AbstractThe negative impact of the use of law as a means of changing society in authoritarian countries is seen already clear when in authority a regime that was decades on authority in Indonesia. The regime overcome all the forces that exist in society and the bureaucracy is crucial. Political parties in that era were not independent. The decisions in the field of legislation more influenced by the government's political vision. Here, the law has been used as synonymous with power, so that can not be distinguished more clearly, where the law where power, where "rechtsstaat" and where "machtstaat", where state laws and which countries tyranny legitimized by law. The law should be given charges philosophical truth values are deduced from the principles of the law by the authorities, in fact the loaded power itself that must be regarded as truth. Manipulation of the truth that's going on here is misdirection logic through language games that the law is the same as the laws in the flow of positivism. Rezim tersebut mengatasi semua kekuatan yang ada dalam masyarakat dan birokrasinya sangat menentukan. Partai-partai politik pada era itu tidak mandiri. Keputusan-keputusan di bidang legislasi lebih banyak diwarnai oleh visi politik pemerintah. Disini hukum telah dijadikan identik dengan kekuasaan, sehingga tidak dapat dibedakan lagi secara tegas, mana hukum mana kekuasaan, mana rechtsstaat dan mana machtstaat, mana negara hukum dan mana negara tirani yang dilegitimasi secara hukum. Hukum yang seharusnya diberi muatan-muatan nilai-nilai kebenaran filosofis yang dideduksi dari asas-asas hukum oleh kekuasaan, pada kenyataanya diberi muatan kekuasaan itu sendiri yang harus dipandang sebagai kebenaran. Manipulasi kebenaran yang terjadi disini berakar penyesatan logika melalui permainan bahasa (language of the game) bahwa hukum itu sama dengan undang-undang dalam aliran positivisme. Sebagai konstituen, rakyat tidak menginginkan anggota DPD yang terpilih bertindak dalam hubungan wakil sebagai partisan akan tetapi rakyat sangat mengharapkan anggota DPD yang terpilih dapat bertindak dalam hubungan wakil sebagai utusan daerah. Terkait dengan unsur keterwakilan daerah dalam pengisian keanggotaan DPD menurut Undang-Undang Nomor 7 Tahun 2017 serta implikasi dari unsur keterwakilan daerah yang diisi oleh keterwakilan politik. Penelitian ini menggunakan metode yuridis normatif yang menggunakan data sekunder. Hasil penelitian ini bahwa dalam pemilihan calon anggota DPD guna mewujudkan persaingan yang sehat antar calon perlu persyaratan pembatasan keterlibatan calon yang berasal dari partai politik. Calon anggota DPD yang berasal dari partai politik akan menghadapi conflict of interest dalam menjalankan tugas dan fungsinya disatu sisi terkait kepentingan daerah dan disisi lain terdapat kepentingan politik.
This study will analyze the modification of reclamation permits in the Riau Islands Province (Kepri) to overcome various reclamation difficulties that are local and national challenges. Based on Governor's Regulation Number 26 of 2017 concerning Procedures for Granting Reclamation Permits in Coastal Areas and Small Islands, reclamation permits are in the hands of the Governor. However, in 2018, Pergub Number 31 of 2018 concerning the Implementation of One-Stop Services for the Riau Islands Province in Article 8 states that the Governor delegates licensing and non-licensing authority which are the affairs of the Riau Islands Provincial Government to regional heads of the relevant services. Rational Choice Institutionalism will evaluate the interaction process of relevant agencies and other players in the reclamation permit procedure within the boundaries of institutions that control and limit the activities of policy actors. The study technique used is qualitative with an interpretive analysis of each actor to describe the motivation to employ institutions as a reasonable choice. The results show that the process that occurs in the reclamation permit in the Riau Islands Province is the rational choice of institutionalism, namely the link between actors and the surrounding institutions. The need for changes to the performance and behavior of good institutionalism towards cooperation between other stakeholder actors for changes to good reclamation permits on an ongoing basis by the Kepri Provincial Government.
In this article the author seeks to answer, within the context of the Indonesia state organizational system, why and how Indonesia should establish a single government authority entrusted with supervising the making of ministerial policy regulations or regional government regulations. To that purpose a comparison with other countries is conducted. It is a fact in Indonesia that regulatory powers or function is shared by and among different ministries and by regional governments. The result of which is the problem of sectoral approach and the existence of numerous overlapping and conflicting regulations. To overcome this problem, in consideration of best practices in other countries, the author suggests the establishment of a single government agency entrusted with, inter alia, previewing ministerial or regional government draft regulations.
The Republic of Indonesia is a country which has a characteristics archipelago. Hence each region boundaries and the rights distribution are regulated and stipulated through the local government laws. Nowadays, the regulatory has been being a multiple implications include the authority, borders and rights problems, challenges and also the obstacles. This phenomenon occurs because the continental paradigmatic model has been being chosen for regional development than its application to the regional regions which should be more ocean government or archipelagic government comprehensively. This research used a literature study method which has collected then analyzed systematically based on documentation and the various official reports which have significantly relevance to the research problem. The results of the study explain that both of the described regions (which has an archipelagic characteristic) shown the restructuring format and regional government laws reformulation. This suitable for catching up to the regional development achievement or performance. The arrangements means for reformulating the new different policy and also the government technical procedures either (Republic of Indonesia's Law Number 23 year of 2014 which concerning to the regional governance).
The Village funds are part of the State Revenue and Expenditure Budget which are allocated for villages and disbursed through the district/city expenditure budget. During the period of 2015 – 2018, two village heads (village of Malang Rapat and Penaga) were the suspects of corruption cases in Bintan District in the province of Riau Islands. There was no evaluation of the use of the village funds by the district government. The objective of this study was to gain an insight into the use of village funds in the province of Riau Islands. The study problem was how to evaluate the use, impact, and constraints in the utilization of village funds in the province of Riau Islands in 2018 (Case study in Bintan District and Lingga District). This study used a qualitative descriptive method, using interviews and observations for data collection. The results showed that a large portion of village funds was used for physical development in the village, while human development in the village was not yet properly implemented due to the limited allocation of village funds for empowerment and community development. The impact of village funds felt by the community for the addition of physical facilities in the village was significant, while the impact on empowerment and economy of the community was not. The constraints of the usage of the village funds were regulation, human resources, and coordination.
The purpose of this study is to compare the marine management authority exercised by local governments based on the laws and regulations that have been in effect since the establishment of the local government law to the current local government law. This type of study is library research with a statutory, comparative, and historical approach. All information and data obtained are then collected and analyzed according to the topic of study. The conclusion of this study shows that the authority for marine management owned by local governments has only been in effect since Law No. 22 of 1999, Law No. 32 of 2004, and Law No. 23 of 2014. At the same time, the previous law did not specifically regulate local governments' authority in marine management.
Protection towards consumer is not only goverments duties, nevertheless business actors as well as much also intervene in protection consumers. In the course of fulfill the life goods, human are inseparable from basic daily needs, where it is traded in traditional and supermarket. Based LPPOM MUI database, there is still so many product that has not had a halal certificates. The formulation of the problem of this research is how the juridical analysis of Law No. 8/1999 concerning Consumer Protection against the distribution of food and goods in supermarkets in Tanjungpinang City. This research method uses the normative juridical method with the legislation and sociological approach. The research located in several supermarket that placed in Tanjungpinang. The focus of this research is snacks, can foods, and household products in several supermarkets in Tanjungpinang. Based on the research that have been authors did, the authors conclude that there are still many food products that are not in accordance with the provisions in Article 8 paragraph (1) of Law No. 8/1999 concerning Consumer Protection, including food products that do not include a halal label, are not in accordance with SNI standards, there is no information language. For this reason, according to the opinion of the writer, it is necessary to improve supervision of the circulation of food products and goods in supermarkets in Tanjungpinang City.
