AbstractIn this article, we discuss the concept of solidarity, its historical roots and characteristics, and how solidarity has become one of the basic pillars of Social Security systems. Furthermore, we describe the incorporation of the principle of solidarity into the Spanish Social Security legal system, both in the Spanish Constitution and in the ordinary legislation. The analysis shows that solidarity has been progressively incorporated by the Constitutional Court and legislation as a basic pillar of the social security system, so that social security in Spain can no longer be understood without explicit reference to interpersonal, inter-territorial and intergenerational solidarity.The article concludes with three reflections that affect the principle of solidarity: the need to reinforce solidarity schemes in both contributory and non-contributory social benefits, the need to continue implementing re-distributional policies, and the need to maintain the State exclusivity in terms of social security competencies.Summary1. REFERENCES ; En este artículo, después de describir la noción de solidaridad, su origen histórico y rasgos que la caracterizan, se analiza cómo dicho principio ha venido a constituir uno de los fundamentos básicos de los sistemas de Seguridad Social, en su modalidad contributiva y no contributiva. Se examina su incorporación al ordenamiento jurídico español de Seguridad Social: en la Constitución y en la legislación ordinaria. Del análisis realizado se desprende que la solidaridad ha sido un principio que el Tribunal Constitucional y la legislación han consolidado progresivamente como pieza angular de la Seguridad Social, de manera que esta ya no puede entenderse sin referencia directa a la solidaridad interpersonal, interterritorial e intergeneracional Se concluye el artículo con tres reflexiones que afectan al principio de solidaridad: necesidad de reforzarlo en las prestaciones contributivas y no contributivas, mantenimiento del sistema de reparto y mantenimiento del régimen económico de la Seguridad Social como competencia exclusiva del Estado.

En las páginas que siguen se ofrece una visión, obligadamente sintética, sobre el devenir y estado actual de la prevención de deficiencias en España 1 . Tienen una finalidad introductoria a los temas que se desarrollan más adelante y de alguna manera les sirven de apoyo, por cuanto no sólo se muestra una panorámica general que ayude a situar adecuadamente cada respectiva singularidad en materia de prevención, sino que en ellas se describen, siquiera sea a grandes rasgos, los marcos legislativo y administrativo en los que se circunscriben los distintos programas de prevención médica y ambiental. Como observación de entrada, dejemos constancia ya desde ahora que nos encontramos en un terreno de difícil deslinde: ni la prevención es una acción netamente diferenciable en cuanto a su objeto (muy al contrarío, muchas actuaciones sanitarias, educativas y sociales son también en sí mismas preventivas), ni la deficiencia es tampoco una noción unívoca. Nos ceñiremos, pues, al concepto estricto de prevención primaria de deficiencias.

Abstract:The study addresses the dependency benefits established in Spain by the Law 39/2006, of 14 December, on the Promotion of Personal Autonomy and Care for people in a situation of dependence and by other recent regional social services laws. Initially, we analyze how these benefits are incorporated into the Spanish legal system as a result of international external influences. Furthermore, we evaluate the nature of social rights in the Constitution, in the Constitutional Court jurisprudence, and in the state and regional legislation. ; Resumen:El estudio se refiere a las prestaciones de atención a la dependencia establecidas en España por la Ley 39/2006, de 14 de diciembre, de Promoción de la Autonomía Personal y Atención a las personas en situación de dependencia y por las nuevas Leyes autonómicas de servicios sociales. Después de describir brevemente dichas prestaciones, se analiza el carácter de derechos sociales que pueden tener en la Constitución, en la jurisprudencia del Tribunal Constitucional y en la legislación estatal y autonómica.Summary:1.
