і формально-логічний методи дослідження. Поняття «етнос» і «нація» розглядаються як синонімічні.
Статья посвящена анализу представлений россиян на политику. Отмечается, что российские граждане-подданные являются политически пассивной этнонациональной группой и de facto не встроены в процессы принятия политических решений. Политику россияне воспринимают как деятельность «государства» по управлению социумом, а стремление участвовать в политической жизни сводят к получению информации о деятельности «государства». Слабый интерес к политике в массовом сознании россиян, дистанциирование населения от всего политически организованного связано с традиционным расхождением интересов «государства» и социума, рассмотрением stato либо в проекции божественного происхождения, любо отождествления с населением.Установлено, что интерес к политике россияне проявляют в периоды: а) активации государством державного дискурса; б) появления устойчивого убеждения в расхождении интересов государства от интересов населения; в) «выборов». Выявлены основные факторы, влияющие на интерес россиян к политике.Цель исследования заключается в выявлении особенностей представлений россиян на политику.Гипотеза исследования: в российском социуме доминирует принципиальная дистанциированность населения от политики, что определено персоналистским характером Российского «государства» и феноменом «Русской власти», в котором суверен сакрализирован и рассматривается в качестве представителя всего населения, осуществляющего деятельность от его имени.В исследовании использовались диалектический, социологический, сравнительный, логический методы исследования.Гипотеза подтверждена. ; Results of the sociological research of the Russians have been given in the article. These results are revealing their perception of a policy as one of the spheres of the public life and a kind of activity.The non-inclusion of the Russians into political processes has been established; their attitude to politics as a sphere of public life, that has no direct relationship to their daily lives, has been found. The political activity in submissions of the Russians belongs to the sphere of domination and is carried out by the sovereign and his close circle, who manipulate the ideas of the Russians, permanently activating subjective and civil discourses. The latter refers to the borrowing from another civilization some paradigm and applying it during the «election» period; first one is connected with the preservation of the basic parameters of the political system, e.g. a personified state, a non-institutionalized institutions, a traditional subordinate society, which consists of «little people» who need protection and who want to kneel before the «state».Based on the results of the research in the experimental region, the peculiarity of the views of Russian citizens on politics has been revealed: the growing interest to politics during the period of the activation of the governmental and imperial discourses by the «state», which is reviving the archaisms of the «Russian power». Interest is falling down in the period of increasing social and economic burden on the population, which is deepening the disunity of the population and social depression. At the same time, both in the first and second cases, the Russians usually remain to be passive observers. This is caused by the combination of both modern and traditional views on the political sphere of society with absolute dominance of the latter ones in their minds. The reasons and factors that influence the population's interest in politics, as well as negative tendencies that stop the development of civil self-awareness of the Russians have been identified in the article: a) the orientation of potential transformation groups of authoritarian political ideas on distancing themselves from the political process; and the orientation of the conservative ones on the integration into it within the institution of service and (or) receivement of material benefits; b) the absence of a critical view of the population on politics under conditions of relative «stability» and satisfaction of physiological needs; c) the understanding of politics as a collective interest, rather than a private one, which reinforces the negative tendency of society's mass and leads to the formation of a new-totalitarian milieu.The conducted research broadens the understanding of the Russians' perception of politics and lead to the development of a set of measures for its (perception) correction. ; Стаття присвячена аналізу уявлень росіян на політику. Відзначається, що російські громадяни-піддані є політично пасивною етнонаціональною групою і de facto не ввійшли в процеси прийняття політичних рішень. Політику росіяни сприймають як діяльність «держави» з управління соціумом, а прагнення брати участь у політичному житті зводять до отримання інформації про діяльність «держави». Слабкий інтерес до політики в масовій свідомості росіян, дистанціювання населення від усього політично організованого пов'язано з традиційною розбіжністю інтересів «держави» і соціуму, розглядом stato або в проекції божественного походження, бо ототожнення з населенням.Встановлено, що інтерес до політики росіяни проявляють в періоди: а) активації державою державного дискурсу; б) появи стійкого переконання в розбіжності інтересів держави від інтересів населення; в) «виборів». Виявлено основні чинники, що впливають на інтерес росіян до політики.Мета дослідження полягає у виявленні особливостей уявлень росіян на політику.Гіпотеза дослідження: в російському соціумі домінує принципова дистанційованість населення від політики, що визначено персоналістським характером Російської «держави» і феноменом «Руської влади», в якому суверен сакралізований і розглядається в якості представника всього населення, що здійснює діяльність від його імені.У дослідженні використовувалися діалектичний, соціологічний, порівняльний, логічний методи дослідження.Гіпотеза підтверджена.
В статье рассматриваются исторически сложившиеся методы консервации российского моноцентризма. Отмечается, что Российское «государство» приобретает моноцентрический персонифицированный характер в период крещения Руси и татаро-монгольского ига, который сохраняется на протяжении веков. Выявлены основные механизмы консервации российского моноцентризма: а) сакрализация суверена (как персоны, так и его властного статуса), б) консервация доклассовой структуры общества, в) фрагментация элитных групп и создание альтернативных им в функциональном плане политических акторов и чрезвычайных органов, г) функциональная перегрузка и дублирование полномочий государевых «учреждений», клиентелизм, д) использования популизма, репрессий и цензуры, с формированием Государственной Думы – избирательные технологии. Во все времена существовали закрытые (гильдийные) механизмы формирования института персонифицированного лидера.Цель исследования заключается в выявлении основных механизмов консервации персоналистского моноцентрического характера российской политии.Гипотеза исследования: с течением веков у Российского «государства» сформировался комплекс механизмов, обеспечивающих «хороший» эквилибриум (равновесие) в рамках архаичной политической системы. Методы исследования: диалектический, исторический, логический. ; An analysis of the historical past is one of the ways of understanding of the present and the future. Evaluation of the past allows revealing that the Russian «statewas historically evolved as a personified one. Grand dukes, monarchs, general secretaries de facto were sole rulers, who subordinated the functioning of the political system to their interests.It has been found in the study that the basis for preserving the subjectivity of the autocrats and the non-institutionalization of other political actors in both tsarist and soviet Russia was a system of historically established mechanisms that ensured a «goodequilibrium (balance) within the framework of archaic politics.It has been noted in the article that the main mechanisms for monocentrism's maintaining are of a patrimonial nature, which is closely connected with primordial values.The main directions of the preservation of the state monocentrism have been singled out: a) the strengthening of the power potential of the autocrat (the sacralization of the status and personality of the autocrat, identifying him/her with the Divine Viceroy or the representative of the whole population; provision to the sovereign ample opportunities to select elites and non-institutionalisation of «state bodies», clientelism, etc.); b) the weakening of elites (the formation of a conflict inter-elite space, the reproduction of the conflict between the elites («boyarsand «party nomenclature»), represented in «institutionsand the population, c) Sustaining the society at the pre-class level, while preserving its primitive organization - the sovereign and «the others(employees and officials); d) the use of repressive practices, censorship, which are aimed at the creation of a sense of fear among the population with its orientation toward serving the sovereign state as a guarantor of the integrity and stability of the system. These mechanisms are intertwined and complement to each other, contributing to the preservation of politics in its initially formed form.The conducted research broadens the nature the «Russian powerconcept, deprives it of the mythological core, and allows developing (borrowing from the general civilization paradigm) alternative mechanisms of Russian political management that orient the «stateto serving individuals and peaceful coexistence with various actors of the world political system. ; У статті розглядаються історично сформовані методи консервації російського моноцентризму. Відзначається, що Російська «держава» набуває моноцентричний персоніфікований характер у період хрещення Русі і татаро-монгольського ярма, який зберігається протягом століть. Виявлено основні механізми консервації російського моноцентризму: а) сакралізація суверена (як персони, так і його владного статусу), б) консервація доклассової структури суспільства, в) фрагментація елітних груп і створення альтернативних їм у функціональному плані політичних акторів та надзвичайних органів, г) функціональне перевантаження і дублювання повноважень государевих «установ», клієнтелізм, д) використання популізму, репресій і цензури з формуванням Державної Думи – виборчі технологій. В усі часи існували закриті (гільдійські) механізми формування інституту персоніфікованого лідера.Мета дослідження полягає у виявленні основних механізмів консервації персоналістського моноцентричного характеру російської політії.Гіпотеза дослідження: з плином століть у Російського «держави» сформувався комплекс механізмів, що забезпечують «хороший» еквілібріум (рівновага) у рамках архаїчної політичної системи.Методи дослідження: діалектичний, історичний, логічний.
The article researches amendments to the Constitution of Ukraine submitted on February 7, 2019 regarding their reasonableness and the way of enshrining. Attention has been focused on motivation part as well as forecasts described in the explanatory note to the draft law No. 9037 of 03.09. 2018. Provisions which supplemented or changed the norms of the Constitution were analyzed. The issue regarding enshrining a specific geopolitical course of the state in the Constitution, identification of its civilized membership has been investigated. Amended and other provision of the Constitution of Ukraine, an explanatory note to the draft law No. 9037 of September 3, 2018 as well as scientific works on the issues referred to this issue have been analyzed. Results of sociological survey which the legislator used when it motivated necessity to amend the Constitution of Ukraine have been investigated. Personal opinion on possibility to use this research during amendments to the Basic Law has been provided. Provisions which would be reasonable to be introduced to the constitutional text have been thoroughly thought. Recommendations regarding the way of enshrining of constitutional provisions which was chosen by legislator have been made. Personal conclusions regarding formalization of the legislator's idea to enshrine mentioned ideas in the Constitution of Ukraine have been made. Problems which in author's opinion are connected with amendments made to the Constitution have been identified. The reasons for such problems as well as the means of their overcoming have been researched into. Attention was drawn to international experience regarding mentioning of international organizations in constitutions. The author has attempted to identify the reasonableness of amendments which related to foreign policy in general as well as to choose the best way for reforming of constitutional text.
Abstract. The paper considers public goods in the realm of international governance, provides a framework explaining their provision, and applies it in the analysis of the trade policymaking in the GATT/WTO. International governance regime is seen as a public good; it is conceptualized as an equilibrium state, one where the extent of ideational and material conflicts, incongruities in policy mechanisms and the lack of institutions are substantially minimised. Such state is brought by policy entrepreneurship on the part of multiple actors. Three generic entrepreneurial functions (policy leadership, innovation and facilitation/coordination) are identified. Successful equilibration is characterized by the complementarity of entrepreneurial functions, as well as by the persistence and ingenuity of entrepreneurs in selecting and using specific means and instruments of entrepreneurship. Policy entrepreneurship is considered crucial in several areas, including problem framing, advocacy and coalition building, policy experimentation, and creation of the analytical instruments. In the present article, planning and monitoring processes are considered as elements of management of enterprises of the military-industrial complex. The main tools of program and target planning of industry development, developed in different periods in the country, are presented. The composition of the state defense order is analyzed. The analysis of specificity of the state program of arms is carried out, the main stages of its development are allocated. The features of the existing system of statistical data collection on the results of enterprises are considered. ; В настоящей статье процессы планирования и мониторинга рассматриваются как элементы управления предприятиями оборонно-промышленного комплекса. Представлены основные инструменты программно-целевого планирования развития промышленности, разработанные в разные периоды в стране. Проанализирован состав государственного оборонного заказа. The article describes the first use of acid-free alcian-alizarin staining for tailless amphibians in comparison with the standard method of acid staining on the example of the moor frog. The acid-free protocol is applicable for Anura and it has a number of advantages, such as the absence of decalcification, safety for the researcher and others. Since the beginning of the twentieth century processes of centralization of economic and political power into the hands of the 'nomenklatura' have been taking place in Russia while in the Western capitalist countries the process of decentralization of power has accompanied economic development. The centralization of power during the Soviet period led to the deformation of horizontal and the strengthening of vertical relations, which today still determines the imbalanced economic development of Russia. One of the main characteristics of the deformation processes that have been taking place in the economy is the redistribution of investment resources in favour of the largest economic and political centers in Russia. The aim of this research is to show which of the following features are the main indicators of centralization of investment resources: The formation of polarized structure of society (very small stratum of middle-class representatives), the formation of extremely imbalanced banking sector: Moscow financial-industrial groups play the key role, while the regional financial institutions are very weak, Development of Russian regions is primarily local, not global. The centralization of investment resources and the formation of elites are interrelated processes. That is why in our research we pay much attention to the processes of emergence and development of central and regional elites. These processes have greatly influenced the deformation of economic structure, disturbances in the process of redistribution of private ownership (the so-called process of 'nomenklatura privatization'), and in investment processes. The clan-corporate structures formed on federal and regional levels prevent Westernized market transformation. It is therefore necessary that the economy reorganizations should be taken simultaneously with the change in the hierarchic structures of political power. For a more even and better targeted distribute of investment resources and to counter spatial-economic imbalances, it is necessary to eliminate the old system of branch and regional clan-corporative structures.
An article contains first data on internal skeletal anomalies of smooth newt juveniles. The material was collected on the territory of urban agglomeration of Yekaterinburg. We found 16 variants of anomalies. An increase of general frequency of deviations along urbanization gradient were mentioned. The article provides a systematic review of the scientific works of Russian legal scholars in the field of public finance law in China, in particular tax, budget and currency law. Today, it is premature to talk about fully functioning schools of Chinese law in the Russian legal science. However, at the same time there are examples of successfully conducted fundamental researches on Chinese public finance law. Authors have to admit that the last few years have not been marked by the appearance of any monograph on Chinese public finance law in Russia – the studies conducted today are usually devoted to specific problems and are published on the pages of the relevant journals. There are obvious reasons for this – difficulties in Chinese language learning and understanding specific Chinese legislation, which is characterized by uncertainty, ambiguity and plurality of sources of law. Existing studies can be classified into studies entirely devoted to the study of particular institutions or branches of Chinese law, and studies of a comparative nature. The article examines and systematizes the work of Soviet and Russian legal scholars devoted to various areas of research in the fields of tax, budget and currency law of China, with an assessment of their significance and contribution to the development of the relevant branch of knowledge. The materials in this article may be useful for future researches, which, in turn, can predetermine the strengthening of bilateral relations, as well as the implementation of joint investment projects. The article allows to identify unexplored areas in the considered field, thereby laying the foundation for future research. Authors note research issues that seem to be perspective based on the conducted review. ; Представлен системный обзор научных работ отечественных ученых-юристов, посвященных исследованиям в области правового регулирования публичных финансов в Китае, в частности налоговому, бюджетному и валютному праву. На сегодняшний день в отечественной правовой науке преждевременно говорить о сформированных и полноценно функционирующих школах изучения китайского права. Однако в то же время имеются примеры успешно проведенных фундаментальных исследований китайской отрасли публичных финансов. Обзорная статья позволяет определить неисследованные области в рассматриваемой сфере, тем самым заложив основу для будущих исследований. С учетом проведенного исследования авторы статьи отмечают отдельные вопросы, исследование которых представляется актуальным и перспективным.
