Political rights are part of human rights that shall be guarded and protected by the State in the form of legislation ranging from constitution to its implementing regulations. The presence of regulation is substantial for safeguarding the existence and implementing political rights possessed by citizens, including civil servants. However, in practice there are restrictions by the lawmaker towards the political rights of the civil servants in Indonesia. In this regard, this paper attempts to highlight two issues: first, the position of civil servants in Indonesia in the 1945 Indonesian Constitution; second, the regulation of the political rights of civil servants in the implementing regulations of the 1945 Indonesian Constituion.Keywords: political rights, human rights, civil servants, 1945 Indonesian Constitution, implementing regulation. Pengaturan Hak Politik Pegawai Negeri Sipil di Indonesia AbstrakTulisan ini menyoroti pengaturan hak Pegawai Negeri Sipil (PNS) di Indonesia berdasarkan Undang-Undang Dasar Negara Republik Indonesia tahun 1945 (UUD 1945). Hak politik merupakan bagian dari hak asasi manusia (HAM) yang harus dijaga dan dilindungi negara dalam bentuk pengaturan perundang-undangan mulai dari undang-undang dasar sampai dengan peraturan perundang-undangan pelaksananya. Kehadiran peraturan perundang-undangan tersebut menjadi penting agar keberadaan maupun pelaksanaan hak politik yang dimiliki warga negara, termasuk PNS, dapat berjalan sebagaimana mestinya. Dalam praktiknya, terdapat pembatasan yang dilakukan oleh pembentuk undang-undang terhadap hak politik PNS di Indonesia. The Incident of George Floyd's death reminds people of the peril of discrimination that still exists within the American society. The incident has triggered worldwide reactions from people who feel sympathy for the victim and reject racism. To eliminate racial discrimination, every modern society needs to remove any negative paradigm towards intergroup relation. In the context of the United States, the American Government has the responsibility to protect the rights of citizens from any forms of discrimination. That includes racial discrimination. In addition, people have to be reminiscent of the danger of racial discrimination in the modern era. The danger has the ability to disturb human rights protection. This study revealed history, criteria, and impacts of discrimination within the scope of human rights protection.Memerangi Diskriminasi dalam Perlindungan Hak Asasi Manusia: Perjuangan Tiada Akhir Abstrak Insiden George Floyd seakan mengingatkan kembali bahaya diskriminasi yang masih ada di masyarakat AS. Kejadian itu memunculkan reaksi dari orang-orang yang turut bersimpati dan menolak rasialisme dari seluruh belahan dunia. Masyarakat modern semestinya sudah mengubah pandangannya yang negatif terhadap kelompok lain, sehingga tidak terjadi diskriminasi rasial. Oleh karena itu, pemerintah AS memiliki tanggung jawab untuk melindungi hak warga negaranya dari segala bentuk diskriminasi termasuk diskriminasi rasial. Di samping itu, masyarakat perlu diingatkan kembali tentang bahaya diskriminasi rasial di era modern yang dapat mengganggu perlindungan hak asasi manusia. The research aims to find out how discretion is implemented as a form of government policy innovation in Indonesia. The importance of discretion for local governments to provide innovative policies for ideal government services. This study uses normative legal research methods with statutory approaches, conceptual approaches, case approaches, and comparative approaches. The analytical method used is descriptive and prescriptive methods. The results of the discussion show that discretionary arrangements that are implemented as a form of government policy innovation are steps that must be taken in supporting innovative officials as an effort to find common ground between innovation and law, not to be passive in realizing innovation. Discretionary criteria as government policy innovations in their implementation are assessed based on four aspects: authority, limits, testing, and judicial control. The ideal discretionary model in making innovation policies to realize bureaucratic reform must be based on the main values of the welfare state. In addition, discretionary policies must follow Pancasila values, as well as collaboration between authorities. Discretionary policies must follow the general principles of good governance (AUPB). Thus, it is necessary to have additional principles as a basis for implementing discretionary innovation policies in realizing bureaucratic reform, namely the principle of motivation, the principle of fair play, the principle of prohibition of detournement de pouvoir, the principle of justice, the principle of freedom, the principle of integrity, the principle of real goals, the principle of effectiveness and the principle of participation.
