Die amerikanischen Gerichte leiden unter Überlastung. Neben einer allgemeinen Prozeßbereitschaft, zu der die allzu große Offenheit der Gerichte beiträgt, ist die quantitativ unverhältnismäßige Zunahme der Zahl der Anwälte und die Politik der organisierten Anwaltschaft als Begründung anzuführen wie auch die Neigung der Legislative, zu viele Fragen Gerichten zur Entscheidung zu überlassen, die juristisch nicht zu klären sind. Hinzukommen die Verhaltensweisen des Jury-Systems. Zur Beseitigung dieses Mißstandes schlägt der Autor eine Reihe von Verbesserungen vor, etwa eine Selbstbeschränkung der Richter, gerade in Streitfragen, die politisch entschieden werden müssen.
