vThe possibilities and methods of creating a stable defective structure, including dislocation structure near the zones of p–n-transitions of silicon diodes of noise generators on plates with crystallographic orientations (111) and (001) have been investigated. The effective distribution control of uncontrolled impurities in monocrystalline silicon is achieved by forming a stable dislocation structure in its volume. In order to obtain the reproducible characteristics of noise generator diodes, it is necessary that the dislocation density be homogeneous throughout the plate area. Since the density of dislocations is slightly lower at the edge of the dislocation trail than in the middle, this means that the dislocation traces formed by the adjacent melting zones with the help of a laser beam should overlap. On the basis of experimental studies, it has been established that the necessary degree of uniformity of the density of defects generated is achieved by compliance with the condition of a = (1.5–5.0)d, where a is a step, d is a width of the laser spot on the wafer. The melting process was carried out in a nitrogen environment using a laser hettering unit. The real width of the melting zone turns out to be slightly larger than the diameter of the laser spot due to the thermal conductivity of the silicon and is about 10 μm. Increased dislocation generation on the Si3N4 inclusions, as opposed to dislocations on the Si–SiO2 border, leads to an additional expansion of the dislocation track at the work surface of the plate of noise diodes. The presence of the stable dislocation structure, as well as the presence of impurities and secondary metal atoms in the noise diodes ND 103L structure are confirmed by the secondary ion mass spectroscopy (SIMS) method. The results of the study have been tested at Corporation "INTEGRAL" (Belarus) and can be used in the manufacture of silicon noise diodes.

У статті розглядаються міжнародні стандарти захисту свідків та потерпілих осіб у сфері кримінального судочинства, які слугують моделлю для національної системи кримінального правосуддя і втілені у деклараціях, конвенціях, угодах, резолюціях, рекомендаціях та інших міжнародних актах. Важливу роль у їх розробці відіграють міжнародні організації, зокрема Організація Об'єднаних Націй, Рада Європи, Європейський Союз, Міжнародний кримінальний суд та інші. Аналізуються документи та рішення, ухвалені конгресами ООН з питань попередження злочинності та поводження із правопорушниками: Каракаська декларація 1980 р., Міланський план дій 1985 р., Декларація основних принципів правосуддя для жертв злочинів і зловживань владою 1985 р., в якій викладені основні принципи захисту свідків та потерпілих осіб у транснаціональному кримінальному праві, та інші документи. Особлива увага приділяється Конвенції ООН проти транснаціональної організованої злочинності 2000 р., в якій містяться положення щодо захисту свідків та потерпілих у зв'язку зі здійсненням транснаціональних злочинів.Досліджуються заходи із захисту свідків, що беруть участь у кримінальному судочинстві; аналізується законодавство окремих держав і дається порівняльна характеристика. Автор розглядає програми, які забезпечують захист свідків та потерпілих осіб, а також надання їм моральної та матеріальної допомоги, зокрема в США, Німеччині та інших державах. Метою статті є вивчення змісту, завдань та принципів реалізації міжнародно-правових актів, направлених на регулювання відносин захисту свідків і потерпілих осіб у транснаціональному кримінальному праві.Наукова новизна. Виявляються основні проблеми у регулюванні відносин захисту свідків та потерпілих осіб у транснаціональному кримінальному праві, зокрема досліджується необхідність узгодженості норм транснаціонального кримінального права і національного законодавства країн з різними правовими системами, обміну інформацією про найбільш успішні види практичної діяльності, удосконалення програм захисту свідків та потерпілих осіб у тих державах, де вони існують, і прийняття таких програм, насамперед, у тих країнах, де особливо швидко розвивається транснаціональна злочинність.Висновки. Щодо захисту свідків та потерпілих у міжнародному кримінальному праві склались міжнародні стандарти охорони прав цих осіб у сфері відправлення правосуддя, що представляють собою нормативно виражені положення, напрацьовані на міждержавному рівні, адресовані державам, які зобов'язані в межах своєї юрисдикції забезпечити охорону прав своїх громадян. Досягнення цього завдання можливе при наявності внутрішньодержавного механізму імплементації міжнародних кримінальних норм, що дозволить забезпечити повну, всебічну і своєчасну реалізацію взятих державою міжнародних зобов'язань у сфері захисту свідків та потерпілих осіб у кримінальному судочинстві.

Particular attention is paid to the issue of the growth of the role of the comparative legal method, the method of its conduct, as well as the factors that determine the growth of its role. First, it is noted that after the World War II the universally recognized principles of international law have been developed and consolidated in the UN Charter and in other fundamental international legal instruments. Speaking as a product of customary international law (that is the result of the practice of civilized nations in relations between themselves and with societies), they have become universal in character, which puts them "at the apex" of world order. Such principles as respect for human rights, state sovereignty, and territorial integrity of states have received generally accepted content. In many European countries they have "immediate effect", gaining constitutional character. This means that within the framework of national legal systems a new phenomenon has been created, which is really a common archetype present in the constitutional system of every civilized state. Secondly, comparative law is used today as an instrument for judicial investigation of a legal case and, therefore, the argumentation of a court decision. This approach is widespread in the practice of higher courts of states and in particular the European Court of Human Rights. Conclusions have been made that after the World War II there was no significant legislative project, which to one degree or another would not be accompanied by extensive comparative legal research. Such an approach should be reflected in the practice of reform in Ukraine. It is important to emphasize that the comparative approach is inherent not only for science, but also for law-making and law-enforcement bodies (courts). An adequate methodology of a comparative legal approach takes into account a comprehensive understanding of the law itself (written and unwritten), as well as its broad social context. In addition, the change in the nature of international law, the development in the past three decades of full-fledged regional law-enforcement (for example, European rule of law), as well as the strengthening of their interplay with national legal orders, necessitates the use of so-called "vertical methods" of comparative research. ; Досліджено порівняльно-правовий метод в умовах глобалізації. Звернено увагу на нові ознаки сучасного світу, коли інтернет та інші фактори роблять його взаємопов'язаним, але при цьому різним. Проаналізовано методику застосування порівняльно-правового методу, а також фактори, які зумовлюють зростання його ролі. Окремо показано використання порівняльно-правового методу у практиці Європейського суду з прав людини.
